pubhshed Government Whtte Paper entttled “The New NHS” and of further
developments m the near future in respect of this matter. Members noted the srx key

1.30 The Local Planrung Authortty 1s not aware of the exlstmg busmess cansmg any particular

from vehicular movements, hrcludmg those of lorrms, to and from the sate wbtch 1s accessed
through Tudor Close. Nevertheless, whether problems are causedor not, it 1sfact that this is a
nonconforming use accessedthrough, arsdadjacent to, a residential area.

2.34 The 1985 permrssion (ROC/871/85) for 3 bungalows concerned the whole of the Cotswold
Cottage sue r e. 0.3ha. (0 7 acres) resulting m a denarty of 4.1 dwellings per acre (dpa). The
later refusals, F/O278/91iRoC and F/O752/9l/ROC were based on smaller site areas of 0 2&a
(0 64 acres) and 0 23ba. (0 54 acres) respectrvely and prow
hrgher numbers of dwellmgs, 5
and 4 bungalows Furthermore, these refusals excluded other areas of the Cotswold Cottage
These areas had the potentrnl for further developmentplots

2.35 Accordmgly whilst these were not high densrties m themselves when compared to surroumbng
properties to the north and west, where densrtres range from 7 5dpa to 8dpa., the refusals were
hrgher than that of the 3 bungalows pcrmittcd in 1985 and had potentud to mcrease the overall
densrty of the Cotswold Cottage site above that of the surroundmg.
2 36 The 1995 apphcation (F/O442/95/ROC) for 4 bungalows did relate to a different srte area these
refusals but even this was not the whole curtrlage of Cotswold Cottage The densny figure here
of 6.36 dwellmgs per acre was acceptableto the Authonty. The approved plans mdicated that the
remamder of the Cotswold Cottage curtilage outside the applmatron sateboundary was to be used
as a garden extension, with a detached garage thereon, to the adjobg bungalow, 73, Broad
Walk Thts property and the application sue were wrthin the control of the apphcants.
2 37 Due to the cbaracterrsticsof that apphcatron tt was suggestedthat, and the applicanta consentedto
enter into, a Legal Agreement restricting the number of runts on the whole land holdmg (1 e
Cotswold Cottage and 73, Broad Walk) to a maxmrmn of 5, be completed.

2.38 It is m.portanJ to note at Bus point that, as wrth other agreements the Atiorrty drafts, thrs

2.44 Grven that the.proposed develqxnem is dependem on alterations to a Fubhc Footpath, partudly
outside the apphcatmn sue whrch wtlJ be SubJectof a Footpath Drvrsron Order, rt 1s intended to
reqnre that these alterations are reahsed before the redevelopment takes place by way of a new
Section 106 Agreement or, possrbly, an amendmentto the exishng agreement.
2 45 Although the County Surveyor has mdmatedhts agreement to the access arrangementsproposed
for the 4 bungalows he did initrslly n&ate objectrons to the one bungalow (followmg Item)
whmh was to take accessoff White Hart Lane. Nonetheless, m vrew of the hrstory of the srte,
e.g. ROC/871/85 where d was agreed that 3 new properttes could take accessoff thts road, there
was an nmiication that this objection may be wtthdrawn Consequently negotratfons commued
with a view m providmg a mom sattsfactory layout for all 5 dwellmgs However, sbrce receipt of
these rewed plans the County Surveyor has re-afi%med hrs objectton to the one bungalow t&mg
aceessfrom Whtte Hart Lane.

9.26 In ‘The Fm’ appeal the Inspector also stated that he dtd not accept the Counctl’s conchtstons for
the contmumg ‘need’ in the R&ford Dtstrtct for the retention of such accommodahon, against
the trend elsewhere in the County
9 27 It 1s notable that those comments made by the Inspector regarding ‘n&’ m upholdmg the
dectston to ltft a restrictive comhtton, were m relstton to a hoidmg that had justified the
constructton of the dwellmg in the Brst place In the case of Pondstde, its construction m 1965
was tietied on the basis of a larger farm holdmg. In support of his decision he also cited the
general ttae III paa tune workers wtth a correapoudiug decline in full ttme workers wluch in lus
opmton would account for a rednction in the demand for these dwelimgs He also mnchtded that
“Thts mdicates to me that wuh the declmtng trend tn fullttme agriulltural employment, there 1s
unlikely to be a shortfall of agncuiturai accotmnodation generaliy, and that the most pressing
n&s are likely to contmue to be for accomm&tton on the employment holdmg ”
9 28 In the wider context, Members wtll be aware of other contemporaty applicatrons wnlun Rocbford
Dtstrmt, for new agricubural workers dwellings on the grounds of agricuitural need, together with
other proposals for the removal of agrtcultural occupancy condrtions on the grounds of msufftcmnt
agrmtltural need. The Couracil’s own mveshgations togetkr arlth other information subnutted m
reap& of situ&r proposals elsewhere in the diitct, have proved to be mcon&stve

9.30 There IS no wncluslve file evidence that it ever successfully later functioned as a smallholdmg,
only of mtenhon by previous owners by virtue of the applications they subrmtted
9.31 There IS evidence that It became the focus for unauthonaed retxi sales suggestmg fauUre of the

9 32 The history of the site does not support the corrtenhon that the dwellmg and land mnst~tuted a

The Sub-Committee cowxiered the report of the Head of Leisure and Client Servmes on the
detad of the proposedDrug ReferenceGroup Sprmg Campargn.
In commendmg the work of all involved in the campaign Members rrcognised that there would
be greater value locating the campaign bus in the Town Centre of Rayleigh on 16thMay 1998
rather than in Websters Way Car Park. Durmg debate Members questioned O&em on the
prospect of usmg the Boots lagoon. It was determmed that a temporary Street Closure Order
would be necessaryto achieve this. A Member requested that, due to the nature of the business,
considerahon be. given to locatmg the cnme preventron csravau elsewhere m the District. On a

advised Members that 45 sets of body armcur including some stumble for women had been
revved from Police H.Q.
Wtth regard to mobile CCTV, Members noted the successful outcome of usmg the I&a-red
equipment, resulhng m an arrest. In addition, the Police Chief Officer’s Group had requesteda
