Home inspections are an integral part of
the real estate industry and have been
around since they’ve been building houses.
Our turbulent housing market, changing
regulations and increasing liability have all
affected the home inspection industry. But,
most believe that the changes have been
for the best and that the keys to riding out
turbulent times are education, diversification
and the ability to adapt to the way the
market has changed.

To Washington We Go

In the movie Mr. Smith Goes to Washington, the title character explains how
he was magnetically attracted toward
the Capitol with, “I don’t think I’ve
ever been so thrilled in my whole life.
And that Lincoln Memorial! Gee Whiz!
And Mr. Lincoln, there he is. He’s just
lookin’ right straight at you as you come
up those steps. Just, just sitting there like
he was waiting for somebody to come
along.”
And come we did! Thousands of REALTORS® from across the country
journeyed to our nation’s capital for the
annual National Association of REALTORS® Midyear Legislative Conference.
May 10 marked the beginning of the
meetings and expo held in Washington
DC. The trip was packed with a three
day Real Estate Summit and an additional two days of meetings and briefings, including our Capital Hill visits
to Congresswoman Mary Jo Kilroy and
Congressman Pat Tiberi and a visit to
NAR Headquarters in Washington.
strengthen housing stability. He stressed
that FHA currently plays a huge role in
the financing markets. However, he also
cautioned that FHA, being the largest
lender, is not healthy. We need to have
private markets and capital return to the
lending scene to stabilize the lending
markets. Threats to recovery and stability include unemployment and negative
equity, according to Mr. Stevens.
One of the many sessions I attended
featured our lobbyists from NAR. I was
impressed by the talented team led by
Jerry Giovanello who represents our
voice in Washington on every issue from
federal taxation to mold. I was always
aware our lobbyists existed but until I
sat in a session where each lobbyist addressed their areas of expertise, I did not
fully understand how well represented

providing us with the opportunity to
take in many meetings that could not
have possibly been attended by just one
or two representatives.
The three day Real Estate Summit
kicked off with a keynote address by
David Stevens, HUD Assistant Secretary for Housing and FHA Commissioner. He provided perspectives and
insights regarding the president’s agenda to restore our nation’s economy and

our profession is in Washington. When
NAR sends out a call for action, we need
to step up because this group is counting
on our voices to back up all their hard
work in DC.
Gavin Blair, CBR’s Governmental Affairs Director, prepared our group well
to visit with Congressman Tiberi and
Congresswoman Kilroy on Capitol Hill.
He provided us with four main talking
points on which to focus while at these
visits.
Affordable and Available Property
Insurance
Action is needed by Congress to ensure
the availability and affordability of property insurance, including a long term
reauthorization of the National Flood
Insurance program (NFIP) and natural
disaster coverage. Property insurance is
not widely available and insurers have
responded to recent natural disasters by
raising premiums or declining to write
policies. Without a federal role, affordable insurance would not be consistently
available. Congress has approved six
short term extensions and allowed them
to expire twice. (They have expired as
of May 31.) The federal government
could reduce the amount of disaster
relief taxpayers would have to remit by
proactively making the NFIP permanent,
thereby ensuring that property owners
have insurance as well as incentives to
mitigate property against the full range
of natural disasters.
GSE Reform and GSE Loan Limits
(Government Sponsored Enterprises)
Action is needed by Congress to restructure Fannie Mae and Freddie Mac
(the GSEs) in a manner that provides
the federal government with a continued
role in the secondary market. In this
position, the federal government would
ensure mortgage liquidity in all markets
and to make permanent the higher GSE
loan limit formula and caps to provide
affordable financing for all borrowers.
Higher loan limits have been extended
through 2010 but their temporary nature
continues to make lenders and investors
wary of supporting them. Making the
limits higher will provide homeowners
and buyers with affordable financing and
will help stabilize local housing markets.
Currently, the higher GSE limits are set
to expire Dec. 31.
Protecting Affordable, Safe financing
for American Families
Action is needed by Congress to
strengthen the FHA MIP, make permanent the higher FHA loan limits and
exercise caution before considering
additional proposals that would have
a profoundly adverse impact on FHA
programs that serve a critical role for
our nation’s families. Without FHA, our
economy could not be on the verge of
recovery. Higher loan limits need to be
permanent and available in all markets.
Commercial Mortgage Market Liquidity
Action is needed by Congress to enhance
liquidity in the commercial real estate
market and thereby avoid driving down
the economic recovery. We are urging our representatives to allow credit
unions to increase their business lending
cap from 12.25 percent to 25 percent
of total assets. These credit unions can
be an important additional source of
funding for small commercial properties
that need to be refinanced. Also, we are
requesting that the Federal Reserve and
Treasury encourage banks to provide
term extensions for performing commercial properties. Currently, lenders do not
offer term extensions because they are
wary of regulatory oversight. Commercial markets have a strong impact on our
economy but face liquidity challenges.
As anyone can see, these important
issues will have a long term negative effect on our businesses if Congress is not
attentive to these requests.
The weight of these issues and the importance of the meetings that took place
during NAR’s conference had a huge
impact on me. The longer Washington
dithers around with these issues the
slower the recovery will be.

