Terms and Conditions
Al Shamil, landline, eLife
and Etisalat select services
1.Introduction
a) These Terms and Conditions shall govern
the sale and hire of all equipment
and services provided by Emirates
Telecommunications
Corporation,
hereinafter referred to as “Etisalat”,
in respect to the above services. The
party with whom Etisalat enters into a
contract shall hereinafter be referred
to as “Subscriber”. Further information
regarding the above services, prices and
packages available can be found at www.
etisalat.ae or by contacting the Etisalat
Customer Contact Centre on 101.
b) These Terms and Conditions shall be
deemed an integral part of the agreement
concluded with the Subscriber, where, the
Subscriber applies for any of the above
services.
2. The services
a) Etisalat shall provide its services as per
the applicable law and these Terms and
Conditions.
b) The Subscriber shall pay bills issued by
Etisalat for such services and shall comply
with these Terms and Conditions.
c) A Subscriber will usually subscribe to
a service by completing an application
form which will refer to these Terms
and Conditions. However, a Subscriber
may also have the option to subscribe
to a service or amend his subscription
through the Etisalat Customer Contact
Centre, Etisalat online services, Etisalat’s
telephone IVR system or Etisalat TV screen
menu. Such subscription or amendment
shall be legal and binding upon the
Subscriber with immediate effect, and in
all cases the Subscriber is deemed to have
accepted these Terms and Conditions.
d) The Subscriber shall be solely responsible
for and confirms the correctness of all
information provided to Etisalat at the
time of applying for a service or when
utilizing any of the services.
e) Etisalat reserves the right to reject
any request for subscription to any of
the services for any reason, whether
previously accepted by Etisalat or not,
including but not limited to the inability
or impracticality of providing a service or
if it finds out that information provided by
the Subscriber is incorrect or inaccurate.
f) The Subscriber should inform Etisalat
immediately if he changes his contact
details or any other particulars that may
affect the services.
g)The relevant minimum commitment
period for the service shall commence
from the date on which Etisalat activates
or makes available the service or part
thereof, or the date when the Subscriber
first starts to use such service, whichever
date is earlier. Upon the expiry of the
relevant minimum commitment period,
the contract for the service will be
automatically renewed on a monthly
basis and shall continue until either
the Subscriber or Etisalat terminates
the service.
The relevant minimum
commitment periods are set out in clause
11(a) (Minimum Period of Hire).
h)Upon subscription to any service
the Subscriber will be subject to any
acceptable use or fair use policies
published by Etisalat from time to time.
i) For the avoidance of doubt, Etisalat is not
responsible for material or information
contained in any third-party content
that is accessible through the services.
The Subscriber is solely responsible for
all content that it accesses or transmits
(whether by electronic communications,
voice or other means) and for determining
the suitability of all such content.
3. Access and wayleaves
The provision of Etisalat services is
conditional upon the Subscriber allowing
access at all reasonable times to Etisalat
employees in the execution of their
duty for the purpose of maintaining,
inspecting or recovering Etisalat plant
and equipment. The Subscriber agrees to
grant permission to Etisalat to run wires,
install devices, equipment (including but
not limited to routers, modems, gateways)
and erect poles on the Subscriber‘s
property through a suitable right-ofway to the extent that such equipment
is required to provide service(s) to the
Subscriber.
4. Commencement and Activation
a) These Terms and Conditions are in full
force and effect on and from the date
on which the procedure for purchasing
or subscribing to a service has been
completed and registered by Etisalat, such
date being the service commencement
date.
b) The service will be activated by Etisalat
as soon as is reasonably possible after the
procedure for purchasing or subscribing
to the service has been completed,
which may include the installation of
equipment.
c) Etisalat will use reasonable means to
notify the Subscriber when the service
has been activated.
