INTRODUCTION
I.
1.1
Complainant Moen Incorporated (“Moen” or “Complainant”) requests that the
United States International Trade Commission commence an investigation pursuant to Section
337 of the Tariff Act of 1930, as amended, 19 U.S.C. 9 1337, to remedy the unlawful importation
into the United States, the sale for importation into the United States, and the sale within the
United States after importation by the owner, importer, or consignee of certain articles that
infringe a valid and enforceable United States design patent owned by Moen.
1.2
The proposed respondents, Foremost International Trading Inc., Hometek
International Group, Sisco, Inc., Chung Chiang Faucet Co. Ltd., and Lota International Co. Ltd.
(collectively “Respondents”) have engaged in unlawful activities in violation of Section 337
through the importation into the United States, the sale for importation into the United States,
and/or the sale within the United States after importation of certain two-handle centerset faucets
that infringe U.S. Patent No. D347,466 (“the ‘466 patent”). A certified copy of the ‘466 patent is
attached hereto as Exhibit 1. These faucets are referred to herein as the “infringing faucets.”
1.3
As required by Section 337(a)(2) and defined by Section 337(a)(3), an industry in
the United States exists relating to the faucets protected by the ‘466 patent. The design claimed
in the ‘466 patent is used in the “MONTICELEO@O”
line of faucets manufactured by Moen in the
United States. The domestic industry for the ‘466 patent includes Moen’s substantial United
States investments and expenditures in the manufacture of faucets using the design claimed in the
‘466 patent.
1.4
In addition, Moen seeks a permanent general exclusion order pursuant to Section
337(d) excluding from entry into the United States all infringing faucets. Finally, Moen seeks a

permanent cease and desist order pursuant to Section 337(f) directing Respondents and all others
to immediately discontinue the importation into the United States, or the sale within the United
States after importation of all infringing faucets.

COMPLAINANT
2.1
Complainant Moen Incorporated is a corporation organized and existing under the
laws of the state of Delaware, with its corporate headquarters at 25300 A1 Moen Drive, North
Olmstead, Ohio 44070-8022.
2.2
Moen is the owner of the ‘466 patent, which claims the design used for the
particular MONTICELLOO3 two-handle centerset faucet at issue in this case (the “MOEN
faucet”).
2.3
Moen manufactures and distributes throughout the United States a diverse line of
plumbing products including kitchen faucets, lavatory faucets, shower heads, tub spouts, sinks
and related plumbing accessories. Moen has devoted extensive resources to the development of
distinctive designs for its kitchen and lavatory faucets. Since 1992, Moen has sold the MOEN
faucet to mass merchandisers, plumbers and wholesale distributors of plumbing products. The
MOEN faucet, which is available in three distinctive finishes (all chrome, chrome with polished
brass handles, and polished brass), is shown in the brochure attached as Exhibit 2. Exhibit 3 is a
physical exhibit of the MOEN faucet in the chrome finish with polished brass handles.
2.4
Moen’s faucet manufacturing facilities include those located in Elyria, Ohio,
Sanford, North Carolina, and New Bern, North Carolina. Moen makes all of the parts for the
MOEN faucet in the United States. Moen manufactures parts for the MOEN faucet at the Elyria

and Sanford facilities and assembles them at the New Bern facility. Moen distributes the MOEN
faucet from its facilities in Kinston, North Carolina and Las Vegas, Nevada.
111.
PROPOSED RESPONDENTS
3.1
Foremost International Trading, Inc. (“Foremost”) is a corporation organized and
existing under the laws of New Jersey, having a principal place of business at 906 Murray Road,
East Hanover, NJ 07936. Upon information and belief, Foremost imports into the United States,
and sells within the United States after importation, infringing faucets under the heading
“Connoisseur Series.’’
3.2
Sisco, Inc. (‘‘Sisco’’) is a corporation organized and existing under the laws of
California, having a principal place of business at 2945 E. Maria Street, Rancho Dominguez, CA
90221, Upon information and belief, Sisco imports into the United States, and sells within the
United States after importation, infringing faucets under its CASCADETMby HOME PRIDETM
label.
3.3
Hometek International Group (“Hometek”) is a corporation organized and
existing under the laws of Michigan, with its office located at 1755 Park Street, Suite 350,
Naperville, IL 60563. Upon information and belief, Wometek imports into the United States and
sells within the United States, after importation, infringing faucets.
3.4
Upon information and belief, Lota International Co. Ltd. (“Lota”), located at
1O/F 1 Xiamen Special Economic Zone, Trade Center North Hubin Road in Xiamen, Peoples
Republic of China, manufactures infringing faucets and sells those faucets to Sisco for
importation into the United States.

