A
s summer comes to a close our membership
experiences both a sigh of relief to see the
crazy months wind down as well as sheds
a small tear to see yet another too-short season
come to an end. The majority of Owner members
are jumping into Budget preparation and our
Supplier members are scrambling to assist with
the preparation associated with those budgets. As
evidenced at the recent Economic Conference, all
outlooks associated with our industry appear very
favorable. The fundamentals for Denver including
limited development, low vacancy rates, increasing
demand and affordable rents create a perfect storm
for our Industry. We’ve certainly earned it. Seeing
the end to 8 years of declining performance just in
time to experience the 2008 economic meltdown
made many of us reconsider the intelligence of our
career choices. Thankfully, we’re about to put the
last decade behind us and move on to greater things.
Speaking of greater things, Tributes 2011 quickly
approaches and with a record 542 nominations,
we are certain to have an incredible celebration of
the best of the best! This month’s issue highlights
the finalists in each award category as determined
by the independent panel of judges from across all
industries.

Personal interviews and site visits will be conducted in September
by the same judging panel. The judges this year hold positions such
as CEO, Vice President and Director within industries of Banking,
Hospitality, Marketing and Technology. Please be sure to contact

of them! I’d like to personally thank Foy Bailey and the Community
Interiors team for their continued support and generous financial
commitment to this very special event.

Requesting Photo I.D.’s
from prospective renters

I
just hired a new leasing specialist and asked him to blind shop
several communities in the neighborhood. He returned from this
experience indicating that he wasn’t asked for government issued
photo I.D. in order to tour. Now he is questioning our company
policy as to whether we need to be asking for proof of identity since
it is an inconvenience and apparently discontinued by others. Has
this industry practice been discontinued?
No. I blind shop communities around the country and have
experienced some inconsistency when being asked for government
issued photo ID. It appears that apartment communities that are being
pressured to get more leases are taking it upon themselves to alter their
company’s policy.
I have also experienced that when asked I have been able to bluff
and get special consideration. These actions are an inconsistent
application of their company’s policy and are exposing themselves
and others to fair housing liability. As serious as this exposure is it is far
more important that you provide for the personal safety of your onsite
team. This is the #1 reason you should take steps to ensure that this
policy is followed without exception.
You certainly have the right to require this simple method of
precaution when someone arrives at your property and expects a tour. It
should be standard operating policy at your community and you should
declare that it is normally standard at other communities as well. If a
potential renter indicates otherwise ask for specifics and follow up with
the person and/or company responsible for managing that property.
Report what a customer has indicated to you and question whether
their policy has changed in this regard. I’m confident that this feedback
will be a welcome wakeup call for another professional in the market.
You would want the same heads-up if the roles were reversed.

Dealing with hail damage to your property

olorado is one of the most hail-prone states in the country, and
this hail season, typically mid-April through mid-September, has
supported that fact. Over the years, hailstones have been known
to fall at the rate of 80 mph and some have been so driven as to go
right through a roof.
If your apartment building has hail damage, here are a few tips to
follow to ensure adequate payment from your insurer so that you can
properly replace a hail-damaged roof.
Apartment building owners, landlords, and property managers
whose properties suffered hail damage must first determine whether
their property replacement cost insurance policy requires the insurer
to replace not only the hail damaged surface, but also any substrate,
insulation or the structural deck.
If a commercial flat roof EPDM layer is damaged by hail and the
insurer’s adjuster admits part or all of the EPDM must be replaced, the
insurer will likely issue a check for coverage of the EPDM layer only.
The insured must have an expert examine the board insulation and all
layers down to the roof deck to determine if the roof system condition
is adequate to satisfy the applicable building code and manufacturer’s
specifications for placing new EPDM on top.

improper condition for placement of new EPDM on top, the insured’s
replacement cost insurance policy may require the insurer to replace
the insulation and/or decking as well.
The Colorado Court of Appeals confirmed this in Dupre v. Allstate
Insurance Company. The policy in Dupre required replacement of
portions of the plaintiff’s house with “equivalent construction for similar
use” and “the plain meaning of the term ‘equivalent construction for
similar use’ includes maintaining the property’s prefire function.”
The Court determined that replacing portions of the insured’s house
to pre-fire functionality included replacing parts of the house that were
not directly fire damaged but had to be brought up to code to allow for
fire damaged items to be properly repaired or replaced.
[W]hile an actual cost policy is designed to avoid placing the
insured in a better position than he or she was in before the fire, a
replacement cost policy allows for such a possibility because it is
intended to allow the insured to replace the damaged building.

