It is charged with finding permanent funding for TBA’s Building Trades Academy for the 2008 fiscal year and beyond. A group of veteran TBA members, led by TBA past President Jeff Ainslie will personally seek out viable options for permanent funding for the training program. “Jeff has worked diligently in years past to help keep the Building Trades Academy open and training atrisk students,” said TBA President John Olivieri. “With his experience and desire to see the program continue, it made him the logical choice to chair this task force.” Ainslie, President of Internal Operations of Ainslie-Widener, was governor-appointed through the Virginia Caucus of Mayors and Chairs to the Hampton Roads Workforce The new “Building Trades Academy Funding” Presidential Blue Ribbon Task Force is headed by TBA past President Jeff Ainslie. In an effort to address the demand for skilled workers in the building and construction industry, Ainslie was an integral part of the development of this year’s Hard Hat Academy in southeastern Virginia for local high school guidance counselors this past June. The goal of the event, a partnership between TBA’s Building Trades Academy, local builder/developer firm Ainslie-Widener, Tidewater Community College and Paul D. Top Spikes of 2006 An estimated 360 TBA members and guests attended the 2006 Stanley Awards Gala April 21 at The Hilton Virginia Beach Oceanfront. The annual TBA Picnic at Camp Pendleton offered new sights and sounds, along with the usual favorites, for some 1,241 TBA members who converged on the event June 2. The picnickers enjoyed food from more than 65 vendors, and reveled in the fun and games. Every year the Charity Golf Tournament raises funds to benefit the TBA Building Trades Academy. This year’s tournament April 26 at NAS Oceana Aeropines Golf Club drew 220 players and raised a record $29,000 and the sponsorships contributed $14,000. The first-ever Reverse Trade Show was such a big success for TBA that another one was held in Virginia Beach. This event is a great way for associates to personally speak to builders and let them know what their company has to offer. Builders also get to hear about the latest and greatest products for their homebuyers. Combined, there were a total of 51 participating builders and 353 attending associates. This year also saw continuation of the more-fun-than-business membership meeting, the third annual TBA Oyster Roast held Oct. 26 at The East Beach Bay Front Club. Lewis McGehee performed his special brand of acoustic music while guests got their fill of delicious food and drink, and the gorgeous Chesapeake Bay setting. Valentine Construction Inc., won top honors for both the People’s Choice Favorite Home award and the Favorite Interior Design award at Tidewater Builders Association’s 2006 Homearama at The Estates of Pitchkettle Farms in Suffolk. The Valentine House was decorated by Rich Kahler, Tamyra Spear and Angie Lowry of Interiors by Decorating Den with furnishings by Thomasville. The People’s Choice winners were determined by votes from the attendees The Tidewater Builder of the annual home showcase event. More than 81,000 visitors had the opportunity to view 15 newly constructed and decorated homes at The Estates of Pitchkettle Farms, which is an AinslieWidener Development. Wendell Homes L.L.C. received the second-place Favorite Home award for The Suffolk House. The third place Favorite Home award went to The Craftsman, built by Richmarc Building Corp. The Craftsman was also awarded second place honors for Favorite Interior Design, which was by Leslie Scarlett of The 2007 Homearama lot drawing will take place in the TBA boardroom at 2 p.m., Thursday, Dec. 7. A lakefront section of the Chesapeake luxury–home community of Edinburgh is the locale for the 2007 Homearama showcase of homes, tentatively set for Sept. 29-Oct. 14, 2007. Located just off the Chesapeake Scarlett Interiors with furnishings by Interior Visions. The Suffolk House also won third place for Favorite Interior Design, which was by Kim Campbell of Showcase Solutions and Jenny Wendell of Wendell Homes L.L.C. with furnishings by Willis Furniture Co. December 2006 3 R E P O R T C A R D I S S U E TBA Builder Services Division continues builder support Tidewater Builders Association’s Builder Services Division has been busy providing guidance to more than 100 builder members this year. The TBA Monday Morning Briefings, produced weekly by the Builder Services staff, continue to supply current information on happenings in South Hampton Roads jurisdictions of interest to members. Builder Services success stories, published each month in The Tidewater Builder, illustrate successful assistance to members provided by Builder Services staff. Each related a satisfactorily resolved issue. More