To: Planning Commission From: Patti Voelker, Director of Planning, Building and Ordinance Subject: Public Hearing for Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road for a New Erhard BMW Dealership (19-06-226-010) Date: April 1, 2015 CC: Leo Savoie, Township Supervisor PROPOSAL DESCRIPTION Maptel Properties, LLC/Erhard BMW is seeking a rezoning request as part of their site plan for redevelopment of the former Ford Dealership property, located at 1845 Telegraph Road on the northeasterly side of Telegraph Road, north of Square Lake Road. The site plan shows expansion of the existing building and site improvements to accommodate the new dealership operation (87,119 sf). The purpose of the rezoning request is to rezone the rear portion of the property from ML Light Manufacturing to B-3 General Business to be consistent with the balance of the property currently zoned to the B-3 classification. On July 8, 2014, the ZBA granted a variance request to allow Erhard BMW to occupy the former Ford Dealership property by continuing the property’s nonconforming lot size of 8.02 acres with a minimum of 10 acres required for new car sales agencies. LEGAL DESCRIPTION – 2.25 Total Acres Commencing at the Northeast corner of said Section 6; thence S0130-00 E, 1264.98 feet along the east line of said Section 6 to the Point of Beginning; thence S00-35-29 E, 374.11 feet to the northwesterly corner of “Bloomfield Park”, Oakland County Condominium Plan #1718, as recorded in Liber 35092, Page 207, Oakland County Records; thence along the westerly line of said condominium, S01-4228 E, 245.20 feet; thence N49-50-45 W, 424.69 feet; thence N42-1340 E, 466.35 feet to the Point of Beginning. MASTER PLAN RECOMMENDATION The Master Plan Update as adopted by the Township in 2007 recommends that the subject property on the northeasterly side of Telegraph Road, north of Square Lake Road, be used for commercial businesses. The development policies of the Master Plan do not differentiate between the different business zoning classifications of B-1 Local Business District, B-2 Community Business District, B-3 General Business District, or B-4 Planned Business District. During the Master Plan Update process, the Ford Dealership site was found to be an acceptable commercial development with uses intended to serve passerby traffic. The Master Plan Future Land Use Map identifies this property as part of a recommendation to expand the commercial business zoning classification by rezoning Public Hearing: Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road April 1, 2015 Page 2 of 6 those portions identified with ML Light Manufacturing District classification for the specific parcels fronting on Telegraph Road. EXISTING ZONING The Township’s Zoning Ordinance specifies the allowable uses of land for each zoning district and further provides regulations to protect the public health, safety, and general welfare of the community. Of the four business zoning classifications, the B-3 General Business District is characterized by more diversified business types and is often located so as to serve a broader market area, and is typically mapped along the Woodward Avenue and Telegraph Road corridors. The B-3 General Business District allows retail businesses or service uses, office uses, and a variety of special land uses including vehicle dealerships. The subject parcel abuts the Honda Dealership and Lowe’s properties which are zoned in a similar fashion with a B-3 classification along Telegraph Road and the rear portion zoned ML District. The property to the south is Reimer Floors with a B-3 zone classification. PROPOSED ZONING Erhard BMW is asking for a change in zoning classification for the rear 2.25 acres zoned M-L Light Manufacturing to B-3 General Business to match the balance of the property. The change in zoning will result in the proposed northerly 10 ft. side parking setback complying with the B-3 setback requirements. The proposed southerly 4 ft. parking setback will still require a variance from the Zoning Board of Appeals. The applicant meets the location, height, and building setback requirements for the B-3 General Business District, except for the south side parking setback, fence height, and plantings setback. SITE PLAN STANDARDS FOR REVIEW Chapter 42, Article 6.0 Development Procedures, Section 42-6.1 requires that the following standards be addressed by the applicant as part of the Board’s consideration of a site plan. In the process of reviewing the site plan, the Planning Commission shall: A. Consider single-family development on the basis of a subdivision. Not applicable. B. Consider the location and design of driveways providing vehicular ingress to and egress from the site, in relation to streets giving access to the site, and in relation to pedestrian traffic. The site plan shows a reduction in the number of driveways along Telegraph Road from three to two driveways. The existing southerly driveway will allow continued truck turning movements, and general site access. The new northerly driveway is shown with a curbed island for right-in and right-out turning movements to prohibit any access to the northbound median crossover. A new right turn taper lane is also shown leading up to the northerly right-turn driveway. The proposed traffic circulation with a new dedicated right turn lane is supported by Mr. Labadie, the Township’s Traffic 2 Public Hearing: Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road April 1, 2015 Page 3 of 6 Engineer. It is further noted that any improvements within the MDOT’s Telegraph Road right-of-way will require review, approval, and permitting by MDOT. C. Consider the traffic circulation features within the site and