Few addresses in Toronto evoke such instant cachet as the dense tract of land bordered by Davenport Road to the north, Yonge Street to the east, Bloor Street to the south and Avenue Road to the west. That said, Yorkville has more than just a fancyschmancy side. J.P. Rasminsky, an investment J.P. The location is amazing,” he says of his one-bedroom unit with west-facing balcony, where Rasminsky opens the day with his laptop and coffee. At night, he likes the option of being able to dine upscale in the ’hood (Amber, Four Seasons, One), but prefers the vicinity’s hoi polloi haunts (The Oxley Public House, Remys, Dimmi Bar & Trattoria, Trattoria Nervosa and — a favourite — Carens Wine and Cheese Bar for its casually cool outdoor patio and bistro menu). “Everything you need is minutes away,” Rasminsky continues. “You’re at the intersection of two major subways. If I want a grocery store, there’s Whole Foods or Pusateri’s. And the area is saturated with coffee shops.” But, it’s the fact that he can go car-less that has proven really convenient. This past winter, while everyone was cursing Mother Nature, Rasminsky’s work commute involved a quick dash across the street, often without a jacket over his suit. “I didn’t have to worry about trudging through the snow. He lists the proximity of the dynamic Libeskind-designed ROM and the Gardiner Museum by way of examples. “It’s a location everybody in Canada and many people in the world know because whenever they visit Toronto they likely spend time here, having drinks or dinner at the Four Seasons.” As for demographics, Yorkville isn’t restricted to bejewelled ladies toting their mini poodles to lunch. Barnicke says his project is attracting a wide mix. “We’re seeing domestic and overseas parents who have kids at U of T and they want them to live close (to school) in a safe area. You’ve also got people who live or work in New York City and want a pied-àterre in Toronto. We also have empty nesters who have a place in cottage country or Florida and want a good size one- or two-bedroom for the shoulder seasons, and of course investors who see the long-term value in this location.” In answer to the naysayers who would call Yorkville an urban jungle, Barnicke cites Ramsden Park — a lovely stretch of green that runs north of Pears Avenue, between Avenue Road and Yonge Street. The park offers tennis courts, skating rinks in winter, a kids’ wading pool and an off-leash dog park. Additionally, there’s the modern Yorkville Park, punctuated by The Rock, a 650-tonne chunk of the Canadian Shield where visitors often perch to snap selfies. Bistro tables are also set up nearby for people-watching and ice-cream eating. Rasminsky himself is a nature lover who praises Yorkville’s greenery. “My condo is 10 minutes to U of T’s Philosopher’s Walk,” he say of the leafy footpath located in the St. George campus, where architectural aficionados can also get their daily fix of 19th-century eye candy. “The Annex is close and Rosedale ravine isn’t far, either. I cycle there on weekends.” Whether sporty on Saturday afternoons or snazzy on Saturday nights, Yorkville, as most would agree, epitomizes the good life. And you can’t argue for aspiring to that. As part of the campus expansion, a massive instructional centre opened in 2011 to house the Management, Computer and Mathematical Sciences programs. As a result, UTSC is attracting a substantial number of international students who need close, quiet and clean accommodations. Here are some tricks for dealing with smaller space gardening: • Leverage your CUBIC footage – plant vertically for lots of impact in a small footprint. Vines or columnar plants are great for creating privacy or blocking an unsightly view. Hanging baskets add colour at eye level and can be enjoyed from inside the home. A big trend these days is to mix ornamentals and edibles. Don’t be afraid to plant things together – herbs and lettuces can be tucked in with annuals, perennials or shrubs. Always make sure they have drainage, and always use a quality container mix, not soil from the garden. And be ready to feed through the season. • Make your watering as easy as possible (especially on a balcony – you’ll need it). If you have an outdoor tap, use a hose that recoils; if not get a large watering can. For singer, songwriter and actress Fefe Dobson this couldn’t be more fitting. With her third studio album complete, Dobson is prepared to leave a musical legacy and make her mark as one of the premiere voices in pop/rock music. Following the success of her sophomore studio album Joy released in 2010 (21 Music), Dobson earned two Canadian certified platinum singles with “Ghost” and “Stuttering” and a gold single for “Can’t Breathe,” a collaboration with legendary