than 100 members received some form of assistance this year. Builder Services also has contributed to a sense of community, bringing builders and subcontractors together to discuss current issues affecting their livelihoods. Six Builder Breakfast Club Forums packed the TBA boardroom with more than 250 builder members seeking industry insight. The lineup of programs, which are free to builder members, follows: • In February, John Whaley, deputy executive director for the Hampton Roads Planning District Commission provided an inside analysis on the 2006 residential forecast. Always a popular event, TBA quarterly Builder Breakfast Forums are held to provide builders with up-to-date informations and idustry insights. 4 December 2006 • In May, Dominion Virginia Power officials were on hand to discuss development and building procedures. Drying Solutions was also on hand to share the latest in technology for moisture detection, control and mediation. • In August, TBA past Presidents John Peterson of Terry/Peterson Residential Companies and Larry Hill of L. R. Hill Custom Builders Inc. led discussion on business strategies and other helpful ideas on how to survive a changing market. • In early October, the changing market series continued with a Bankers Forum. Board Member Sam Scott, Senior Vice President of BB&T moderated a panel discussion with Steve Halsted, Loan Officer with Bank of America; Joe Kesterson, Senior Vice President of Sun Trust; and Herbert Hamlet, Executive Vice President of TowneBank. • Later in October, local building officials were on hand to answer questions on Virginia Statewide Building Code and the 2003 International Residential Code that is now fully enforced since November 16. Bob Smalley of Chesapeake, Cheri Hainer of Virginia Beach, and Lynn Underwood of Norfolk were on hand to highlight the significant changes from the 2000 IRC as well as other hot topics in the new codes. • As of press time, the final meeting of the changing market series was scheduled for late November. TBA’s General Counsel, Grig Scifries of Williams Mullen moderated a panel discussion with Frank Santoro of Marcus Santoro & Kozak, P. C.; Joe DiJulio of Williams Mullen; and Vincent Olivieri of Inman & Strickler. In addition to hosting Builder Breakfast Club Forums, four municipal affairs committees (each focused on a south Hampton Roads city: Chesapeake, Norfolk, Suffolk and Virginia Beach) continuously work with city development staff to resolve issues of mutual concern. • In Chesapeake, Chairman Stephen Quick IV and Vice Chair Greg Dodd along with TBA staff continued quarterly meetings with city management and development staff. This year, TBA was successful in lobbying for changes to the HVAC setback requirements to accommodate narrow lot construction. TBA members and staff worked long hours opposing an amendment to reduce Quick the number of infill lots available for construction in the R-6 and R-SFA districts. A compromise was approved by City Council. Based on feedback from the industry, the Department of Neighborhood Services revised their inspection request policy regarding the combination of requests for mechanical and gas rough-ins. With input from Chairman Quick, Vice Chairman Dodd and other TBA members, the City of Chesapeake established a new procedure regarding the installation of water and sewer laterals on existing and infill lots. See Builder Services Division, page 7 The Tidewater Builder Court decisions affecting residential real estate By C. Grigsby Scifres Scifres, a partner in the Virginia Beach office of the law firm of Williams Mullen, is Tidewater Builders Association’s general counsel. This column features legal issues of interest to TBA’s members. Set forth in this article are brief descriptions of several recent court cases relating to residential real estate matters: Homeowner’s association assigning parking spaces for exclusive use In a case involving a townhouse subdivision in Williamsburg, the Virginia Supreme Court determined that the homeowner’s association could not assign parking spaces for the exclusive use of individual unit owners. The Virginia Property Owners’ Association Act allows a homeowner’s association to adopt and enforce rules with respect to use of common areas. In this case, the townhouse development included a common area containing parking spaces. The Board of the homeowner’s association issued regulations specifically assigning each parking space to an individual unit owner. In resolving a lawsuit brought by one of the unit owners, the Virginia Supreme Court determined that the applicable declaration of covenants did not give the homeowner’s association the power to license portions of the common areas. Absent such a provision, the Virginia Supreme Court determined that