Prior to the fire, the plaintiff’s house was a habitable dwelling
yielding rental income. Merely restoring it to its prefire condition [not
in compliance with code] would have rendered it uninhabitable and
thus unfit for any similar use. Such a result does not comport with the
plain language of the limitation or the reasonable expectations of an
insured purchasing a replacement cost policy.

The same concept may apply to an apartment building owner’s
hail damaged roof—especially if the roof is an older one with substrate
conditions that may no longer conform to code or manufacturer’s
specifications. To simply restore a roof to its pre-hail damaged
condition may render it unfit for similar use if the substrate or deck is
deteriorated and insufficient to support a layer of new roof materials.
Obsolescence and deterioration are insurable risks, and a property
insurance policy may require the insurer to pay for either after hail or
another covered cause of loss has damaged a policyholder’s roof.
The key is to provide sufficient evidence to the adjuster, so that
denial of coverage for a portion of or all of the roof system becomes
less likely.
If your building has sustained hail-damage:
1. Immediately notify the carrier of all damage.
2. Inform the insurance adjuster that an expert needs to determine the
condition of the entire roof system, in addition to areas immediately
visible.
3. Review the property insurance policy to determine which provisions
may apply to the damage. If a complete copy of the policy is
not available, make a written request to the adjuster to obtain a
complete certified copy of the policy (including all endorsements)
as soon as possible.
4. Retain an expert in roof repair and replacement to perform nondestructive testing in conjunction with core cuts to determine if the
damaged top layer (i.e., EPDM, TPO, Built-Up, Modified Bitumen,
shake shingles, asphalt shingles) can be replaced with or without
additional work to substrate, insulation, sheathing or decking based
on code and manufacturer specifications for repair/replacement.
5. Document everything including test results, photos of all substrate
layers down to the roof deck, and the expert’s findings/conclusions.
6. Provide the adjuster with maintenance records, which may show
the roof functioned properly until the date of loss.
7. If your expert/roofing contractor determines any substrate, including
the structural deck, must also be repaired or replaced in order to put
the roof back to its pre-loss condition and functionality, immediately
provide all information for this additional covered insurance benefit
to the adjuster.
8. If you are concerned with the progress or resolution of your claim,

insurance adjuster or an attorney.

Surprise can be the best
resident retention program

t’s amazing what going off the usual script will do for a company’s reputation, their
fan base, and even their employee’s pride in working there. Last month, one of
the big Twitter stories was how Morton’s Steak House delivered a steak to Peter
Shankman, a customer service and marketing specialist, when he got off his plane in
New Jersey. It all started when Peter made the following tweet:
Hey @Mortons - can you meet me at newark airport with a
porterhouse when I land in two hours? K, thanks. :)
When he got off his plane, standing there in a full tuxedo was Alex from Morton’s
Steak House with Peter’s very own steak! How randomly awesome is that? Not only
did it make Peter a fan and active ambassador for Morton’s for life, but the story echoed
throughout Peter’s network of friends, family, and business associates. One trip to the
airport was probably more effective than most of the traditional marketing avenues that
Morton’s utilizes!
But it wasn’t just the steak that did it. In fact, the taste, aroma, presentation of the
steak itself played very little role in the story. And it really didn’t have to do that it was
free either. Peter Shankman in a world renouned speaker and CEO of a New York City
PR firm, and doesn’t have a problem affording Morton’s pricey steaks.
At our properties, we often give all our residents a free meal for our summer
apartment party, and although it is never on the level of Morton’s, it’s a nice little treat
for many residents. But how many do you think told their friends and family that their
community gave them a free meal? And how many even remembered the meal a week
later, let alone when it was time to renew their lease?
The real nugget to this story was not
that it was free, but that it was a surprise,
and done in such a unique and memorable
way! The company made a mark because it
actually took the time to do something fun,
creative, and probably altruistic for someone
else. (Sure, they were doing it for an
influential person, but what kind of response
were they expecting?)
In the end, if a company wants to be
memorable, it needs to start with truly
caring about their customers and look for
opportunities to be remarkable and make an
impact. It doesn’t have to be as extravagant
as a steak – even a small handwritten card to
someone who has had a rough time could do
wonders for retaining them as residents.