5. Account Billing
a) Etisalat shall render monthly bills for all
applicable services.
b) Etisalat bills shall include past arrears and
any applicable charges.
c) Bills for the above Etisalat services
including any other supplementary
services must be paid to Etisalat within
14 days of the date of the bill or by
the second day of the month following
the date on which the bill was served,
whichever is later.
d) Any disputes which the Subscriber may
have regarding a bill must be brought to
the notice of Etisalat within 45 days from
the date of issuance of the bill by Etisalat,
otherwise, the Subscriber is deemed to
have accepted the bill.
e) If a Subscriber fails to pay his account
within the period specified above, Etisalat
may: (i) temporarily suspend service to the
Subscriber, without prejudice to Etisalat’s
right to recover any amount which may
be due at the time of suspension or
which may accrue during the time of
suspension; (ii) charge a late payment or
service restoration charge; (iii) take any
debt recovery action as Etisalat deems
appropriate; or (iv) terminate one or more
services upon written notice.
f) Migration of an account shall be deemed
an authorisation to Etisalat to transfer all
the Subscriber’s respective credits, dues
and obligations.
6. Rental and one-off charges
a) Rental charges are payable as per the
amounts mentioned in the bills that are
rendered to the Subscriber for the services
rendered.
b) Usage-based charges, may accrue from
the date and time of service activation
and are billed in arrears.
c) The Subscriber will be charged the rental
and usage prices stated at the service
commencement date. Thereafter any
price increases shall be notified to the
Subscriber upon 28 days’ notice.
d) Subscribers are also required to pay
standard one-off charges, such as a
connection charge or if applicable, a
disconnection charge. Such charges are
advertised or otherwise can be obtained
by the Subscriber by contacting Etisalat
Customer Contact Centre.
e) Rental and usage charges are applicable
during temporary-out-of-service periods
or planned outages which are advertised
in local media, on the Etisalat website
(www.etisalat.ae), or otherwise notified.
A rental rebate is only applicable in
the event the service is completely not
available for a period of one month.
7. Advance payments and
deposits
a) Etisalat reserves the right to collect an
advance payment to cover the cost of
connection and rental, calls or otherwise,
before a service is provided.
b) Etisalat may also collect deposits from
applicants and carry out such checks on
credit references as it deems necessary.
c) Deposits may also be requested before
any service is re-connected following
earlier disconnection due to late payment
of accounts.
d) For certain postpaid services, Etisalat may
limit usage by providing a credit limit to
the Subscriber
8. Etisalat equipment
a)Unless provided otherwise, Etisalat
equipment made available to the
Subscriber as part of a service shall
remain the property of Etisalat, and must
be returned to Etisalat when the service
ends.
b) Subscribers are liable for the cost of any
calls /usage made from or use of the
equipment whether with or without their
knowledge or permission and are liable
for loss or damage to Etisalat’s equipment
beyond fair wear and tear. It is therefore
advisable for Subscribers to include
Etisalat equipment in their insurance
policy.
c) The Subscriber shall not attempt to
install (unless authorized to do so), repair,
modify, or in any way interfere with the
Etisalat equipment (or any words or labels
on the Etisalat equipment), nor permit
an unauthorized third party to do so.
If maintenance or replacement of the
Etisalat equipment is required as a result
of misuse or neglect of, or accidental or
wilful damage to the Etisalat equipment
by the Subscriber, or due to noncompliance with Etisalat instructions,
then Etisalat reserves the right to charge
the Subscriber double the cost of repairs
for such equipment for such maintenance
or the replacement cost, and or take
further action as stipulated in these
Terms and Conditions. Etisalat shall
only be bound to carry out any repair or
replacement if the Subscriber undertakes
in writing not to mishandle or abuse the
equipment any further. Etisalat shall
decide at its discretion whether to repair
or replace any faulty equipment.
d) The responsibility for reporting any fault
with Etisalat equipment rests with the
Subscriber.
e) The Subscriber shall be liable for any loss
or damage to the Etisalat equipment and
Etisalat network resulting from the use of
any equipment or products in conjunction
with Etisalat equipment or connecting
to Etisalat’s network using equipment or
products not approved by Etisalat.
f) Where applicable, the Subscriber is
responsible for making available a
constant electric power supply to the
Etisalat equipment. For example, the
Subscriber is required to provide constant
electrical power to the optical network
device in their property, failing which,
the entire fibre-to-the-premises access
network technology may fail. Etisalat
does not guarantee the continuity of the
fibre-to-the-premises network. In order
to mitigate fibre-to-the-premises service
failure due to power interruption, battery
back-up systems can be separately
acquired by the Subscriber.
