"At the meeting of the Development Services Committee held. on Thesday

instructed at the meeting, the Director of Administration has made
enquiries of the General Manager of the Telford Development Corporation
and it would seem that they would not be embarrased if the party were
to number the same size as that made up by Rayleigh on the visit to

AIM OF DOCUMENT
This
was a collection of all the old Essex County Council Planning Policies
when they were the Thcai Planning Authority and was offered with the
suggestion that the District Council might think it worthy of adoption to
fill the policy vacuum created by kcal Government Re—organisaticn.

LOCAL PLANS
These were now the responsibility of the District Council.
STRATEGIC PLAN
It was intended that this would be produced by 1981 up to which time the
current Development Plan would remain effective.
INTERIM COASTAL PROTECTION POJJICIES
The
County Council Officers confirmed that
the
River Roach up to Rochford
was now, again, included in the protected area as was the area of Maplin.
CONSERVATION ,&REIAS
(a) General — Concern was expressed by several Councillors as to whether,
in some circumstances, the creation of a conservation area was not self—
defeating because owners, unable to develop as they wished, allowed
properties to deteriorate. County Council Officers referred to the provision
for service of Building Preservation Notices requiring the execution of work
in the event of the non—compliance with which the appropriate authority
could compulsorily acquire and carry out the wot themselves.

West Street via Roche

West Street — All agreed on the desirability of the closure to all traffic
and Councillors again expressed disappointment at the refusal of the County
Council, as Highway Authority, to ban buses as a first stage.
(c)
(d) Market Square, Rochford — As a preliminary to the closure of West Street
traffic it was suggested that the Square itself be closed to all except
delivery vehicles.
I1ETROP0LITAM GBEE& BELT
A Member urged a re—think oh the retention within the Belt of areas of
scrubland.
•
MAFLIN
The opinion was expressed that there should be two Stru.ctutePlans, one with
?kplin and one without, but tins was not thought practicable If Maplin
was proceeded with there would be 300,000 people to accommodate and a lange
number of incidental jobs. The whole pattern and quantity of development
would be different if there was no airport.
GENERAL
A Member said there was a need to think on a larger scale and not to be
satisfied with piecemeal infalling. The Planning Authonties should be
considering large developments with associated social and other services
provided concurrently.
CONCLUSION
The Chairman thanked the County Council Officers for attending what he
felt was a useful meebing saying that this seemed to be the right way to
deal with such a document0

CREATION OP PUBLIC FOOUflTH FROM KE]SWICK AVENUE
TOQQLS IIRIDGL
367 The Director of Administration reported as follows:—
"The Secretary of State for the Environment recently confirmed without
modification, the Rural District Council of Rochford (Keswick Avenue
to Pooles Lane, Hullbridge) Public Path Creation Order 1972, made
under Section 28 of the Riglniays Act l959 The path created by the
Order became available for public use as from 31st March, l974
257
a
W
Development Services Committee
The Rural Council anticipated that the path would be heavily used,
being a direct connection between a large housing estate and the
Council's playing field, and surfaced it with rolled hoggin suitably
blinded with ash and provided a childrens' safety barrier at the
northern end of the path. The path follows the western boundary
of watercourses throughout almost all cf its length, the fields which
border the western edge of the footpath being open meadows. The
principal landowner concerned has recently submitted his claim for
compensation under Section 31 of the Highways Act, 1959 which includes
£941.00 for the erection of a fence along the field side of the
footpath, principally to prevent trespass from the footpath onto
the ield and £775.00, the capitalised cost of maintenance of the
fence. These items were included in the landowner's claim, because
I have so far resisted his request that the Council themselves
provide the fence0 I have taken this action on the grounds that the
Council have no obligation, either statutory or moral, to provide
a fence and also because I do not wish to see the footpath fenced
off from the rest of the field, which would have the effect of
creating a narrow alleyway along the edge of the field. It is my
now that the question of trespass from the footpath onto the landowner's open field is surely a matter for him to take such action
as he feels necessary.
The Council are members of the Commons, Open Spaces and Footpaths
Preservation Society and, since I was still being pressed on behalf
of the Council to provide this fencing, I sought their advice. This
has recently been received to the effect that, as a general practice,
fencing is not normally included in the cost of compensation, although
it is conceivable that there may be cases where this would be justified,
e.g. where a new path passed through an orchard0 Since, however, the
fields in question are open meadows, the Secretary of the Society
felt that there were no obvious grounds for the necessity of fencing0
He concluded that the Council should resist the landowner's claim,
before the Lends Tribunal if necessary, and argiae that the proper
enjoyment of his adjoining land is not diminished by the provision
of
a path without fencing0
Members will be aware of the many public footpaths which pass through
open fields without being separated from them by fences and, since
I ant of the view that it cannot clearly be shown that the cost of
such fencing could be properly included in the owners claim for
compensation, I oannot recommend the Council to provide it0"
Resolved that the claim for compensation submitted under Section 31
of the Highways Act 1959 in relation to the creation of a public
footppth from Keswiok Avenue to Pooles Lane, Hullbridge on behalf
of Mr. R.C. Beckwith be resisted on the grounds that the Council
have ho obligation either to provide a fence or to meet its ccst (474)