the homeowner’s association did not have the power to issue regulations specifically designating parking spaces in the common area for use by individual unit owners. Right of first refusal invalidated In a New York case, a recorded lease contained a right of first refusal with a fixed purchase price for the property. At the time the lawsuit was instituted, the right of first refusal had been in existence for 19 years and the stated purchase price was well below the then current market value of the property. The current property owners brought suit asking the court to declare that the right of first refusal was unenforceable. The New York Appellate Court agreed that, because the stated purchase price was significantly below the current fair market value of the property, the right of first refusal was unenforceable The Tidewater Builder Counsel’s because it constituted an unreasonable restraint on alienation of the property. More on markups of fees under RESPA A federal court in Georgia recently ruled that a homebuyer could pursue a claim against a mortgage lender because of a markup in the charge for a credit report provided by a third party. Section 8 of the Real Estate Settlement Procedures Act prohibits accepting any portion of a charge for a settlement service other than for services actually performed. In this case, the mortgage lender obtained credit reports from a third party and the provider charged $18.00 for the report. The mortgage lender charged the borrower $35.00 as part of the loan closing costs. Although federal courts around the country are divided on the issue, this court determined that the RESPA provision is violated when a settlement service provider marks up a third party vendor’s fee without performing any additional service. Existence of a prescriptive easement The Virginia Supreme Court recently determined, in a case from Washington County, that a road that was in use for about 33 years was subject to a prescriptive easement for ingress and egress to a land-locked contiguous piece of property. To establish a “prescriptive easement,” a landowner must prove that its use of the easement area was adverse, under a claim of right, exclusive, continuous, uninterrupted and with the knowledge and acquiescence of the owner of the land over which the easement area passes, and that the use has continued for at least 20 years. Several prior Supreme Virginia cases have concluded that where there has been open, visible, continuous and unmolested use of a road across the land of another for at least 20 years, then this use will be presumed to be under a claim of right. The worthwhile results include increased consumer awareness about products and services, which ultimately helps stimulate the local economy. the Rotunda, Granby Towers and St. Paul’s Place. Also on hand for tours was the ModU-Kraf modular home, built by A-Plus Builders. The home was open throughout the show for tours and was constructed the week prior to the show next to the Scope. The week after the show, the home was taken to the lot of a Norfolk family who lost their home to a fire earlier this year. Mid-Atlantic Home & Garden Show Homearama 2006 Like bees drawn to honey, visitors were drawn to the 22nd annual MidAtlantic Home & Garden Show March 23-26 at the Virginia Beach Convention Center. The show also featured more than 300 exhibitors. Guests saw the world-famous Delta Faucet Fashion Show, sponsored by Ferguson Bath, Kitchen and Lighting Gallery, as well as a dog fashion show by Mrs. Bones Bowtique. Celebrity designer Mark Montano and the Duct Tape Guys wowed the crowds on the Value City Furniture Idea Stage. Local Feng Shui and color expert Bonnie Primm was also on hand to help bring color and harmony into our homes. An impressive lineup of lawn and garden talent at The Green Thumb Theater included Master Gardeners and past president of the Butterfly Society of Virginia, Ruth Burch. They all drew packed crowds. Helping celebrate the 400th anniversary of the settlement of Jamestown, a red, white and blue America’s Anniversary Garden, landscaped by Dreamscape Designers, was on display for all to enjoy at the show as well as a Chocolate garden by Renaissance Outdoor Contracting. Awards: This industry trade show also includes an exhibit awards program that recognizes outstanding TBA members. New Home & Remodeling Show and Tour Visitors were drawn to the second annual Home Remodeling Show & Tour at the Scope May 4-7, presented by the Norfolk Redevelopment & Housing Authority and Hampton Roads Ventures L.L.C. Headliner Tom Silva, general contractor and renovation expert from PBS’ hit series This Old House, mingled with guests and drew crowds during his appearances. More than 100 exhibits and displays showcased new and unique products for