9.
Subscriber
addresses
numbers
and
a) Any telephone number, short codes,
domain name, internet protocol address
(dynamic IP or static IP), email address
or hostname assigned to the Subscriber
by Etisalat may be changed, withdrawn
or reassigned at any time in the sole
discretion of Etisalat.
b) The Subscriber agrees for Etisalat to put
the Subscriber’s number into a telephone
directory and make it available from
Etisalat’s Directory Enquiries service until
such time as the Subscriber may instruct
Etisalat otherwise.
10. Intellectual property
The intellectual property in Etisalat’s products,
services, TV channel packages, trademarks and
in all forms of content created, acquired and/
or distributed by Etisalat including directories,
is owned and/or licensed by Etisalat. Such
intellectual property and content may not be
reproduced, redistributed or resold without
the prior written permission of Etisalat.
11.Minimum period of hire
a) Unless otherwise determined by Etisalat,
the minimum commitment period of
hire for telecommunications services
commencing from the date of activation
or first use (whichever is earlier) shall be
as follows:
• eLife Value Packs : 24 months (Fibreto-the-premises)
• Telephone for home and paging
services: 3 months
• Telephone for business: 1 month
• Webfax, ISDN BRI, ISDN PRI: 3
months
• Leased circuits: 1 month
• Frame Relay, ATM service and
Connect over copper cable: 1 month
• IP Connect, Frame Relay, ATM, 12
months over FO cable and eCentrex
Cable TV service: 3 months
• VSAT voice service: 6 months
• VSAT data services: 12 months
• Etisalat Select services for business:
12 months
• eLife – Single Play : 12 months ;
Double Play: 12 months ; Triple Play:
24 months
• Premium or other non-basic TV: 3
months
• Al Shamil: 12 months
b)Notwithstanding the reasons for
premature disconnection or termination
of the service, the Subscriber shall always
remain liable for the rental and/or other
Etisalat charges as if he had utilised the
full applicable minimum commitment
period.
c) Each Subscriber subscribing to Al Shamil
or eLife Single Play services is entitled to
a discounted price conditional upon the
Subscriber’s commitment to keep his
subscription activated for the minimum
period of hire, being not less than 12
months from the date of activation of
the connection. Similarly eLife Triple
Play Subscribers shall be entitled to
a discounted price conditional upon
keeping the subscription activated for
the minimum period of hire, being not
less than 24 months from the date of
the activation of the connection, as a
fresh connection or upgrade/downgrade
or migration. In the event the Subscriber
fails to comply with the minimum
period of hire requirement or should the
Subscriber desire to cease the service
before the expiry of the minimum period
of hire the Subscriber will have to pay
an administration fee together with the
outstanding cost of any device provided
prorated for the remaining contract
duration. Further information regarding
the above charges can be found at
(www.etisalat.ae) or by contacting the
Etisalat Customer Contact Centre on 101.
d) eLife Triple Play Subscribers are required
to keep their subscription unchanged for
the first 12 consecutive months following
subscription, out of the total contract
duration of 24 months. They can change
their subscription to other eLife Triple
Play packages after completing the 12
months subscription period as per the
applicable upgrade / downgrade charges.
e) The provisions of the last item apply also
when the Subscriber changes the type
of his subscription defined under these
Terms and Conditions.
