General Membership Meeting Set — October 25th

The Long Island Board of Realtors®, Inc.
(LIBOR) will hold its General Membership
meeting on Tuesday, October 25th at the
Marriott Hotel, 101 James Doolittle Blvd.,
Uniondale, New York. All Realtor® members who are present and in good standing
may vote at this meeting. Polls open at 9:00
a.m. and close promptly at 2:00 p.m.
The Board is also exploring the possibility of holding a simultaneous General
Membership meeting at the Smithtown

Issues Working Groups Meet in Albany

A joint meeting of the NYSAR Commission
Protection and Commercial Issues Working
Groups recently took place in Albany to update
our association on the status of the
Commission Escrow Act including details of
meetings with the New York State Bar
Association and bill co-sponsorship.
The legislation, which was reintroduced this
year in both the New York State Senate as
S.193 and in the New York State Assembly as
A.3395, will allow disputed real estate commissions to be placed in an escrow account
until the matter can be resolved.
The NYSAR working groups made recommendations regarding the remaining
issues that the Bar Association has with our
bill including: our support for giving the
seller the right to recover attorney fees from

Rosemarie says, “We tell our Sellers in the East End that if their house is not on
MLS — it’s a secret.” Rosemarie and Susan also own an office in Patchogue which
has been in business since 1990. The Westhampton office of Belzak and Bodkin
represents the 2,500th MLS office to open on Long Island. In the past five years, the
number of MLS participating offices has grown over 65%.

Incoming President Gilbert A. Picard, will
begin serving his term in January 2006. Gil
is the 67th LIBOR President and follows
Marian Fraker-Gutin who currently serves in
that position. For 2002-04 Gil served as

REALTORS® Come to Aid Hurricane Katrina Victims
Realtors® Donate Over 2.75 Million Dollars

In the wake of Hurricane Katrina,
Realtor® organizations across the country are rallying to provide relief to victims in Louisiana, Mississippi and
Alabama. NAR launched the fund-raising drive shortly after Hurricane Katrina
swept through the U.S. Gulf Coast, wiping out cities in the three states. Initially,
NAR donated $150,000
toward relief efforts,
but within a day, as the
extent of the suffering
and devastation caused
by Hurricane Katrina
became more clear,
association leadership
approved an additional
$1 million contribution
to the fund. The $1.15 million donated
by NAR was earmarked as seed money
to funds established by Realtor® associations in Louisiana, Alabama and
Mississippi.
State and local Realtor® associations
have also contributed to the Relief Fund.
An additional 1.6 million dollars has
been pledged as of September 9th, with
more forthcoming, bringing the total of
Realtor® contributions to $2.75 million.
Contributions will be forwarded to funds
such as the Mississippi REALTOR®
Hurricane Relief Fund, which was established by the Mississippi Association of
REALTORS® (MAR) after Hurricane
Katrina struck. MAR is already in the
process of accepting applications for
relief assistance from victims of
Hurricane Katrina. This fund is open to
any resident of Mississippi. Relief applications are reviewed by MAR's six-member board of directors every few days,
and approved applicants will receive
relief amounts up to $2,500 per applicant.
A proposal will be made to the LIBOR
Board of Directors on September 14th to
approve an initial donation of $25,000 to
the Realtor Relief Foundation, which
will be taken from the
LIBOR Disaster Relief
Fund established after
the Tsunami disaster.
As it did after Sept, 11,
2001, to New York families and again recently
to the Tsunami victims
across the world,
REALTORS® are making donations to help the victims. The
Realtor community is asking “What can
we do?” In response to that, the Long
Island Board of Realtors® has established a system of accepting donations on
behalf of the REALTOR Relief

The Habitat for Humanity House being
built in Central Islip for Tim and Candice
Fowler is nearing completion. With just
three Realtor Volunteer Build Days remaining, the house that Long Island Realtors
built should be ready for occupancy sometime in November.

When the callout was made for volunteers to help build the Realtor Habitat
House, over 175 applications were
received by the Board. Many of these

yet to be
scheduled,

we only
have three
volunteer work days left. The last three
dates for Realtor Volunteers are as follows:

We need approximately fifteen to twenty volunteers for each of these days. If
you are interested in working at the
Realtor® Habitat House on any of the
above dates, or if your office is interested
in sponsoring one of these work days,

Election of officers and directors will take
place on October 25, 2005 at 9:00 am at the
Marriott Hotel, James Doolittle Blvd.,
Uniondale, New York. All REALTOR®
members who are present and in good standing may vote at this meeting.
In accordance with Article XI, Section 6 of
the Bylaws, “Additional candidates for the
offices to be filled may be placed in nomination
by petition signed by voting members: for
County Director, 50 signatures from within the
County; County Vice President, 100 signatures
from within the County; Treasurer/Secretary,
150 signatures Board wide; President Elect,
150 signatures with a minimum of 30 per
County. The petition shall be filed with the
Secretary at least 20 days before the election.
Such additional nominations shall be published
in the Board Bulletin at least ten days before
the election.” The deadline for submitting petitions under this provision of the Bylaws will be
5:00 pm, Tuesday October 4, 2005 at the Board
Office in West Babylon. Petition forms may be
obtained from Lisa Gonzalez at the LIBOR
offices, 300 Sunrise Highway, West Babylon,
New York.

