PROTECTING THE INJURED
No one wants to be involved in a serious automobile
collision, but when it happens to you or your family, it
is important to know and understand your rights.
PROTECTING THE INJURED
When it comes to automobile collisions Colorado is
no longer a “No Fault State” and therefore proving
fault absolutely matters. This means that it may be
important to preserve evidence even in situations
when you think fault seems clear. Here are some
other important rights that you should know:
1. You are not required to speak to or give statements
to the other driver’s insurance company.
2. The person who caused the collision or is “at
fault” (and their insurance company) is financially
responsible for ALL injuries, damages and losses
caused by the collision.
3. If you are injured and the at fault driver’s insurance
company attempts to settle with you in the first
thirty (30) days after the collision - that company is
breaking the law and any settlement entered into
during this time period is probably not valid under
Colorado law.
4. Recoverable injury losses may include the
reasonable value of related medical treatment
(even if you have health insurance), wage loss and
future earnings (even if you use sick or vacation
time), as well as compensation for pain, suffering,
loss of enjoyment of life and physical impairment.
Beyond the property damage, the medical costs and
loss of income – the emotional stress, financial distress
and concern over the claims process can simply be
overwhelming, all at a time when the health of the
person injured should be the primary concern.

WHY CHOOSE
BACHUS & SCHANKER
ABOUT THE FIRM
HUMBLE BEGINNINGS: Kyle Bachus
and Darin Schanker started their law
firm in a 10 feet by 10 feet office
a decade and a half ago with a
straight forward yet simple goal: To
provide individuals with a level of
representation usually reserved for
only the most powerful corporations.
FAST-FORWARD: Today, Bachus
&
Schanker’s
goal
of
elite
representation feels realized. The
firm is now made up of 14 trial
lawyers and nearly 50 total firm
members. With offices in Denver,
Fort Collins and Colorado Springs,
Bachus & Schanker has represented
thousands of clients across the
country. The firm’s 21,000 square feet
Denver office has a full courtroom,
with state of-the-art focus group
facilities. Hardly a week goes by
when a jury project is not being run
on site.
No two personal injury cases are exactly the same and the firm’s
attorneys and staff are committed to giving each case and client
the personal attention they deserve.
SERVICE: The firm prides itself on treating every potential client
with dignity, respect, and concern. Many of their staff have
experienced what clients go through and understand how this
single event is life changing. The firm’s attorneys and staff are
there to help!
STRENGTH: Bachus & Schanker, LLC, was founded to help level
the playing field - the goal was to give personal injury victims and
their families the resources available to take on the powerful by
providing access to legal services and a level of representation
previously available only to large corporations. Bachus & Schanker
is committed to using knowledge, innovation and resources to
achieve justice.
REPUTATION: Named to The Bar Register of Preeminent Lawyers as
one of “The Most Distinguished Law Firms in America” for Personal
Injury Law. Named to “Top 500 Personal Injury Lawyers in America”
by Lawdragon. Designated Colorado Super Lawyers for Personal
Injury Law, 2007, 2008, 2009, 2010, 2011, 2012 & 2013. Awarded
the “Highest Attorney Rating for Ability and Ethics” by Martindale
Hubbell.
THE RESULTS YOU DESERVE
In the past four years, the firm has achieved more
than $110 million in verdicts and settlements on behalf
of their clients.
JUDGMENTS, SETTLEMENTS & AWARDS:
$9.4 Million
Motor Vehicle Collision
$8 Million
Motor Vehicle Collision
TRIAL EXPERIENCE: Many firms advertise that they handle cases
like yours but only a few actually litigate cases and are willing to go
to trial when necessary. That is because most car crash cases can
be successfully settled through the work of a law firm negotiating
directly with the insurance companies involved. However, when
selecting a firm, the willingness to go to trial when necessary is
important because the insurance companies know what firms will
actually do whatever is necessary to achieve full compensation.
$4.2 Million
Motorcycle Collision
$4 Million
Semi-Truck Collision
$3.85 Million
Dangerous Property
$3.25 Million
Motor Vehicle Collision
$2.1 Million

RESOURCES: Pursuing complex and difficult litigation can require
both financial and technological resources. Bachus & Schanker
has invested in state-of-the-art technologies and infrastructure for
case and trial preparation. The firm is well equipped to handle
complex cases against well-funded opponents.