Home inspections are an integral part of
the real estate industry. As Jerry Linkhorn
of Linkhorn Inspections says, “Home inspections have been around since they’ve
been building houses.” And as a turbulent
housing market, changing regulations and
increasing liability have all affected the
home inspection industry, according to
most central Ohio inspectors, the changes
have been for the best.
Tough Times
Membership in the National Association of Home Inspectors (NAHI), one of
a small number of home inspector trade
groups, has been down for the past year
and a half across the nation. Forrest Lines,
President of Ohio NAHI, notes that Ohio
membership has mirrored that trend.
“The home inspection industry is not at
the place it was four or five years ago.”
Lines explains. “Just like anyone else in
this industry, we’ve all felt the pain.”
Some estimates reveal that the ranks of
home inspectors have dropped by a third.
“The market goes up and down. It flushes
itself and we lose folks to attrition,” says
Lines.
Randy Via of Gleich Home Inspection
has seen that firsthand. “The recession
shook up a lot of these home inspectors
that weren’t certified and didn’t have any
credibility,” he observes. “Some of these
guys that were doing one hour inspections and were not doing a good job got
pushed out of the business. The market
has thinned the herd and that’s not a bad
thing.”
A Changed Market
Those home inspectors
that have ridden out
the turbulent
economic times
say that the key
is to adapt to the
way the market
has changed.
“Are we doing business differently? You
bet,” Lines says. “Five years ago, one in
ten of my inspections were vacant properties. Today, somewhere between seven
and eight are vacant. We need to embrace
the fact that we’ll be inspecting these
types of properties.”
In the Columbus metro area, homeowner
vacancy rates peaked in 2006 at five
percent and declined through 2008 only to
climb again last year. In May of this year,
the homeowner vacancy rate is at three percent, according to the U.S. Census Bureau.
“We’re being asked, ‘Do you have a
HUD key?’ And now we have to ask,
‘Are the utilities on?’” Lines says.
The market has affected not only the
types of properties home inspectors are
called upon to examine but also the kinds
of inspections they are performing.
“The industry has changed quite a bit
in the last four to six years,” Linkhorn
confirms. “What we do now is more
technical. Instead of your basic home inspection, you’ve got radon, senior home
safety inspections, energy audits, appliance recall checks and other services.”

Enterprises agrees. “We need to learn ways we can diversify one way or the other, either by offer
ing more services or venturing into other areas.”
Many home inspectors viewed the tough
times as an opportunity to increase their
knowledge of the industry. “When business gets bad, education looks more
like an opportunity,” Lines says. He has
seen participation in NAHI educational
programs increase in past months and
attendance improve at the spring home
inspector expo.
“We’re cautious but optimistic,” he explains. “Though we’re not where we were
a couple years ago, we have seen NAHI
membership grow in the last several
months.”
When asked about the broader real estate
market, most home inspectors echo this
positive outlook. “Columbus has always
been a nice area.” Via says. “The market is
usually fairly steady. It’s dependable.”
Allaying Liability
One thing home inspectors can always
depend on is high liability. But in central
Ohio, most do not seem to feel pressured
by that.
“Liability and lawsuits have always been
an issue,” says Via. “What I’ve done to
handle that is to spend more time on my
inspections to lower my liability. Inspections that used to take me two and half
hours, I’m there another hour.”
Confidence in a job well done is important
to home inspectors who, though being
pressured to complete increasing thorough
inspections, are more than happy to rise to
the occasion.
Jackson notes that, “Our industry in general
has always been high liability. Just look at
the insurance we have to carry. But what
really puts me at peace is knowing that I’m
doing the best job I can.”
Through the economic downturn, few
home inspectors reported an increase in litigation or a rise in liability insurance costs,
something that most attribute to the nature
of a business that hinges on personal reputation. To survive in the industry, inspectors
have to do their job well. Those that do not
live up to expectations do not remain home
inspectors for long.
“When I first got into the business, I was
told I’d probably have a lawsuit every two
or three years,” says Via, adding “That
hasn’t happened. I’ve seen far fewer complaints.”
For Linkhorn, liability issues will always be
there. “That’s why The American Society
of Home Inspectors (ASHI) has their standards. We have to have general liability. We
have to have insurance and that’s a good
thing because nobody’s perfect.”
Working Together
A perfect home inspection might not be
possible but many REALTORS® know and
rely on reputable members of the industry.
Because of that, most home inspectors get
the majority of their business from REALTOR® referrals and are dedicated to building that bond.
“We’re all in the same boat,” says Jackson.
“I do my best for the REALTOR®, the
buyer and seller. I’m here to bring an unbiased opinion of the condition of the house
at the time we inspect it.”
Open communication lines are important,”
Jackson continues. “Typically, REALTORS® walk their buyers through the
home inspection process before I show up
and that really helps me do my job.”
Home inspectors look to REALTORS®
to communicate what is involved in the
inspection and simplify the experience,
leaving everyone more satisfied.
For Linkhorn, it’s important to “set the
expectations for the buyers.”
“No house is perfect,” Via says. “It’s important that the buyers know that there will
be issues but that we will talk about them
and look at them and have them fixed.”
To strengthen that relationship, everyone
must be on the same page.
Not only does the buyer’s agent need to be
involved, but the seller’s agent can also play
an important role. The sellers also need to
know “what to expect and how to prep a
house for a home inspection,” Via explains.
“The more information that is shared
among all parties, the happier everyone is.
“If the sellers are aware that we’ll be inspecting, they can take down childproofing