President’s Message

Channeling Our Energy
As we start the fall season whether it be back to
school for the children,
vacations over, getting
more organized in our
business or just looking
forward to cooler weather,
our energy starts to flow
again.
This year sadly our energy should be toward our
fellow Americans in
Louisiana, Alabama and
Mississippi who have lost
their homes and lives to hurricane
Katrina. I was in Europe when the hurricane hit in the U.S. and the pictures
looked like we were one of the third
world countries that were devastated.
Our America should not look like that in
the press or on TV, but it did! I know by
the time you read this article there will be
many programs in place to help our
Americans who are suffering from this
disaster. Your Realtor organization was
one of the first to respond to their needs
and we will continue to do so.
In LIBOR your leadership and
Directors are moving forward to put into
place the changes you voted for on
August 4th. They are continuing to try to
help our members in their day to day
business and assist them in
protecting their bottom line.
We will be traveling to
Albany this month to continue our efforts for the passage of the Commission
Escrow Act. I am continuing
to seek input from you “the
member” as to your needs
and concerns that should be
brought to the Board. You
may call me or email me
anytime; your Chapter
Presidents
and
Representatives are also available for you
to bring your message to the Directors.
Our Habitat House is nearing completion thanks to all the Realtor volunteers
and in October we are bringing a motion
to the Board of Directories that will make
two voting places to select your new
Officers and Directors. One location for
Nassau and Queens and one in mid
Suffolk equal distance to all.
In closing, I want to ask for your
prayers and thoughts for our fellow
Americans and all those who are less fortunate than us, that they receive the help
to overcome their adversities.

as LIBOR Treasurer.
Gil joined LIBOR in 1970. In recent
years, he has served on the Legislative
Committee and on the RPAC Committee.
Gil has served as a LIBOR Director since
2000 and in 2004 he began serving as a
Director at the State and National levels.
He is a graduate of N.Y.U. and is a resident
of Huntington, where he resides with his
wife Myra.
Linda Bonarelli, Broker/Owner of
RE/MAX North Shores and RE/MAX Fine
Homes & Estates, has received the nomination for 2006 LIBOR President-elect.
Linda currently serves as Suffolk Vice
President and in 2003 and 2004 she served
as LIBOR Treasurer. Her committee
involvement for MLS and LIBOR is
extensive and she has served as
chairperson of the Professional Standards
Committee, Budget & Finance Committee,
Legal Assistance Committee, and the MLS
Rules Committee. She also serves as a
Director and on numerous committees for
both the State and National Association of
Realtors. Additionally, Linda is actively
involved in community and political
affairs.
Gil Picard stated, “I am extremely
pleased that Linda received the nomination,
as well as the other nominees, and I am certain they will all do a great job representing
the membership.” Picard further notes with
regard to President-elect nominee Linda
Bonarelli, “Linda has an extensive knowledge of our Board and of the real estate

To be a REALTOR®, you invest a lot in
yourself. Besides your chosen real estate
specialty, you spend time learning and living by the particulars of the REALTORS®
Code of Ethics. And many of you spend
time and money to earn designations. Yet,
for all the prestige that your LIBOR membership affords, many of you aren’t identifying yourselves as REALTORS® by
wearing your REALTOR® pin. That means
you aren’t receiving the full benefit of a
successful seven-year-and-running Public
Awareness Campaign that has been over-
seen
by
the
National
Association of Realtors®.
The national advertising campaign has elevated the perceived
value REALTORS® bring to
the real estate transaction in
consumers’ minds. To piggyback off of those efforts, the
Long Island Board of Realtors®
has launched a REALTOR®
Pin campaign of its own, to
encourage members to let the
public know they are proud to
be a REALTOR®.
Since the Campaign began
in 1999, consumers who
believe there’s a benefit to
working with a REALTOR®
as opposed to a salesperson has
increased significantly, according to a study conducted for
NAR by independent research
firm Riter Research Inc.

The safety of members is a top priority. The Long Island Board of REALTORS®, Inc. (LIBOR) is committed to

awareness about this vital issue, Sept. 1117, 2005 has been officially designated as
the third annual REALTOR® Safety
Week. By working together, we can give
REALTORS® knowledge that will
empower them to work with confidence.

the broker if no action is taken by the broker to recover the escrowed monies within
60 days; and our opposition to adding language to the affidavit that would emphasize
that the seller and broker may agree to
waive the broker’s escrow rights and to
have the statute sunset.
The next meeting between NYSAR and
the Bar Association is approaching shortly
and both groups will debate the differences
that still remain between them with the bill.
The results of that meeting will be reported
shortly.
The Commission Escrow Act garnered
much support in 2005. A total of sixty-eight
majority members in the Assembly and twenty four majority members in the Senate have
signed on as sponsors of the Commission
Escrow Act. This is the highest level of
cosponsorship in the history of this proposal.
Thanks to the efforts of LIBOR’s
Legislative Division and our legislator contact team program — we have had much
success locally. Eight of the eleven
Republican Senators from LIBOR’s region
who could cosponsor the bill did sign on.
The there Senators who did not yet sign onto
the bill as cosponsors are: Michael Balboni
(Garden City Park); Frank Padavan
(Bellerose) and Serphin Maltese (Glendale).
We are currently seeking their support.