Politically Bankrupt
Taking focus off politician’s careers is what’s best for the economy

T
he disastrous performance of this nation’s political elite in
Washington DC over the past six weeks did significant
damage to the American economy. The fact that the
U.S. economy has almost ground to a halt despite massive
and unprecedented fiscal and monetary steroids…the fact
that the Federal Reserve felt compelled to serve notice that
its key interest rate would stay at essentially zero for the next
two years…the fact that the stock market had four days in a row
of more than 400 point swings…can all be traced in one form or
another back to the enormous political vacuum that is Washington DC.
It would have been one thing if all the sweat and tears suffered
by the American people about the three D’s…default, downgrade,
and the deficit had resulted in a realistic and comprehensive plan to
finally address this nation’s unsustainable trillion dollar plus annual
budget deficits for as far as the eye can see. It did not.
The plan was weak, underwhelming, and lackluster…serving to
merely push the tough decisions down the road. It would be great
if the 12-member “super-committee” established to identify at least
$1.5 trillion in reduced government deficits over the next 10 years
would actually make serious progress by November 23. Don’t hold
your breath.
The pressures on these six Democrats and six Republicans to toe
the party line will be enormous. Still, it only takes one to support the
other party’s objectives to get an agreement. Getting the full Congress
to then embrace recommendations of the Committee by December 23
would be another party line vote. If they fail to reach an agreement,
$1.5 trillion in lesser spending will automatically be applied equally to
the military budget and various domestic programs…
…what a sad way to run a country
Blame Game
Meanwhile, the President blames the Republican House of
Representatives for its unwillingness to embrace any tax increases
(whoops!…make that revenue enhancements). The Republicans blame
the Administration and the Democratic Senate for their unwillingness to
embrace necessary reductions in future government spending growth
rates on entitlement programs.
The far right and the far left media fan the flames of embitterment and
dissention. The general populace of this once and still great nation—the
average person on the street—wonders how we got so far off track…and
can it ever be fixed.

Both Sides
As a somewhat conservative economist, most of my criticism
is leveled at those who espouse bigger and bigger and bigger
government…yes, typically the liberal Democrats. However, one
statement during October 2010 by Senate Republican Minority
Leader Mitch McConnell noted, “the single most important thing we
want to achieve is for President Obama to be a one-term President.”
What happened to focusing on other things like, Oh, I don’t
know…economic growth, job creation, getting a handle on
government spending, helping to restore the public’s confidence? It is
this type of destructive dialogue coming from both sides that damages
the economy. Such dialogue and childish political behavior of recent
weeks led the Thomson Reuters/University of Michigan index of
consumer sentiment to a 31-year low as reported last Friday…a 31year low!
It again makes one wish we had term limits in the nation’s
capital—letting politicians focus on what is best for America…not just
what is best for themselves and their party…
…what a concept.

In Memorium: Irving C. Baker
I
am honored to write about my
good friend and colleague, Irv
Baker, and his legacy with the
apartment industry.
After graduating from
University of California
Berkley in 1971 with a
degree in Criminology,
Irv started in the
graduate program in
San Jose to become
a probation officer.
Needing a job to
support his schooling
he went to work with
Klingbeil and Associates
as an apartment manager.
Shortly thereafter he was
given more responsibility
and the probation officer goal
was placed on the back burner
– never to be looked at again.
In 1973 he was offered a position
with Klingbeil to open a new apartment
community in Lakewood, CO. After a successful lease
up he was transferred to a new lease up, Buckingham Oaks
in Aurora, CO. His success created a great opportunity in
1974 he went to work for Lincoln Property Management and
open two new communities on east Hampden Avenue. This
is where his relationship with the AAMD started.
In 1976 Irv, Mark Kramer and Ralph Jensen formed JBK
Management Group. In June of 1976 Mark and Irv hired me,
fresh out of college, as their new controller. Mark went on
to run JBK Landscaping, as he still does today, and I spent
the next ten years working with Irv in the apartment industry.
During this period we managed over 4,000 different units in
the Denver area. Irv taught me the business from the ground
up and was always available to help not only his employees

but anyone in the industry as necessary. Irv
made certain that anytime someone
requested his help be it networking
or operations he found the time to
accommodate.
With the downturn in the
Denver market, Irv moved to
California where he worked for
Insignia. Upon acceptance
of a position with Simpson
Property Group in 1998 Irv
moved back to the Denver
area where he reacquainted
himself with many industry
friends.
Irv was always a supporter
of local apartment functions,
especially the annual golf
tournament. Upon Irv’s passing this
year one of his last requests was that
someone would have a golf tournament
in his honor. Since I was on the golf
committee I could not think of a better golf
tournament to be named in his honor. I then made
the request to have the tournament named in his honor
and shortly thereafter the Executive Committee of AAMD
informed me my request had been granted and this year’s
tournament would be in his honor.
I was very proud that one of his three children was able
to attend the ending ceremonies of the golf tournament as
Irv loved his children more than anything in life. Irv was
a very special friend to me and will be missed dearly. He
was a friend and colleague to many individuals on our local
apartment industry. I so appreciate AAMD for asking me to
write my friend’s legacy with our industry.