safeguards and allow us access to storage
areas,” Jackson adds. “That would really
help streamline the process.”
Fostering open communication between
buyers, sellers and their agents can have
a big impact and because of that, home
inspectors actively encourage dialogue with
REALTORS®.
“Communication and honesty are vital for
us when we work with REALTORS®,”
Linkhorn says.
“Integrity is important for building our
relationships.”
Buyer ‘Buy In’
Building relationships occurs during the
home inspection, as well.
“Always have the buyers present during
the inspection,” Via says. “We go all over
the house and I show the buyers each issue.
It’s critical for them that they see the whole
concept and they know what they’re spending their money on. They need to see what
a full house inspection is.”
“This experience is especially important
for first time home buyers,” says Jackson,
“They get an explanation of the basic
mechanicals of the house, maintenance and
proper budgeting for repairs and preventative upkeep”
How this information is communicated can
make all of the difference. “Our goal on an
inspection is not to scare people,” Jackson
explains. “Buying a home is the single largest investment you make in your lifetime
and I want the buyers to feel confident that
they understand what is going on with the
house and how to handle it.”
“You can’t be an alarmist,” Via agrees. “You
need to spend a little more time speaking
with the buyer. As the home inspector, I’m
not trying to save the deal. I’m just telling
people what they’re buying while emphasizing that everything is fixable.”
Linkhorn echoes that sentiment. “If I do find
major issues, I let my clients know that anything can be fixed. There is no such thing as
a perfect home. I remind them that they fell
in love with the house. They’ve got to make
that decision on their own but they shouldn’t
let a needed repair dissuade them from buying the home if they really like it.”
“My goal at the end,” says Jackson, “is for
the buyers to say, ‘I feel good about this
house. There may be things that we need to
address and we’ll talk to the REALTOR®
but I feel confident that we can do this.’”
No Such Thing as a Perfect Home
Fortunately, most issues found by home
inspectors can be easily dealt with by a
licensed contractor. Common problems
include water issues such as poor outside
drainage, faulty windows, foundation
movement and efflorescence as well as
electrical problems and maintence-related
issues like dirty furnaces and bathtubs/
showers that need caulk.
But home inspectors run into other, more
unusual situations, especially when it
comes to vermin. Some report finding rats,
slugs, raccoons and on one occasion, a nest
that housed more than 50 sparrows.
“Some of the stuff you see, you just have to
chuckle,” says Linkhorn.
Making it Work
Barring any major infestations, home
inspectors strive to make the situation
work. Including a home inspection in a
transaction can add value to the property,
expedite negotiations and improve the
likelihood of an offer. Home inspections
help sell homes.

Need to Know About
Home Inspections
Home inspectors stress that communication among all parties makes for the
smoothest inspection process. Here is
information to share with home buyers
and sellers to ensure everyone is on the
same page.
Information for buyers:
• No house is perfect. The home inspector will find issues but they will
be repairable.
• Home inspectors give a general overview of the condition of the property.
They do not delve into the details of
repairs but will recommend if other
professionals need to be consulted for
specific problems.
• Plan on attending the home inspection.
• Set aside enough time – Some inspections last four hours or longer.
• Bring a list of questions and don’t
be afraid to ask questions during the
inspection.
• Don’t bring the kids.
• Plan on learning about the house and
how to maintain it.
Information for sellers:
• Allow for access to the attic, crawl
space, garage and storage areas.
• Take down childproofing.
• Make sure the utilities are on.
• Move items that might be blocking
windows or electrical outlets.
• Plan to be away from the home for at
least four hours while the inspection
takes place.
In preparation of a home inspection, NAR recommends sellers:
• Clean debris from gutters and roof
• Caulk around windows and doors
• Seal asphalt driveway
• Clean HVAC filters
• Seal basement walls
• Clean the chimney
• Replace burned out light bulbs
• Have all documentation on hand for
recent repairs and inspections
• Remove firewood from contact with
the house

REALTORS® brave the rain to create change
On June 9, 400 REALTORS®, family and friends gathered under
gray skies, rolled up their sleeves and labored to improve communities across central Ohio. From Hilliard to Pickerington, Dublin to
Delaware, CBR and 19 area associations tackled dozens of projects
in one day.
Despite the rainy weather, many of the 58 planned projects were
completed. While a few had to be postponed, the REALTOR® family
was able to make a huge impact on its neighbors regardless of the
atmospheric interference.

For the main project, CBR again partnered with the Columbus
Housing Partnership (CHP) and focused on Framingham Village, a
neighborhood of 22 homes converting from rental to ownership under
CHP’s Lease Option Program. Volunteers power washed exteriors,
sealed driveways, planted flowers and shrubs, installed new address
plates and repaired mailboxes at each of the homes. In addition,
landscaping was added around the entry features of the neighborhood and at the community center while the hydrants received a
fresh coat of paint.
Columbus Commercial Industrial Investment REALTORS®
participated in an outside clean up at the Heinzerling Foundation, a
non-profit organization which serves clients with mental retardation.
The Fayette County Real Estate Association worked for two elderly residents, providing them with yard cleanup, planting, mulching
and painting.
The Delaware County Board of REALTORS® cleaned up litter from
along the 12 miles of paved pathways that constitutes the Delaware
City Bike Path; landscaped two properties owned by Delaware
Creative Housing, Inc.; and donated 100 single use tickets for the
Delaware City Jack Florence Pool to elementary students.
The Gahanna Area Realty Association participated in the beautification of the City of Gahanna’s Swimming Pool, including planting
and mulching the flower bed at entrance and painting picnic tables.
The Delaware-Knox-Licking Morrow Suburban Realty Association provided aid to an elderly Sunbury resident cleaning and restoring the property inside and out.
The Greater Dublin Realty Association spent the day helping three
Dublin senior residents with yard cleanup, landscaping and light
painting.

The Greater Worthington Area Real Estate Association chose
the cottage for art therapy at the United Methodist Children’s Home
as their project, remodeling and refurbishing two rooms in cheery
colors.
The Hilliard Area Realty Association painted picnic tables at Veterans’ Memorial Park to help the city ready itself for Hilliard Fun Day.
Madison County REALTORS® instituted “Operation Curb Appeal”
and chose two neighborhood blocks - one in W. Jefferson and one in
London - to improve with landscaping.
Downtown, the Midtown Area Realty Association partnered with
the Central Ohio Furniture Bank (formerly MAP Furniture Bank),
assembling, sanding and painting furniture to placed into homes of
those in need.

