Executive Search Committee, the AMA is

the new president of the Arizona Multihousing Association.
Many of you probably recognize the
name, as Tom has been an active member
of the Phoenix community for many years.
Experienced in association management,
he brings to the AMA over 20 years of
public, private and community service.
Tom currently serves on the Phoenix
City Council representing a district of
200,000 residents. Previously, he owned
his own small business selling real estate
and consulting with Fortune 500 companies on federal legislative issues. Other

AMA Recognizes Industry’s Best at
Tributes Awards Presentation
The Arizona apartment industry
honored its best May 22 when, before
a record crowd of over 1,300 individuals, the AMA presented 16 awards to
rental communities and individuals
who "achieved a standard of unqualified excellence" in their respective categories.
TEAM AND COMMUNITY
AWARDS
Judges for the 16th Annual
AMA/Cox Communications Tributes
Awards considered several factors during the judging process of the team and
individual award nominees, including:
professional presentation, industry
experience, industry education, problem-solving capabilities and impact on
property.
Honored as the best team and community for properties built between
2001 and 2007 was Grigio at Tempe
Town Lake, a 522-unit community in
Tempe. Gray Clow Residential, LLC
manages the property.
Chosen as the best team and community for properties built between
1990 and 2000 was Tresa at Arrowhead, a 360-unit development in
Glendale. Managing the community is

Recognized as the best team and
community for properties built prior to
1990 was Mission Springs, a 306-unit
site in Tempe. Fairfield Properties, L.P.

Teams of judges selected the winners
from a total of 246 entries from 29 man-
agement companies. Among the factors
the judges reviewed were written recommendations from the nominees’ supervisors and results of two-rounds of
in-depth interviews with the finalists.
They considered each candidate’s professional presentation, industry experience and education, job knowledge and
problem-solving skills.
The AMA also presented two awards
to recognize outstanding volunteer
efforts and achievement in the association.
Honored as Volunteer of the Year

AMA Goes ‘Hollywood’ at 38th Annual Phoenix
Education Conference and Trade Show
The AMA took to the "Big
Screen" May 21-22 at the 2008
Phoenix Education Conference and
Trade Show at the Phoenix
Convention Center. Over 1,000 individuals attended the 38th annual program.
The theme of this year’s conference and trade show was "Lights!
Camera! AMA!" Exhibitors on the
trade show floor donned costumes of
famous movie stars and celebrities,
while their booths showcased movie
backdrops ranging from "Gone with
the Wind" to "Indiana Jones and the
Kingdom of the Crystal Skull."
Chairing this year’s Phoenix Trade
Show Committee were Doug Benson
of Burns Pest Elimination and Jodi
Bart of MEB Management Services.
Featured at the Education
Conference were keynote speaker
Victoria Labalme, who demonstrated
how to get off the "conveyor belt of
life;” breakout speaker Christopher
Higgins, who provided valuable tips
for apartment industry personnel; and
breakout speaker Andy Hull, who
addressed the Arizona Residential
Landlord and Tenant Act.
A popular attraction was the

executives squared off in a computerized guitar-playing competition.
Two lucky attendees each left the
trade show with cash in their pockets
after winning the Greater Phoenix
Apartment Guide’s $1,000 Grand
Prize. Winning the Wednesday drawing was Karen Cloyd of Dunlap &
Magee Property Management, while
Jennifer O’Neil of Equity Residential
was Thursday’s big winner.
The Big Hearts for Little Hands
community outreach campaign—
which benefits four homeless shelters
in Arizona—helped raise donations
and provided trade show goers with
information on the fourth annual pro-
gram. Staffing its booth were AMA
member volunteers and UMOM Day
Center representatives who also gave
out Boys of the AMA calendars (featuring AMA Board members) to
donors and began the promotion of
Homer, UMOM’s turtle mascot.
Additionally, member company
Arizona Fire and Water Restoration
raised $676 for this year’s campaign.
(The company added $1 for every
business card collected to its $500
donation.)
Following the first day of the conference and trade show, attendees and
exhibitors met at the Mid-Show Party

HEIGHT RESTRICTIONS
No sign, display or specially-built equipment can extend above the official booth
height of 8 feet. In addition, no material in the front 5 feet of the booth is to exceed 3
feet in height.
PAYMENT GUIDELINES
Payment in full is due 30 calendar days after reservation is received or booth may be
subject to cancellation. Associate members must be current in their account with the
AMA in order to reserve a booth. Reservations made after June 27, 2008 must be paid in
full at the time of reservation. The AMA will make every attempt to avoid placement
close to a competitor. In some cases, however, this may not be possible.