sign on are: Nettie Mayersohn (Flushing);

Anthony Seminario (Richmond Hill). We
will seek their support in the coming year.
The way politics works in the New York
State Legislature is clear-cut — a minority
member of the Assembly or the Senate cannot become a cosponsor on a majority
member’s bill. However, many of the legislators who are not cosponsors have
already expressed their support for the bill
when it comes up for a vote on the floor of
the Senate and the Assembly.
We can’t stop now - we need your help.
Just because the legislative session has
ended doesn’t mean that our fight has
ended. In order to be successful with a
Commission Escrow Act bill — we must
continue to spread our message to each and
every legislator at the local and state levels.
In addition REALTORS® must continue
to raise RPAC dollars as we need to support legislators who support REALTORS®. Please tell every REALTOR®
you know to make sure they contribute to
RPAC today — so you can save your
earned dollars tomorrow!

2005 has been a banner year for RPAC
contributions here at LIBOR. To date we
have collected $290,000 in RPAC contributions. Our goal amount is $333,333. Thus
we are only $43,000 away from reaching
our target. This is due largely to the great
RPAC fundraising efforts here at LIBOR
and the continuous RPAC education that
has been provided over the years and the
awareness and generosity of 25 percent of
our REALTORS®.
LIBOR’s RPAC Committee has worked
very hard over the past few years to continually strive to collect more and more dollars each year. The dollars that we raise help
us continue to fight for a much needed
Commission Escrow Act as well as opposing transfer taxes and other onerous proposals that always seem to manifest themselves on the local, state and federal levels
of government.
LIBOR RPAC Chairperson Patricia
Levitt has made it her personal mission to
see to it that we succeed in reaching our
goal. Pat and her committee members raise
money by constantly attending meetings,
making telephone calls and soliciting gifts
for all of our sweepstakes. This year we
have had very successful fundraisers with a
Mets vs.Yankees game and a Day at the
Races. In addition to Pat, LIBOR’s own
Audrey Livingstone serves as a NAR
RPAC Trustee. Audrey tirelessly travels the
country to advise other REALTOR®
boards about the importance of RPAC.
LIBOR has come a long way with RPAC.
With each passing year our efforts our produced tremendous results! In 1995 —
LIBOR raised a mere $8,300 for RPAC.
When Audrey Livingstone became the
RPAC Committee Chairperson in 1998 —
we raised a respectable $40,000. In the year
2001 — LIBOR raised a total of $129,000
with just 2,480 contributors. To date this
year we have already raised $290,000 and
have more than 5,137 contributors! Now
that is success!
But our work is not done. We must continue to collect more and more RPAC dollars so we can protect our industry! Please
give to RPAC today. If you have already
contributed to RPAC in 2005 — please
advise your fellow REALTORS® to do the
same. We need the support of the majority
of our over 24,000 members who do not
contribute to RPAC. We need to increase
the amount of REALTORS® who donate to
RPAC so we can better support legislators
who support REALTORS®.

a user clicks on Sperling's School Profiles,
a change has been made. Now when there
is a School District Name stored in the listing, instead of viewing the school information based on zip code, Sperling will be

have current information on each listing

agents of the status of the listing.”

8 E-mail Essentials

1. Spell it right. E-mail may be less formal than printed correspondence, but that
doesn’t excuse sloppiness. If your e-mail
software has a spelling checker, use it. If
not, write important client e-mail in a
word processor, which also typically
offers a grammar checker. Then copy and
paste memos into your e-mail software.
2. Organize by importance. Create separate mailboxes within your e-mail software for active clients and customers
based on their e-mail address. Then have
your system automatically filter mail
from these people into those boxes.
You’ll always be able to find your most
important e-mail quickly.
3. Include complete URL links. So that
recipients can click into Web site addresses you’ve included in e-mail, use formal
conventions.
For
instance,
http://www.canale.com will allow most
readers to click on the address as a hyperlink; www.canale.com won’t.
4. Use signatures. Make sure your email software automatically attaches a
prewritten identification message (signature) to each outgoing e-mail. Keep the
message short, no more than four lines.
Include your preferred e-mail address
and a link to your Web site.
5. Create prewritten messages. Much
of the e-mail you send, such as responses
to listing inquiries, will be repetitive.

Christa House: The Jerry Residence is a
not-for-profit home for the dying poor, particularly those who are living with endstage AIDS. The Christa House
Community promotes holistic living within
oneself and with others, and empowers the
dying to live in peace, safety and dignity.
Christa House has educated over 200
volunteers and retains 180 in active service. Their volunteers come from all walks
of life and cross all racial, ethnic, age, religious and socio-economic boundaries.
Volunteers dedicate 3-4 hours a week on
a regular basis for an initial Period of 6
months. Some of their volunteers are
receptionists, some are housekeepers,
some help in maintenance. Kitchen help
for the cook is needed on a daily basis.
Some act as buddies and offer companionship and service both inside and outside the
house. Some assist in fund raising activities and others work at direct hands on care
of the dying. Several offer not only the
work of their hands but also a dedicated
hour of prayer every week. Christa House's
volunteers are an invaluable asset and
addition to the work of our community.