Upon information and belief, Chung Chiang Faucet Co. Ltd. (“Chung Chiang”),
located at 69 Lane 22 Chang Tin Road, Ting Fan Ei, Lu Kang Chang Hua in Hsien, Taiwan,
manufactures infringing faucets and sells those faucets to Foremost for importation into the
United States.
IV.
THE PRODUCT AT ISSUE
4.1
The articles involved in this investigation are two-handle, four-inch centerset
lavatory faucets. Such faucets include two major components: (1) an “escutcheon,” or base,
which typically is mounted on the top surface of a lavatory sink, and supports the handles and
valve mechanisms; and (2) a “spout” through which water flows from the valves into the sink.
These two components are made using a simple casting process, making production of the faucet
components easily portable. The escutcheon and spout are formed by the joining of a top plate
and a bottom (or “throat”) plate.
4.2
The MOEN faucet, which embodies the design claimed in the ‘466 patent, is
Moen’s leading retail lavatory faucet in terms of sales volume and revenue. At least twenty-one
retail home center chains across the United States carry the faucet. In 1997, sales of the MOEN
faucet totaled $29 million. Since introduction of the product in 1993, total sales of the MOEN
faucet have exceeded $90 million. Photographs of the MOEN faucet, which are available in
three finishes (all chrome, chrome with polished brass handles, and polished brass) are attached
as Exhibits 4-6. The MOEN faucet retails in the United States for approximately $1 19 to $170,
depending on the finish.

V.
THE ‘466 PATENT
A.
5.1
Identification of the Patent and Ownership by Moen
U.S. Patent No. D347,466 entitled “Faucet Body” issued on May 31, 1994 to Paul
P. Kolada, Michael J. Painter, and Terry Birchler, the named inventors. A certified copy of the
‘466 patent accompanies this Complaint as Exhibit 1. The named inventors assigned the ‘466
patent to Moen. A certified copy of the assignment accompanies this Complaint as Exhibit 7.
5.2
Pursuant to Rule 2 10.12(c) of the Commission’s Rules of Practice and Procedure,
the Complaint is accompanied by: (1) a four copies of the prosecution history of the ‘466 patent
(Appendix A); and (2) four copies of each reference document mentioned in the prosecution
history (Appendix B).

Moen has not granted any licenses under the ‘466 patent.

5.4
Identification of Licenses
Non-Technical Description of the Patented Design
The design claimed in the ‘466 patent covers a novel, ornamental design for a
spout and escutcheon, which is used in the MOEN faucet. At the time this design was conceived,
no prior art existed with clean and graceful lines, yet with the traditional look achieved by the
patented design. The design claimed in the ‘466 patent filled that void.
5.5
The design of the ‘466 patent creates a unique ornamental effect in which the
components of the faucet provide an impression that they were integrated into a unitary design
that gives the feeling that the water flow is a natural part of the faucet design. The inventors of
the ‘466 patent achieved this appearance by designing a unique spout, among the novel features
of which is that the spout cover (the top piece) and the throat plate (the bottom piece) join

together to create a distinct oval curvature. The end of the spout is then cut at an angle, to create
a circular-shaped spout opening.

Foreign Counterparts
There are no foreign patents or foreign patent applications corresponding to the
‘466 patent that have been issued, abandoned, denied, or remain pending.
VI.
RESPONDENTS’ UNLAWFUL ACTIVITIES
6.1
Respondent Foremost sells its Model No. 1032 two-handle, four-inch centerset
faucet in three different finishes (all chrome, chrome with polished brass handles, and polished
brass) under the heading “Connoisseur Series.” Photographs of these three faucets are attached
as Exhibits 8-10.
6.1.1 As the photographs marked Exhibits 8-10 show, these faucets
infringe the design claimed in the ‘466 patent -- they are substantially the same as
the MOEN faucet to the eye of the ordinary observer.
6.1.2 Upon information and belief, Chung Chiang in Taiwan makes the
Foremost faucet, which has been sold at retail in the United States at $29.96. The
retail packaging of the Foremost faucet states that it was “Made in Taiwan.”
Moreover, the “IAPMO” listing for Chung Chiang lists Foremost products. (See
Exhibit 11).
6.2
Respondent Sisco sells its Model €3-2700 two handle, four-inch centerset lavatory
faucet under its CASCADETMby HOME PRIDETMlabel in three different finishes (all chrome,
chrome with polished brass handles, and polished brass). Photographs of these three faucets are
attached as Exhibits 12-14.