A percentage of people can see
opportunity. They recognize it, ask questions, and do the leap of faith.
I know a reformed addict who turned
her life around. This person put one foot
in front of the other every day. At first,
she filled the void with lots of meetings,
from Alcoholics Anonymous and Gamblers Anonymous to some I hadn’t even
heard of. She applied for jobs, even
though the most important people in
her life said she wasn’t going to get one.
She landed one and put 100 percent
into it everyday. She purchased a house
and worked diligently on making it a
home.
Watching others around her, the urge
to accumulate real estate hit. She couldn't afford much, as she made less than
$11 an hour. She therefore started with
a studio condominium with a great city
view. In no time, she rented it to an
individual who was also turning his life
around.

MEETING SCHEDULE
Upon moving in, the new renter was
putting one foot in front of the other
everyday, and the landlord kept one eye
open to any behavior that even resembled a stumble. After a couple years, that
renter purchased his own home and my
client, who I admire so very much,
cleaned up the unit and is marketing it
for another resident. I have a hunch her
example inspired him!
Since then, she bought another studio condominium. She is leasing it to
another individual who is reforming her
life. We will be closing on her fourth
property in three weeks. She now has
the hang of buying property, and I'm
helping her fine-tune her management
skills.
The fourth property happens to be
next door to a unit she already owns.
When we first visited the newest unit,
we encountered a barking noise from
next door, and she immediately called
the tenant to find out about the noise. I
mentioned to her that a notice to enter
the unit to check for any damages was in
order. After making arrangements with
the resident to access the unit, we arrived
three days later for the inspection.
We found one dog, two cats and a
hamster. Also, the renter had been
smoking in her non-smoking unit. I
advised my client to issue a 10-day
notice for the pets and the smoking. I
also instructed her to have the resident
begin paying for the clean-up while still
living in the unit. At this point, I would
allow only one pet—the hamster—with
a pet deposit. Action such as this is necessary if you want future compliance
from the renter. Welcome to the free
world.
It is very important to have at least
one payment made in advance. Do not
put up with a defiant tenant just because
you need the rent. Damages will often
exceed a month’s rent. Start a repair
fund the minute you close escrow. One
dollar will turn into two. Save money
separately for repairs, as you will have
them as sure as the sun comes up in
Phoenix.
Be everything you can be. Put one
foot in front of the other every day.

who is watching, and you never know
who you are helping just by being you!

Tom’s credentials and management style,
which we believe will be an appropriate
fit with the AMA staff. He has overseen
similar organization formats with comparable staffing, and we are confident in his
ability to lead the AMA in becoming an
even greater and more respected voice of
the Arizona apartment industry.
Tom is very excited about his new role
at one of the country’s most respected
apartment associations.

Tucson City Council Again Considers Sales Tax on Rent

Arizona is one of the few states in
the country where municipalities can
charge sales tax on rent. While most
state municipalities impose a tax
between 1.4 percent and 1.8 percent,
Tucson renters have been spared from
this unfair and regressive tax.
SUCCESS IN 2004
In summer 2004, the Tucson City
Council considered a sales tax on rent
for the third time in as many years.
As the city struggled to balance a $26
million deficit in its fiscal year 20042005 budget, its 175,000 renters
became a prime target to close the
financial gap.
The reason for this additional tax
is simple: Elected officials view
renters as transient with little interest
in public policy decisions that face