Lock Boxes, Keys,
Consider the Risk
Realtors often obtain keys to premises
which they have listed for the purpose of
facilitating the showing of the property.
With the convenience of the key, however,
comes considerable legal risk which should
be carefully considered. This article will
explore the risk involved when you accept a
key from a homeowner for the purpose of
showing the property; utilize a mechanical
lock box; or utilize an electronic lock box
and offer suggestions with respect to minimizing the risk.
When you accept a key for premises, you
also accept the responsibility with respect to
how that key is used. While it does not occur
with frequency, there have been situations in
which brokers have been sued and disciplinary action has been taken against them by
the department of state because of a theft
which occurred in a listed property and
where there were no signs of entry by force.
Sometimes the victim homeowner has been
able to identify a time period in which the
theft occurred which corresponded to the
time in which an agent had signed out for a
key. There have been instances where persons who were not agents used false identification and represented themselves as
agents to obtain keys as well as instances
where agents have been suspected of duplicating a key and making that key available
to a third party who actually committed the
crime. One Realtor suffered through the
experience of having an ex-agent with a key
for a mechanical lock box enter a vacant
house and become a squatter requiring eviction proceedings to force their removal from
the property. While there is no bullet proof
defense to such situations, there are certain
things a broker can do to minimize the risk.
ACCEPTING THE KEY
First, obtain a written consent from the
owner with respect to the key that clearly
sets forth and describes the full extent of the
risk and exactly what office procedures you
will follow in an attempt to minimize that
risk. Be implicit concerning potential risks
including the fact that a person obtaining
the key could duplicate it without your
knowledge. After fully setting forth the risk,
have the owner agree to assume all those
risks and to free you from any liability for
damage, injury, theft or any other loss as a
result of unauthorized use of the key or a
duplicate made from the key except for
gross negligence on your part. Make sure
the statement covers your company, all its
agents and the individual broker-owner.
Next, establish written office procedures
that in fact keep very close tabs on the key
and the identity of the person who is given
the key for the purpose of showing the
property. It is recommended that those
policies include making a photocopy of the
agents pocket card issued by the department
of state and confirming the name on the
pocket card with photo ID of the person
who is actually given custody of the key.
Make a copy of the photo ID as well. Under
no circumstances should you give a key to
anyone who has not been positively identified. In addition to logging in the time when
the possession of the key was given the
agent and the time it was returned into a key
log, those times should be noted on the
copy of the person’s pocket card. The copy
of the photo ID and the pocket card should
be stapled together and kept in a file and
maintained in the listing file. If the property
is not sold, these records should be kept in
a file for at least one year after the expiration of the listing unless special circumstances indicate a need to keep the records
longer. Those policies must be distributed
to all agents who should sign off on them.
They should also be the topic at office or
manager’s meetings. Management should
do periodic investigations to assure compliance with the policy.
MECHANICAL LOCK BOXES
Popular in a great deal of Long Island are
mechanical lock boxes. These lock boxes
respond to a universal key and have been in
use on Long Island for many decades.
Their popularity and history are what create the problem. Literally tens of thousands, if not over a hundred thousand, of
lock box keys are floating around Long
Island. These keys can be used to open a
lock box and obtain entry into the house
with complete anonymity. Unlike a situation where the broker has control of the key
and logs in each user, the broker who uses
the lock box has absolutely no idea who is
entering the premises at anytime. In the
event of a theft or worse yet a crime involving physical violence, the broker, while not
guilty of the crime, faces at least an argument that they recommended the lock box
without sufficient notice to the homeowner
of the risk involved in placing such a lock
box on the house. Brokers who use such
lock boxes should obtain the written consent of the owner to use the lock box, and
that consent should very clearly set forth
the fact that by placing the lock box on the
house, the owner is going to make the
property available to any person who has a
key that fits that lock box whether or not
that person is still a licensed broker or
agent. The disclosure should also state the
broker has no idea how many keys fit the
lock box, and persons who have not been
licensed for years may still possess a key.
Again, the permission should state in clear
language that the owner has accepted full
responsibility for loss or any occurrence
which takes place by a third party entering
the house.
ELECTRONIC LOCK BOXES
Electronic boxes are used heavily in
some areas of Long Island and virtually not
used at all in others. If you wish to use a key
to facilitate showings, it is strongly recommend this type of lock box be considered.
While this type of lock box does not
absolutely prevent criminal activity, it
reduces the risk of such activity substantially. This is because the electronic lock box
has an electronic key owned by one individual person who is identified as an agent.
If that agent leaves the industry, their broker
simply notifies the lock box company and
that key is invalidated. Unlike keys to
mechanical lock boxes, the agent, once they
leave a broker’s company, cannot utilize
that key and must obtain a new key which
is also identified with that agent and their
new company. The electronic key identifies
who uses the lock box and records the
moment somebody opens the lock box and
the moment the lock box is closed. This
means if a crime is committed in the house,
there is a record of any entries made at or
about the time of the crime. This, of course,
is a great deterrent to criminals who might
consider using the key to a mechanical lock
box where they can enter with anonymity
but refrain from using a lock box key that
will identify them as the criminal. The electronic lock box also diminishes the risk of
an agent making a duplicate key. Keys
made locally can often be traced by police
in the event of a crime. Keys made at a distance from the house result in an extraordinary length of time during which the key
holder had possession and are evidence that
they in fact committed the crime. In other
words, while the electronic lock box does
not prevent the crime, it most likely will
establish the identify of the perpetrator
resulting in a conviction and a jail sentence.
This is a deterrent to the occurrence of
criminal activity and thus helps reduce the
broker’s risk. Finally, with the electronic
lock box, the broker is in entire control of
the situation. One word of caution. If you
own an electronic key, do not let anyone
else use it. If it is lost or stolen, report that
fact immediately. There should also be written permission obtained with respect to
electronic lock boxes, but in this case, the
owner need only assume the risk of a computer or electronic transmission failure. I
know of no instance where such has
occurred, but it is not beyond the realm of
possibility.
So why doesn’t everybody utilize electronic lock boxes and electronic keys? The
answer to that question is they are more
expensive than the alternatives. However,
during the last five years the price of real
estate has increased greatly as has the compensation paid to agents and brokers. The
corresponding cost of electronic lock boxes
has not risen at the same pace. Perhaps electronic lock boxes deserve a second look.
Think about the difference of the listing presentation an agent can make when they are
utilizing an electronic lock box as opposed
to a mechanical lock box or keeping a key in
the office. Think about the listing where all
of the adults in the residence work and
where access to the homeowner is extremely limited. Think about facilitating sales and
sleeping well at night.
It is time to rethink whether or not electronic lock boxes are for you.