location of automobile parking areas, and may make such requirements with respect to any matters as will ensure: a. Safety and convenience of both vehicular and pedestrian traffic both within the site and in relation to access streets. b. Satisfactory and harmonious relations between the development of the site and the existing and prospective development of contiguous land and adjacent neighborhoods. The site plan and traffic impact study were reviewed by Mr. Labadie, the Township’s Traffic Engineer, for parking and traffic access requirements. His report dated February 27, 2015 finds that the parking, traffic impacts, on-site circulation, and site access improvements are acceptable to service the proposed development. The 313 parking spaces exceed the 146 parking spaces required for the dealership operation. A total of 202 vehicle spaces are noted for inventory and display. D. The Planning Commission may further require landscaping, fences, and walls in pursuance of these objectives and same shall be provided and maintained as a condition of the establishment and the continued maintenance of any use to which they are appurtenant. The landscape plan was reviewed by the Township’s Landscape Architect, Michael J. Dul & Associates, Inc., for conformance with the Ordinance. The report dated February 17, 2015 concludes that the proposed landscape improvements meet the intent of the zoning ordinance and recommends approval subject to the applicant seeking the necessary variances. A masonry enclosure with a wood gate is shown to contain a trash compactor at the rear of the building. A loading area for the new building is located at the rear of the building, and within the vehicle inventory area as required. The roof top mechanical units will be set back from the building edge and screened from view by the building parapet wall. E. In recommending approval of the site plan to the Township Board, the Planning Commission may recommend marginal access drives. For a narrow frontage, which will require a single outlet, the Planning Commission may recommend that money in escrow be placed with the Township so as to provide for a marginal service drive equal in length to the frontage of the property involved. Occupancy permits shall not be issued until the improvement is physically provided or monies have been deposited with the Township Clerk. Not applicable. F. The Planning Commission shall require marginal access drives for all subdivisions having residential lots facing onto a major thoroughfare. Where practical, the Planning Commission shall require a rear lot relationship to major thoroughfares. Not applicable. 3 Public Hearing: Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road April 1, 2015 Page 4 of 6 STANDARDS FOR REVIEWING SPECIAL LAND USES The Township Board shall review each case individually based upon the standards set forth in Section 42-6.2 and, in addition, such uses, if approved, shall be subject to conditions, restrictions, and safeguards as are authorized by law and deemed to be necessary by the Township Board: A. Taking into consideration the size, location and character of the proposed land use, viewed within the context of surrounding land uses and land use planning for such area, the proposed use shall not be incompatible nor inharmonious, as determined by the application of generally accepted planning standards and/or principals, with: a. The surrounding uses; and/or b. The orderly development of the surrounding neighborhood and/or vicinity. The applicant meets the location, height, bulk and area, screening, landscaping, parking, and building setback requirements for the B-3 General Business District. Variances are required to exceed the 6 ft. fence height, provide parking within the required side setback, and for planting closer than 4 ft. to the property line for the transformer screening. B. The proposed use shall be of a nature that will make vehicular and pedestrian traffic no more hazardous than is normal for the district involved, taking into consideration vehicular turning movements in relation to routes of traffic, flow, proximity and relationship to intersections, adequacy of sight distances, location and access of offstreet parking and provisions for pedestrian traffic, with particular attention to minimizing child-vehicle interfacing. The reduction in the number of curb cuts along Telegraph Road and installation of the dedicated right turn lane will improve site access and traffic circulation as part of the right-of-way modifications to comply with MDOT requirements. C. The proposed use shall not unreasonably impact upon the surrounding property in terms of noise, dust, fumes, smoke, air, water, odor, light and/or vibration, and shall not unreasonably impact upon a person perceiving the operation in terms of aesthetics. Where such concerns can be remedied by way of design, construction and/or use, the proposed use shall be designed, constructed and used so as to eliminate the effects of the use which would otherwise substantiate denial thereof, taking into consideration the location, size, intensity, layout and periods of operation of such use. Noise –No additional noise is anticipated other than those customarily associated with a commercial use. Odor – No odors other than those customarily associated with a commercial use. Light – New parking lot lighting will be low profile, LED full cut–off fixtures, not to exceed 20 ft. in height as measured from grade, and to be directed downward to illuminate the parking area only. The rear exit doors shall be illuminated by a full cut-off wall pack fixtures. The revised photometric plan shows the level of illumination of the proposed front parking lot fixtures not to exceed 9.0 fc (footcandles) to meet the maximum provided throughout the balance of the property. 