The New Albany Realty Association performed extensive yard
work for a New Albany resident in need.
The North Area Real Estate Association rebuilt and painted the
gazebo at the Whetstone Park of Roses and painted the home of a
fellow REALTOR® who has been battling cancer.
The Northeast Suburban Realty Association beautified the Licking
County Bike Trail in Johnstown and Alexandria.
The Northeast/Westerville Area Realty Association spent the

couple in Alexandria, Ohio.
The Northwest Area Realty Association revitalized a home in
Upper Arlington, including yard work, landscaping, mulching, and
outside painting.
The Southeast Area Suburban Realty Association members visited and delivered gifts to each of the inbound patients at Altercare
and Winchester Place rehabilitation and rest homes for the elderly.
The Southern Delaware County Realty Association cleaned up
the landscaping at the Powell-Liberty Historical Society.
The Tri-County Area Realty Association helped a Reynoldsburg
mother with chronic health problems by providing funds and a
new washer and dryer in addition to volunteering for the Pataskala
LEADS center, doing extensive cleaning and beautification of the
grounds.
The West/Southwest Area Realty Association contributed 32
Double Knockout rose bushes to beautify the front of the Big Splash
at Evans Park, a seasonal, municipal, family aquatic facility.

Committee Report
Adding online C/I classes this year

C/I Education Committee
The CBR C/I Education Committee started
the year with six goals:
1. Create two online commercial classes
2. Have six one-hour luncheon commercial courses, mostly focused on “hot
topics”
3. Have at least two one-hour courses take
place at non-CBR venues
4. Have 3-hour courses that touch on all
aspects of commercial real estate
5. Create a C/I CE calendar that has certain “core” or “touchstone” courses that
are given at the same time every year
6. Create the first course in a series of
Introductory Commercial Real Estate
Courses
further their knowledge of commercial real
estate.
We have also formed a subcommittee to
work on the first course in a proposed series
of Introductory Commercial Real Estate
courses. The subcommittee has not decided
yet what the content of the first course shall
be, but we had discussed an overview course
that would give a course attendee an overview of office, retail, industrial and multifamily, familiarizing them with each product
type and explaining how each product type
has its own “language” and its own “hot
button” issues for both the tenant and the
landlord.
Finally, a course that we are very excited
to be presenting is a Commercial Internet
Marketing Course to be given in September.
In my experience, commercial agents usually lag residential agents in the widespread
use of new technology, and we expect this to
be a well-attended course in how the various
Internet social media options can be used
beneficially by the commercial agent. I also
want to thank all of you who have attended
a commercial course at the Board this year,
and remember we appreciate anyone’s input
at any time. If you have an idea for a course
or a speaker, please do not hesitate to let us
know.
To date we have had three 1-hour luncheon
programs and three 3-hour courses covering
these topics:
1. One-hour courses: US Route 33 Corridor Development (Canal Winchester
& Pickerington); Governmental Incentives Available to Developers, Tenants,
Building Owners; CBR C/I Commercial “Legends Luncheon” featuring
Frank Kass, Chairman of the Continental Companies;
2. Three-hour courses: Commercial
Core Law; Commercial Civil Rights;
LEEDS: Overview for Commercial
Realtors®.
We have formed an online Commercial
Class Subcommittee to work with the CE
Shop to develop commercial classes for the
agent who wishes to have an online option.
The first course on which we are working is a Commercial Ethics class. Belinda
Ohlinger has taught this course at the Board,
and that should make it easier to develop an
online version. We find that many agents
are opting to take a portion of their continuing education courses online and we think
this will allow the commercial agent to have
online CE classes that will interest them, and

REALTORS® heart their smartphones
• The top five features used most by respondents on their smartphones are the
telephone function (91.2 percent), email (88.4 percent), SMS/texting (73.8
percent), a calendar (52.6 percent) and
the web browser (42.3 percent).
• For general purposes, social-media-related apps were the most popular type
of application downloaded by survey
respondents (54.5 percent). This was
followed by maps (43.3 percent) and
weather applications (41.8 percent).
• On a scale of 1-5, where 5 is extremely satisfied, respondents’ satisfaction
with their current smartphone averages 4.23.
In January 2010, NAR’s Center for REALTOR® Technology (CRT) extended an
e-mail survey to REALTORS® about their
use and views of smartphones. Below are
the results, based on the 1,485 completed
surveys.
• Blackberry and iPhone were the top
brands being considered for future purchase among current smartphone users
and non-users (some are unsure about
the smartphone they would choose in
the future).
• The top three reasons why respondents
were motivated to choose the smartphone are that it is the best device for
e-mail (45.9 percent), easy to use (26.2
percent) and it offered the use of a keyboard (23.7 percent).

May closings maintain frenzied pace
Central Ohio home closings in May
significantly outpaced the previous
month as well as the previous year. The
number of home sales (2,401) was up 15
percent over April of this year and was
32.7 percent higher than homes closed in
May of 2009.
Home sales this year (January through
May) now exceed 2009 by 24 percent.
The average sale price of $166,156 in
May dipped slightly from the previous
year but was up almost five percent over
the previous month. The average sale
price for the first five months of the year

stands at $156,452, fully five percent
over the $148,956 average sale price for
the first five months of 2009.
There were 3,366 homes added to the
market in May bringing the inventory
to 15,282 homes for sale – almost three
percent more homes than were listed for
sale at the same time last year.
Statewide home sales were up 27.7 in
May compared to May of 2009. Year to
date (January through May) sales were
up 16.4 percent and the average sale
price so far this year is $129,769, which
is a 10.4 percent increase from last year.

