THE BULLOCH COUNTY BOARD OF COMMISSIONERS
RESOLUTION # 2008 - ~
WHEREAS, O.C.G.A. § 15-12-7 provides that the grand jury shall fix the
expense allowance for jurors in the superior and state courts, and that such expense
allowance shall not be less than $5.00 nor exceed $50.00 per diem ; and
WHEREAS, O.C.G.A. 15-12-7 further provides that any increase in the expense
allowance for jurors fixed by a grand jury shall be subject to the approval of the
governing authority of the county; and
WHEREAS, the grand jury for the May 2008 term of the Superior Court of
Bulloch County recommended that juror pay be increased from $25 .00 per day to $50.00
per day; and
WHEREAS, the Bulloch County Board of Commissioners, as governing authority
of Bulloch County, considers that an immediate one hundred percent increase in the per
diem for jurors is inadvisable due to budgetary constraints;
NOW THEREFORE, BE IT RESOLVED by the Bulloch County Board of
Commissioners that the expense allowance for jurors shall be increased to $33.00 per day
from the date of adoption of this resolution until and unless revised upon
recommendation of the grand jury and approval of the governing authority.
Resolution approved and adopted this 2nd day of September, 2008.

NOVEMBER 2007 TERM
We, the Grand Jury for the November Term 2007, make the fullowing presentments:
The Bulloch County Orand Jury convened on Monday, May 7, 2007, and reconvened on
Tuesday, June 19, 2007. The Bulloch County Grand Jury then recessed on January 9, 2008.
We returned ;2., True Bills and _ _ No BiUs.
We wish to thank Chief Judge, WJlliam E. Woodrom for his instructions and assistance.
We wish to thank District AttomeyRichani Mallard, and Assistant District Attorneys J.
Barclay Black, W. Scott Bmnnen and Daphne H. Jarriel and their staff for the expeditious
handling of the cases'presented to this Grand Jury.
The Grand Jury hereby wishes to commend SheriffLyno Anderson and all law
enforcement officers of the Bulloch County Sheriff's Department; Chief Stan York and all law
enforcement officers of the City of Statesboro, agents with the Georgia Bureau of Investigation,
and law enforcement officers with the Public Safety Office at Georgia Soutborn University for
their professional and efficient presentations to this Grand Jury and their efforts on behalf of the
citizens of Bulloch County.
The Grand Jury voted to increase per diem for Traverse Juror's and Grand Juror's from
$25.00 to $55.00. This increase will take effect beginning with the February 2008 term of court
for BuUoch County, Georgia

On January 9, 2008, the Grand Jury filed a Presentment regarding the per diem
compensation rate applicable to Traverse Jurors and Gtand luron. The Grand Jury voted to
increase the per diem rate fiom $25.00 to 555.00. Payment of an elC.pen8Il lI110wance to jurors is
governed by O.C.O.A. § 15-12-7, which stat~ in part:
(a) The first grand jury impaneled at the fall term of the superior CO\IIt$ of the scweral
counties shall fix:
(2) An expense allowance for jurors in the superiorcourta of such counties for the next
succeeding year, such expense allowance not to be IClSS than $5.00 nor to exceed SSO.OO
per diem. The same expense allowance shall be allowed to jllroJB oflhe severaistllle
courts and special courts as is allowed jurors in the superior court of the county in which
the state or special court islocatcd. The expense aUowancc oftalcs jurors shall be the
same as that of a tegIlwly drawn trial juror; and
(3) An expense allowance for gmld jorors, such expense allowance not to be less than
$5 .00 nor to exceed 5S0.00per diem.

After reviewing the applicable law, the Court findll th&t the Grand Jury exoeeded its

addressed during the next Orand Jury panel. Until that time, tbe Bullocb County Clerk of Court
is directed to continue juror compCllSltiOll at the previous per diem rate of$25.oo.

Approval of Resolution to Increase Juror Per Diem

O.C.G.A. § 15-12-7 provides that the grand jury fixes the expense allowance for jurors within a range of 55.00 ta
$50.00 per diem, subject ta approval of the governing authority. As shown by the attached grand jury minutes
and court order, the grand jury far the November 2007 term voted to increase the juror per diem from 525.00 to
555.00 per day. Subsequently, the court ordered that, since this exceeds the amount allowed by law, the juror
per diem would continue to be $25.00 until further addressed by the next grand jury panel. The grand jury for
the May 2008 term voted to increase the juror per diem to $50.00. Based on budgetary considerations, it is
recommended that the Commissioners approve a juror per diem increase in accordance with the fallowing
sclledule: (1) $33.00 per day until June 30, 2009; (2) 542.00 per day from July 1, 2009 until June 30. 2010 ; and
