With deadlines to meet, clients to keep happy, and competition to crush, maintaining an employee handbook
can easily fall to the bottom of the corporate to-do list but
the benefits of a legally compliant, up-to-date handbook
make it well worth the effort. Not only is it a powerful defense against litigious employees, it helps set expectations
and ensure that policies are applied correctly and consistently. Here are five things to look for in your employee
handbook.

The employee handbook is often the first taste an employee gets of a company’s culture, so it’s important to
make the right first impression. Even though many companies start from a standardized handbook template, a
little bit of effort can go a long way to make a handbook
feel unique to the company. A message from the CEO,
President, or Founder, a company history, or a mission
statement are all ways to customize a handbook. These
sections can help bring new employees into the team and
reinforce the company’s culture. The employee handbook
is also a great place to highlight policies and perks that can
help attract and retain top talent.
Does it Cover the Basics?
There are a few essential protections that every company should include in its employee handbook. The first
is Equal Employment Opportunity / Anti-Harassment
policy that strictly prohibits discrimination, harassment,
and retaliation on the basis of race, color, sex, religion, age,
disability, national origin, and any other class protected
by state or local law. A legally compliant policy that sets
forth procedures for reporting and addressing unlawful
discrimination, harassment, and retaliation can be effective defense in litigation. It is essential that this section
be reviewed by legal counsel because state and local law
often sets out certain protected classes that are not covered
by federal law. Additionally, certain states have specific requirements for what must be included in a policy.
Another essential protection is the At-Will Employment
statement. This should state that 1) all employment at the
company is at-will, 2) “at-will” means that a company can
terminate employment for any reason not prohibited by
law or no reason at all, and 3) that nothing in the handbook constitutes an employment contract. This statement

Start Off Small When Setting New Year’s Resolutions

The New Year is a time for new beginnings and to set goals that strengthen one’s
spirit, mind and body. While it’s tempting to make big goals, it’s essential to start
small. Set goals that are attainable, easy to sustain and lead to big benefits over
time. As a community-serving organization, we see how things such as getting
involved in with the community and making lifestyle changes can change someone’s life for the better. Here are five New Year’s Resolutions the Kent County Y
recommends for 2014:
1. Eat Healthy: Make water your drink of choice (supplemented by age-appropriate
portions of 100 percent fruit juices and low-fat milk) and eat more fruits and vegetables. Keep it interesting and create some variety by mixing and matching fresh,
frozen and canned fruits and vegetables.
2. Commit to Community Service: Giving back and supporting neighbors can
benefit everyone involved. Not only is it a personally rewarding experience to help
others in need, but it’s also a way to meet new people or discover an interest. Find
an opportunity in your community, such as cleaning the neighborhood park or
distributing food at a local food bank.

3. Unplug from Technology: Limit screen time (television, video games, computer,
etc.) and instead set aside an hour or two for activities. If weather permits, go for
a walk, bike ride, trip to the park, or have a game night at home with family or
friends.
4. Be Physically Active: It’s important for children to get at least 60 minutes of
physical activity each day (30 minutes for adults). Incorporate physical activity into
your daily routines and spend more time walking to places instead of driving to
improve your health and well-being.
5. Put Extras to Good Use: Do you have extra canned goods or clothes that could
benefit others in need? Clean out your pantry, closet or attic and donate extra
items to homeless shelters or community outreach programs.

County’s Executive Director. “Setting a goal to achieve any one of the recommended five New Year’s Resolutions can help improve one’s health and well-being.”

Avoid Disaster-Stay Warm and
Dry This Winter
Roof winterization is an important task that needs to be handled sooner rather
than later. Homeowners and business owners should get ready for winter storms
that include high winds, freezing rain, hail, and heavy snow. If the roof on a
home is not properly prepared, these kinds of conditions can do a lot of damage.
Roof inspections are critical before the Big Stom hits. This inspection will include looking for missing and damaged tiles, warped or missing flashing, worn

should be included in the handbook itself and in an acknowledgement form
that the employee signs and returns. Note that if your company has a union,
the at-will statement will not apply to members of the bargaining unit.
Finally, all handbooks should include guidelines for conduct and safety. Instead of limited rules that forbid specific acts, it is typically more helpful to
identify broadly defined categories that can include a variety of misconduct,
such as absenteeism or tardiness; conflict of interest; damage to property;
fighting, threats or weapons; fraud, dishonesty or false statements; insubordination; unsafe work practices; or other applicable misconduct. Make it clear
that the company retains the discretion to terminate an employee for any infraction, even a first offense and even if you have a “progressive discipline”
policy, make sure it is applied consistently to all employees and keep detailed
records of each step.
Is It Clear and Concise?
A handbook is worthless if employees can’t understand it and managers
can’t apply it consistently. Read through your handbook, cover to cover. Are
there sections that make no sense? Work with your HR advisors and legal
counsel to rewrite these section so that they are easy to understand and still
legally effective. Look for old policies that are either irrelevant or are no longer
enforced. Decide if these policies should be revamped or discarded altogether.
If a significant portion of your workforce speaks a language other than English, consider having your handbook translated.
Is it Tech-Savvy?
If your handbook hasn’t been updated in the last five to ten years (or more!),
it may not address the realities of work in the internet age. Policies that set
forth rules on use of company technology, company ownership of email, and
social media are essential to any modern company. Additionally, global companies and companies operating in certain states may be required to create
and maintain data privacy policies that dictate how personal information is
protected and what by law must be done in the event of a breach of security. A
failure to maintain and comply with a required data security policy can make
a company vulnerable to litigation and penalties.

How Will it Be Rolled Out and Maintained?
Once you’ve created a clear, personalized, legally compliant handbook,
make a plan for how it will be implemented. One option is to hold mandatory
meetings with your employees to make sure they understand any changes or
new policies that have been put in place, and keep a record of every employee
that attends. You should also display the date of the latest revision prominently on the cover, specify that the new handbook replaces earlier handbooks,
and, if possible, collect any old handbooks so that there is no confusion which
handbook should be followed. Make sure every employee signs and returns
an acknowledgement form that states that 1) the employee has read the handbook and understands the policies and 2) the handbook is not a contract and
all employment is at-will. Keep these signed acknowledgement forms in the
employees’ personnel files. Alternatively, this can be done online depending
on the size of the company and its IT capabilities. Finally, make a plan with
your HR advisors and legal counsel to receive updates on any changes in the
law that might require another update to the handbook.
Bottom line: the time to update your employee handbook is before you run
into a problem, not after. It is one of the most important employee-relations
projects your company can embark on. Reach out to your HR advisors and
legal counsel about updating your handbook today.

Winter Driving Tips
• In the event your car begins to spin out of control, here’s what you should do:
- Do NOT slam on the brakes.
- When you begin to skid take your foot off the gas & quickly shift to neutral, then
steer in the direction you want your car to go
- After your vehicle stops skidding, shift to drive and gently press the accelerator.
• Maintain at least a half tank of gas during the winter season to keep the fuel lines
from freezing over.
• Plan long trips carefully, listening to the radio or NOAA Weather Radio for latest
weather forecasts & road conditions
