This Code is promulgated by NALS and accepted by its members to accomplish these ends . Canon 1. Members of this association shall maintain a high degree of competency and integrity through continuing education to better assist the legal profession in fulfilling its duty to provide quality legal services to the public. Canon 7. Members of this association, unless permitted by law, shall not perform paralegal functions except under the direct supervision of a lawyer and shall not advertise or contract with members of the general public for the performance of paralegal functions. Canon 2. Members of this association shall maintain a high standard of ethical conduct and shall contribute to the integrity of the association and the legal profession. Canon 3. Members of this association shall avoid a conflict of interest pertaining to a client matter. Canon 8. Members of this association, unless permitted by law, shall not perform any of the duties restricted to lawyers or do things which lawyers themselves may not do and shall assist in preventing the unauthorized practice of law. Canon 4. Members of this association shall preserve and protect the confidences and privileged communications of a client. Canon 9. Members of this association not licensed to practice law shall not engage in the practice of law as defined by statutes or court decisions. Canon 5. Members of this association shall exercise care in using independent professional judgment and in determining the extent to which a client may be assisted without the presence of a lawyer and shall not act in matters involving professional legal judgment. Canon 10. Members of this association shall do all other things incidental, necessary or expedient to enhance professional responsibility and participation in the administration of justice and public service in cooperation with the legal profession. Canon 6. Members of this association shall not solicit legal business on behalf of a lawyer. Trindle Byrne, PLS I introduced you to my childhood experiences at Disneyland in the last two posts in this series and discussed how over the course of thirty years, I learned several lessons from Disney. If you have read the previous posts, you know I use my Disney experiences and apply those lessons to everything I do today, including my involvement with NALS. The first lesson I shared with you was that cast members are there to help you, just like NALS members. The second lesson was details enhance the guest experience at Disneyland and the membership experience in NALS. I have also learned from Disney (and my parents) that adventures are more fun with friends and anyone can be a friend. Growing up, my family was a small group; a family of five made up of my parents, me, my sister, Koleen, and my brother, Shawn. Everyone in my family is an extrovert. My dad explores the world by trying to figure out everyone and everything. He asks a lot of questions and is actively involved in whatever is going on around him. My mom is the kind of person who will talk to everyone, other park guests, cast members, performers-everyone, and she will do it everywhere. She will strike up conversations with people standing in line, washing hands in the ladies’ room, having lunch, sitting on a park bench for a parade-everywhere. As a kid, I would sometimes be embarrassed by this, but as an adult, I get it. We were able to have experiences inside and outside of the park because they were both so outgoing. My parents were great at networking and making connections. Inevitably, we would end our day at Disneyland by sitting down to watch the “Main Street Electrical Parade” or “Fantasmic” followed by fireworks. As the crowds began to converge, my parents would invite conversation with the people around us. If there was empty space, they found a nice family to fill it. We met people from all over the country and the world. I even developed a pen-pal relationship with a girl from Australia. Because they spoke with cast members, as well, we have been able to ride in the Lilly Belle Caboose, steer the Mark Twain, experience parades, “Fantasmic” and “World of Color” from preferred locations. Yes, my parents even formed a relationship with Lagniappe, the mime, who performed in New Orleans Square. He gave us a backstage tour of part of New Orleans Square and the Disney Art Gallery above Pirates of the Caribbean. Since developing a relationship with him, my parents have seen Mark Wenzel perform at other locations around California. Everyone was a friend. The same is true at NALS, everyone is a friend, even someone we have never met before. As members, we share common goals, experiences and interests. Simply by virtue of our membership, we all work in the legal field in one way or another. Guests at our meetings and events are there for a specific purpose. They want to obtain CLE hours, information on a specific topic, interest in the association, or they want to form relationships with other