BAUGBOG, DEPUTY CHIEF OF POLICE, INFORMED US THAT ON JULY 28, 2012 AT PUROK 3,
BARANGAY MOTHERLODE, JOSE PANGANIBAN, CAMARINES NORTE, CONDUCTED CHECKPOINT AND
FLAGGED DOWN FOUR (4) DUMP TRUCKS; LOADED WITH MINERAL ORES UPON VERIFICATION,
DRIVERS PRESENTED THE FOLLOWING:

PROOF OF OWNERSHIP OF DUMP TRUCKS OWNED AND OPERATED BY ONE NONIE BESA OF
1390 TAHIMIK ST., FELVILLE SUBD., STA. CRUZ GUIGUINTO, BULACAN.

AUTHORIZATION LETTER FROM GOV. TALLADO IN FAVOR TO BOHAI TOP FOR THE
TRANSFER OF 5,000 MT OF LUMPY IRON ORE;
3.
ORE TRANSPORT PERMIT, DATED JULY 5, 2012, ISSUED TO NONIE BESA AS MINING
OPERATOR AND BOHAI TOP INTERNATIONAL MINING CORPORATION AS A BUYER.

Gallardo said in her Sinumpaang Salaysay, that De Jesus and even employees of the mining
facility, particularly a certain Polding Borja and Leo delos Angeles, who led the digging of the open pit,
often referred to Tallado in conversations as the owner of the facility. “I strongly believe that they
(employees) are just using the Chinese to protect Tallado. He is in fact the owner of that mine,” Gallardo
claimed.

There are several substantial evidences that Nonie Besa aside from
the fact that he is using by Gov. Tallado as a front mining operator and
exporter; he was also acted as owner of the dump trucks and equipment
used in mining operation, hauling and transportation up to the export
shipment of mineral ores:
1. MEMORANDUM FOR THE OIC PNP PROVINCIAL DIRECTOR WHICH SUBJECT IS
ABOUT ILLEGAL TRANSPORT OF MINERALS, DATED AUGUST 4, 2012,
FORWARDED BY PS/INSP JAMES SEBANDAL BAUGBOG. HE REPORTED THAT UPON
THEY FLAGGED DOWN FROM THE CHECKPOINT, DRIVERS OF SAID TRUCKS,
PRESENTED TO THE POLICE A PROOF OF OWNERSHIP WHICH OWNED AND
OPERATED BY ONE NONIE BESA OF 1390 TAHIMIK ST., FELVILLE SUBD., STA.

2. SINUMPAANG SALAYSAY OF ZENAIDA GALLARDO, TO WIT:
Paragraph 3. “Na, noong humigit kumulang sa ika-8:00 ng umaga Hulyo 26,
2011 ay nagulat na lamang kami ng aking mga anak ng may dumating na
grupo ng kalalakihan na ang isa ay kilala namin sa pangalan na POLDING
BORJA (former VIP Security of Gov. Tallado and a relative of Atty. Mata) at LEO
DELOS ANGELES na at sila ay may dalang (2) Bulldozer, (2) Backhoe at (4) na
Dump Truck na may nakalagay sa unahang salamin na “GOVT PROJECT DO

Paragraph 4, Sinumpaang Salaysay ni ZENAIDA GALLARDO: “Na, sa pagdating
ng nasabing grupo at mga heavy equipment ay tuloy-tuloy na itong pumasok sa lupain
na aking pinamamahalaan at binuldoser na nila ang mga punong kahoy, punong niyog
at iba pang pananim, at ang bundok naman ay kanilang pinatag at dahil doon ay
kinausap ko ang mga ito na huwag naman nilang sirain ang lupang pinagkukunan
namin ng aming kabuhayan, subalit hindi nakinig ang mga ito sa akin;”

Paragraph 6. Na, bagamat pinapatigil ko na ang walang humpay na pagmimina gamit
ang mga heavy equipment tulad ng Bulldozer, Backhoe, Dump truck at iba pang uri ng
malalaking makinarya na ginagamit sa pagmimina at pagsira sa lupang pansakahan
na mahigit sa apat-napung (40) taon naming pinagyaman. Sa kabila ng aming
pagpapatigil ay nagpatuloy pa rin ang mga ito sa pagmimina sa pangunguna ni
POLDING BORJA at isang nagngangalang LEO na kilala sa tawag na BOTSOK, na
ayon sa pagpapakilala nila sa amin ay mga tauhan sila ni GOV. EDGARDO A.
TALLADO;
Paragraph 11. Na, sa aking pagkaka-alam ay si Gobernador Edgardo Tallado ang
nag-papamina sa aking lupain na pinamamahalaan, at ito ay naririnig namin mula sa
mga trabahador ng mina, at batay na rin sa ginawang pagpapakilala sa amin nina
POLDING BORJA at ENGR. RONALDO VARGAS;

Paragraph 2 “Na, noong buwan ng Hulyo taon 2011, humigit kumulang sa lka-7:00
ng gabi ay nakatanggap ako ng tawag sa cellphone at ilang text messages mula
kay ANTONIO DE JESUS at ayon kay ANTONIO DE JESUS ay kanya nang binigyan
ng authorization si GOV. EGAY TALLADO na minahin o magmina ng bakal sa lupain
na aking pinamamahalaan; bilang patotoo sa pagkakaunawaan na ito ni ANTONIO
DE JESUS at GOB. TALLADO upang wasakin at minahin ang aming lupang
pinagyaman at sinasaka na pinagkukunan naming ng aming ikinabubuhay ay
inilalakip ko ang kopya ng mga larawan na magpapakita ng mga text messages ni
ANTONIO DE JESUS sa akin na nagsasabing binigyan na niya ng permiso si Gob.

Gallardo said she came to know of Tallado’s involvement from Antonio “Tony” de
Jesus, heir of her former landowner, Felixberto de Jesus. “It was Tony who told me in a text
message that he had given Governor Tallado the authority to mine on his land. He said he
signed an agreement with him,” said Gallardo. She still keeps De Jesus’s text messages
as evidence

“Gallardo claimed that Tallado was using the Chinese firm as a front
for his illegal mining activities”. The National Bureau of
Investigation has since come in, investigating the allegations
against Tallado. “We lost everything, our livelihood and my
children’s houses. All that is left is this house my husband and I
built, and a few square meters of land,” said Gallardo”.
