Executive Summary
Section 15.2-2221 of the Code of Virginia states that local planning commissions shall produce
an annual report to the governing body concerning the operation of the commission and the
status of planning within the jurisdiction. This document is intended to satisfy that statutory
requirement and help provide information on growth and development in Shenandoah County
to the Board of Supervisors and the general public.
In 2010, Shenandoah County continued to feel impacts of the global economic recession.
However, the review of last year’s housing and permitting data has provided an opportunity to
become guardedly optimistic about the notion that Shenandoah County has weathered the
worst of a market correction that has hopefully solidified a more sustainable level of growth
and development in Shenandoah County, and around the Commonwealth.
To that end, the Planning Commission reviewed only two site plan requests, six special use
permits, numerous text amendments, and no rezoning requests. These numbers are similar to
last year’s requests. In addition, no subdivision plats came before the Planning Commission in
2010. The outcomes of these requests heard by the Planning Commission are spelled out in the
report along with a history of these types of applications from previous years. Also, there is a
summary of staff’s actions concerning administrative plats, building permits, and land
disturbance permits, along with a summary of the actions of the Board of Zoning Appeals.
Similarly, administrative subdivision requests held nearly steady, and the total number of new
residential buildings in the County and towns decreased slightly. The number of new land
disturbance permits decreased, but inspections of existing dormant projects continued.
In 2010, the County its work with Milton Herd of Herd Planning and Design to conduct a
Community Planning Project (CPP) in order to prepare the necessary amendments to the
Comprehensive Plan and Zoning/Subdivision Ordinances in order to accomplish the vision
statement set forth in the current Comprehensive Plan. This significant achievement is
intended to preserve the rural areas of the County, while directing growth to its towns and
public service areas. In addition, a comprehensive three-tiered wind energy ordinance was
adopted in 2010.
The Planning Commission is faced with the challenge of meeting the demands of its
constituency in the midst of a constantly changing political and economic climate.
Furthermore, it recognizes that over the course of the upcoming 2011 calendar year, priorities
are bound to shift. However, this document sets forth a flexible list of goals to be pursued with
diligence, haste, and careful deliberation, above and beyond the Commission’s ministerial
duties and unsolicited discretionary requests.

Review House Location Survey legislation as requested by the BZA.
Continue to pursue the joint adoption of Urban Growth Areas in concert with the Towns,
including Land Use Maps for the Maurertown-Toms Brook area and Basye-Bryce area.

mandated by the State.

Develop ordinances that take into consideration mixed-use traditional style development.

Agricultural & Forestal Districts
In 2010, the Woodstock East Agricultural and Forestal District (466.910 acres) was renewed for
another ten year term. Several new parcels were added, and several were removed, resulting
in a net loss of 59.476 acres. Since no individual requests for removal or withdrawal from other
districts were considered during the 2010 calendar year, the overall County acreage in
Agricultural and Forestal Districts at the end of 2010 was reduced by an equivalent amount for
a remaining total of 41,332.716 acres. Shenandoah County remains a top Agricultural and
Forestal District participant in the State of Virginia.

following page indicates total acreage, year of establishment, and renewal dates for each
district.

Shenandoah County issues building permits and conducts inspections under the Virginia
Uniform Statewide Building Code. Building permits are required for new dwellings, additions,
accessory buildings, electrical and plumbing work, heating and air conditioning, commercial
projects, and other projects. The following analysis focuses on new dwellings only. Certificates
of Occupancy are issued on new residential dwellings that are completed during the year and
are given final inspection approval (completions). The New Residential Buildings category
shown below takes into consideration only permits issued in 2010 for new structures,
regardless of whether a certificate of occupancy has been issued. These numbers often do not
match because dwellings started in the year aren’t always finished the same year. The
following chart depicts both numbers for each month in 2010.

Erosion & Sediment Control Permits
Shenandoah County operates an Erosion & Sediment Control Program per the requirements
found in Section 10.1-560 of the Code of Virginia. The state and local codes require all
developments that involve more than 10,000 square feet of land disturbance to have an
approved land disturbance permit before excavating begins. To obtain a land disturbance
permit, an Erosion & Sediment Control plan must be designed by an engineer and approved by
the local program administrator. E&S plans in Shenandoah County are reviewed by a contract
reviewer (Racey Engineering) and inspections are conducted by County staff to ensure
compliance with the plan. Shenandoah County requires E&S bonds and as-built plans. The E&S
program extends to all of the towns in Shenandoah County except Woodstock, which operates
its own program.

whether active or inactive. Therefore, several sites permitted as long ago as 2004 are still

Rezonings
Rezonings, also referred to as map amendments, are required in order to change
a property from one zoning classification to another. Rezonings require a joint
public hearing and a recommendation from the Planning Commission, with final
approval determined by the Board of Supervisors. Rezonings are a legislative
decision, which means the Board may exercise discretion when making its
decision.