music producer Bob Ezrin (KISS, Pink Floyd) and recording artist Orianthi. During this celebration of joy in her life, Dobson reconciled with her biological father who had been absent for the majority of her adult life. While her compositions embody the allure of a dense forest, it is the obscure manner in which she manipulates these influences that keeps her audience captivated. She draws her inspiration from nature, but her paintings are deliberately abstract. She applies the paint to the canvas entirely with a palette knife, often mixing the colour directly onto the canvas. This method promotes spontaneity, and she allows herself to be guided by intuition as the artwork begins to take shape. Bands of vivid colour are smoothed onto the canvas in sections, and then blended by the edge of her knife. Her pigments dance vertically in rhythmic columns of bold reds, oranges, and her omnipresent turquoise blue. As in nature, loose patterns form in her paintings, which the mind is unintentionally drawn to recognize. the power of natural abstraction “I do not simply paint a forest. Instead, I try to capture the wondrous emotion that it evokes. Working in an abstract style allows me to use my creativity freely. For me, creativity is to accept the unknown, to welcome the unexpected as an opportunity, and to not be afraid of failure. BY MARTIN RUMACK, E B.A., L.L.B. very owner and tenant of a unit should obtain their own Standard Condominium Insurance Policy providing both loss and liability coverage. That policy must be in effect the day one becomes an owner, or the day one moves in as a tenant. With this insurance in place, there will be no insurance coverage gap between the Condominium Corporation’s policy and that of the owner or tenant. Otherwise, you’re at risk. Here’s why. RESPONSIBILITY FOR INSURANCE DEDUCTIBLE Owners should review their policies, and consult with their insurance brokers to confirm the extent of the coverage provided by their policy. Similarly, if you rent out your unit to a tenant, ensure that the tenant’s insurance policy provides this coverage. Changes to the Condominium Act, 1998 also enabled a situation where, by by-law, a unit owner may be held liable for the insurance deductible payable by the Condominium Corporation under the insurance policy. In other words, the Corporation may choose to transfer liability for paying the deductible to the unit owner. Normally, each time the Condominium Corporation makes a claim against its policy as a result of an insurable loss, a deductible is charged and is payable – usually by the Condominium Corporation via the monthly maintenance fees paid by all of the owners. The payment of the deductible is made regardless of whether the damage: • is caused by an accident or careless act of an owner or tenant of a unit; • originates in a unit; or • is caused by the neglect of an owner or tenant in maintaining and repairing the unit. Essentially, all owners subsidize the cost of the insurance deductible payable for insurable damage originating in a unit. But to ensure fairness amongst all owners, a properly drafted and enacted by-law sets out the circumstances under which the Condominium Corporation can transfer the responsibility for the deductible to individual unit owners. The by-law can permit the Condominium Corporation to charge the lesser of the deductible payable and the actual cost of EXPERT ADVICE A STANDARD CONDOMINIUM UNIT DEFINED For buildings constructed after May 1, 2010, the Act requires builders to include with their Agreements of Purchase and Sale a schedule listing what a standard unit consists of. However, in many cases these schedules provide only bare-minimum levels of compliance, are prepared for sales document purposes only, and do not address equitable matters. Any items subsequently added to a unit but not contained in that builder’s schedule (or one amended or newly-added by the Board of Directors) constitute an “upgrade” to the unit. This means that loss or damage to these upgrades are not covered by the Condominium Corporation’s insurance policy and aren’t considered an “insurable loss”. BEWARE OF GAPS IN COVERAGE A major change introduced by the Condominium Act, 1998 was to require all Condominium Corporations to pass a by-law, for insurance purposes, defining a “standard unit” of the Condominium building. Every Condominium Corporation must also obtain and maintain insurance for both a standard unit and the Common Elements. It is important to note that improvements made to the units are not covered. This means that the Corporation’s insurance is not required to - and does not - provide any insurance coverage for any betterments, improvements, or upgrades contained in a unit in the event of an insurable