Golf (2012) Limited appeals part of the Thames-Coromandel District Council's
decision in respect of the Proposed Thames-Coromandel District Plan
(Proposed Plan).

Golf (2012) Limited made a submission and further submissions on the
Proposed Plan.

Golf (2012) Limited is the owner and operator of the Dunes Golf Resort at
Matarangi. The Dunes Golf Resort currently operates an 18 hole golf course
(the Site).
4.
Golf (2012) Limited is not a trade competitor for the purposes of section 308D
of the Resource Management Act 1991 (the Act).
5.
Golf (2012) Limited received notice of the decision on 29 April 2016.

The decision was made by the Thames-Coromandel District Council (the
Council).
The Council's decision
7.
The parts of the decision that Golf (2012) Limited is appealing are:
(a)
Section 50 - The Council's decision to rezone the Site (which was
previously zoned Recreation Passive under the Operative District
Plan) as Open Space;
(b)
Section 27.3 - The Council's decision to include part of the Site
(holes 1 and 2) within the Matarangi Structure Plan;
(c)
Section 54 - The Council's decision not to amend the Residential
zone provisions to allow the continued operation of the golf course as
a permitted activity on the Site; and
(d)
Planning Maps 12, 12A, 12B, 12C and 12D (the Planning Maps) the Council's decision not to amend the Planning Maps to show the
Site as Residential zone.
Reasons for the appeal

The general reasons for the appeal are that the Council's decision on the
Proposed Plan:
(a)

is inappropriate in terms of section 32 of the Act;

(b)
is inconsistent with the relevant regional planning instruments;
(c)
inappropriately addresses the potential adverse effects that might
arise as a result of development pursuant to, and constraints
imposed upon development by, the Proposed Plan;
(d)
will not promote sustainable management of natural and physical
resources and is not in accordance with the purpose and principles of
the Act;
(e)
does not represent the most appropriate way of exercising the
Council's functions, having regard to the efficiency and effectiveness
of the provisions, and in particular the assessment of the benefits and
costs of the environmental, economic, social, and cultural effects that
are anticipated from the implementation of the provisions; and
(f)
will mean that the Site is incapable of reasonable use in terms of s 85
of the Act.

Without limiting the generality of the above reasons, further reasons for the
appeal are set out below:
(a)
The proposed zoning of the Site as Open Space is unlawful as it
imposes a requirement on privately held land which limits its use to
an 18 hole golf course, for the public benefit.
(b)
The proposed Open Space zoning imposes significant constraints on
the use of the privately owned land and denies the owner reasonable
use of the land in terms of s 85 of the Act.
(c)
With the Golf Course zoned as Open Space, the Matarangi Structure
Plan
imposes onerous and
unreasonable restrictions on the
subdivision of land within the Open Space Zone.

Relief sought
10.
Golf (2012) Limited seeks the following relief:
(a)
that the Site be zoned Residential and not Open Space;
(b)
that the Residential Zone provisions (Section 54) be amended to
allow the continued operation of the golf course as a permitted
activity;
(c)
that the provisions of Section 27.3 (Matarangi Structure Plan) and
Section 50 (Open Space Zone) be amended by deleting all
references to the Matarangi Golf Course; and
(d)
that the Planning Maps be amended to show the Site as Residential
and any necessary amendments to be made to the Residential Zone
provisions in Section 54.

Golf (2012) Limited also seeks cost of and incidental to this appeal.