4 Public Hearing: Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road April 1, 2015 Page 5 of 6 Aesthetics – The proposed architectural design of the building compliments the design of the adjacent commercial buildings. D. The proposed use shall be such that the proposed location and height of buildings or structures and the proposed location, nature and height of walls, fences, and landscaping will not interfere with or discourage the appropriate development and use of adjacent land and buildings or unreasonably affect their value. The proposed new dealership meets the requirements for the B-3 General Business District. E. The proposed use shall relate harmoniously with the physical and economic aspects of adjacent land uses in regards to prevailing shopping habits, convenience of access by prospective patrons, continuity of development, and need for particular services and facilities in specific areas of the Township. The proposed commercial use of a BMW Dealership is compatible with the adjacent Honda Dealership and other retail service uses along Telegraph Road. F. The proposed use is so designed, located, planned and to be operated so that the public health, safety and welfare will be protected. The public’s health, safety and welfare are not impacted. G. The proposed use shall not cause substantial injury to the value of other property in the neighborhood in which it is to be located and will not be detrimental to existing and/or other permitted land uses in the zoning district. Bill Griffin, Township Assessor, indicates that the subject property is located on the east side of Telegraph Road north of Square Lake Road and is classified as commercial property by the Assessor’s Office. Preliminary analysis indicates that the surrounding commercial properties would not suffer from any external obsolescence caused by the proposed expansion of the subject property. The subject property abuts no residential property. Ultimately the market will determine any future accrued depreciation to properties abutting the subject property. Mr. Griffin concludes that the proposed expansion of the subject property would not create any substantial value changes to the neighboring properties. H. The proposed use shall not result in an impairment, pollution, and/or destruction of the air, water, natural resources and/or public trust therein. The development does not pose any negative environmental impact as presented. I. The proposed use shall not unreasonably burden the capacity of public services and/or facilities. No proposed impact to current public services. J. The proposed use shall have appropriate physical, visual and spatial characteristics based upon compatible design and architectural elements that relate harmoniously to 5 Public Hearing: Rezoning/Site Plan and Special Land Use Request for 1845 Telegraph Road April 1, 2015 Page 6 of 6 the design characteristics of area development, taking into consideration the design criteria set forth in Section 42-6.4. The architectural design of the building is consistent with the character of the Telegraph Road corridor. DEPARTMENT REPORTS The Township Departments of Assessor, Building, Fire, Engineering and Environmental Services, Ordinance, Public Works, and Police have had an opportunity to review the site plan and drawings, with their comments attached. Fire Department - No objections to the proposed project. Police Department – The Police department endorses the crime prevention measures proposed with the installation of perimeter security to include 8 ft. fencing, lighting, and property surveillance. Engineering and Environmental Services Department (EESD) – Engineering plans of the site improvements will need to be submitted upon Township Board approval, and prior to the issuance of a building permit, to meet stormwater management, water and sewer, and engineering site plan review standards. BUILDING DESIGN & SIGNAGE The exterior façade of the building will be comprised of glass and light grey metal panels with a white cornice, and metal framed windows and doors. The building elevations have been provided that reflect a building design that is architecturally compatible with surrounding businesses. The applicant will be required to submit signage plans to the Design Review Board for review and approval prior to installation. Signs shall comply with the B-3 General Business District sign requirements. DESIGN REVIEW BOARD RECOMMENDATION The Design Review Board reviewed the site plan, drawings and materials for the BMW Dealership on March 4, 2015 and forwarded the request to the Planning Commission and Zoning Board of Appeals, as follows: Motion by Barnett and supported by Devine to approve the site plan and design as submitted, and to forward to the Planning Commission and Zoning Board of Appeals, contingent upon compliance with all other Departmental requirements, including obtaining all necessary permits. The motion was carried unanimously. PLANNING COMMISSION CONSIDERATION It is recommended the Planning Commission hold the public hearing to receive any comments from the public on the proposed rezoning request as part of the site plan for redevelopment of the former Ford Dealership property, located at 1845 Telegraph Road for a new Erhard BMW Dealership, and forward a recommendation to the Township Board for their consideration. 