them. They also view them largely as
non-voters.
AMA Tucson members decided it
was time to demonstrate the strength
of the rental housing industry and our
unwillingness to allow an additional
tax imposed on families who choose
to rent homes.
The association initially contacted
management companies and property
managers to alert them of the issue.
Tucson member then prepared petitions and circulated them at Tucson
apartment communities. The AMA
made quite a statement when it presented over 4,000 signatures to the
City Council.
Once the Council set the date of
the public hearing, the association
distributed flyers to all area communities and managers and encouraged
their residents to attend. The AMA
informed the mayor and city manager's offices of its intentions, and the
Council moved the meeting to the
Tucson Convention Center.
Tucson management companies
strongly supported the effort, and several even chartered buses to make it
convenient for their residents to
attend. Associate members also contributed to the efforts. Approximately
1,000 people enjoyed a barbeque dinner on the plaza before heading into
the council meeting. Voter registration tables were also setup on the
plaza. Attendees wore bright orange
AMA stickers that read, "Not on our
Backs" and "I rent and I vote." Many
also carried homemade signs with
similar messages.
The "renter revolt" was the lead
story on every television newscast in
Tucson that night. Additionally, the
event was front-page news in The
Tucson Citizen, The Arizona Daily Star,
Inside Tucson Business and Tucson
Weekly.
Although the numbers were
impressive, public testimony from
industry leaders, apartment managers
and especially residents drove the
message home. While the Council
did not take a vote that night, within
days of the hearing five council members indicated publicly that they
opposed the sales-tax-on-rent proposal.
CITY AGAIN CONSIDERING
TAX
The AMA recently learned that
the City Council requested information from staff on a sales tax on rent,
with a goal to fund the recently established affordable housing trust fund.
While the Council is also considering
alternate funding mechanisms for the
trust concurrently, it is important that
we make the connection that those in
need of affordable housing are often
renters and our residents. Adding an
additional tax burden to the same
families who are in need of help is
counterintuitive.
When affordable housing becomes
a community crisis, it is just that: a
community crisis. The funding solution should involve the entire community. Municipalities should not
single one industry out, and the very
people in need should not inherit
new taxes.
Many Council seats have changed
since the effort of 2004, and Capitol
Consulting is currently meeting with
Council members on behalf of the
AMA to educate them, not only on
our history on this issue, but also the
undo burden this places on the families we work to provide safe, affordable housing to.

to gain momentum, may need your

Review List of Provisional AMA Members
Editor’s note: All applicants who are applying to be Regular or
Associate members of the Arizona Multihousing Association must complete the application and pay applicable dues. The applicant shall agree
to abide by the provisions of the Articles of Incorporation, the Bylaws
of the association, and by the Code of Conduct prescribed by the association.
The applicant will then be classified as a Provisional member. During this period, the Provisional member will have the rights and responsibilities of full membership.
Within 60 days of applying for membership, the names of the Provisional members will be published in Apartment News, and existing
members will be encouraged to provide comments on the suitability of
the application.
If no negative comments are received from existing members within
90 days of membership application, the Provisional member will be
deemed automatically approved into membership.
If any negative comments are received, the Ethics Review Board
must review the application within 120 days from the receipt of the
negative comment and recommend to the Board of Directors the
acceptance or rejection of the application. If the Ethics Review Board
does not recommend acceptance of a Provisional member, the Provisional member must be notified and given the opportunity to request a

Brand Engagement
"We’re getting married!" Those are
three of the happiest words in a person’s life. But before that happens,
somebody’s gotta’ buy the ring and
drop down on a knee. And someone
else has to say, "yes."
In our property management
world, companies may struggle to
achieve such long-term relationships
or "marriages" with their residents
because the union between a consumer and a brand is not governed by
logic. You can create a quality product and service, but if you don’t
engage the customer’s emotions, you
may get left at the altar. The first step
to achieving brand engagement is to
pop the question:
Do you treat your residents as people or apartments? Do all of your
communications, actions and practices consistently deliver across all
touch points on your brand’s promises
over time?
"Touch points" are where the
brand connects with the consumer
and stimulates them emotionally.
Examples can include social networks
like Facebook, guerilla marketing
campaigns, advertising and the product/service itself, down to the doorknobs and fixtures selected. If you
dedicate the time, thought and
resources to making every touch point
uniquely true to your brand, your residents will be monogamous and stay
by your side through the good times
and bad. That is brand loyalty.
In the multi-housing industry,
brand loyalty is also known as "referrals and retention." When moving
across town or relocating to another
state, where will your resident choose
to live? Brand loyalty can be the
deciding factor. A positive experience
with a familiar name encourages residents to continue leasing communities managed by the same company or
refer them to others.
So how do you create brand
engagement and brand loyalty in the
apartment industry?
Saturation. One property, however spectacular it may be, will not
generate brand recognition, engagement or brand loyalty in a market.
Multiple properties all simultaneously
fulfilling on the brand makes your
brand different and better than the
others.
Marketing budgets. A great deal
of time and money has been dedicated to building and managing a property, which means it’s essential to
commit significant resources to advertising, marketing and public relations
to promote it. You have to invest in
training your staff to be "on brand,"
in quality marketing materials and
ongoing advertising programs to
ensure consistency of message and
brand.
Time. Building brand awareness
doesn't happen overnight—it takes
time and patience and generally three
to five years. And one lapse in services or management can erode all of
that goodwill in the blink of an eye.
As hard as it is to focus beyond shortterm profitability, always take into
account what the long-term ramifications are to your brand when making
decisions.
Target audience knowledge. It’s
likely your target resident is between
the ages of 21-29. Millenials and Gen
Y’ers are accustomed to having continuous information at their fingertips. With text-messaging, e-mail and
instant messaging, these renters are
abandoning traditional marketing
channels altogether. In fact, they are
more distrustful of advertising and
hard-sale tactics familiar to traditional apartment leasing.
Creativity. This is the most
important, valuable and intangible
component of a brand. Find the most
creative people your marketing budget can afford and set them free. Don’t
constrain their ideas. If you want to
become the leader, your marketing
shouldn’t follow the others. For
example, try a different publication
than your competitors to advertise in
or add humor to your campaign