legal professionals. We have more things in common with each other than we do differences. Networking is one of the fundamental differences between NALS and other legal support professional organizations. Networking is the reason I joined NALS and not another association. At local, state, regional and national meetings, you will find time set aside for members, guests, vendors and sponsors to interact with one another. NALS believes in networking so much that we include it as a part of our Mission Statement, “NALS is dedicated to enhancing the competencies and contributions of members in the legal services profession. NALS accomplishes its mission and supports the public interest through…networking opportunities at the local, state, regional and national levels…” We have fun while we fulfill our responsibilities to our profession and our association. I challenge you to take a page from the Greg and Merrinda Trindle Disney handbook. The next time you are at a NALS event and there is someone you have never met before, strike up a conversation with them. Maybe you can send an e-mail to a member you do not know well inviting him or her to lunch. Perhaps you could send a thank you note to a presenter or vendor you met at a meeting and ask them more about what they do. Listen to the people in your office and in your building. Find out what interests them and what you have in common. You never know what your next experience will be. They could be the connection to a new project, a career move, a new NALS member or simply someone who shares a similar interest or hobby. You may even make a new friend. Roach Ronald Roach is an associate in DLA Piper’s Litigation practice, based in Phoenix. His experience includes serving as first chair in a commercial breach of contract case resulting in a unanimous verdict in his client’s favor. He is a member of both the Arizona and California bars. The exams will be given on the last Saturday of September [September 29, 2012] in Phoenix, and the deadline to apply is August 1. There are three levels of certification offered by NALS and these are the basic qualifications for each level; detailed information is available on the NALS website at http://www.nals.org/?page_id=15 ALS - Accredited Legal Secretary, the basic certification. It is designed for those with a minimum of one year general office experience or who have completed an accredited business/legal course and/or the NALS Legal Training Course. PLS - Professional Legal Secretary, the advanced certification. It is designed for candidates with three years' experience in the legal field who can demonstrate a mastery of office skills; the ability to interact on a professional level with attorneys, clients, and other support staff; the discipline to assume responsibility and exercise initiative and judgment; and who have a working knowledge of procedural law, the law library, and how to prepare legal documents. PP - Professional Paralegal, a certification designed for legal support staff with five years’ experience performing paralegal/legal assistant duties (a candidate may receive a partial waiver of one year if he or she has a post-secondary degree, other certification, or a paralegal certificate; a candidate with a paralegal degree may receive a two-year partial waiver) who work under the supervision of a practicing lawyer or a judge. I know that some of you have already set a certification goal for yourself, and you should pat yourself on the back for doing this - it will be one of the most rewarding experiences of your life. Please let me know if you are interested in joining the group for this session, and we'll make our plans after we get a good headcount. I have an out-of-the box idea for conducting the group this year... one that will make it easy for everyone to attend! Jeanes, Clerk of the Superior Court for Maricopa County THE BRIEF Vol. 8, No. 7 July 2012 Moving? Changing Firms? Whether you or the entire firm are moving to a new office, remember to keep your information updated with the Clerk’s Office, including your preferred email address. The accuracy of the attorney address database depends on your timely updates and what you put into the system. This impacts regular mail, minute entries and other notices from the Clerk and Court. Changes to attorney contact information can be made on the Clerk’s website at http://www.clerkofcourt.maricopa.gov/address_change_form.asp. You should also contact the Clerk’s Office if you notice a former employee’s documents are still being sent to your firm. ECR to Double Over Two Years The Clerk’s Office recently started its largest-ever scanning project. A records management and information technology company will scan and convert over 337,000 court case files into 56 million electronic images for storage in the Clerk’s electronic court record (ECR). The project will take over 24 months, eliminating almost 8,500 square feet of files and file shelving and double the size