Will Fired Texas City Cop Get His Job Back?

TEXAS CITY - The arbitration hearings
in the case of fired Texas City police officer Darren Allen is over, but it may be
6-8 weeks before Allen finds out if he
will ever be back in a Texas City Police
uniform.
Allen appealed his firing by Chief
Robert Burby on multiple charges primarily that he assaulted a policewoman
in her home while the two were there
while on duty.
As previously reported online, only
by The Police News, Allen and officer
Eulalia Irene Authorlee had responded
to a call together, in separate cars, and
afterward went to her nearby home.
There are two sides to what happened
there. Her side resulted in a criminal
assault charge being filed against Allen
which was later dismissed.
Allen was represented by Houston
Attorney Bob Thomas, a former Houston Police Sergeant, now employed by
CLEAT (Combined Law Enforcement
Associations of Texas). The Texas City
Police Department was represented by
attorneys Carla Cotropia and Charles P.
Dunkel, Jr. of the Houston law firm Mills
Shirley, hired by the city. City Attorney
Ron Plackmeier also participated.
Thomas sought to prove that Burby
and his investigators conducted a sloppy
investigation of the incident, ignoring
established police department policies
and procedures, instituted by Burby,
with an aim toward reeking vengeance
on Allen and setting him up as an example.
Cotropia, as lead counsel for the city,
suggested to arbitrator Diane Dunham
Massey of Sugar Land that Allen followed Aurhorlee to her home, parked
his patrol car inside her garage and went
inside where she was in the bathroom.
When she came out of the bathroom she
claims there was some unwanted touching of her by Allen and she slapped him.
That’s where the assault charge came
from. Allen claims he grabbed her hand
after the slap and held it down. She
claims he twisted her arm behind her
back injuring her.
On occasions Massey cleared the
room of spectators when there were discussions of similar incidents involving
other officers which resulted in lesser
punishment than termination. Spectators were asked to leave the room to
protect the identity of those officers.
The hearings have been conducted
in the Media Room of the Doyle Convention Center. The room was filled
with Allen family members, including
Darren Allen’s father, retired Galveston County Chief Deputy Sheriff Donald Allen, and his brother, a Galveston
County Constable’s Deputy. Darren Allen testified that at one time the Allen
family had 20 relatives in law enforcement in Galveston County. There were
also representatives of the Texas City
Municipal Police Association and the
NAACP present, observing.
A point surfaced throughout the hearings that officer Authorlee was a lone
woman officer who worked with, socialized with, and was surrounded by
mostly male officers, on and off duty.
There was testimony she joked, talked
and acted like “one of the guys,” but
there came a time when being “one of
the guys” was apparently too much for
her.
Allen claimed he was invited into
Authorlee’s home to observe some recent remodeling. She had been passing
photos of the home around to other officers depicting the recent remodeling
and decorating. Allen was interested
because he and his father have a home
remodeling business and additionally,
he had looked at the home as a prospective buyer before Authorlee bought it.
He wanted to see the improvements she

Basically the story of what happened
inside Authorlee’s home is “he-said,
she-said”. Clear violations, according
to the city, is the fact they were out of
their police cars, in her home, while on
duty, and had not notified dispatch of
their status.
Lawyers for both will review transcripts and file final pleadings with
Massey who will later make the final
determination of whether or not Allen
returns to the ranks of the Texas City
Police Department.

Starting Salary: $35,407.45/yr
Applicants must have a Basic TCLEOSE Peace Officer certification by date
of conditional offer of employment. Applicants with 60 college hours from
an accredited college or university, will be preferred. A minimum of 2 years
qualified street experience with a municipal, county, or state law enforcement agency is preferred, but is not required. Successful applicants must
pass a written entrance examination, comprehensive background investigation and physical assessment. Essential Job Requirements will be posted at

Two still sought in
11-year old Galveston
murder
On June 18, 2001, in the early morning
hours after Father’s Day, Mario Espinosa was brutally murdered at the front
door of his home in Galveston .
Four people were subsequently indicted for his murder, a murder that the evidence showed to have been committed
for the promise of money, money to be
paid by Jose Pablo Lopez.
Two of the four were convicted and the
other two accused, Jose Pablo Lopez and
Elisandro Salinas, remain on the run.
Authorities believe Jose Pablo Lopez
was the mastermind of the murder for
hire and the individual that promised to
pay the killers money in exchange for
the murder, and Elisandro Salinas provided the weapons.
It has been more than nine (11) years
since this senseless murder and we will
never stop in our efforts to bring those
responsible for the death of Mario Espinosa to Justice, said Galveston County
District Attorney Kurt Sistrunk in a
2009 interview.