"The Øcunty Planner has recently sent copies of a report submitted

Development Services Committee
The report concerns sand and gravel extraction in Essex and leads to
a recommendation for the adoption of the following policy dealing with
applications for sand and gravel extractiona:
"That in addition to the general minerals policy set out in the Written
Statement (Part IV, Paragraph 35), the following matters be taken into
consideration:—
(a) Regard will be had to the demand/supply situation in relation to
sand and gravel
(b) Account will be taken of foreseeable effects of the working and.
associated activities on the landscape, trees, wild life and
features of scientific, historic or archaeological interest0
(c) The Council will also consider the proposed after'use of the site0
Where no beneficial after use is proposed or can be obtained, it
is unlikely that permission would be forthcoming0 Where the
use is a suitable one, evidence will be required.
proposed
to show that it can be satisfactorily implemented0 Where filling
materials are necessary to obtain a beneficial after use permission
will not be granted unless the Council are satisfied as to the
availability and suitability of the filling material0
after
(d) There will be a general preferexd3e for releasing land for the
contiguous extension of existing quarries until either the
deposits are exhausted or an overriding objection arises to such
extension on agricultural, landscape or other grounds including
the state of restoration of the existing pit0
(e) Regard will be had to the phasing of extraction and restoration
operations to ensure that the minimum area of land remains
unrestored while extraction proceeds0t'
A limited number of copies of the County Planners report are available,
but briefly it may be summarised as follows:—
Part 1 of the report sets out the County Council's existing policies as
contained in the County Development Plan, Piret Review, Written Statement
and as supplemented by the interim policy1 adopted by the Committee in
19670
Part 2 contains a summaxy of the Northern London Gravel Working Party
Report submitted to Standihg Conference in April0 The Conference
commended the general approach of the report to the local planning
authorities
concerned0 Estimates of demands and supply are set out
over the study area as a whole0 There are sufficient supplies to meet
foreseeable demands over the next few years and th3re is no case at
this stage for recommending allocation of additional areas in the
development plan, or for any change in the local planning authorities'
policy for maintaining a reasonable flow of planning permissions for
gravel extraction0 Prom manual pit surveys in Essex, it appears that
reserves in Essex with planning permission at this stage do not warrant
any major change in the Written Statement General Policy0
Part 3 comments briefly on factors such as avoidance of sterilising
deposits, effects of workings on agriculture and the landscape and
other aspects of traffic generation, local amenity, certain technical
matters and restoration0

Development Services Committee
Part 4 considers existing policy and the 1967 additions in the light
of the current situation and suggests that the Written Statement
General Policy with some special additions would form a satisfactory
policy for the future.
Part 5 sets out certain suggested additions to the General Minerals
Policy contained in the Written Statement which would apply to sand
end gravel extrabtion.
The County have asked for any comments by 30th May, 1974 if possible
and the Committee are reminded that all planning applications for
mineral workings are County matters. (654)
Resolved that the Essex County Council be informed that this Council
accept the principles of the report on mineral working in Essex,
and that special attention be drawn to Paragraph (b) relating to
the effects of such workings on landscape and environmental ftures.

