Dear Ms. McFarland, Ms. Meale, and Mr. Ray,
As early as August 31, 2009, I expressed concern with a database that the Brevard Public School Board
was facilitating.
The attachments detail that concern.
And the concern continues with two FLORIDA TODAY reports of Wednesday, January 22, 2014, that
state in part:
“An 18–year–old high school senior at the center of a dispute over his appearance on a gay pornography
website will return to Cocoa High today.”
“Former Heritage High band director James Wilkins was reinstated after an administrative judge
determined he was wrongfully terminated and should receive back pay.”
To that concern, would you please find out what happened to that database? According to reports
published by the Brevard Public School Board, there were thousands of names obtained; thousands of
children.

Dear Dr. Binggeli,
Recent revelations of misconduct by your assistant superintendent of educational technology for
Brevard Public Schools have served to heighten my concerns over potential misuse of personal
information contained in the Brevard Public Schools database. My concern also applies to certain
related Florida Profit Corporation databases you have endorsed.
A year ago, on August 31, 2009, I wrote you expressing those concerns and asking why you as
the Superintendent of Brevard Public Schools were making an endorsement on behalf of a
Florida Profit Corporation for the solicitation of my personal family information that, once
obtained, may fall within the public domain.
I am now compelled to sharpen my previous question: As the Superintendent of Brevard Public
Schools, what have you done to ensure that the Brevard Public Schools database you manage as
well as the Florida Profit Corporation databases you have endorsed have not fallen into the hands
of predators such as organized child pedophilia and child prostitution enterprises?

Assistant superintendent resigns after inquiry.
Steve Muzzy, assistant superintendent of educational technology for Brevard Public Schools,
resigned Tuesday.
Muzzy, 49, left the district after an investigation found he asked a coworker to alter records from
his work–issued cell phone, according to school district documents.
Had he not resigned, he would have been fired for misconduct, Deputy Superintendent Lee Berry
said.
Muzzy spent seven years with the district and was in his former position since 2005. He had 77
people under him, although he did not directly supervise all of them. He was one of 13 people on
the superintendent’s senior staff.

District–Issued Phone Used To Make Sex Calls
BREVARD COUNTY, Fla. — An assistant superintendent for Brevard County schools resigned
Friday. The district said he admitted to calling phone sex numbers with his district–issued cell
phone.
Stephen Muzzy was one of the top officials with the school district in charge of educational
technology. Muzzy allegedly tried to cover up the calls; he’s accused of asking another employee
to destroy the phone records of the sex lines.
Muzzy resigned from his job, making $114,000 a year, amid the allegations he tried to get
another employee to destroy district records.
“It’s very disconcerting, actually kind of disappointing for the district,” said Christine Davis,
Brevard Public Schools.
The allegations stem from a phone bill that shows he used his district–issued Blackberry to call
sex lines and call–girls. When WFTV caught up with Muzzy at his home he admitted making the
calls, but he would not say who he called.
“I made some inappropriate calls,” Muzzy said.
“What do you mean you’re not sure what the calls were? You said you weren’t sure what the
calls were,” WFTV reporter Jason Allen asked Muzzy.
“I honestly do not. The calls were inappropriate. The calls were inappropriate,” he said.
“Were they escort services?” Allen asked.
“I don’t believe that’s what they were,” Muzzy replied.
Muzzy’s also accused of asking another employee to destroy phone records and the district said
he admitted it, but he told WFTV it was taken out of context.
“I had asked what the possibility was of removing those from the phone bill,” Muzzy said.
The district recommended firing him. Instead, he resigned. In fact, Thursday, he went to district
headquarters to clean out his office.
Muzzy faced similar allegations on a school trip in 2008, but in that case he used the hotel phone
and someone had the charges removed. That complaint was considered unfounded.
If Muzzy had been fired after admitting felony official misconduct, he could have lost his
pension for his 12 years with the district.

Based on the trust my family places in the Superintendent of Brevard Public Schools, it concerns
me that you are making an endorsement on behalf of the “Whole Child Connection” for the
solicitation of my personal family information that, once obtained, may fall within the public
domain.
Points of my concern are as follows:
I noticed that the only data one is required to provide to the “Whole Child Connection” in order
to “Get Started” answering questions is a “Zip Code” and a “Family income.”
I noticed that the questions being asked seem to be of a very personal nature. Examples are, “Do
you need to overcome extreme stress?”, “Are you pregnant? If yes. …”, “Do you need an
attorney or have outstanding legal concerns that you would like to speak to a legal professional
about? If yes. …”, and so forth.
I noticed that your home page of the Web site for the Brevard Public Schools states,
“Information collected from the Whole Child Connection® will be used by Brevard’s leaders to
improve the quality of life for all of us.”
I noticed that there is no authentication by you of the enterprises that are collecting the
information, or of the enterprises that would receive the information once collected.
I noticed in an e–mail I received yesterday that you are prominently featured pictorially. A
caption to your head shot states in part, “BPS is proud to be affiliated with the Whole Child
Connection.”
So I ask, “Why are you making an endorsement on behalf of the ‘Whole Child Connection’ for
the solicitation of my personal family information that, once obtained, may fall within the public
domain?”