This same item shall also apply when the
Subscriber fails to settle the amounts
outstanding against his subscription and
upon disconnection of his line(s) due to
such non-settlement or due to any breach
of the Terms and Conditions of this
document including but not limited to
delayed settlement beyond credit period,
cease of service under a court order or
based on an official body’s request or
service disconnection owing to violating
any of the provisions of these Terms and
Conditions.
f) In the event there are any temporary-outof-service periods during the minimum
period of hire, such temporary-outof-service periods shall not be deemed
part of the minimum period of hire,
accordingly the minimum period of hire
shall be automatically extended to cover
the temporary-out-of-service periods.
12.Etisalat Select Service
a) To subscribe to Etisalat Select Service,
the Subscriber must have a landline
telephone service from another UAE
telecommunications service provider
which line shall be:
• registered in the Subscriber’s name;
or
• registered in the name of another
Subscriber who is authorising the
Subscriber to subscribe to Etisalat
Select Service.
Etisalat has the right to terminate the
service immediately, if it discovers that
the Subscriber has provided information
that is inaccurate.
b) The Etisalat Select Service can be used
in two ways: (i) by dialling the Etisalat
Select prefix code (08877) before calling;
or (ii) by using an auto-dialer device.
c) The Subscriber shall be responsible for
all calls made using the Etisalat Select
Service from the Subscriber’s defined
landline number. Etisalat will either bill
the Subscriber separately for these calls,
or include the charges for these calls in
any other account the Subscriber has
with Etisalat.
d) The Subscriber will remain liable to the
landline access provider for line rental,
and any calls and services provided by
the landline access provider which are
not part of the Etisalat Select Service. It
is the Subscriber’s responsibility to advise
Etisalat in case of a change to the landline
number. Failure to do so will not release
the Subscriber from its responsibility to
pay all call charges.
e) The Subscriber shall report any fault,
shortcoming or inadequate service to
Etisalat Subscriber Contact Centre.
However, where such fault, shortcoming
or inadequate service arises from the
Subscriber’s landline network or is not
attributable to Etisalat Select Service,
the Subscriber will be responsible to
refer the matter to the landline service
provider. Etisalat shall not refund charges
in such circumstances and shall not be
responsible for faults reported or referred
to the other landline service provider.
13.Television content and
packages
a) Etisalat provides many hundreds of TV
channels which are available through its
various packages offered under its eLife
services. Etisalat may, under prescribed
guidance, monitor the content of the
TV channels presented and at times
block or censor images or audio that
are considered inappropriate under local
standards. Subscribers are nonetheless
advised to further monitor TV content
for their own preferences and utilise
the available PIN-based parental control
features included in the TV set-top boxes
provided. Additional advice on TV content
is available on request from Etisalat
Customer Contact Centres.
b) TV packages selected by Subscribers may
be changed by Etisalat without notice.
Pay Per View and Video On Demand
are not part of any packages and are
chargeable separately.
14.Disconnection, Termination
and claiming compensation by
Etisalat
a) Etisalat reserves the right to claim
compensation and/or suspend or
terminate at any time one or more
services rendered to the Subscriber,
whether rendered under one or more
contracts, if the Subscriber shall:
(i) delay payment of Etisalat charges in
respect of any or all service contracts
with Etisalat. Non-receipt of a bill
shall not constitute a valid reason for
non-payment;
(ii) install (without authorization), repair,
modify, or in any way interfere
with any Etisalat equipment or any
internal circuit or other component
of such equipment, or without first
obtaining Etisalat’s written authority,
cause or permit any attachments to
be made to, or anything to be placed
in electrical contact with, or to be

used in such a manner or position
in relation to Etisalat equipment
that transmits messages or other
communications to or from such
equipment;
(iii)
fail to return in a reasonable
condition,

equipment,
provided on loan for the purpose of
receiving services such as, optical
network terminals, TV set-top boxes,
modems, routers, gateways etc;
(iv)
use Etisalat’s telecommunications
system in a manner which is contrary
to public morals, the religious values,
social or moral welfare of the UAE,
or is prohibited by law. For example
Subscribers must not use Etisalat’s
telecommunications network to
bully, intimidate or harass others, use
profane language, carry out malicious
or fraudulent activities or infringe
third party rights or privacy;
(v)unreasonably monopolise local line
facilities; or
(vi) in the opinion of Etisalat, commit any
breach of these Terms and Conditions.
