Motion for Summary Judgment.
The Plaintiff filed a motion for summary judgment, alleging that the Defendants were
in default on their mortgage as a matter of law. The Defendants asserted that summary judgment should not be granted because the Plaintiff failed to comply with the regulations issued
by the Department of Housing and Urban Development (HUD), so the Defendants could not
be deemed in default as a matter of law. Based on the Pennsylvania Superior Court case, Fleet
Real Estate Funding Corp. v. Smith, 366 Pa. Super. 116, 530 A.2d 919 (1987), the Court
denied the Plaintiff’s Motion because the Defendants may raise the Plaintiff’s failure to
comply with HUD regulations as an equitable defense at trial.

AND NOW, this 18th day of August 2006, the Motion for Summary
Judgment, filed by Plaintiff, Mortgage Electronic Registration Systems,
Inc., is DENIED.
STATEMENT OF REASONS
Presently before the Court is Plaintiff’s Motion for Summary Judgment against Defendants John R. Handlovic and Carole Handlovic (“Defendants”). Plaintiff, Mortgage Electronic Registration Systems, Inc.
(“Plaintiff ”), asserts that it is entitled to summary judgment because Defendants have defaulted on their mortgage. Defendants contend that we
should deny Plaintiff’s Motion because a genuine issue exists as to the
material facts in this case. Based upon our review of the relevant Pennsylvania case law, we find that an issue of material fact exists, and we must
deny Plaintiff’s Motion for Summary Judgment.
Standard of Law
Pennsylvania Rule of Civil Procedure 1035.2 states that where there
is no genuine issue of material fact and the moving party is entitled to relief
as a matter of law, summary judgment may be entered. A non-moving
party may not rest on averments contained in pleadings or answers to sur12

vive a Motion for Summary Judgment if the burden of proof rests on the
non-moving party. Manzetti v. Mercy Hospital, 565 Pa. 471, 776 A.2d 938,
945 (2001). However, for summary judgment to be granted, the moving
party cannot rely exclusively on the oral testimony of its own witnesses to
establish the absence of a genuine issue of material fact. Nanty-Glo Boro.
v. American Surety Co., 309 Pa. 236, 163 A. 523 (1932); Sherman v. Franklin Regional Medical Center, 443 Pa. Super. 112, 660 A.2d 1370 (1995).
In determining whether summary judgment should be entered, the
record must be viewed in a light most favorable to the non-moving party,
and all doubts as to the existence of a genuine issue of material fact must
be resolved against the moving party. Manzetti, supra, 776 A.2d at 945.
“An entry of summary judgment may be granted only in cases where the
right is clear and free from doubt.” Sherman, supra at 115, 660 A.2d at
1372. Pennsylvania Rule of Civil Procedure 1035.1 defines what the relevant record is for deciding this type of motion. The following statement
of facts is taken from the submissions of the parties viewed in the required
light.
Statement of Facts
On March 13, 2003, Defendants executed a mortgage with Plaintiff
for the premises located at 1809 Hay Terrace, Easton, Pennsylvania (“the
premises”). Complaint at ¶3. Plaintiff asserts that the Defendants are currently in default on the mortgage of the premises. Id. at ¶5. As a result of
Defendants’ default, Plaintiff invoked the acceleration clause in the mortgage in order to collect on the entire amount due plus interest and costs.1
Id. Defendants contend that they are not in default because Plaintiff cannot
invoke the acceleration clause in their mortgage, due to the fact that Plaintiff has failed to comply with the regulations issued by the Department of
Housing and Urban Development (“HUD”), which are set forth at 24 C.F.R.
§§203.500 through 203.660.
Discussion
In this case, the only real disputed fact is whether or not Plaintiff
complied with HUD regulations. Thus, the only issue before us is whether
this disputed fact prevents us from granting summary judgment in favor of
Plaintiff as a matter of law. Our determination of this issue is controlled by
the Pennsylvania Superior Court case, Fleet Real Estate Funding Corp. v.
Smith, 366 Pa. Super. 116, 530 A.2d 919 (1987). In Fleet, the mortgagor
appealed the trial court’s decision to grant the mortgagee’s summary judgment motion in a mortgage foreclosure action. Id. at 118, 530 A.2d at 920.
In that case, the mortgagor contended that the mortgagee should not be

granted summary judgment because the mortgagee failed to comply with
HUD regulations. Id. Upon review, the Superior Court concluded that a
mortgagee is not required to comply with HUD regulations prior to foreclosing on an FHA-insured mortgage. Id. at 122-23, 530 A.2d at 922-23.
Despite this determination, the Superior Court reversed the trial court’s
decision, holding that summary judgment was inappropriate because noncompliance with HUD regulations raised an equitable defense to foreclosure.
Id. at 124, 530 A.2d at 923. Therefore, summary judgment could not be
granted because a material fact was at issue. Id.
After review of Fleet, it is clear that our case is nearly identical to
the facts in that case. Here, the Defendants allege that Plaintiff failed to
comply with HUD regulations.2 According to Fleet, noncompliance with
HUD regulations is an equitable defense that, when properly pled, prevents
summary judgment. In this case, the Defendants have properly pled this
defense in their New Matter, citing numerous violations of the HUD regulations by Plaintiff. Thus, it would be improper for us to grant Plaintiff’s
Summary Judgment Motion because a genuine issue of material fact exists
regarding Plaintiff’s compliance with the HUD regulations. See also, Commonwealth School Employee’s Retirement Fund v. Terrell, 399 Pa. Super.
328, 582 A.2d 367 (1990) (relying on Fleet to hold that summary judgment
could not be granted for the mortgagee when the mortgagor properly alleged
that the mortgagee failed to comply with HUD regulations). Therefore, in
accordance with Fleet and after giving the Defendants the benefit of all
reasonable inferences and resolving all doubts in favor of the Defendants,
Plaintiff’s Motion for Summary Judgment must be denied because there is
a material fact in dispute concerning Plaintiff’s failure to adequately service the mortgage.

with the Defendants. Plaintiff has offered no evidence to dispute this allegation and to prove