Property Law that allows Brokers to pay commissions to a corporation if all of the
shareholders of the corporation are licensed agents of the Broker. This change

He was advised that a REALTOR® is definitely responsible for pertinent statements of
his salespersons in real estate transactions.
REALTOR® C and REALTOR-ASSOCIATE® D were found in violation of
Article 2.
Grievance Committee and then referred to
the Board’s Professional Standards
Committee which promptly scheduled a
hearing and asked REALTOR® C and
REALTOR-ASSOCIATE® D to be present
to answer charges of unethical conduct in
violation of Article 2 of the Code of Ethics.
At the hearing, REALTOR-ASSOCIATE® D confirmed that he had made the
statement attributed to him; that he thought
it was correct because the information had
been given to him by a neighboring property owner. Questioning revealed that REALTOR-ASSOCIATE® D had made no effort
to verify the information from authoritative
sources. REALTOR® C protested he knew
nothing about the matter; that he had not
been present when REALTOR-ASSOCIATE® D made the statement; that he was
not responsible for the oral statements made
by a REALTOR ASSOCIATE®; and that
REALTOR-ASSOCIATE® D’s first contact
with the buyer had occurred while REALTOR-ASSOCIATE® D was associated with
REALTOR® A.
It was concluded by the Hearing Panel
that REALTOR® C and REALTORASSOCIATE® D were in violation of
Article 2 of the Code of Ethics in a way that
materially imposed upon the buyer, who
actually received measurably less in package of ownership rights when he purchased
the property than he was led to believe he
was buying. Since it had been demonstrated that REALTOR-ASSOCIATE® D
made the statement containing misinformation on a pertinent fact while he was affiliated with REALTOR® C, and in view of
the fact that REALTOR® C was the exclusive agent of the seller at the time, REAL-
Case #12-13: Advertising Including
Information Based on Other Brokers’
Transaction
Shortly after mailing his “Homeowners
Neighborhood Newsletter” to local residents, a complaint was filed against
REALTOR® B alleging he had engaged in
deceptive advertising in violation of
Article 12’s “true picture” mandate. The
complaint was reviewed by the Grievance
Committee which determined that a hearing should be held. Appropriate notices
were sent and a hearing was convened.
REALTOR® A, the complainant, provided panel members with copies of REALTOR® B’S “Homeowners Neighborhood
Newsletter” noting that REALTOR® B had
compiled a list of 20 homes in an exclusive
area of town, titling the list “Recently Sold.”
REALTOR® A, the listing broker for two of
those properties, stated that he believed that
readers could conclude that REALTOR® B,
in advertising this way, had constructively
claimed to have listed and sold all of the
properties on the list and that such claims
violated Article 12.
In his defense, REALTOR® B acknowledged that his “Homeowners Neighborhood
Newsletter” was, in fact, primarily an advertising vehicle and that it did not have a regular publication schedule. While it included
news and information, including tips on how
to make residential property more readily
saleable and information regarding products
and services offered by REALTOR® B’s
firm, its primary purpose was to generate
business for REALTOR® B’s firm.
REALTOR® B defended inclusion of
the “Recently Sold” list pointing out that
all of the properties on the list were the
subject of recent sales transactions; that the
period of time during which the transactions had closed was clearly stated; that the
fact the information was taken from the
local MLS compilation of historical data
had been duly noted; that a footnote at the
bottom of the page clearly indicated that
the properties on the list had been listed
and sold by various Participants in the
MLS; and that such use was consistent
with the local MLS rules and regulations.
The Hearing Panel accepted REALTOR®
B’s defense, holding that reasonable readers
would conclude that most newsletters were,
in reality, promotional advertising pieces
and, in any case, that REALTOR® B’s
newsletter had included some items of
“news”. Moreover, they noted that if
REALTOR® B had simply listed the 20
transactions, titling them as “recently sold”
and had done nothing more, then a reasonable reader might have concluded that he
was claiming to have listed and sold those
properties. However, since REALTOR® B
had included a footnote pointing out that the
properties on the list had been listed and sold
by various Participants in the MLS, the fact
that REALTOR® B had not included the
names of each listing broker could not be
construed as REALTOR® B claiming to
have been the listing broker in each instance
or to have “sold” each of the properties.
Practical Ethics: Four Paths to Greater Virtue
It is no surprise that, in this day of comprised ethics and values, there is an ever
increasing number of books and articles
highlighting the importance of ethics and
values in everyday life.