of the Office’s electronic records repository. The conversion of these records will achieve many key records management objectives for the office: Improve faster access to the records for the staff and the public; improve security of the records; reduce liability of the Clerk’s Office due to elimination of accidental damage and lost or misplaced documents; and improve long-term storage and physical space strategy for the Office’s growth and the millions of records it manages. Stay tuned to The Brief for project updates. ECR Milestones Ten years ago the Clerk’s Office started digitizing all paper records in adult case-type Superior Court cases. Paper documents in cases that originated in 2002 went through a time-intensive dual process to scan and maintain the digital image and keep the paper record in a physical case file. Five years ago, effective 1/1/07, the Arizona Supreme Court designated the electronic court record as the official record in the Superior Court in Maricopa County. This designation recognized the security and dependability of the ECR and allowed the Clerk’s Office to destroy the paper, thus reclaiming much-needed space for an increasing number of filings. Multiple quality assurance checks and improving technology allow the Clerk’s Office to maintain the electronic record more reliably and faster than the standards for paper. This year the Clerk’s Office was recognized with an innovation award from the National Association of Counties for the ECR Online, which makes public records in individual cases available over the internet to parties and their attorneys. I know I had a fantastic time and I always feel better when I do things for fun and for free. From all reports, everyone who volunteered had a great time. It is a great opportunity to be of service, promote NALS and yourself and even get to attend some great CLE sessions for free. I recently received a letter from Nancy Nichols at the State Bar of Arizona thanking us. In part Nancy wrote: “[w]e sincerely appreciate your coordinating the NALS volunteers … [y]ou and the others can always be depended upon to do a great job.” Also, “[n]ext year’s convention is scheduled for June 19-21, 2013 at the Biltmore, so I look forward to our working together again to secure good, dependable people to help out.” NALS of Phoenix and NALS as an organization has a reputation of being good, dependable and doing a great job. Nancy has high praise for our volunteers. All of this is a great reflection on you, the volunteers, and on NALS as a whole and should make us all proud to be part of such a dynamic and outgoing organization. By Terry Houston, PP Emerita I like to travel, as many of you know, and I’ve found a way to have a travel adventure on the way to this year’s NALS National Forum in Portland, Oregon – Amtrak! There’s always the fly option… Southwest Airlines has flights from Phoenix and Tucson to Portland and back throughout the day; fares range from $290 from Phoenix/$273 from Tucson. Expedia has similar offerings on Alaska Airlines and other carriers for the same fares. But if you’re willing to invest only about $150 more, your trip can become an adventure. Amtrak’s Sunset Limited calls at tiny Maricopa AZ on Sunday evening on its way from New Orleans to Los Angeles. The station features a former converted California Zephyr dome observation lounge car. After the 9:02 departure, we’ll ride through the southwest desert during the night and arrive in Los Angeles at 5:35 a.m. after a restful snooze in one of Amtrak’s Superliner Roomette berths. The Superliner Roomette is ideal for one or two passengers, with two comfortable reclining seats on either side of a big picture window. At night, the seats convert to a comfortable bed, and an upper berth folds down from above. Roomettes are located on both upper and lower levels of the double-decker Superliner train cars. Each Roomette features: Meals included Picture window Electrical outlets Climate control Individual reading lights Garment rack Fold-down table Fresh towels and bed linens Soap and shower amenities Personal service (turn-down, coffee, paper, make-up bed) Bottled water Daily newspaper There’s a short layover in the beautiful Los Angeles Union Station on Monday morning. The station is a luxurious blend of Spanish and Art Deco styles, reflecting both the city’s early heritage and its great film tradition. Opened in 1939, it is the last of the great “union stations” serving multiple railroads. We board Amtrak’s Coast Starlight at 10:25 a.m. for the scenic overnight trip to Portland, Oregon. Here’s what Amtrak has to say about the journey: En route daily between Los Angeles and Seattle, the Coast Starlight train passes through the San Francisco Bay Area, Santa Barbara, Sacramento and Portland. Widely regarded as one of the most spectacular of all train routes, the Coast Starlight links the greatest cities on the West Coast. The scenery along the Coast Starlight route is unsurpassed.