Nationwide sales were up 19 percent
in May 2010 compared to May of
2009. First-time buyers accounted for
46 percent of the sales in May and 49
percent of the April sales. The median
sales price in May was $179,600, up

percent of the sales in May and 33
percent of the sales in April.

Residential Education Committee
The Residential Education Committee has a
clear understanding that there are many opportunities for our members to receive their
education and that the landscape is crowded
with vendors that provide classes and
seminars for our members. While we would
like 100 percent of our members to get their
education requirements at CBR, we know
that we have to earn your business.
This year, our mission is to make sure that
we are providing a high quality education
to our members at an outstanding value; to
make sure that our members realize what
we have available; and to provide new and
exciting ways to provide education to our
members.
Did you know that we were awarded a
grant to educate the public on foreclosures
and what to do if they get behind in their
payments? Due to the hard work of our
staff liaison, Lucy Buzzee, and past chair
and now CBR Director Lorri Molnar, and
some other hard working volunteers, we
were awarded a grant from NAR! The
exciting news is that after holding the
seminar twice in different parts of Columbus educating the public, we are going to
use the leftover money to provide a free CE
class to our members in September about
foreclosures. Stay tuned!
Did you know that we have started a new
program called Lunch & Learn? It has
come from the WIN (What’s Important
Now) Subcommittee. We have a varied
list of hot and timely topics where, for a
nominal fee, you can take a one-hour class
on some of the latest and hottest real estate
topics that are on the real estate horizon,
and eat lunch. The first one is August 23.

tapes or cds and videos for free? Our
books aren’t just about real estate, but
include motivational topics, legal topics,
marketing and selling, textbooks and even

Last month, we introduced you to part
of our fabulous support team in Sedalia,
but due to a communication snafu, left
out the most important person! In addition, we have a new team member in the
Columbus market. So here’s ‘Meet the
Team – Part Two.’
Rebecca McFarlin,
Team Lead, Senior Market Analyst, started her
career with Xceligent in
August 2007 as part of
the first ten people hired
when the call center
opened in Sedalia. She initially handled
Indianapolis and helped with Columbus.
In October 2009, she took over management of the Columbus data.
In April 2009, she was promoted to
Senior Market Analyst/Trainer. Now, she
spends time with new employees, showing them how to handle market analyst
duties as well as she does.
Rebecca is Xceligent’s number one
market analyst month after month. She
consistently has more “broker touches,”
makes more record updates and gathers
more lease comparables than any other
Market Analyst in our company. She
constantly keeps our available property
records current, with over 95 percent of
our listings updated on a 30 day cycle.
We are very lucky to have her working with our members and nonmem24
bers alike. In January 2010, she was
promoted to Lead Market Analyst with
responsibilities for Colorado, Indiana
and Ohio. (Colorado and Ohio are
Xceligent’s two largest markets – more
listings, more agents and more data.)
Rebecca’s job entails updating both
member and nonmember listings in
the CDX; adding new properties; and
completing monthly audits to ensure that
listings are represented correctly in the
system. Her data diligence ensures that
your listings appear in every property
search that they should.
If we feed your listing data to your web
page, she does a monthly audit of your
lstings on the CDX. In addition, Rebecca
is the Editor of Columbus’ Extra!Extra!,
our very popular weekly report showcasing new listings in the market. In addition, she oversees the Colorado team
projects and daily activities.
Every quarter, she gathers lease comparable data, assists me with analytics and
helps verify market absorption.
Finally, she attends Retail, Office and
Industrial Advisory Board meetings in
Columbus during the second and fourth
quarters.
Although she works in our Sedalia, Missouri call center, Rebecca was born in
Willard, Ohio. Both of her parents and
her younger brother still reside in Ohio,

checks on new construction and verifies
sales comparables.
Toward the end of every quarter, he will
be out in the market checking the status
of every building on the database listed
as “planned,” “proposed” or “under
construction.” When he drives to photograph the verified sales transfers, he
counts parking spaces, dock-height and
drive-in doors and validates the number
of apartment units. All this while also
on the lookout for new listings.
Finally, he checks on “Research Pending” listings for us and retakes ugly
building pictures for the database.

Short sale form updated
The one-page (one-sided) CBR Notice of Short Sale Contract
Termination form has been updated to include an option for
the seller to terminate. (The original form only had an option
for the buyer to terminate.) The updated form is available in
the store (pad of 50/$5), online as a pdf document and in the
PCF online forms system.
Franklin County Auditor looking at
‘Mobile’ web platform
CBR staff and leadership met with Franklin County Auditor
Clarence E. Mingo, II and his staff in May to provide input on
a “mobile” website for Franklin County auditor information.
Although the website at this point is in the theoretical and
planning stage, most of the discussion was on the type and
specifics of information that would be useful to access for
real estate professionals when showing houses with a client.
Part of the discussion surrounded the importance of accessibility and the need to have quick access to such a site.
Members appreciated the opportunity to give valuable input
on a tool that would improve their day-to-day activities and
are excited to continue working with the Auditor to assist
them to develop a framework for mobile access to auditor
data.
FHA Approves Electronic Signatures
Great news for real estate professionals! The Federal Housing
Administration (FHA) now accepts electronic signatures on
real estate contracts. This new process will allow an easier,
faster way to help your clients get more offers and spend less

Military personnel still eligible for tax credit
The home buyer tax credits may have expired for most but
military personnel and foreign service employees deployed
overseas have an additional year to take advantage of the
savings. Those that have been overseas for 90 days or more
between Jan.1, 2009 and April 30, 2010 can still claim the
credit if they sign a contract on or before April 30, 2011 and
close on or before June 30, 2011. The extension will benefit
members of the military coming home from Iraq and Afghanistan, among others. For more info contact Ken Trepeta at