Ethics, ethical behavior, and taking personal responsibility for choices are even
more important in business today. Here are
a few reflections on ethics to help maintain
that high standard of thought and behavior.
To help guide us along that route, here
are four ideas for your consideration.
1. WHAT IS THE COMMON
GOOD,AND WHAT ROLE DOES IT
PLAY IN OUR DECISION MAKING?
In all of our businesses, this question
needs some consideration. Generally
speaking, what is good for the "other",
whether it be our customer, staff, spouse,
family, etc., takes precedence over our own
needs and wants.
Sometimes, in business, egos take precedence over good business practices, and
good relationship building, and overall.
Can get in the way of truly being of service.
We need to ask whether we are in business for ourselves, or to take our gift and
talents to the workplace and in the spirit of
service -try to make a difference in the lives
of those we serve.
2. THE IMPORTANCE OF COMMUNAL WISDOM
It seems to be in business today, we
sometimes tend to be too narrowly focused
to see a bigger picture. There is a tendency,
at times, to see our way as the only way or
our approach as the only approach. It seems
necessary, if you're ever uncertain whether
something you want to do is ethical, appropriate, or acceptable, to find colleagues,
friends, etc. who you know are "for you"
and bounce your choices off them.
We need to have people around us who
have no other agenda than to do what's
right for us. Whether we agree or not, that
type of advice is invaluable in helping to
discern which path to follow.
We need to be open to their perspectives,
their honesty, and their genuine concern for
us and our success. Any number of ethical
issues, questions, and situations could be
easily resolved by "tapping" the wisdom of
those who have your best interest at heart.
It certainly will cut the "learning curve" and
keep you on task and better focused.
2. STAYING TRUE TO YOURSELF
AND YOUR VALUES
Let it be stated up front that this statement
is not to be interpreted as what I think and
feel are always right or can be justified; but
rather, we are the sum total of all that has
gone before us in our lives. All the people,
experiences, relationships, etc., that have
been influential in the development of our
value system, are part of us and need to be
taken into account in our decision making.
Whether the influences were religious,
ethnic, political, or cultural, they play a key
role in the development of who we are as
individuals, not to mention business people.
That journey of life to this point instilled
in us perceptions, attitudes, values and
insights that have directed us as individuals
and have been instrumental in the building
of our businesses.
2. BEWARE OF THE ETHICS GAP
What is the ethics gap? The gap is what I
know is right from wrong and I think it
takes to be successful. Most people know
right from wrong; however, when it comes
to business, sometimes compromising those
values can become a real “temptation.”
This gap is present in any situation, especially business. It's involved in how we
work with customers, colleagues, staff, and
even family. Everyone knows somebody
that they prefer not to do business with or
refer business to on the basis of what's
important to them. The real challenge is to
lessen the size of the gap rather than hope
to eradicate it altogether. How do we do
that?
People need to align their work values
and principles with their personal values
and principles and proceed accordingly.
However, we can choose a negative or a
positive path to follow, based on whatever
our values are and the effect those choices
have on those around us.
People must go slowly in analyzing their
values and ethics, and then must choose
well which path to follow.
If we keep these four "paths" in mind for
reflection when faced with an ethical and
conflicting situation, they can't help but
help us get pointed in the right direction to
help us make the best possible decision.

Case #2-9: REALTOR®’S
Responsibility for REALTORASSOCIATE®’S Statement
REALTOR-ASSOCIATE® D, associated with the firm of REALTOR® A,
obtained an offer to buy a property at less
than the listed price. The offer was rejected. The property had been exclusively listed by REALTOR® B and had been published through the Multiple Listing Service
of the local Board of REALTORS®. The
owner received no further offers and at the
expiration of the exclusive listing with
REALTOR® B, he approached REALTOR® C and exclusively listed the property with him.
About this time, REALTOR-ASSOCIATE® D terminated his association with
REALTOR® A and became affiliated with
REALTOR® C’s organization.
The prospect who had made the unsuccessful offer on the property continued to
seek the assistance of REALTOR-ASSOCIATE® D and made another offer on the
property, this time at the full listed price.
REALTOR-ASSOCIATE® D and REALTOR® C, the listing broker, submitted this
offer to the owner, and it was accepted.
A few months following the sale, the
purchaser complained to the Board of