Rising Foreclosures Affect Renters

The huge number of property foreclosures in Arizona is putting renters
in a very difficult situation. These
individuals typically do not understand what their rights, remedies and
responsibilities are once they learn
their landlord or owner may lose the
property at a foreclosure/trustee sale.
The process begins when the
owner or landlord fails to make the
monthly mortgage payment for an
extended period of time, usually six
months. The bank, owner of the deed
or other entity then starts a foreclosure/trustee sale. At this point, the
renter receives a notice alerting him
or her to the date and time of the
pending sale. Most residents will then
naturally become quite concerned
about losing their housing and being
evicted.
The first mistake an individual can
make is not paying rent because of
the pending sale. Many renters do not
understand that the owner or landlord has until the sale to pay all past
due amounts and reinstate the loan. If
he or she reinstates everything, the
lease is in full force and effect. If the
residents have moved and refuse to
pay rent, they are in breach of the
lease and subject to eviction or lawsuit.
However, if the individuals pay the
rent but the landlord does not reinstate the loan, they must move and
receive no credit from the bank or
new owner. The lease is null and
void, and the renters will receive a
five-day notice to move and possibly
face eviction if they fail to do so.
Additionally, they do not receive any
credit from the new owner for any
existing security deposits. The residents would have to locate the previous landlord or owner and sue for
return of their deposit.
Arizona law states once the properly sells at the foreclosure/trustee sale,
no one other than the new owner or
bank has any legal interest in the
property.
A.R.S. 33-811(E) states:
The trustee’s deed shall operate to
convey to the purchaser the title, interest
and claim of the trustee, the trustor, the
beneficiary, their respective successors in
interest and all persons claiming the trust
property sold by or through them, including all interest or claim in the trust property acquired subsequent to the recording
of the deed of trust and prior to delivery
of the trustee’s deed. That conveyance
shall be absolute without the rights of
redemption and clear of all liens, claims
or interests that have priority subordinate
to the deed of trust and shall be subject
to all liens, claims or interests that have
a priority senior to the deed of trust.
The renters are in a real Catch-22.
Do they pay their rent, hope the
landlord brings everything current
and, if not, be prepared to move? Or
do they not pay rent, find another
home and run the risk of a possible
lawsuit for breach of contract if the
landlord does reinstate the loan prior
to the sale? This can be a very difficult situation to address. AMA

A Man’s Home is His…Bazaar?