Notice: The following is the MCOA policy on Background Checks and Badges for Sports Officials
Recently, the Florida Legislature added a requirement that non instructional contractor employees of Florida schools be issued a state badge to
be displayed when on school property. Non instructional contractor employees includes sports officials. As applied to sports officials,
displaying the badge means having it available for display when officiating. The badge requirement is in addition to the requirement for a
background check. The Brevard School Board requires sports official to have a current background check before officiating. Current means a
background check within the past 5 years.
Each sports official is individually responsible for complying with the background check and badging requirement. To obtain a background
check or badge, the official applies in person at the school district office in Viera. The cost for the background check is about $78.50. The cost
for the state badge is $10.00. The MCOA strongly encourages all officials to comply with these requirements.

Hi, Everyone!
This is Cris Smith. I am the president of Viera/Suntree Little
League. I am writing to address something that transpired last
week.
I am not addressing the entire league about it because I don’t
want to start a fire storm, but I feel like you deserve an explanation of the events since your teams are directly effected.
Last week, around Monday or Tuesday, Joe Pallante emailed
me to tell me that he was stepping down as the VP if machine
pitch and that he was also withdrawing his children from the
league due to personal reasons. That is all he said. Since this is a
volunteer organization, I am used to people stepping down due to
personal issues. I felt it was weird that he was pulling his children,
but I did not ask any questions. Members of the Board just set out
to replace him.
Bart Baxter stepped up to be the VP of machine pitch. Jeff
Virsik stepped up to take the machine pitch team that Joe was
managing. And Dan Roman stepped up to take his tball team. I
want to stop and say THANK YOU to these guys for so quickly
volunteering to handle these positions. Your time is valuable to us,
and we greatly appreciate your willingness to help us in our time
of need!
These people were all in place and ready to take over by Friday.
Saturday morning is when I found out the real reason Joe Pallante
stepped down. By now, since news travels so fast, you probably
already know this reason. But, for those of you who don’t, Joe was
arrested on Friday for child molestation. I got a call early Saturday
morning about it. I checked the Sheriff’s Office website where you
can see the recent arrests, and there he was..... Since then, the only
bit of information that I received on the matter is that the victim
was NOT a child from VSLL.
Little League International has very strict rules about doing
background checks on anyone who volunteers with the children of
their leagues all around the world. We collect volunteer applications every year from the people who work with our players. No
one goes on the fields with the children unless they have submitted a form and has been cleared. This is where VSLL’s badge
system comes into play. When games begin, you will notice that
everyone who is on the field will be wearing a brightly colored
badge. This badge indicates that the person has submitted a
volunteer form and has been background checked and cleared. If
there is a person who is on the field or in the dugout during games
who is not wearing a badge, the Board Member on Duty will ask
that person for his or her badge. If the person cannot produce it,
they will be asked to leave the field. Managers, 2 assistant
coaches, and team moms are issued the badges and are the only
people allowed on the field or in the dugout during games. At
practices, more parents are allowed to help on the field. They are
not issued badges, but they ARE required to send in a volunteer
form to be background checked. This is the manager’s responsibility to make sure everyone he or she has helping with practices are
cleared because we cannot have a Board member out at every
practice for every team.
As for the situation with Joe, he has been a part of VSLL for a
long time. He has been background checked every year since I
have been the president. He has always been cleared. This Spring,
our background checks were due to be processed this past weekend
- one day after the arrest. Two weeks ago, we ran a check of the
Florida Sexual Offenders and Predators website AND of the US
Department of Justice National Sex Offender registry
((www.nsopr.gov). There were no red flags for us. We run checks of
these websites on a regular basis. We do not take this lightly.
Since Joe had already stepped down, and he had already been
replaced, there was no need to take immediate actions to remove
him. He did this on his own.
As I stated above, I am not addressing this issue to the entire
league, but I did want to try and calm your nerves about having
had him as your manager. Up until Friday, he had never been
arrested for anything like this. Had he had prior arrests in this
sort of manner, he never would have been a part of our league.
The safety of your children is a major priority at Viera/Suntree
Little League as it is with Little League International! We take
every precaution available to ensure that your children are safe
when they step onto our fields. Rest assured that we would never
knowingly put your children in harm’s way. Speaking as a mom,
this has been my #1 priority since I took over because I have
children in the league too. I want to know that I know that I know
they and all 650 other players are safe!!!