New HUD lead-based paint rules
As of April 22, 2010, owners of market-rate properties built
before 1978 will have to comply with EPA lead safety regulations that govern common renovation and repair activities.
Known as the Renovation, Repair and Painting (RRP) regulations, the rules were issued on March 30, 2008. (Age-restricted properties, properties with no children occupying them and
properties that have been certified to be free of lead-based
paint by a state inspector are exempt from the RRP regulations.)
Under the regulations, if renovation or repair work undertaken
on a covered property disturbs more than six square feet of
surface area for interior work or 20 square feet for exterior work,
the work must be carried out by a trained and certified renovator.
In addition, residents must be notified and provided with a copy
of the EPA pamphlet entitled “Renovate Right.” (This is a different pamphlet from the EPA’s “Protect Your Family” pamphlet
that owners are required to provide to residents at the time of
the lease signing.) There are also recordkeeping requirements
imposed on owners or the third-party contractors they hire to
undertake work covered by the regulations.
Importantly, the RRP rules expand existing Lead Safe Housing (LSH) rules that have imposed comparable – but not
identical – compliance obligations on pre-1978 properties
that receive federal assistance, including Section 8 vouchers.
Under RRP rules, federally assisted properties must comply
with the more stringent elements of both the LSH and RRP
regulations.
A resource guide that provides information for real estate
professionals on the new RRP rule is available on NAR’s
website. The information describes the new lead paint safety
practices established by the rule and what steps contractors,
renovators, real estate professionals and property managers
may need to take to comply with the rule. The information
includes a one-page summary of the rule, two video FAQs
- one for real estate brokers and one for property managers,
webinar recordings, printable Powerpoint presentations and
information on additional resources for lead paint disclosure

A broker’s “For sale” sign in
the yard – but it’s not in MLS?!
From time to time the Board gets
calls from members asking what
the Board can do about situations
when a broker’s For Sale sign is on
a property that does not show up in
the MLS. Although the MLS listing agreement requires that listings
are entered into the MLS database
within 72 hours, property that is
subject to an “office exclusive” listing – when a seller has requested
that a property not be entered in
the MLS – is an exception to that

Vivian R. Graham passed away on Thursday, May 13, 2010
in Westerville. She was a former sales associate with Coldwell
Banker King Thompson in Dublin and a loving and devoted
mother, sister, aunt, grandmother and friend to the many who
shared her life. Vivian cherished the 25 years as an Air Force
wife, traveling to many countries. She also enjoyed the Buckeyes, playing golf, bowling and bridge club. Vivian is survived

Army in WWII as an airborne jump instructor with the 82nd
Airborne Division. Away from his real estate business, he found
enjoyment playing poker and bridge and always looked forward

Rudolph Melvin “Rudy” Stern, Jr., passed away on Tuesday,
May 11, 2010 at The Zusman House. For 40 over years, Rudy
was a well-known and respected REALTOR® on the east side
of Columbus. He served as a member of the 1972-74 CBR
Board of Trustees, was a member of the CBR MLS Committee and he taught many classes for new agents. He was also a
member of the Ohio State Alumni Association, B’nai B’rith,
Zeta Beta Tau fraternity and an active member of Temple Israel
for over 50 years. He was also a supporter of many charitable
causes. Rudy is survived by his loving wife, Mary Joel Gleeson
Stern; son, Robert H. Stern of Columbus; daughter, Nancy
Stern Lipson (Ira) of Dallas; two grandsons; stepsons, Stephen

What is the most useful new tech tool?
New technology offers the prospect of making business easier but it often fails to live up to the hype. What is a new
tech tool that you’ve found actually does increase your productivity or make your work easier? What would you recommend other real estate agents use? How do you keep up with technological advancements?

quickly so I try to stay with
what is true and steady. I
use Microsoft Outlook and
it syncs to my Blackberry. I love having my
contacts, calendar and tasks all updated
daily. This may sound simple but it makes
such a difference having my phone connected to my computer.
The new technology I am starting to use is
ListHub (ListHub.net). It uploads your listings to many websites and keeps it current
by changing the listing when needed and
removing it when sold.
Social networking tools like Facebook and
LinkedIn have been great ways to keep in
contact with my clients. I especially like it
when I find out about big events like the
birth of a child in one of my clients’ lives.
Then I follow up with a greeting card. It
adds the personal touch and doesn’t make
technology so cold.
I try to always continue to learn what is happening with new technology but I wait to see
how it works for others before I join in.

When my daughter gave
me a Flip video camera for
Christmas, I thought, “Ok,
when will I use this new
toy?” The camera sat in its box on my desk
for a few weeks. But as I work with many
families who are relocating to the area, I
soon found the Flip Video to be one of my
best tools for helping families save time and
airfare. When the prospective buyer selects
a property they think they may want to see,
I preview the property with my Flip Video.
As I walk through the property, I discuss

what I am seeing, points that are good
for resale or the family’s needs as well as
undesirable features. I then can e-mail the
video to my clients before they decide if
they want to come back to town to see the
property. My clients have shared that they
send the videos to other family members
and friends and they enjoy getting to know
me better as they listen to my narrative.
Because I am seeing the house for the first
time, they enjoy hearing my unedited impressions of the property. I try to keep up
with technological advances via colleagues
in our office as well as my 24 and 28 year
old daughters.

the new technology tools

on Twitter and Facebook that are bleeding
edge adaptors. I use their expertise and
become an early adopter to the technologies they endorse. My technology of choice
right now is the Google family of applications. I’ve integrated Google Voice into
my business along with Google Docs and
Google Analytics and each one has had a
major change on how I do business. The
best part is that they’ve decreased expenses at the same time.