NAA/NMHC Comment on Proposed CMBS
Risk Retention Rules
T
he National Apartment Association and National Multihousing
Council have submitted comments on proposed risk retention rules
for the securitized market. The rules implement key sections of last
year’s Dodd-Frank financial reform law, including a provision requiring
securitizers to retain 5% of the credit risk for new securities.
Our comments touched on several areas where the proposal
has the potential to adversely affect the availability and pricing of
credit. We stress the importance of aligning the interests of borrowers
and investors in the servicing function, explaining how the existing
servicing arrangements have often failed to serve borrowers.
We also urged regulators to allow more commercial real estatebased mortgages to be exempt from risk retention requirements, noting
our sector’s historically strong loan payment performance. And we
provided input on ways to implement the Dodd-Frank Act provisions
that would allow the subordinated investor (i.e., the B-piece buyer) to
meet the risk retention requirements. We noted that the proposed rule
creates disincentives that could reduce the participation of B-piece
buyers and adversely affect transaction pricing.
Debt Limit Bill Omits Carried Interest,
For Now
The commercial real estate industry secured a victory when the
debt limit bill enacted last week omitted a tax increase on carried
interest. NAA/NMHC and a coalition of organizations had mounted
an aggressive public relations campaign to oppose such a change
after it was mentioned early in the negotiations by President Obama.
Through media outreach and a coordinated advertising campaign
in publications targeting Capitol Hill, we made the case that raising
taxes on carried interest isn’t just a Wall Street issue and would have
a serious detrimental impact on Main Street.

The threat of a future tax increase is far from over, however. The
debt limit legislation created a deficit reduction panel of 12 yet-to-benamed members of Congress, which is charged with identifying $1.5
trillion in deficit reduction by Thanksgiving. Taxes, including carried
interest as well as a possible scaleback of the mortgage interest
deduction, may again be on the table.
If the panel embraces the carried interest proposal, the threat
would be even more serious than in the past because under the terms
of the legislation if seven of the 12 panel members agreed on the
package of recommendations it would move through the House and
Senate under a fast-track procedure that would prevent it from being
amended or altered.
NAA/NMHC and our real estate partners will continue to make
the case that a carried interest increase would harm our economic
recovery and the production of affordable housing.
ICC Alters Code Revision Process
The International Code Council (ICC) has revamped its process for
updating the 15 codes it publishes, beginning with the 2015 codes.
In the past, all the codes were updated on the same schedule, and
each update involved two rounds of hearings.
The codes will now be divided into two groups, each with one
round of hearings in a three-year code update cycle.
Group A codes, which include the building, mechanical and
plumbing codes, will have code development hearings in April 2012
and will be finalized in October 2012, even though they won’t be
published until 2015. Proposed changes are due January 3, 2012.
Group B codes, which include the residential, green building,
fire, energy, existing building and property maintenance codes, will

be considered in April 2013 and finalized in October 2013. Proposed
changes are due January 4, 2013.
Members interested in submitting changes through NAA/NMHC for
the Group A codes should forward their proposals to Ron Nickson by
December 15.
ICC has also created four new Code Action Committees (CAC)
to allow members more input into the code development process.
Recommendations from these four new CACs will have a major influence
on the final actions taken during the code development process.

NAA Industry Mobilization Fund (IMF)
Now Available to Support Advocacy Efforts
The new NAA Industry Mobilization Fund (IMF) supports advocacy
efforts to address issues of major significance to the apartment industry
with potential national implications. Proposals for IMF funding can be
submitted by an NAA Affiliate, the Board of Directors, the Legislative
Committee or NAA staff. Examples include:
• State and local advocacy campaigns, such as defeating rent
control regulation, inspection ordinances or building code retrofit
requirements
• National advocacy efforts not supported through NAA’s
government affairs program
• Public opinion polling, such as identifying support for higher rents
in exchange for greater energy efficiency in apartments
• Research projects when the results could be utilized nationally,
such as identifying alternatives to sprinkler retrofit mandates or
economic impacts of rent control.
• IMF awards cannot be used to fund campaign contributions for
individuals running for elected office or that are in conflict with
NAA policy positions. In addition, IMF awards cannot be used for
legal action or support. (Legal requests are currently addressed
through a specific line item in the NAA Government Affairs budget.)