6.2.1 As the photographs in Exhibits 12-14 show, these faucets
infringe the design claimed in the ‘466 patent -- they are substantially the same as
the MOEN faucet to the eye of the ordinary observer.
6.2.2 Upon information and belief, Sisco has sold the Model H2700 faucet to retailers, who sell the Model H-2700 faucet for $49.96 -approximately one-third the price of a genuine MOEN faucet. Upon information
and belief, Lota makes the Sisco faucet in the People’s Republic of China. The
packaging of the Sisco faucet states that it was “Made in China.” Moreover, a
shelf sign at a retail outlet selling the Sisco faucet advertises the faucet using the
designation “Lota Xiamen.” (See Exhibit 15).
6.3
Respondent Hometek has offered its Model 43092 two-handle, four-inch centerset
lavatory faucet for sale to at least one distributor in the United States, leaving a sample of the
faucet with that distributor. A photograph of this faucet is attached at Exhibit 16.
6.3.1 As the photograph marked Exhibit 16 shows, this faucet infringes
the design. claimed in the ‘466 patent -- it is substantially the same as the MOEN
faucet to the eye of the ordinary observer.
6.3.2 Moen obtained the sample of the Hometek faucet, which is chrome
with polished brass handles, from the distributor. The packaging of the Hometek
faucet states that it was “Made in Taiwan.”
6.4
Upon information and belie€, Lota manufactures infringing faucets at its foundry
located at 1 Youngmin Road in the Xinglin District of Xiamen, China and sells these faucets to
Sisco for importation into the United States.

6.5
Upon information and belief, Chung Chiang manufactures infringing faucets at its
facility in Hsien, Taiwan and sells these faucets to Foremost for importation into the United
States.
VII.
SPECIFIC INSTANCES OF UNFAIR IMPORTATION
7.1
Upon information and belief, the infringing faucets manufactured and sold by
Respondents are not manufacturedLin the United States. They are manufactured in the People's
Republic of China and in Taiwan.
7.2
Upon information and belief, and as explained in 77 6.1 to 6.5, Respondents have
imported, or sold for importation into the United States, the infringing faucets.
7.3
Three styles of the infringing Foremost two-handle, four-inch centerset faucet,
(one style having an all chrome finish, one style having a chrome finish with polished brass
handles, and the third style having a polished brass finish), were observed being offered for sale
in Wal-Mart store No. 1805 (LaQuinta, California) and Wal-Mart store No. 1832 (Cathedral
City, California) on March 4, 1998. (Exhibit 17 at 7 3).' Exhibits 8-10 are photographs o€the
three styles of Foremost faucets. Exhibits 18-19 are photographs of the Foremost faucets
observed for sale at Wal-Mart store No. 1805 in LaQuinta, California on March 4, 1998. Upon
information and belief, these faucets were manufactured by Chung Chiang in Taiwan and were
imported into the United States by Foremost.
Note that the Affidavit of Jeffrey B. Tyler (Exhibit 17) was prepared for the district court
litigation involving Foremost. Exhibits 3-5 and 8-10 cited in that Affidavit are physical exhibits
in the district court litigation. Photographs of those physical exhibits are marked as Exhibits 810 and 4-6, respectively, to this Complaint. Exhibits 6 and 7 cited in the Tyler Affidavits are
marked as Exhibits 18-19 to this Complaint.

7.4
Multiple specimens of the infi-inging Sisco two-handle, four-inch centerset faucet
were observed being offered for sale and were purchased in Broadview, Illinois, Deerfield,
Illinois, and Brooklyn, Ohio between December 3, 1998 and February 17, 1999. (See Exhibits
20-22). Upon information and belief, these faucets were manufactured by Lota in the People’s
Republic of China and were imported into the United States by Sisco.
7.4.1 The infringing Sisco faucet shown in Exhibit 14 was purchased at
the Home Deport store in Broadview, Illinois on December 3, 1998. (See Exhibit
20 at 72). A second, identical faucet was purchased at the same store on January
15, 1999. (Id at 7 3 ) .
7.4.2 Another infringing Sisco faucet, identical to the faucet shown in
Exhibit 12, was purchased at the Home Depot store in Deerfield, Illinois on
December 3, 1998. (See Exhibit 21 at 72).
7.4.3 Three more infringing Sisco faucets, two identical to the faucet
shown in Exhibit 12 and one identical to the faucet shown in Exhibit 14, were
purchased at the Home Depot store in Brooklyn, Ohio on December 3, 1998. (See
Exhibit 22 at 72). A shelf display sign advertised the faucets using the
designation “Lota Xiamen.” (See Id. at 13; Exhibit 15).
7.4.4 Finally, two more infringing Sisco faucets identical to the faucet
shown in Exhibit 12 were purchased at the Home Depot Store in Brooklyn, Ohio
onFebruary 17, 1999. (Id. atT4).
7.5
On January 22, 1999, Moen obtained an infringing faucet marketed by Hometek
from Anderson Lumber, a distributor of plumbing supplies. (See Exhibit 23). The packaging