My Blackberry is by far the
best technology tool for
me and my business. It
may not fall into the “new” category, but
I’m constantly learning new ways that it can
help keep me organized and efficient. Many
clients communicate solely by e-mail and
having the ability to read e-mails no matter
where I am is crucial. I love being able to
pull up addresses on TEMPO Mobile and
share the status or price with a buyer as
we are driving by a property. I also assign a
particular ring tone to all clients so that if
I’m in another room, I have an idea of how
quickly I need to run and answer it!

I joined the ranks of Blackberry users last year, and it
has become the best techie
toy I have ever purchased
to save time and money. I chose the Curve
because of the ability to access the MLS
and to open/program lockboxes with the
Bluetooth fob. I can change access times
or CBS codes specific to each home, if I so
desire. Since I no longer needed the keypad
(and the cradle), I was able to cancel my
home landline and saved money. The fob
stays in the car, so now I don’t find myself
without a means to open lockboxes as I
often forgot the keypad and had to return
home. The required MLS update takes just a
few seconds and can be done anytime.
As with most smart phones, my e-mail and
attachments are pushed through for my
instant response. I like having office and CE
meetings added directly to my calendar.
Plus, when I set up a meeting with a client,
I can enter the meeting into their calendar
if they have that capability. Naturally, the
calendar and contact info can be synced
with or backed up on the laptop.
I recently learned how to make the screen
become a flashlight when electricity goes
off or when I’m in a dark basement. The
camera and flash are quality enough to
allow me to take photos for my blogs. Of
course, I can tweet, blog and use Facebook
when there are free moments. Basically, with
all the many apps available, everything I
need, or need to know, is at my “thumbs” so
I don’t rely on my laptop anymore.
Oh, yeah … it’s also a great phone.

tool for me as a commercial agent is high speed
Internet and PDF files. I can
now send a large information package on
a building or space in two seconds. Several
years ago, I would have to print out the
package and FedEx it to the co-op broker
or prospect. I now save enough in overnight
mail charges to pay for the DSL internet
line.

I actually have two tools
that have been useful in
my business. The first is
the ScanSnap that we installed in our team
office several years ago. We have been able
to save a lot of money with this little machine which scans documents to computer
files. We no longer pay for a fax machine
or the extra phone line for it and we have
saved money by going paperless and avoiding file storage fees. That’s not to mention
the time we save by having all of our past
files easily accessible on our computers.
The other useful tool for me is my Blackberry. I spent years not wanting to give up
my Treo and so delayed taking advantage
of all of the Blackberry has to offer. The
ability to respond to e-mail requests immediately is huge and allows you to deliver
great customer service. I also love having
maps at my fingertips and rarely get lost
anymore. I don’t often buy new technology
the minute it comes out, having done so in
the past and wasted time and money. Now,
I generally take the “wait and watch” approach to make sure it is a good application
for my business.

The most useful new tech
tool I have recently gotten
is my Verizon Droid Eris
phone. Prior to owning this device, I had
a normal cell phone. Now with my Droid, I
can access listings from anywhere while I’m
in the field. That helps me out a lot. I also
like being able to access my e-mail any time.
And now with the release of the Android
2.1 operating system, I no longer have to
worry about forgetting my GPS, since I have
turn-by-turn directions and maps on my
phone. At the time I bought this phone it
was great, but if I were to get one today I
would get the HTC Incredible. It has better
specs and appears to run smoother then
the Eris.

I have found the Blackberry
(and similar devices) to

industry. The ability to send and receive
important documents on the go allows me
to optimize my time without waiting at my
computer for documents or e-mails. That’s
not to mention TEMPO Wireless which is a
great mobile tool. The key to success with
technology is to find a proven, stable device
that has minimal bugs and problems. I used
to like to be the first guy with the newest
technology. Now I like to wait, read reviews
and be the guy with the most stable technology. I think the next great tool will be
the ability to sign contracts right on your
laptop. Looking forward to that day!

the use of Gmail helps
integrate all of these messages and mailboxes into one. Its ability to collectively
receive and send any POP3 mail addresses
into one application organizes the seamlessly unending number of messages that
are a foundation of our business. Gmail
offers an online collaboration document
management system (Google Docs), which
allows either public or private access to
documents without having to send separate
emails for signatures and review. They also
offer a calendar (which also can be shared)
and a never-ending amount of third-party
plug-ins. All for free.

I’ve been licensed since
1989, when all we needed
was a copy machine and our vehicle to
deliver our contracts to the broker’s night
drop box. Back then, we even had to pick
up keys at the listing agent’s office. How
things have changed with today’s technology and advanced devices. As my business
today is mostly REO-driven, it is essential
to have a laptop which can easily download
photos from memory cards, as well as good
wide lens cameras and of course, a reliable
cell phone and/or Blackberry. Being out in
the field most of the day, it is important to
always have the best communication tools
available. Additional devices which come in
handy are the Kodak Z6 Pocket Video camera and a GPS system which gets me to the
property a little quicker than using the old
map books. Technology has changed and
improved our business for the better and I
can only imagine what tomorrow will bring.