remodeling, landscaping and organizing. Visitors didn’t just stop at the show. Many walked their way to numerous sites around Downtown Norfolk to see the latest in downtown living. Stops included full-scale models of newly constructed lofts and condominiums at 6 December 2006 This year, TBA celebrated Homearama’s 25th anniversary at The Estates of Pitchkettle Farms, an Ainslie-Widener development, in the Suffolk countryside. Held Sept. 30Oct. 15, the event drew more than 81,000 visitors touring the 15 showcase homes. Several of the houses were sold before the end of the show, and the builders have many other contacts and prospects as a result. The Homearama Critics’ Choice awards, The Virginian-Pilot Awards of Excellence and the People’s Choice awards recognize the region’s best builders, interior designers and landscapers, as well as excellence among TBA members in other industry specialties. The 22nd annual Mid-Atlantic Home & Garden Show was another big success. Homearama 2006 drew crowds of more than 81,000 visitors during the 16-day event. Mid-Atlantic Fall Home Show Eager visitors came from far and wide to the second annual MidAtlantic Fall Home Show Nov. 17-19 at the Virginia Beach Convention Center. The show also featured more than 150 exhibitors. The Mole Hunter Jeff Holper, a nuisance wildlife control specialist, helped visitors with their mole problems while demonstrating the latest in pest control. Meanwhile, The Wall Wizard, Brian Santos, showed visitors how to revamp their home’s walls into works of art. Other stage talent included local horticulturist and plant aficionado Dabney Morgan. Guests were also treated to a “New Home Sweet Home” feature with one-on-one discussions with TBA’s builders, remodelers, mortgage companies and real estate companies. Free antique appraisals from Holly Hill Antiques and fitness demonstrations from Superior Fitness were also incorporated into the show. Local horticulturist and plant guru Dabney Morgan brings some holiday color to the show and shares with visitors how to make the most of their holiday plants year round. Jeff Holper, better known as the Wall Wizard, demonstrates just exactly how to kill those pesky moles during the three-day event. Steve Rockerfeller of SunTrust Mortgage shares with show visitors what’s new in real estate financing and how they can get the mortgage for their new dream home. Painting is no longer a difficult thing when the Wall Wizard, aka Brian Santos, takes to the stage at the Wizard’s Workshop and shares his tips and tricks to the Basics of Painting. Dora the Explorer came to the Mid-Atlantic Fall Home show in search of a few new friends. Many children were able to see Dora throughout the show. Kotarides along with TBA staff continued bimonthly meetings with development staff. Thanks to work begun last year under Chairman John Ainslie and continued this year by Chairman Hill, the Planning Department’s Development Services Center issued DSC Notice #119 allowing location of sanitary sewer cleanouts and water meters within public utility easements, sharing the first five feet of the Dominion Power easement directly behind and parallel to the public right of way. Committee members and interested builders also continue to serve on a work group consisting of builders/ developers, neighborHill hood representatives and city staff, to come up with alternatives to proposed amendments for R-5R Residential District that would have eliminated the garage exception in calculating total allowable square footage in a dwelling. The committee represented the industry by serving on both the Virginia Beach Housing Partner Group and the Redevelopment Leadership Team. • In Suffolk, Chairman Tuck Bowie and Vice Chair Branch Lawson along with TBA staff continued meetings with Development Staff. Chairman Bowie and TBA staff successfully worked with the Department of Public Works to continue allowing a letter of credit (one year renewable) for erosion and sediment control. Originally, the City proposed to only accept bonds. Chairman Bowie and TBA staff provided comment on the City’s proposed policy for Closed Circuit Bowie TV inspection of storm drain lines prior to acceptance and continue to provide input on the proposed Public Facilities Manual. • In Norfolk, Chairman Emma Williams, TBA staff and interested builders represented the industry in meetings to discuss design guidelines and other regulations for Norfolk’s residential neighborhoods. Other Builder Services highlights: • During the Spring, TBA Builder Services Specialist Barbara York arranged classes for members: Spanish for Contractors and Construction Workers. • TBA’s Political Action Committee hosted a successful Williams Fall Golf Outing in September, raising funds for PAC activities and candidate support. Member