Partnership Strengthened Between Brevard Public Schools and the Brevard County
Sheriff’s Office
VIERA: Brevard Public Schools and the Brevard County Sheriff’s Office have enhanced its current security
partnership effective July 1, 2014. The increased partnership provides BPS with a highly trained law enforcement
lieutenant who will provide leadership for the Office of District Security to improve communication and
coordination between the district and all local law enforcement agencies. This unique collaborative effort is
designed to enhance safety and security on school and district sites, while increasing learning opportunities for
students, parents and staff. “We have always enjoyed a strong partnership with the BCSO and this next step is the
right direction,” states superintendent of schools, Brian Binggeli.

Leaders believe that one immediate advantage will be an enhanced interface with all local law enforcement
agencies offering a seamless communication and response system, joint training opportunities, and a uniformed
presence at major school and district functions. The partnership will reduce operational costs for both the district and
BCSO through the elimination of the director of district security position, which will be replaced with a BCSO
lieutenant. “This is an exceptional opportunity to partner more closely with the BCSO and our law enforcement
community to enhance the safety for our students,” Binggeli continues. “Ms. Alford has provided dedicated service
to the students of Brevard County and we thank her for the years of support to this department.”
The benefits are not one way. The Brevard County Sheriff’s Department will gain increased coordination
and participation opportunities for all School Resource Officers and more direct communication with students,
parents and staff members pertaining to school and community safety issues. Sheriff Wayne Ivey stated, “This
valued partnership is a complete win / win for Brevard County citizens. In our discussion with Superintendent
Binggeli, a creative concept was presented to go well beyond past practices. This collaborative effort creates an
effective solution for safe school strategies and most importantly, safe learning environments for our students,

SECURITY INITIATIVE
The Brevard County Sheriff's Office is pleased to announce an enhanced security
initiative with the Brevard Public Schools and our entire Public Safety community. Last
night, during the Brevard Public Schools Board meeting, a valued partnership was
unanimously approved that is a complete win/win for our citizens with a strong emphasis
on protecting our most precious resources, our children.
Over the course of the last several months the Sheriff has worked closely with
Superintendent Binggeli and his Staff to create a new "School Security" concept that goes
well beyond past practices. This collaborative effort creates an effective solution for safe
school strategies and most importantly, safe learning environments for our students,
educators, volunteers and staff.
This newly developed partnership provides Brevard Public Schools with a highly trained
Sheriff's Office Lieutenant that will now oversee District Security. The initiative will
immediately work to enhance communication and coordination between Brevard Public
Schools and all Law Enforcement agencies. A partnership designed with the complete
and unanimous support of our Brevard County Chiefs of Police and their respective
agencies.
This unique collaborative effort is designed to enhance safety and security on school and
district sites, while increasing learning opportunities for students, parents and staff. The
immediate advantage will be an enhanced interface with all local law enforcement
agencies offering a seamless communication and response system, training opportunities,
and a uniformed presence at School and District functions.
This new partnership reduces operational costs for both Brevard Public Schools and the
BCSO through the elimination of the Director of District Security position, which will be
replaced by BCSO Lieutenant Mike Scully. Lt. Scully's position will be funded by both
Brevard Public Schools and the Sheriff's Office. Lt. Scully is a 30-year law enforcement
veteran with exceptional skills in law enforcement administration, patrol, site security,
and crime prevention.

On Wednesday, March 6, 2014, the Satellite Beach Police Department completed a
lengthy investigation into allegations of Felony Child Abuse and Felony Failure to Report
Child Abuse. As a result of the investigation, an arrest warrant was obtained for the
defendant, Jason John Burchfield (details below). The warrant outlines that on three
separate occasions in 2013, BURCHFIELD visited a male friend in Satellite Beach who
has a minor, step-daughter (under 14 years of age). On three separate visits, the minor
female was made to undress and be completely naked in the presence of the men for
hours at a time, while being forced to consume alcohol, including vodka. BURCHFIELD
acknowledged he was in fact present and confirmed the victim’s allegations.
BURCHFIELD is currently employed as a teacher with the Brevard County Public
Schools, which requires him by law to report such activity. Investigators do not believe
that any criminal events occurred on school property.
BURCHFIELD was charged with:
3 Felony Counts - Child Abuse, Florida State Statute - 827.03 (1)(b)
3 Felony Counts – Failure to Report Child Abuse, Florida Statute – 39.205 (1)
Bond: $36,000
Information regarding his employment status should be obtained through the Brevard
Public Schools in Viera.