"The County Council is prepared to make grants for the repair of

removal of all front boundary and division fences from most of
the new dwllings, so far as concerned those dwellings fronting

388 The Director of Finance reported as follows g—
"The Committee are required. to review the rate of interest charged
to borrowers in respect of house purchase loans in May of each
year, to take effect on 1st October following, or at such other
time as considered necessary0
The 1present rate of interest charged is 9% per annum, effective
from 1st April 1974, which was based en an estimated loans pool
rate for 1973/74 of 7,8%.
The calculation of the eatimated loans pool rate for any year is
fraught with difficulties in so much as you. have to forecast the
trend of interest rates on all ty-pes of money in the coming year6
The present national policy of controlling the growth of the
economy by the oost of money rather than by central government
control further complicates any assessment of interest rate

The
Director of Finanoe reported as
follows:—
Scheme 1
"There are two borrowing methods being operated at present.
caters for borrowers included in the priority categories, e.g. council
house tenants, persons who are homeless, living in over—crowded
conditions, etc., and Soheme 2, a special method designed to assist
young married couples with the purchase of their first home.
The operation of Scheme 2 was suspended on 26th April 1974 on financial
and administrative grounds, and subsequently reported to the Policy and
Resources Committee on 7th May 1974.
Advances for property outside the district boundaries have generally
been refused where the Council have no interest0
The present limitation of any advance undr Scheme 2 is 34 times the
joint annual incomes of the husband and wife or 7 times the annual
income of the male partner, whichever is the lower0
With the probable
increase in the interest rate charge, some further limitation should be
made on the maximum advance in order that the monthly repayments do not
account for an unreasonable proportion of the monthly inoome of the
borrowers.
I
Whilst Scheme 2 is headed "100% Joint Income", it is not designed to be
a 100% mortgage scheme •
The advance wifl normally be limited to 90% of
valuation or purchase price, whichever is the lower, It is proposed in
special cases that this percentage may be extended, but that the
borrowers be required to have an interest in the property of at least
£500 and only in exceptional cases would a 100% mortgage be granted0
The
demand for mortgage
facilities in April 1974 on the Council has been
extremely heavy, due to various factors on both the local and national
fronts, and which was about six times greater than that experienced in
It is regretted that Scheme 2 had to be suspended so early in

Since the construction of these dwellings'has not yet been started,

In 1974 the Council plans to take another step towards
age-limits and more selective staffing, (giving larger and

and amusements on offer.
To set up a second scheme in Great Wakering, which would compete for
the attendance of the same children, would appear to be financially
wasteful and against the interests of the children in the long-term.
On current planning, Schemes are kept extremely flexible and can be
adjusted easily to meet any special local requirements, (within set
financial limits,) by a request in good time to the Council Department

"The

of great interest
to the residents of Grove Road and surrounding areas. During the last

going to be made to out down trees to make way for two or three football or rugby pitches, and placing a club pavilion and car park as
close to residential areas as possible. We understood that the car
park was in fact actually to be located at the side of Grove Court0
Many of the residents' houses, including my own, back onto the playing
field which is at the end of Grove Road. This field has been used as
a rugby pitch for the last two seasons, however, the pitch is used
only once a week and yet the Rayleigh Council proposed to place a

a period of approximately 18 months or 2 years would elapse before the

The Director of Administration reported as follows:—
"At a recent meeting of the Co—ord.inating Committee consideration was
given to a scheme for the provision of a centre for all people with a
need of any kind, regardless of age or disability. It is envisaged
that such a centre would provide both creative and leisure activities
daytime and evenings and that social services would be in attendance to
give guidance and support as required.
Although the Working Party which looked into this matter was originally
concerned with the Rayleigh area only, as the Co—ordinating Committee
has now been extended to include the whole of the area of the Rochford
District Council, consideration was given at the meeting to provision
of such centres in the whole of the District and. during the discussion
mention was made of a possibLe suitable site within the Ashingdon area.
The Committee are also making enquiries on their own behalf to obtain
the use of the Old Peoples9 Day Centre at Castle Road, RayLeigh for
such a purpose.
It is felt that similar facilities are needed in all the residential
areas of the District and it will be the eventual ain of the Committee
to achieve this.
With regard. to financing these schemes, whilst it is anticipated that
a certain amount of the money required can be raised on a voluntary
basis, the Committee will look to the appropriate authority, i.e. the
Essex County Council, to provide some sort of financial assistance and
now asks this authority to support this scheme and to make appropriate

NOISE NUISANCE.
I
The Director of Administration reported that complaints had been made
to the Chairman of the Council concerning noise nuisance emanating
from the Mill Hall, being due to the ventilating system being out of
order, necessitating windows having to be opened. The Director of
Technical Services reported that the ventilating system had now been
repaired, but was not sufficiently effective in very hot weather.
Resolved that the Director of Technical Services report to a future
Meeting of the Committee on the necessary improvements to this
ventilating system.