sup- port made this a sell out event, with 144 players at Sleepy Hole Golf Course in Suffolk. • The Builder Services Division also focuses on regional impact, while keeping a finger on the pulse of state legislative activity. During the General Assembly Session 2006, TBA successfully lobbied against APF/Impact Fee and other legislation detrimental to the housing industry. TBA assisted the HBAV Legislative Committee in successful passage of the following industry bills: House Bill 558, by Delegate Glenn Oder, CONDOMINI- UM NOTICE AND RIGHT TO CURE; House Bill 919, by Delegate Glenn Oder, EASEMENT TIMING (modify the timing for transfer of easements from a developer to a franchised cable television operator); House Bill 684, by Delegate Tom Rust, ADEQUATE OUTFALL LEGISLATION; and House Bill 1375, by Delegate Bob Hull, TEN-DAY SUBDIVISION PLAN REFERRAL REQUIREMENT (Requires certain preliminary plats to be forwarded to the appropriate state agency for review within ten days of receipt by the locality). Also this year, TBA continued Build the Vote, TBA’s Get Out The Vote Campaign, a program created to register member firms’ principals and employees, educating them on the importance of participating in the election process. The campaign is designed to communicate the issues and candidates who support the industry to all member firms and employees. A lavish Build the Vote reception was successfully held in the spring with Attorney General Bob McDonnell as the featured speaker. President Olivieri appointed a Presidential Blue Ribbon Committee, chaired by past president Jeff Wermers, to bring increased member awareness to the program. The committee contacted over 120 member firms resulting in a 75% participation rate in the GOTV program. These efforts will continue in 2007 with another spring reception, increased efforts from the committee and increased member awareness. TBA provides insurance benefits to the building industry across Virginia through its general liability carrier, Builders Insurance Association Inc., a risk retention group, (BIAI), and worker’s compensation carrier, Building Insurance Association Inc. (BIA) TBA entered the insurance arena, offering workers’ compensation coverage in November 1999 to builders, remodelers, subcontractors and suppliers who are members of the local home builders associations in Virginia. Based on the success of the company, BIA was able to reduce rates this year. The workers’ compensation program is geared specifically for the residential building industry and was developed to respond to a need in the industry for a competitive product that would be available for the long term, not just when market conditions made it possible. The general liability company was licensed in 2003. While some general liability insurance policies being offered in Virginia contain a “completed operations” exclusion that will not cover prop- 10 December 2006 erty damage resulting from work performed by a subcontractor on a builder’s behalf, the TBA-owned insurance company does provide this coverage. When TBA began publishing Virginia Builder (circulation 6,500) in 1992, it saw an opportunity to offer its expertise to other state and local home builder associations around the country. But rather than adding staff to produce these magazines, TBA developed a cadre of talented freelance editors, salespeople and artists. Last January, the BTA learned that it would be losing its primary source of funding and was faced with securing financing for future students. After learning of this dire situation, TBA members and a number of local community agencies readily opened their hearts, and their wallets to help. Through a number of charity events and direct monetary donations, the BTA was able to continue its tradition of providing free training in the construction trades to deserving students and producing qualified tradespeople for the local building industry workforce. During the 10- to 12-week preapprenticeship training program, the BTA offers students classroom instruction and hands-on training in one of five specific areas of construction: apartment maintenance, carpentry, plumbing, electrical, and HVAC. Schoch Building Corp. built the first ever BTA House for the 2006 Homearama with a portion of the proceeds from the sale of the house to benefit the BTA. • The Schoch’s hosted a wine & cheese reception at the BTA House during Homearama, which raised over $6,000 to benefit the BTA. • Brian & Aretha Valentine of B. Valentine Construction Inc. built The Valentine House: House with Heart for the 2006 Homearama with a portion of ■ ■ ■ the proceeds from the sale of the house to benefit the BTA. • Addition to the BTA staff include Franklin Cobb, who has 15 years experience in construction electrical work, was