Special Use Permits
The Zoning Ordinance contains a list of uses allowed in each zoning district by-right and by
special use permit. Special Use Permits require a joint public hearing and a recommendation
from the Planning Commission, with final approval determined by the Board of Supervisors. The
BOS can impose conditions on the Special Use Permit as long as they bear a reasonable
relationship to the legitimate land use concerns and problems generated by the proposed use
of the property. Special Use Permits are a legislative decision, which means the Board may
exercise discretion when making its decision.
In 2010, there were six Special Use Permits approved, and none were denied. The chart below

Subdivision Plat
Shenandoah County requires preliminary and final subdivision plat approval in order to
subdivide land (the PC makes a recommendation to the BOS on both). The final subdivision plat
is recorded at the Clerk’s Office and legally divides a parcel. Subdivisions are a ministerial
approval, which means that if all of the applicable codes are met, the Board must approve the
plat. Shenandoah County also allows one-lot divisions, family subdivisions, and cluster divisions
that are approved administratively by staff.
In 2010, there were no subdivision applications requiring Board approval. All subdivisions were
administratively reviewed by the Planning & Zoning staff. Staff approved 23 one-lot
subdivisions, 13 family subdivisions, and 7 Ag & Forestal divisions. The total number of
developable lots created in 2010 in the unincorporated areas of the county was 36.
Administrative plats create a maximum of one new lot. Boundary line adjustments move or
adjust internal property lines between contiguous parcels but cannot create any additional
parcels. Family subdivisions create new lots for an immediate family member. The person
subdividing the lot has to have owned the property for five years and the person receiving the
lot has to retain the lot for an additional five years. A family subdivision affidavit is required,
and is recorded with the plat. Agriculture and Forestal plats allow the division of land to be
used for agriculture or forestal purposes only. An Ag and Forestal Affidavit is required by
Shenandoah County, and it is recorded with the plat. In addition, language is placed on the plat
indicating that the lot is for ag and forestal purposes only, not for development. The Office of
Planning and Zoning performed administrative divisions and boundary line adjustments at
levels consistent with historical trends.

The Code of Virginia requires all jurisdictions with a Zoning Ordinance to have a Board of Zoning
Appeals. The Board of Zoning Appeals is a five member board of citizens appointed by the Circuit
Court. The Board hears appeals of decisions made by the Zoning Administrator and variance requests
from the requirements of the Zoning Ordinance. All appeals and variance requests require a public
hearing. Variance and appeal requests are discretionary decisions; although case law does provide
guidance as to what the courts consider a hardship (which is required for a variance approval).
In 2010, the Board of Zoning Appeals heard eight variance requests. Of the eight requests, all were
approved and none were denied. The chart below shows the actions taken on variance requests by
the Board of Zoning Appeals in 2010.

Text amendments add, change, or delete text from the county code. Text Amendments involve a joint public
hearing and require a recommendation from the Planning Commission with final approval determined by the
Board of Supervisors. Text amendments are a legislative decision, which means the Board has discretion in
making its decision, although some text amendments are required by changes in the Code of Virginia.

According to Section 165-104 of the Shenandoah County Zoning Ordinance, “A zoning permit is required for any
change of the use of land or building or the construction of a new building or the reconstruction, enlargement
or alteration of an existing building, except that fences driveways, sidewalks, roof coverings, siding, shutters,
doors, gutters and downspouts, interior remodeling, interior and exterior painting, uncovered steps, and
uncovered handicapped ramps shall not require permits.” Zoning permits are ministerial decisions, and are
approved administratively by staff.
2010 permit data, as represented in the chart on the following page, shows an increase in residential addition
activity, as well as in accessory structures. However, permitted farm structures decreased significantly. New
residential permits held steady, and commercial/industrial permits returned to historically average levels after
last year’s spike.