Without prejudice to the above, Etisalat
reserves the right to terminate one or
more services for any other reason, upon
providing the Subscriber 30 days’ notice
in writing. In this case, no termination
fees will be payable.
Notwithstanding the above, Etisalat may
suspend, disconnect or terminate the use
of one or more services, with or without
notice and without exposing itself to
any liability, at any time, in the event
that Etisalat is required to do so under
any applicable laws or regulations, or
under any other regulatory requirements,
or upon request by Government or
regulatory or security or other competent
authorities.
Etisalat will notify the Subscriber prior
to any disconnection or termination of
the service(s), and, where possible, will
provide details of what the Subscriber
can do to avoid such disconnection or
termination.
Reconnection of any service which has
been disconnected will only be possible,
at Etisalat’s discretion, after (i) any
outstanding charges have been paid and
(ii) the Subscriber is not in breach of these
Terms and Conditions.
15.Disconnection by the
Subscriber
a) Unless stated otherwise, Subscribers are
required to give at least 30 days’ notice
in writing if they wish to disconnect any
service. However as explained above,
additional charges will apply in the event
such disconnection takes place during the
minimum period of hire. Normal rentals
are applicable during the notice period.
b) If the Subscriber cancels a service order
after work has started on the provision
of the service, the Subscriber shall pay
Etisalat the costs of such work. Etisalat
may alternatively deduct these costs from
any advance payment or deposit which
the Subscriber may have paid towards the
provision of the service or from any other
entitlement which Etisalat must pay back
to the Subscriber.
c) Where the Subscriber terminates any
accounts with Etisalat, he will not be
entitled to a refund of any prepaid
amount(s). However, the Subscriber
may transfer the same to another one
of his accounts or to the account of a
third party. If Etisalat terminates the
Subscriber’s account for any of the
reasons specified in Clause 15(a), any
prepaid amounts paid by the Subscriber
will be forfeited.
16.Transfer of service from one
Subscriber to another
Services are provided by Etisalat for the sole
use of the Subscriber. The Subscriber may
not transfer services or use of such service
whether temporarily or permanently, to a
third party without the prior approval of
Etisalat in writing.
17.Limitation of Liability
a) Subject to the rest of the provisions
in this Clause (Limitation of Liability),
the liability of Etisalat (including its
employees, agents or sub-contractors)
to the Subscriber arising in connection
with the service under any legal construct
shall be limited to: (i) per event or series
of connected events, the amount of
the charges paid by the Subscriber and
received by Etisalat in respect of the
particular service that is the subject
matter of a claim in the 3 month period
immediately preceding the event in
which any such liability accrued, or
where the particular service at the time
of the event of loss has been provided
for a period of less than 3 months, three
times the monthly rental charge; and (ii)
a maximum aggregate liability in any 12
month period of 30% of the total amount
of the charges paid by the Subscriber and
received by Etisalat during such 12 month
period.
b) Etisalat shall not be liable to the
Subscriber, for any loss of business, loss
of business opportunity, loss of revenue,
loss of profits, loss of anticipated savings,
loss of goodwill, business interruption,
wasted expenditure or for loss of any
other economic advantage however
it may arise, or for data loss or data
corruption, or for any indirect, punitive,
special, incidental or consequential loss
suffered by the Subscriber.
c) Etisalat shall not be liable to the
Subscriber:
• for temporary non-availability of
Etisalat’s network;
• for loss, late receipt or non-readability
of any message or communication;
• for any defects, malfunctions or
delays connected in any way with the
provision or use of content;
• for any order from third parties made
by a Subscriber using the services;
• for failure to provide a service due
to unforeseen reasons or reasons
beyond the control of Etisalat;
• for unauthorized access to or theft,
alteration, loss or destruction of the
Subscriber’s applications, content,
data, network or systems; or
• for errors, omissions or other
irregularities in the listing of directory
contents.
d) The Subscriber is liable for loss or damage
to Etisalat resulting from the use of any
equipment, products or programmes
which are not approved or used in a
manner not approved by Etisalat.
e) This Clause (Limitation of Liability) shall
survive the premature cancellation,
termination and/or expiration of the
services.