hired as an instructor. • The BTA partnered with Tidewater Community College, Ainslie-Widener and Paul D. Camp Community College to hold a Hard Hat Camp to educate 34 area K-12 guidance counselors on the variety of job opportunities in the building industry so that they may offer these informed options to their students. • The BTA is currently in the process of training it’s 175th class of students. • Jeff Ainslie of Ainslie-Widener named to head the Presidential Blue Ribbon BTA Task Force organized to secure future funding for the BTA. Whether you’re into the urban lifestyle in Norfolk or Virginia Beach or the rural surroundings of Suffolk, you can visit from the convenience of your home, thanks to TBA’s new online video Web site, www.NewHome.TV. Launched this summer, the site already hosts over 40 videos that allow you to meet home builders, visit new home communities, meet Homearama builders and tour their homes. Videos are also available to realtors, mortgage companies and any other business that offers products or services needed by new home buyers. “It’s well established that online videos are only gaining in popularity,” said TBA President John Olivieri. “In this new housing environment, we need Over 40 videos are available for viewing at the newly designed www.newhome.tv. The first place they go is online, so it just makes sense to have your product available there.” Site visitors have come from not only Hampton Roads, but also from the Washington D.C. area, and all other parts of the country and the world. An Internet advertising campaign to attract online visitors is under way. Surfin’ the TBA Web site TBA’s Web site traffic is up over last year, with nearly 90,000 visitors (and over a half a million page views) through October 31, 2006. The total represents an average increase of 600 visitors per month over the same period in 2005. Earlier this year, TBA added a Web module to the TBA database to allow our online membership directory to be as current as possible. The Web module also allows visitors to search by company. The membership directory is one of the most visited sections to the site with nearly 3,000 visitors per month. Members can purchase a link to their own Web site, as well as a featured listing that places their name and company logo at the top of the category. Web banners that rotate throughout the site are also available to members. Read all about it! The monthly Tidewater Builder membership newspaper is available in a PDF format on the TBA Web site. In addition, TBA offers a twice monthly enewsletter update, Nuts and Bolts. December 2006 19 20 December 2006 The Tidewater Builder R E P O R T C A R D I S S U E Scholarship Foundation builds upon future for students With a groundbreaking for one scholarship house and a ribbon cutting for another, 2006 marked another banner year for the Tidewater Builders Association Scholarship Foundation. Since 1965, over $1.1 million dollars has been awarded to more than 330 students thanks to generous donations and fundraising efforts. In March, the Sadler Building Corp. broke ground on the 2006 TBA Scholarship House in the new Heritage Park community in Virginia Beach. Many people came out to support Ed Sadler and daughter Lauren at the groundbreaking luncheon for the first custombuilt home built to benefit the scholarship foundation. Vice Mayor Louis Jones and Va. Beach Schools Interim Superintendent Sheila Magula took part in the official ceremony attended by more than 50 people. In June, $85,000 in scholarship funds were awarded from the foundation. Academic scholarships in the amount of $50,000 were awarded to 10 area high school seniors ($5,000 per recipient) who demonstrated a financial need, academic achievement, and community involvement. In addition, the annual Young Designers competition awarded $6,000 in scholarships to six area high school drafting and design students along with awards to the schools with the greatest and second greatest number of entries totaling $4,000. Also, $25,000 was awarded to TBA’s Building Trades Academy to assist economically disadvantaged persons interested in learning a trade in electrical, plumbing, carpentry, HVAC or apartment maintenance. The second scholarship award breakfast was at the beautifully restored TowneBank in Downtown Norfolk, attended by over 120 people including Norfolk Mayor Paul Fraim and Norfolk TowneBank President Billy Foster who provided the welcome. Also, five area school superintendents and a number of principals and instructors were on hand to support the students. Dr. Robert Saul, a 1970 TBA scholarship recipient, and Trip Rice III, a 2006 University of Virginia graduate and 2002 TBA recipient, served as guest speakers. Even Joe Flanagan of WVEC found the event noteworthy enough to be featured