With the advent of Internet-based
flea markets, making money from the
comfort of your computer chair has
never been easier. Forget telecommuting, where instead of traveling to your
place of employment by car, bus, bicycle or feet, you utilize fax machine,
computer and multiple-line telephone
to handle your transactions. Now,
home-based business is even easier:
you need only to have items gathering dust in the hall closet and an
Internet connection.
Of course, working from home is
technically in violation of the
Arizona Residential Landlord and
Tenant Act (ARLTA). In part, the
Act prohibits the use of a dwelling
unit for anything other than as a residence:
Unless otherwise agreed, the tenant
shall occupy his dwelling unit only as a
dwelling unit. A.R.S. § 33-1344.
Under normal circumstances, landlords turn a knowingly blind eye to a
resident utilizing his or her home as
the "home office," providing that the
individual keep the disruption to a
minimum. After all, excessive traffic,
noise disturbances and warehousing
goods on the apartment patio disrupt
the quiet and peaceful enjoyment of
the community by the other renters.
But what happens if the resident
uses the apartment to facilitate a business and the landlord does not want
to "wink and nod" at the transactions? Setting aside the patently illegal "home businesses" of narcotics
production and distribution, how do
you handle otherwise legitimate operations that should not be taking place
within the community’s grounds?
Take, for example, the unlicensed
daycare provider. He or she uses the
apartment to host a half-dozen children, none of whom are his or her
own. As the landlord, you’ve received
complaints about noise, and you’ve
seen non-resident vehicles regularly
arriving and leaving the community
twice a day. The answer to this problem is straightforward: issuance of a
notice of default under the terms of
the lease, or, in common usage, the
10-day notice.
Many leases have clauses that prohibit using apartment as anything
other than a residence, but even
without that clause, A.R.S. § 33-1344
still controls the landlord-tenant relationship. As always, proving the
breach lies with the landlord, so be
prepared to fight your resident in
court unless you have the necessary
witnesses and documentation to support your case. Excessive traffic
reports and back-tracking random
cars frequently parking at the community will help support your claims—so
much the better if you have eyewitness accounts or photographs of the
incidents, too. Additionally—and
especially if you have an issue of children (due to the very specific references to families with children in
both ARLTA and the Fair Housing
Act)—make sure you thoroughly document the incidents.
Sometimes, however, the discovery
of the business operation is solely
serendipitous. An advertising card or
a Website hyperlink could disclose
the existence of a business in the
grounds of the community about
which management would have no
knowledge otherwise. Unlike that
unlicensed daycare I referenced
above, most businesses that can operate from an apartment are necessarily
quiet and unobtrusive. Discovery of
the unauthorized business is generally
only by accident.
Speaking of accidents, while I was
researching a wholly different topic
for a client, I came across an odd reference in the Scottsdale City Code.
Under section 16-453, it is: unlawful
for any person to conduct, manage,
operate, maintain, offer to furnish or
furnish an escort bureau business or
introductory service without first obtaining and maintaining in effect an escort
bureau license. The city of Phoenix
has a similar series of ordinances in
Chapter 10, Article X. In these cities,
an escort business may operate pro-
vided that the people involved possess a license from the city, much the
same way a bar must have a liquor
license to sell alcohol.
I imagine you’re a bit surprised that
we even have an escort licensing law
in some of our municipalities. I must
admit that it surprised me. When you
think about it, however, it makes
sense. Technically, it doesn’t fall
under the prohibitions of A.R.S. §
33-1368(A), because in and of itself
the escort business isn’t offering anything illegal. We might just be winking and nodding at the true nature of
the undertaking, but the fact remains

the first day of the month, with a late
charge imposed on the third day of the
month. An elderly resident living on
Social Security says he doesn’t receive
his check until the third day of the
month and cannot pay rent by then. He
wants his payment date extended or late
charges waived. He says my refusal to
accommodate this is age discrimination.
Is it?
A :
NSWER Unlike other civil
rights laws, age is not a protected status
under fair housing laws. There is no obligation to make exceptions to your standard
due date and late charge policies because of
age or dependence on Social Security retirement benefits. If the resident was disabled
and dependent on Social Security benefits,
the answer might be different since reasonable accommodations for handicapped residents may be necessary. In the absence of a
handicap, those rules do not apply.
However, be aware that simply because the
law does not require exception does not prevent you from making it out of compassion.
That is a matter of whatever your policies
are.

UESTION After an eviction, is
it legal for us to make the former resident pay not only what he or she owes
on the court judgment, but also the next
month’s rent as a condition to let him or
her stay on the property?

up with any numbers on the furniture. As
far as what to do with the food, you should
hold it unless it is something perishable, in
which case you can dispose of it. At the end
of the of the 21-day period, you can then
dispose of the remaining food or donate it to
a local food bank or other organizations.

recently had its grand opening. A new
resident who uses a wheelchair complained he could not get into the swimming pool and is insisting we install a
pool lift to enable him to do so. Do we
have to do this?
A :
NSWER No. Fair housing law
accessibility standards must be met by communities first opened after March 12, 1991.
But these only impose limited requirements
that apply to "covered multifamily
dwellings." This does not include pool lifts.
However, the law also requires you to make
reasonable modifications to the premises to
enable access at the resident’s expense.
Incidentally, a new Arizona Court of
Appeals decision casts doubt on whether
accessibility standards cover facilities not
located in "multifamily buildings" (those
with four or more units).