when an ice cream van was parked in the area. The Member suggested
that consideration be given to extension of the car parking facilities
on a long tern basis, or alternttively an immediate solution by use of
the space adjoining the old cafe at present used for the storage of
materials. The Director of Technical Services stated that the area
wan unsurfaced and no supervision of parking was possible. The
adjoining area could be used for additional parking but even this would

that the question of car parking facilities at Hockley Woods

AND CONTROL OF HACKNEY CARRIAGE JM4nu BJJfl
The Director of Administration reported as follows:—
"By virtue of the provisions of the Town Police Clauses Act 1847, as
applied by the Icoal Government Act 1972, the Council is responsible
for the licensing end control of hackney carriages with effect from
1st April 1974. This legislation is already in operation in the area
of the former Rayleigh Urban
and by virtue of Schedule 14 to
the 1972 Act, it continues in operation in that area only until the
Council, by resolution, either cease to apply it or decide to apply
it to the whole of the area of the new District0
The Schedule further
provides that the resolution applying the legislation to the whole
a local

subsequent approval of the Home Secretary.

It-is considered that the legislation should be applied throughout the
whole District in ordar to give uniformity of control, and because
there are known to be private oar Mze operators in the Rookford area
who are anxious to be licensed as hackney carriage operators0
The
recommendation below is fremed accordingly,
If
the Council decide to adopt this recommendation it will be
necessary to make and submit for approval by the Home Secretary
bye-laws governing the operation etc., of hackney carriages.
connection it will be recalled that the Council have decided to accept
the offer of the SoutheixiDistrict Council of licensing services
including advice on the making of bye—laws0
Discussions have been
held with officers of the Southend Council and
would be most
desirable if the bye—laws adopted by this Council could be identical
to those in operation in Southend, since the Southend Staff will hairs

Additionally, it should be said
that the Southend bye—laws are considered to be fair and just, and
appear to be accepted as such by those in the "taxi" business, some of
whom operate in both districts0
bye—laws could lead to confusion0
should at this stage be pointed out that Southend. Council have
additional bye—laws to control and licence private hire cars, as

Southend—on-.Sea Corporation Act l97O
Vh.ilst it would be desirable
for iMs Council to make similar bye-.laws, in addition to the hackney
carriage bye—laws, it is not possible for this legislation to apply
to this District unless it can be incorporated at some time in the
Thature in an ssex County Council Act or in a Public General Act
promoted by the Government1
In addition to the bye—laws, the Southend Council has adopted
pre—licensing standards for hackney carriage licances (plates) and
for hackney carriage drivers licences, which deal with such matters
as the age and size of the vehicle, Its availabIlity for hire, its
regular inspection and maintenance, adequate insurance etc and, with
regard to driveiis, with their suitability taking account of driving

ability,
Again it would be necessary for the Council to adopt such standards
and those in operation in the Sout, hend area are considered perfectly
suitable0
However, before -the Council proceed
and pre-lioensing standards it
to consider and
adopt bye—laws
is felt advisable for the officers to
meet representatives of the existing Rayleigh licence holders and
interested persons in the flochford. area to discuss the proposed new
service generally and to give consideration to matters such as the
numbers of plates to be issued throughout the District, the siting of
ranks etc0, and the question of phasing in the pre—licensing
standards — one provision of these standards deals with the age of the
vehicle and it
may be necessary for some operators to renew their
vehicles0 In these circumstances Lt would be unreasonable to require
such renewal overnight0
It is also felt that such a discussion, at
which the officers of the Sou'tbend Council responsible for the
operation of the service would be present, would assist in creating
an a&aosphere of co=operation between the Ootmcils end the taxi
proprietors which would be of benefit to the operation of the service
generally0
could be followed by further consideration by this

The tern of office of Members is normally four years but the
statutory regulation provides that in the first instance one half
of the Members appointed in each category will serve for a period
ending on 30th June 1976 and the other half for the period ending
30th June 19780 The North East Thames Regional Health Authority
have now asked if authorities would indicate which Members they

fact that each authority appoints an uneven number of Members it
would seen desirable to consider this matter in consultation with

An agreement was reached at a recent Meeting of the County Liaison

Members in each case until 1978 with the one remaining one retiring