on the evening news. With contributions from the builders and their contributors, the proceeds from the home brought $75,000. A generous portion of that contribution, $14,000, was given by East Beach Realty. City officials including Mayor Paul Fraim and Norfolk Schools Superintendent Dr. Stephen Jones participated in the August 30 ribbon cutting ceremony in Norfolk’s East Beach neighborhood. An outpouring of supporters attended to share in the celebration of this noteworthy event. Also, the TBA Scholarship Foundation received: • $3,000 from Raymond and Janice Key of Woodmasters, Inc. The TMHC Scholarship fund received: • $5,000 from Howard and Nancye Weisberg • $1,000 from S. L. Nusbaum • $1,000 and The Richard E. Tradition of giving continues A lot of heart and hard work goes into the construction of the Tidewater Builders Association Charity House. The 2006 Charity House The Charity House was built by Charlie Anderson of Charlie Anderson Builder Inc. along with the help of many generous contributors. Proceeds from the sale of the house will be donated to Children’s Hospital of The King’s Daughters during the annual CHKD telethon next spring. Proceeds from the annual Homearama Charity Gala will also be donated to CHKD. Since its first Charity House in 1988, TBA has raised more than $1 million dollars for local charitable organizations. More than $500,000 was raised for Boys and Girls Clubs of South Hampton Roads. MSA President installed as NSPE President The National Society of Professional Engineers (NSPE) installed Robert S. Miller III F.NSPE, from Virginia Beach, Virginia, as president for the 2006-2007 year, at the Society’s Annual Convention in Boston, Mass. Miller most recently served as NSPE treasurer from 2002 to 2005. Miller founded a Miller successful engineering consulting business, MSA, P.C., in 1973 and currently serves as president and chief executive officer. Miller has long been active in the engineering community, holding the offices of NSPE treasurer, NSPE Professional Engineers in Private Practice (PEPP) vice president, and serving on the NSPE Strategic Planning Task Force. He is an active member of both the Virginia 22 December 2006 Society of Professional Engineers (VSPE) and the Tidewater Chapter of VSPE. Miller is a 1967 graduate of Virginia Polytechnic Institute, with a bachelor’s degree in civil engineering. The Cosmopolitan Apartments received the Award of Merit in the Residential Development Category. Linxx Academy of Martial Arts in Virginia Beach received the Award of Merit in the Non-residential Development Category. The Planning Commission Design Awards Program was created to encourage and formally recognize creative and innovative development solutions for projects involving the built environment. The Hard Hat Academy was made possible through grants from the U.S. Department of Labor for the President’s High Growth Jobs Initiative and the Virginia Community College System. “In recent years, guidance counselors and parents have shifted from promoting work in the trades to their students and children to directing them more to the path of traditional higher education,” states Ainslie. “Part of the objective of this program was to remove the stigma attached to jobs in the building and construction industry by arming the counselors with important information that they can dispense to the students.” Teresa Bryant, Vice President for Workforce Development at Tidewater Community College and the TCC representative for the Hampton Roads Continued from page 1 Workforce Development Board praised Ainslie for his contributions to this project. “Many thanks goes to Jeff Ainslie and Ainslie-Widener Inc. for literally opening the doors of their company to these guidance counselors and exposing them to the broad range of possibilities that are out there for students.” The Building Trades Academy provides classroom instruction and hands-on training in the construction trades to students and is the only training program of its kind in the nation being offered by a home builders association. Funding for the program was drastically cut in 2006 and TBA was left searching for other funding options. While most funds for the 2007 fiscal year have been secured, funding for 2008 and beyond is still lacking. Did you know… The Tidewater Builders Association received a 2006 Award of Excellence from the Executive Officers Council (EOC) of the National Association of Home Builders for its Homearama 2005 partnership with the Norfolk Redevelopment and Housing Authority? TBA won for Best HBA Partnership/Coalition for partnering with NRHA to develop and promote a mixed-use affordable housing community in the Broad Creek neighborhood of Norfolk during Homearama 2005, resulting in greater visibility and sales for the agency.