for that faucet indicates that is was “Made in Taiwan.” Once Moen obtained this faucet, it
became apparent that, given the ease of manufacture of these faucets, more infringing faucets
would be imported in the future.
VIII. CLASSIFICATION OF THE INFRINGING PRODUCTS UNDER THE
HARMONIZED TARIFF SCHEDULE OF THE UNITED STATES
8.1
Upon information and belief, Respondents’ infringing faucets are classified under
848130.1030 of the Harmonized Tariff Schedule of the United States. The escutcheon, if
imported alone, would be classified under 8481.9O.5000 of the Harmonized Tariff Schedule of
the United States.
IX.
THE DOMESTIC INDUSTRY
9.1
As defined by Section 337(a)(3), a domestic industry exists in connection with
Moen’s manufacture and sale of the MOEN faucet (using the design claimed in the ‘466 patent),
including (1) significant United States investments in plant and equipment, and (2) significant
employment of labor and capital in the United States.
A.
Moen Domestically Manufactures Faucets Using the Design
Claimed in the ‘466 Patent
9.2
Moen manufactures the MONTICELLOB four-inch centerset faucet using the
design claimed in the ‘466 patent in the United States.
B.
Significant United States Investments in Plant and Equipment
9.3
Moen has invested substantially in plant and equipment in the United States
devoted to the manufacture and distribution of the MOEN faucet using the design claimed in the
‘466 patent. Moen makes all the components used in the MOEN faucet in the United States.

9.4
Moen manufactures components of the MOEN faucet at its facilities in Elyria,
Ohio, and Sanford, North Carolina. Moen assembles the MOEN faucet at its plant in New Bern,
North Carolina. Moen distributes the MOEN faucet from its facilities in Kinston, North Carolina
and Las Vegas, Nevada.
9.4.1 Moen's Elyria, Ohio plant, which supplies components for the
MOEN faucet, is located at 377 Woodland Avenue, Elyria, Ohio, 44035. Detailed
information about this plant is contained in Confidential Exhibit 24.
9.4.2 Moen's Sanford, North Carolina plant, which also supplies
components for the MOEN faucet, is located at 2609 Cox Mill Road in Sanford,
North Carolina 27330. Detailed information about this plant is contained in
Confidential Exhibit 24.
9.4.3 Moen assembles the MOEN faucets at its New Bern, North
Carolina plant, which is located at 101 Industrial Drive in New Bern, North
Carolina 28562. Detailed information about this plant is contained in
Confidential Exhibit 24.
9.4.4 Moen distributes the MOEN faucet, as well as other Moen
products, from its Kinston, North Carolina and Las Vegas, Nevada distribution
centers. These facilities are located at (1) 1700 Dobbs Farm Road in Kinston,
North Carolina 28504 and (2) 4335 N. Arcata Way in Las Vegas, Nevada 89030.
Detailed information about these centers is contained in Confidential Exhibit 24.

9.5
Significant Employment of Labor and Capital in the United States
Moen employs a substantial amount of labor in the United States to manufacture,
assemble, and distribute the MOEN faucet. Detailed information about Moen’s labor
employment is contained in Confidential Exhibit 24.
9.6
Moen has promoted the MOEN faucet in the media, using both television and
print advertisements. Moen has spent more than $9 million advertising and promoting the
MOEN faucet, including $7 million in television advertising. Commercials for the MOEN faucet
have appeared on ABC, CBS, NBC, ESPN, A&E, CNN, and other national networks.
X.
RELATED LITIGATION
10.1
Moen filed a complaint against Foremost in the United States District Court for
the Northern District of Illinois on December 17, 1997 (CA 97 C 8739). Moen alleged, inter
alia, infringement of the ‘466 patent. On September 1, 1998 the court granted Moen a
preliminary injunction on the issue of design patent infringement. On March 4, 1999 the court
entered summary judgment for Moen, ruling that the Foremost faucet infringed the ‘466 patent
and entering a permanent injunction prohibiting Foremost from making, using, selling, or
importing the infringing faucet. Foremost requested reconsideration of this determination, which
the court denied on May 5, 1999. The court’s decision remains subject to appeal.
10.2
Moen filed a complaint against Sisco in the United States District Court for the
Northern District of Illinois on December 11, 1998 (CA 98 C 7947). Moen alleged, inter alia,
infringement of the ‘466 patent. On January 15, 1999, Sisco moved for a transfer of venue to the
U.S. District Court for the Central District of California. This issue was not decided, however, as
Moen voluntarily dismissed the case on May 10, 1999, in anticipation of filing this Complaint.

