MISSION STATEMENT
The purpose of this association is as follows:
To lawfully promote the general business welfare of all persons, firms or corporations
engaged in the business of distributing, marketing or selling tobacco, candy and related products
at wholesale.
It is the intent of the by-laws that all activities of the Kentucky Tobacco and Candy
Association Incorporated will conform to local, state and federal laws and regulations, including
all federal anti-trust laws, and such laws in individual states. No member or group of members shall
be authorized to conduct a meeting in the name of this association without prior approval by the
President or the Board of Directors. No member shall in the name of the association, take any
action that will in any way constrain or restrict fair competition within our system of competitive
free enterprise. This association shall in no way attempt activities that will be detrimental to the
public welfare.

KTCA …. The inception 1972
On April 21, 1972, James Hallahan, Clerk of Jefferson County received the articles of
incorporation of the Kentucky Tobacco and Candy Association, KTCA, was in operation.
Filing of the articles had followed filing at Frankfort as a non-profit association within the law
after communications and meetings over several months.
At the first meeting on February 19, 1972, prior to the formal filing, a meeting had been
called to order at Stouffer’s Inn, Louisville, by Moderator Stuart M. Grossman with the following
present: Frank Atkins, Ashland; Tracy Axton, Louisville; M. Little, Ashland; J. A. Ruffra, Jr.,
Frankfort; Harold Gillett, Newport; Henry Goodman, Glasgow; Robert Linker, Louisville; Bert
Trompeter, Louisville; James Birdwell, Bowling Green; Harold Wagner, Paducah; Stuart M.
Grossman, Louisville; and representatives of the N.C.W.A. and the N.A.T.D.
The by-laws were prepared and then discussed, recommended and adopted at a meeting
on May 13, 1972 at the Holiday Inn North, Elizabethtown. The business meeting was attended by
24 people.
Assuming offices were Stuart Grossman, president, Claude Fannin, vice president; Bert
Trompeter, secretary and treasurer. Others elected to the board at that meeting were Harold
Wagner, Harold Gillett, Joe Ruffra, Jim Birdwell, Earl Crouch and Eugene Johnson.

KY Sales Restriction Laws
KENTUCKY
ADAMHA COMPLIANCE
The Department of Agriculture shall conduct annual, random, unannounced inspections. Persons under the age of 18 may be
enlisted to test compliance, provided that written parental consent has been given and law enforcement officers provide direct
supervision. [KY. Rev. Stat. Ann. 438.330.]
MINORS – 18:
State law prohibits a person under the age of 18 from purchasing, accepting receipt of, attempting to purchase, or attempting
to accept receipt of, a tobacco product. It also prohibits the use of fraudulent proof of age for the purpose of purchasing
or receiving a tobacco product. Violation is deemed a status offense, and peace officers and Department of Agriculture
employees are authorized to issue field-release citations for violations. State law also prohibits the distribution of tobacco
products, including samples, to require proof of age from a prospective buyer or recipient if the person has reason to believe
that the prospective buyer or recipient is under the age of 18. State law defines “proof of age” to mean a government-issued
photo ID bearing date of birth. Violation is deemed a status offense, and the Department of Agriculture employees are
authorized to issue field-release citations for violations. [KY. Rev. Stat. 438.311, 438.313.]
SIGN REQUIREMENTS:
Retailers are required to post in a conspicuous place a sign stating that it is illegal to sell tobacco products to persons
under the age of 18. Violators will be fined $100-$1,000 for second and subsequent offenses. [KY. Rev. Stat. Ann.
438.310.]
LICENSE REQUIREMENTS:
Vending machine operators must obtain and display a license from the Department of Revenue. The license
fee is $25. [KY. Rev. Stat. Ann. SS 138.130(12), 138.195(1) and (4).] Counties are authorized to impose a
license fee of up to $10 per year on retail outlets for tobacco products. [KY. Rev. Stat. Ann. SS 173.115(1)
(d).) Failure to procure the necessary license is subject to a fine of $25-$200 for each offense. (KY. Rev. Stat.
Ann 137.990(1) (a).]
VENDING MACHINE RESTRICTIONS:
Tobacco vending machines must be located within the line of sight of the cashier. Machines located within
factories, or bars/taverns to which minors are not permitted access are exempt from this requirement.
Violators will be fined $100-$500 for each offense. [KY. Rev. Stat. Ann. 438.315.]
PREEMPTION:
State law prohibits the subsequent adoption of any local laws, ordinances or regulations that relate to the
use, display, sale, or distribution of tobacco products. [KY. Rev. Stat. Ann. 438.300.] The Supreme Court has
subsequently overridden the preemption clause of this Statute.
OTHER:
State law restricts billboard advertising. [KY. Rev. Stat. Ann. 438.047.] State law prohibits the sale by or to a
retailer of cigarettes in packages of less than 20. Violations by a retailer is subject to a civil penalty of $100$500. Violation by a wholesaler is punishable by a civil penalty of $1,000-$2,500. [KY. Rev. Stat. Ann. 438.]
SAMPLING:
No state laws restrict sampling of tobacco products to adults. However, state law prohibits wholesalers, retailers, or
manufacturers of tobacco products from providing free samples to any person under the age of 18. [KY. Rev. Stat.
Ann 438.313.]
ADVERTISING:
State law prohibits tobacco advertising on billboards with display space larger than 50 square feet located
within 500 feet of any elementary school building or adjacent school-owned property. Violators shall be
fined not less than $100 for each offense. [KY. Rev. State. Ann. 438.047.]