Texas City teen
jailed on Capital
Murder charge
TEXAS CITY - Cory Percy Becton, 19,
initially charged with murder in a Jan.
24 shooting in Texas City was back in
Cory Percy Becton
jail in February after the charge against
him was upgraded to Capital Murder.
The indictment accuses Becton of
shooting Danzel Campbell, 21, while in
the course of burglarizing his home in
Texas City .
A warrant was issued for Becton on
the capital murder charge, and deputies
rearrested him.
District Attorney Jack Roady said
there has not yet been a determination
on whether or not to seek the death penalty.

The California Board of Parole is
considering releasing cop-killer Gerald
Youngberg from prison on compassionate parole

In 1973, San Bernardino County Sheriff’s Lt. Al Stewart was shot to death by
Gerald Youngberg who had also killed
CHP Officer Larry Wetterling and a gas
station attendant. Youngberg was sentenced to death but his life was spared
when the California Supreme Court declared the state’s death penalty unconstitutional.
Lt. Stewart, who was accompanied by
a San Bernardino County deputy DA,
was on the way to a narcotics task force
meeting in Barstow when he heard about
Youngberg’s crime spree on the police
radio. He made a quick detour – it turned
out to be a fatal one - to assist his fellow
officers in trying to apprehend a ruthless
cop killer.
Al Stewart and I not only worked together on a number of narcotics cases,
but he was also one of my very closest
and best friends during the time I lived
in California . We bonded immediately
the first time we met because he had
come from New Jersey and I had lived
in New York for a number of years.
Youngberg is being considered for
release on compassionate parole at a
Board of Parole Hearing in March at
High Desert State Prison in Susanville.
No one is less deserving of compassion
than this ruthless cold-blooded cop killer. This vermin should never be allowed
to leave prison in anything other than a
pine box. I would consider it a personal
affront if the California Board of Parole
were to release that worthless piece of
excrement from prison for any reason
whatsoever.
That is why I am now pleading with all
of you to please write to the authorities
listed below and demand that, in the interests of justice, Gerald Youngberg not
ever be granted any type of parole. Even
if you do not live in California , please
take the time to write and let the Board
of Parole know that you are opposed to
any parole for Youngberg.

Former parole
officer claims
termination from
TDCJ due to race
GALVESTON – A former parole officer
is suing the Texas Department of Criminal Justice for terminating her because
of her race.
Galveston resident Ellen Mae Burton
filed suit against TDCJ on Feb. 19 in
the Galveston Division of the Southern
District of Texas. Burton , who is white,
alleges she experienced disparate treatment compared to her African American co-workers.
According to the suit, Burton began
working for TDCJ in February 2004 and
was employed as a specialized officer
who oversaw the sex offender caseload.
In early 2012, TDCJ claims Burton
used her authority as a parole officer to
have a parolee sign temporary custody
of her son over to a foster mother.
TDCJ disapproved of Burton interviewing the offender’s minor child
without representation however she insists her actions were at the direction of
the Galveston County Sheriff’s Office
Sex Offender Compliance Unit and that
she also worked with Children’s Protective Services. The boy needed to be in
a safe place pending the arrest of his
mother, Burton said.
Burton asserts TDCJ failed to properly investigate her alleged violations and
used them as “a mere pretext to have her
terminated.”
Meanwhile, several non-white parole
officers at the Webster office committed “more serious” acts of wrongdoing,
but were not disciplined as seriously as
Burton , she claims.
A disciplinary hearing was held on
March 2, 2012, in which TDCJ moved
to terminate Burton . She claims she
submitted a resignation letter but it had
“no effect on the negative entry into her
permanent employment file.”
Burton alleges the defendants acted
against her as an act of retaliation.

The body of Benjamin Earl Stanford, 25, reported missing
from Dickinson
was located the
morning of Feb.
22, in a wooded area in the
3000 block of

Detectives said it appeared Stanford
had taken his own life.
The Galveston County Medical Examiner made positive identification and
performed an autopsy to determine the
exact cause of death.

tried to avoid arrest by giving officers a
false name or identification.