6 February 27, 2015 VIA EMAIL Ms. Patricia Voelker Planning and Building Director Charter Township of Bloomfield 4200 Telegraph Road Bloomfield Hills, MI 48303 RE: Erhard BMW Site Plan and TIA Review Telegraph Road Bloomfield Township, MI Dear Ms. Voelker: Fleis & VandenBrink (F&V) staff has completed our review of the updated site plan dated February 2, 2015 and received February 26, 2015 for this proposed project. Based on these reviews, we have the following comments and observations: • • • • Access to the site will be provided by an existing south driveway and new north driveway with two way traffic around the building. As previously recommended the project engineer has simulated truck (WB-62) movement around the site and shown this data on plan sheet P-3.1. Based upon this data a typical semi-truck will be able to adequately move around the building in either direction; however, the location of proposed trees, proposed sign, and an existing block wall may create a challenging movement at the southeast corner of the building. The proposed north driveway will align with an existing south bound to north bound cross over. To mitigate poor LOS at this location, the consultant has recommended a right-in right-out only driveway as well as new “Left Turn Only” signage at the cross over. Also, based upon MDOT guidelines, a full-width right turn lane is recommended for this driveway. As previously recommended the project engineer has included these modifications in the proposed site plan. Based upon MDOT guidelines, a right turn taper is recommended at the existing south driveway. As previously recommended the project engineer has included these modifications in the proposed site plan. Since Telegraph Road is under the jurisdiction of MDOT, a review and approval of the driveways will be required. Our comments are as follows: EXISTING TREE PRESERVATION/REPLACEMENT 1.) The tree replacement information shown on the charts on Sheet L-1.0 have been updated and all information is correct. Items to be addressed: No action required. 2.) There is a total of 642 caliper inches required for replacement. The landscape calculations chart on Sheet L-1.0 shows that there are 39 inches being replaced along Telegraph Road and 0 trees proposed within the woodland area for replacement. There is a deficit of 603 caliper inches that have not been replaced. The plan indicates that the owner must contribute to the Township Woodland Tree Fund for the deficit in replacement inches. Items to be addressed: No action required. The applicant indicates requirement to contribute to the Woodland Tree Fund for above deficit. February 17, 2015 Landscape Review/ Erhard BMW 1845 Telegraph Rd., Bloomfield Twp., MI Page Two TELEGRAPH GREENBELT 1.) The 25’ greenbelt along Telegraph is intended for landscape and buffer between thoroughfare(s) and the proposed parking. Although there are large deciduous trees along Telegraph, there aren’t any shrubs being proposed along the greenbelt to screen the parking spaces. Since the parking is intended for inventory display only, this is an acceptable solution. Items to be addressed: No action is required. PARKING LOT LANDSCAPE 1.) Section 42-5.3 Off-Street Parking Space layout, Standards, Construction and Maintenance of the zoning ordinance indicates the following requirements: (9)c. “Each planting bed shall be a continuous earth-planting bed at least eight (8) feet wide and a minimum of three hundred (300) square feet in area. Landscape materials shall be planted no closer than four (4) feet to the property line.” The applicant has relocated the two proposed parking lot trees (Gingko biloba) so they are no longer on islands that do not meet ordinance size requirements, thus they no longer need to request a variance. The new locations are, however, nestled within proposed parking lot trees of a different variety. Item to be addressed: No action required. We would recommend, however, that the applicant considers changing the proposed species of these two trees to match the proposed Honeylocust trees that surround them to create more continuity throughout the site. 2.) According to the Landscape Calculations on Sheet L-1.0, there is 52 parking lot trees required based on 313 parking spaces outside of the inventory parking area. The plan shows that 52 trees have been proposed to meet this requirement, which satisfies the parking lot tree requirement based on 313 parking spaces. Items to be addressed: No action required. GENERAL SITE 1.) A note on Sheet L-1.0 indicates that “Irrigation system to have separate zones for lawn, parking islands, and plant beds with different control moisture level adjustments per zone as required.” Items to be addressed: No action required. Section 42-5.6 Plant Material of the zoning ordinance indicates the following requirement: (1)a. “Plant materials shall not be placed closer than four (4) feet from the fence line or property line.” The applicant has placed a note on the plans indicating this requirement. Items to be addressed: No action required. 3.) Typically the electrical transformer should be screened on all sides, but due to the location of the proposed transformer it is impossible, for clearance reasons, to plant an evergreen screen around all four sides of the transformer. Items to be addressed: Providing the Township approves the location of the transformer, no action will be required. 4.) The applicant is proposing to re-zone the rear parking lot area from ML to B-3, which reduces the side yard setback from 20 feet to 10 feet. The proposed parking falls 3.9 feet within the 10 foot side yard setback line that spans the entire length of the rear lot line. Items to be addressed: A variance will be required to install parking within the required parking lot setback. Apply for and secure required variance for parking within the required side yard setback line. 2.) Secure permit for tree removals and contribute to the Woodland Tree Fund for deficit in replacements provided.