Sending Out Your Best Silent Message: First Impressions Are Lasting Impressions

You make a statement about yourself even
before you open your mouth. This isyour
"silent message," and it can include everything from your posture to your positiveness.
In short, it's the way you carry yourself,
physically, emotionally, and intellectually.
Such quiet signals profoundly affect people's
initial perception, or image, of you.
Of course, image isn't everything-but it is
important. As you know by now, doing well
in life doesn't hinge solely on merit and
hard work. Image, especially when backed
up by strong performance, is a powerful
force. And a negative first impression-saying the wrong thing, wearing the wrong
clothes, coming across as uncaring or
inept-creates roadblocks that can cut off
relationships before they get started.
When we meet people we immediately
like, we tend to put a positive spin-at least,
initially-on everything they say or do.
Some call this favorable first impression
presence. Others liken it to energy, or aura.
People with a presence, energy, or aura
are able to maintain an excitement about
themselves that starts with-but usually lasts
far beyond-a favorable first impression.
Thus, we admire them before we even
know much about them, therefore, they
possess an enormous advantage in establishing a bond with people.
Here are some other ideas on projecting
a positive image:
1. A winning image starts with a good
self-image. A good self-image doesn't follow success-it precedes it. Someone saddled with a poor self-image may fool some
people some of the time, but eventually he'll
fail, unless he comes to grips with his basicself-image. Get some photographs or videotapes taken of yourself when you feel you're
looking your best and study them carefully.
What do you see that you like, or don't like?
Then ask your best friends for their candid
opinions on not only how you look, but how
you carry yourself, how you come across
verbally, how you come across in terms of
knowledge, enthusiasm, sincerity, and
integrity, and what your car or house or briefcase or other material goods say about you.
Promise you won't take offense-and don't!
2. Avoid annoying or distracting habits or
mannerisms. Marcia Grad, in her book
Charisma: How to Get That Special Magic,
calls these distracting habits or mannerisms
"charisma robbers" and includes among
them:
• Tugging at clothing
• Drumming fingers on a table
• Tapping pencils or clicking pens
• Doodling
• Jangling keys or change
• Biting nails
• Cleaning teeth
Not only do these habits make it more
difficult for the other person to hear you,
they also detract from your image.
3. Seek winners, spurn losers. Attitudes
are contagious! So nurture your emotional
well-being by choosing friends who genuinely want you to succeed and who
encourage you. Also, ask yourself about
your surroundings: How's my house or
apartment decorated? What about my
office? Is it drab, or energizing?

books. Or listen to happy music. (Have you
ever heard a mournful banjo tune?) Or make
it a point to go to funny movies or watch a TV
sitcom that makes you laugh. Consciously
reduce your exposure to the negative, whether
it's gossip from co-workers, violence in the
media, or pessimism in your own thoughts.
4. Practice treating everyone as if he or
she is the most important person you'll meet
that day. This will mean seeking to replace
arrogance with empathy-not an easy task for
a lot of people. However, it's a real test of
character, and every once in a while, you'll
learn a big lesson from that "little" person.
5. Make fitness a lifestyle, not a chore.
You don't need an expensive club membership or a cross-country ski machine to
maintain a body that exudes vitality. Forget
the spandex, stopwatches, and ankle warmers, for instance, and just:
• Walk up and down the stairs to your
high-rise office or apartment.
• Ride a bike to the neighborhood convenience store to pick up that quart of nonfat milk.
• Take a nature hike instead of watching
a nature film on television.

Time Management for New Agents

One of the questions that come up from
new agents frequently is: how do I control
my time so that I get everything done? New
agents get wrapped up in the business and the
first thing that they set aside is prospecting! If
you keep putting this important aspect of the
business aside you will end up with lots of
time because you will have no business. Here
are two tips to follow to keep you on track:
Use Your Appointment Book Wisely
Use your calendar, or appointment book,
or Palm Pilot, whichever you use, to your
advantage. Take a month at a time and
schedule in your basics; such as, one hour
per day for prospecting, one hour per week
for the office meeting, three hours per week
for previewing properties, four hours on
Sunday for your open house, etc. These are
appointments with yourself. Schedule
everything else around these. Remember, a
good Realtor never breaks appointments.
Don’t be so quick to change these times. All
of these activities are important.
When you write items in your appointment
book you know what you are going to do that
day and it makes it fun to get up and go. Also
use your appointment book to schedule when
items need to be accomplished, such as sending out your open house invitations, completing your board orientation, picking up your
new signs, etc. When you turn the page and
see something written in the time slot or on
that day — do it! It’s just that simple. Showing
property, doing a CMA, going to an inspection, etc. all come around the other activities.
There’s always time in a day to write an offer
or take a listing; I guarantee you will find it!
It takes a lot of self-discipline to stick to
your schedule. The great news is that if you
do it regularly it becomes habit and the time
just flies. You hear agents complain all the
time that they don’t have any listings or buyers, and yet if you look at their schedule, there
is also nothing written down about prospecting on a consistent basis. If you start your
career using your appointment book and stick
to it — you are going to be successful.
Use a Journal
In this business there are so many notes
that you have to take. You take notes of
something you want to remember at your
office meeting, you note phone numbers
because they won’t stay on your voice mail
forever, you take notes at seminars and training classes, you takes notes when you go out
on a listing appointment, you take notes at
your open houses of different buyers needs,
and so on. Where do you keep all these
notes? Many people are using their Palm
Pilot for these, some use paper napkins. The
most efficient way is to have all your notes
in one location. I suggest using an inexpensive 5 x 8 spiral binder. Write the date at the
top of each page and write everything in this
book or journal. You will never lose information again. You can roughly remember
the date that something was done, just go to
that date in your journal and voila it’s there!
Keep things simple. When you are new you
have lots of notes. Put them in one place so
that you can refer back to them frequently. If
you make this a habit you will have journals
with notes that you can use your entire career.
And, no fancy cost for a time management
system. Just good old common sense.
Using your computer is fabulous and I
would be lost without mine, but it is not
convenient at all times. A simple journal
can always be used. It is just a matter of getting used to it.
That’s it! Write the basics in your calendar
and do them. Keep track of all your notes in
one place. These two simple things will help
you control your time and keep you on track.