Ohio’s REALTORS® are a remarkable bunch

In the midst of the traditional spring home
buying season, hundreds of REALTORS®
journeyed to Columbus for the betterment of our industry. And they did so in
an environment where housing markets
throughout the Buckeye State been facing
severe challenges since the start of the
Great Recession in 2008.
Yet, despite the economic uncertainty, the
market is showing hopeful signs of improving and the REALTORS® attending
the organization’s meetings truly embodied the can-do spirit that will help us reach
full recovery. The events of our three-day
meeting confirm that the long-term prospects are bright for our profession and the
American Dream.
The biggest reason I’m so proud of my
chosen profession is the fact that many of
my peers from throughout Ohio can gather
together, explore and discuss the issues of
the day and reach a consensus on how to
improve the climate for both the industry
and property owners.
This was never more evident than during
the Ohio Association of REALTORS®
recent Spring Conference held May 23-25
in Columbus. Nearly 400 REALTORS®
from across the Buckeye State gathered
in Columbus’ beautiful Easton area to
deliberate on the issues confronting our
industry and the rights of property owners.
These folks took time away from their
daily business and families to work for the
advancement of our profession.
Lest you think it was all work...We, being
REALTORS® and all, were able to mix in
some fun as well.

I’d like to share with you some of the
highlights from the Conference:
• The MLS Forum featured guest speakers Jeff Young, Senior Vice President
of Operations, and Ernie Bottom,
Industry Relations Manager, REALTORS® Property Resource, highlighting NAR’s nationwide property
information database.
• A “Lunchbox Economic” session, presented jointly by the Economics Issues
& Trends and Housing Needs Forums,
featured Candy DeClark, a CPA and
attorney, who highlighted the changes
in tax laws, maximizing profitability,
incorporating, tax mistakes and tax issues REALTORS® should know about.
• The Professional Standards Forum
discussed the Grievance Panel Review
Process Part II, dealing with complainants, basis for hearing vs. trying the
case and routine hearings.
• Hundreds of REALTORS® earned CE
credit with a timely education session
on “Investment Strategies & Energy
Tax Credits for Homeowners.” Thanks

certified residential appraiser, Ohio
Division of Real Estate & Professional
Licensing, on recent updates from a
regulator perspective.
• Directors passed a resolution in
memory of OAR Past President Marvin
Yerke, who passed away on Nov. 27,
2009.
• Dayton REALTOR® Steve Brown provided a comprehensive update on his
candidacy for the 2014 NAR President
post. To date, he’s received endorsements from 47 states and territories.
• NAR Region #6 Vice President Darlene
Breen urged participation in the Broker
Involvement Program and support for
NAR’s Major RPAC Donor program.
In addition, she encouraged members
to investigate joining NAR’s Credit
Union, which offers competitive interest rates.
• Remember how I mentioned that attendees were able to find a little time to
mix in pleasure with the business? Our
RPAC event afforded everyone the opportunity to shine as members took the
stage at a special Karaoke Night event.
Some amazing talent took the spotlight for a worthwhile cause including

form as to whether carbon monoxide
detectors and fire extinguishers are
installed properly in the property.
Oppose HB 487 which would impose a conveyance fee for housing
programs. While Ohio has a relatively low rate of conveyance fees
compared to other states across the
country, these fees, no matter how
small, inject another financial hurdle
into the real estate transaction. OAR
steadfastly supports affordable housing programs but opposes placing
another burden on property owners.
Giving counties the authority to levy
above the current 3 mils required in
statute opens the door for an increase
in the conveyance fee down the road.

bankruptcy. In Ohio, this legislation
is being promoted as a means for
keeping associations solvent thus
protecting current owners’ investments. We’ll monitor this legislation
and work to make sure any solution
benefits condo owners and does not

The CORPAC Auction rocks the boat
On May 27, 340 shoppers with a cause gathered at the Grange Insurance Audubon Center for the
2010 CORPAC Auction. With only the most noble motivation, they bid on the 150 items up for grabs
and managed to raise more than $31,700 in two and a half hours.
Julie Morgan and Brad Bennett paid through the nose for the “honor” of golfing with the infamous
“Captain” Bob Kidwell and ignominious Larry Metzger (something they’ll probably regret later.)
Dave Dewey outbid everyone for a weekend stay at the Inn & Spa at Cedar Falls. (After all of the
contentious bidding, he’ll need to get away for a few days!)
One item up for auction, a pink patent leather Coach purse, caused a tussle between Amy Beck and
Kathy Elliott. After they indulged in some very unladylike (and yet entertaining) behavior to win the
dainty clutch, some witnesses suggested that next year a ladies’ wrestling match might be a good
CORPAC fundraiser.
After a serious bidding contest with Ted Oatts, Gavin Blair walked away with an ultra-modern gas grill.
Since then, however, someone has walked it off of his porch. (Police have yet to check the Ted cave.)
Lynda Long kept being outbid for the naming rights to CBR’s boardroom and was quite miffed until
she realized her competitor was her colleague, Pamela Meige. They joined forces to win the bid and
rename the boardroom in honor of both of them.
A live performance from Tempo 5.2 went to Pat Kearns-Davis who was disappointed to learn that they
are a rock and roll band and not a demonstration of the latest MLS.
Those claiming full liability for the evening were this year’s CORPAC Fundraising Committee co-chairs
Karen Lambert with ValMer Land Title Agency, Gretchen McKay with Coldwell Banker King Thompson
and Anthony Masci with Edwards Commercial Realty, LLC.

CBR’s 2010 Blood Drive draws 44 productive units
The Columbus Board of REALTORS® Blood Drive
Committee sponsored a blood drive Friday, May 7.
The blood drive was successful with 64 registered
donors and 44 productive units of blood drawn.
Forty-four units of blood can either save or prolong
the lives of some 132 critically ill or seriously injured
men, women and children throughout the central
and southern Ohio areas. Thanks to all of the
REALTORS® and affiliate members who took time
out of their busy schedules to donate to this worthy
cause.
