Project: Herburger Wetland Reasonable Use Exceptions.
Description of Proposal: The applicant is requesting two wetland reasonable use
exceptions to construct a single-family residence within a required wetland buffer
on each of two adjacent legal lots of record.
The two lots are encumbered by a large Category II wetland. The required buffer
associated with the Category II wetland is 100 feet which consumes 75 to 80 percent
of the area on the lots.
Applicant: Greg Herburger, 2904 16th Street SE, Puyallup, WA 98374
Location of Proposal: The addresses for the lots are 1157 and 1161 Lake Park Drive
SW, Tumwater, WA 98512. The lots are within a portion of the NW ¼, Section 34,
Township 18N, Range 2W. Thurston County Tax Parcel Nos. 80700001202 and
80700001201.
Date of Complete Application: July 8, 2014.
Required Project Permit/Approvals: The following approvals/permits are required:
Wetland Reasonable Use Exception, Environmental Review (SEPA Determination),
Fish and Wildlife Habitat Protection Plan Approval, Land Clearing Permits and
Building Permits.
SEPA Review: The proposal must be reviewed under provisions of the State
Environmental Policy Act (SEPA). A SEPA threshold determination is required to
be issued by the City of Tumwater Community Development Department.
In accordance with WAC 197-11 (SEPA rules) and TMC 16.04, the applicant has
submitted a completed environmental checklist. The purpose of the checklist is to
provide information to help individual citizens and reviewing agencies identify
possible environmental impacts from the proposal. In addition, a wetland delineation
report and fish and wildlife habitat protection plan has been submitted.
Determination of Consistency: At this time no determination of consistency with
City plans or standards has been made. At a minimum, this project will be subject to
the following regulations: Tumwater Comprehensive Plan, Tumwater Zoning Code,
www.ci.tumwater.wa.us
Tumwater Development Guide (street, utility, and storm water standards), Wetland
Protection Ordinance, Fish and Wildlife Habitat Protection Ordinance, Tree
Protection Ordinance and International Building and Fire Codes.
Public Hearing: A public hearing before the City of Tumwater Hearing Examiner is
required for this project. The hearing has not been scheduled at this time. Persons
receiving this notice will be informed of the date, time and place of the hearing, at
least 10 days prior to the hearing.
Public Comment Period: The duration of the comment period for this notice is 14
days. Written comments may be submitted to City of Tumwater, Community

must be received by 5:00 p.m. on July 28, 2014.
