All of these are signs of the progressive
strength of the economy. The desert cities
throughout the valley are in full swing and
embracing our “snowbird” season.
January is also a time of renewed
commitment and new beginnings. I hope
that each of you renew your commitment
to the PDACC through our committee
structure. We are a grass roots committee
led organization. Our committees are
busy making plans for the NEW Business
Breakfast (new format and new time,
starting January 12th at 7:30am), the
State of the City (scheduled for March 4)
and our All Valley Chamber Legislative
Luncheon (on April 8). I hope each of
you finds a place of service that will help
you be a part of the growth of our great
community and chamber.
There are so many places to serve in the
PDACC. Early morning Business Breakfasts and seminars, noon Profit Connections, afternoon ribbon cuttings or

so many ways to promote your business,
make connections and help businesses in

Protecting Your
Pride and Joy
Being a business owner is like being a
proud parent. It’s a lot of hard work, long
hours, and some suffering, physically and
emotionally. We show it off. We promote it
as the greatest on earth. It’s because we
love it, we built a life on what we love to
do. But, when our pride and joy is threatened we defend it. We fight. We will fight
with our last breath. Our business or our
child, it doesn’t matter which.
We are very fortunate to live in a country
of laws. We are protected. Maybe not to
the extremes that make national headlines. But we are protected by laws, which
our military, our local police and sheriff’s
departments enforce. These laws also
protect the safety of the environment for
which we conduct our business, and give
us rights particular to conducting business. We have property rights, rights to
our inventions with patents, rights to a
competitive market place, plus many more.
But the rights we know today are threatened every day. These threats don’t come
as armed assailants, but as laws with
unintended consequences. These laws
cause higher taxes, higher wages for your
employees, required benefits, zoning requirements, additional inspections, and additional reporting obligations just to name
a few. All these things become a burden to
your business, your livelihood.
Too often we think of expanding our
business, our professional family, but the
cost and the legislative hoops are just too
difficult to surmount. This is why the Palm
Desert Area Chamber of Commerce has a
Legislative Action Team. To protect
you and your business. As a team we only
meet monthly, but Chamber staff is here
every day tracking local, state and federal
legislation that may affect your business.
We work with the California Chamber
of Commerce and the U.S. Chamber of
Commerce to direct good beneficial policy
decisions at the capitals. We write letters
and join coalition forces for and in opposition to proposed legislation. We also meet
with our elected officials regularly to
personally explain your needs as business
owners.
We need your help. We need you with
your business experience to help guide
your Legislative Action Team to the issues
affecting your business, your livelihood,
your pride and joy. Your success in business supports your family, your neighborhood, your state and country. Without
businesses like yours and business people
like you, America never would have become as strong and wonderful as it is. But,
it’s not perfect, the people running it are
not perfect. They may have good intentions, but they don’t know what a business
needs to survive. That is why the Leg-
islative Action Team needs you,
your guidance, and especially
your voice.

3:30pm at the Palm Desert Area Chamber

Sandy would like to be remembered for her “love for

amazing portraits, period!” In 5 years, Sandy sees herself “continuing to do what I love, photography. Maybe
a little more travel time. I have visited 16 states in the
U.S. and would love to visit the remaining states.”

The Negative Impact on Retaining Income in
a Trust

As a result of the Affordable Care Act, almost all trusts with net taxable
income in excess of $12,300 are now subject to the 3.8% Net Investment
Income Tax (NII Tax). In addition, trust income in excess of $12,300 is
subject to income tax at staggering rate of 39.6%. The consequences of
retaining income in a trust rather than distributing the income to beneficiaries could be costing you thousands in unnecessary tax liabilities.
To fully understand the consequences of retaining income in a trust, it
is important to know that the 39.6 tax bracket for a trust begins at the
very low threshold of $12,300. A married beneficiary by contrast would not reach the 39.6 tax bracket until their taxable
income exceeded $464,850, and would not be subject to the NII Tax unless their modified adjusted gross income exceeded
$250,000. Discretionary distributions from a trust to the beneficiaries can therefore be an invaluable tax planning strategy
by shifting income to individuals in potentially lower tax brackets, and may even eliminate the NII Tax entirely.