XI.
RELIEF REQUESTED
11.1
WHEREFORE, by reason of the foregoing, Complainant Moen respectfully
requests that the United States International Trade Commission:
(a)
Immediately institute an investigation pursuant to 19 U.S.C. 4 1337(b)(l) into the
violations of that section based on Respondents’ unlawful importation into the United States, sale
for importation into the United States, or sale within the United States after importation of twohandle centerset faucets and escutcheons, and components thereof, that infringe U. s. Patent No.
D347,466;
(b)
Issue apermanent general exclusion order pursuant to 19 U.S.C. 0 1337(d),
excluding from entry into the United States all infringing two-handle centerset faucets and
escutcheons, and components thereof, that are imported into the United States, sold for
importation into the United States, or sold within the United States after importation that infringe
United States Patent No. D347,466;

I, Jeffrey B. Tyler, being duly sworn, depose and state as follows:
1. I have been employed by Moen Incorporated, plaintiff in the aboveentitled civil action, since July 1997 as Senior Product Manager, Bath.
2. On February 13, 1998 I forwarded to Daniel C. McEachran, attorney
for Moen Incorporated in the above-identified litigation, three specimens of a Foremost 4inch centerset faucet, one specimen having an all chrome finish (Ex.3j, one specimen having
a chrome finish with polished brass handles (Ex. 4), and the third specimen having a
polished brass finish (Ex. 5). Those three specimens were acquired, to the best of my
information and belief, by Moen Incorporated in Canada and shipped to the Moen
Incorporated headquarters in North Olmsted, Ohio. I subsequently shipped those faucets to
Mr. McEachran.
3. The specimen faucets identified as Exhibits 3, 4 and 5 are identical to
Foremost faucets which I saw on sale at Wal-Mart store No. 1805 and Wal-Mart store No.
1832 in LaQuinta, Calif., and Cathedral City, Calif., respectively, on March 4, 1998.
Attached as Exhibits 6 and 7 are photographs of the faucets that I saw on sale at Wal-Mart
store No. 1805 in LaQuinta, Calif., on March 4, 1998.
4. On February 13, 1998 I also forwarded to Mr. McEachran three
specimens of a Moen MONTICELLO 4-inch ceriterset faucet, one specimen having an all
chrome finish (Ex. 8), one specimen having a chrome finish with polished brass handles (Ex.
9), and the third specimen having a polished brass finish (Ex. 10). The MONTICELLO
faucets are in packages labeled the "Decorator Series, " which is how such faucets are sold at
retail.

2. On December 3, 1998, I purchased at a Home Depot store in Brooklyn, Ohio, two

depicted in Exhibit 14. The name “Sisco” appeared on the back of the faucets.
3. The sign on the shelf display advertised the faucets using the designation “Lota
Xiamen.” I photographed the sign, a copy of which photograph is attached to Moen’s complaint
as Exhibit 15.
4. On February 17, 1999, I purchased at a Home Deport store in Brooklyn, Ohio two
other faucets like the one depicted in Exhibit 12 to Moen’s complaint. They also bore the
designation “Sisco” on the back of the faucets.

Boulevard in Ogdcn, Utah. During that sales call, Michael Kelleher, the buyer for Anderson
Lumber, handed me a Hometek Xnternational Group Model 43092 two handle, foulcinch centerset
lavatory fauctt. A picture of this faucet is zttached to Mom's complaint as Exhibit 16.
3. Mr. K e l l W told me that hc received the Homctck fawet shown in Exhibit 16 from a
Homctck sales representative who was offering the faucet for sale to Anderson Lumber.
4. The retail package o f the Hometek faucet states that it was "Made in Taiwan."