18.Amendments
a) Etisalat reserves the right to change,
amend or reproduce these Terms and
Conditions from time to time. Any such
change, amendment or reproduction shall
immediately be binding on the Subscriber
from the date on which they are issued by
Etisalat on its website (www.etisalat.ae).
A copy of these Terms and Conditions
may also be obtained from any Etisalat
Business Centre or via the Etisalat
Customer Contact Centre.
b) Etisalat reserves the right to amend its
charges from time to time, provided that
any increase in charges is notified to the
Subscriber with a minimum of 28 days’
notice prior to such revision. During such
notice period the Subscriber shall have
the opportunity to cancel the affected
service(s), without penalty before any
applicable price increase takes effect.
19.Subscriber queries, complaints
and information
a) The Subscriber may contact Etisalat by
attending any Subscriber service centre
located throughout the UAE or calling the
Etisalat Customer Contact Centre on 101
for information about prices, conditions
and options available to it under any
service, for clarification regarding a bill or
to make a complaint.
b) Etisalat will use reasonable endeavours
to resolve any complaint and keep the
Subscriber updated as to the status of the
investigation into the complaint.
c) Etisalat will consider the Subscriber to
have received notices from Etisalat if
Etisalat contacts the Subscriber at the
given postal address, e-mail, fax, any
other form of electronic communication
(including SMS) or by providing a
message in the Subscriber’s bill.
d) All legal notices served by the Subscriber
under these Terms and Conditions shall be
in writing and sent to Head of Contracts
Department, Etisalat, P.O. Box 3838, Abu
Dhabi.
e) The Subscriber agrees that Etisalat or its
affiliates may contact the Subscriber by
mail or by electronic means (telephone
call, fax, email, SMS etc.) with information
about goods, services, promotional offers
and other marketing communications
which Etisalat feels may be of interest
to the Subscriber. At any time if the
Subscriber would prefer to stop receiving
such information from Etisalat, the
Subscriber may use the ‘unsubscribe’
option included in the message (where
applicable) or contact the Etisalat
Customer Contact Centre. Furthermore,
the Subscriber gives Etisalat the right
to disclose the personal information of
the Subscriber to third parties for the
purposes of providing the service, credit
checking, security, fraud prevention or
identity verification purposes.
20. Subscriber Information
a) Before subscribing to a Service, the
Subscriber must satisfy Etisalat’s
customer identification requirements.
b) The Subscriber should inform Etisalat
immediately of any change to their
contact details.
c) Etisalat’s Privacy Policy applies to these
Terms and Conditions. Where there is
any discrepancy between these Terms
and Conditions and the Privacy Policy,
the Privacy Policy shall prevail. A copy of
the Privacy Policy is available on Etisalat’s
website.
21.Network Interruptions
a) The Subscriber acknowledges that Etisalat
cannot guarantee a fault-free service
and that the quality of service may be
affected by factors outside of the control
of Etisalat.
b) The Customer acknowledges that from
time to time Etisalat may carry out
maintenance or testing of its network,
which may cause temporary service
outages.
c) During both planned and unplanned
outages, Etisalat will try to keep the
period of disruption to a minimum.
22.Share, resale and transfer of
the services
Services are provided by Etisalat for the
sole use of the Subscriber. The Subscriber
may not share, resell, transfer or otherwise
commercially exploit the services (whether
with or without consideration and whether
temporarily or permanently), without the prior
written approval of Etisalat.
23. Governing Law and Dispute
Resolution
These Terms and Conditions, and any issues or
disputes of whatever nature arising out of or
in any way relating to them shall be governed
by the laws of the UAE and the parties submit
to the exclusive jurisdiction of the courts of
the UAE.