to your desk to strike up a conversation.
Do you have “toys” and gadgets on your
desk that people feel compelled to touch as
they pass?
Do you keep several projects within sight
on your desk so that you’re tempted to go
from one to the other randomly?
Do you stop to take calls while you're trying to do creative work? Do you ask other
people for opinions and then think about your
rebuttal rather than listen to their response?
Contrary to what many people claim, you
cannot do two things at once as well as concentrating on one task until it's complete.
Create a mental oasis for creative thinking/work. Albert Einstein once stated,
“Imagination is more important than knowledge.” However, you cannot write the Great
American Movie, your annual “accomplishment” report, or a $10 million client proposal without thinking space. For your creative
projects, find a non-routine environment.
Go to a cabin or resort in the mountains
or rent a hotel room. Even closer, less exotic places will do: your backyard patio, the
conference room down the hall, a friend's
office, the neighborhood park, or the
library. The idea is to see different scenery
so that routine tasks and paperwork can't
nag at you from the corner of your eye.
Move from Left-Brain to Right-Brain
Activities. Left-brain activities include
tasks such as fact gathering, reading technical information, writing a report. Rightbrain activities include creating visuals to
use in a presentation, giving constructive
feedback to a boss, planning a marketing
strategy to win over a prospective client.
Most of us have a preference for one
brain dominance. Striking a balance
between both kinds of activities can produce the most creative results and satisfying emotion, not to mention increased energy and motivation.
Think Rationally. Are the goals, pace,
and schedules you've set for yourself reasonable? Even possible?
Make an accurate assessment of what
you can do, and download or postpone the
rest. Keeping “unaccomplishable” duties
dangling in front of you will ensure that you
never feel the satisfaction of accomplishment and always feel the frustration of
being overwhelmed.
When the mental clutter spinning around
your head prevents you from working or
thinking effectively, remember these tips.
Ridding yourself of emotional, irrational,
and even legitimate distractions will help
you bypass mental roadblocks to achieve
maximum productivity.
●
Would you like to make an attitude
adjustment with high payoff, a clearer
mind, and reduced stress? Whether you're
overwhelmed by unfocused mental activity,
have become sidetracked by emotional
concerns, or simply want to improve your
intellectual performance, the following tips
will help you think, work, and feel better.
Plan worry time. When you catch your
mind wandering into worry, postpone the
thoughts until later. Schedule yourself a time
to think about that worry; jot it down if you
must, with titles like: “What to do about...”
Sort your worries into those that are real
and those that may never happen. For those
that may never happen, promise to worry
about them only when and if they happen.
To lessen the anxiety during the waiting
time, use the old principle: “What’s the
worst thing that can happen to me?" "Will I
survive?” “How will I cope?”
For real worries, outline steps to prevent the
situation, correct the problem, or minimize the
impact. Then take action toward a resolution.
Resolve ongoing conflict with others.
When we find ourselves in conflict with
another person, we have four choices. The
issue is deciding on the most expedient
choice for any particular situation.
• Accommodation means giving in to
the other person.
• Compromise involves giving up some
of your goals and wants to reach a mutually satisfying solution.
• Overpowering others insists on a certain
course of action, even if angering others.
• Resolving the issue develops new
alternatives so everyone reaches their goals
and feels good about the situation.
On occasion, any of these actions or reactions are appropriate.
Choose the best action or reaction. Then
let go of the situation. Refuse to over commit yourself. If you're tempted to take on
more than you can realistically handle, ask
yourself these two questions:
• “Does this activity fit my goals and
values?”
• “Why am I being asked to do this taskbecause no one else has the expertise or
because no one else will say ‘yes’?” If you
don’t like the answers to these questions,
pass up the “opportunity.”
If you have difficulty getting “no” out of
your mouth when someone seems to have a
real need and a good cause, think of the
“no” in a positive way: Focus the conversation on what you have decided to commit to
rather than on what you have decided not to
commit to.
Concentrate; don’t invite interruptions.
You may be unintentionally inviting interruptions that break your concentration. Even