loss, such as a fire or flood. repairs to an owner whose unit is the source of an insurable loss. It does not permit the Condominium Corporation to transfer the responsibility for paying the deductible to any owner where damage originates from the Common Elements, or where it is caused by an act or an omission on the part of the Condominium Corporation or any of its employees, contractors, or agents. The good news is that the typical comprehensive condominium owner’s insurance policy may include coverage for the corporation’s deductible in the event it is transferred to a unit owner pursuant to the by-law. It’s often a big move, and the transition can be easier with the help of condo design expertise. When I was approached to participate in the transformation of this client’s lifestyle from a traditional home to a snazzy contemporary condo, I was delighted to embark on this journey with them. Naturally, they anticipated missing the home they were very comfortable in. However, I was sure that my custom-created design suited to their needs would leave them wondering why they did not do it sooner. The first step in an interior design project is the interview, where I gather all the needs, wishes and budgetary concerns of my clients. I wasn’t surprised that their main concern was storage, because they were coming to the condo from a larger house. Dishes, glasses and platters for entertaining, books, home office, and clothing needed to be hidden away, yet easily accessible. Built-ins are not the most budget-friendly solution when renovating, but are the best way to solve storage issues. In this case, I designed the main wall in the living room to house a new contemporary fireplace, floating shelves and cabinetry with touch-latch door mechanisms for a clean look. CONDO ELITE S UM M ER | 23 DESIGN f e at u r e d e s i g n e r e v e ly n e s h u n : c r e at i v e c o n d o s pa c e The client’s second request was to make their new condo home feel like a hotel suite. This set the tone and inspiration for the type of furniture, colour scheme and design style I would adopt for this project. Entertaining regularly, these clients needed a sideboard with lined drawers for their prized silver cutlery as well as to serve as an area for hotplates and drinks. A Cambria countertop was specified for this area so that there would be no concern of wear and tear on the beautiful deco-inspired piece. Mirrors reflect the windows on the opposite wall to expand the area visually. Off the entry hall a pocket door was installed into the tiny room to create an area for the home office. A built-in unit was designed for a desk, TV area, filing storage, and speakers. Our favorite feature in this room is a secret door disguised within the shelving to open into a small storage room behind the built-in. Though there was a walk in closet in the master bedroom, a carefully crafted built-in closet was designed for the lady of the condo with storage for purses, accessories and clothing. This unit was designed to blend into the existing architecture with crown mouldings and millwork details to appear as though it was always there. P urchasing a condominium for rental purpose has become an integral part of the investment strategy for an increasingly large and diverse group of people. When we started reporting on the Toronto condominium rental market in 2001, the city was coming off a rental vacancy rate of 0.1 percent. Builders were working hard to complete another 18,000 new units that were under construction as reported by CMHC. Investors and tenants alike were also waiting for the completions, many of which would become rental units. We predicted this cycle would continue for many years. Since that time the market has rewarded most investors with admirable and reliable returns. In its March 2014 report, CMHC estimated that in the City of Toronto alone, there were over 45,000 new condo units under construction. Approximately 43 percent of the newly completed condo units added to the market for 2013 were rented with the average rent up 9.5 percent from 2012. WILL THIS TREND CONTINUE? Do a quick search on the Toronto area Condo market and you will find forecasts from a wide variety of reputable sources. It can get confusing as the predictions range from the most pessimistic to the most optimistic. One thing is for sure though — the condo market will let us know where it’s heading...when it gets there. What we do know is that this category of housing has continued its trajectory and looks poised to keep performing well, albeit at different intervals of growth and return for the stakeholders. Rents have increased dramatically since early 2011 when a shortage of rental units resulted in bidding wars on many of the available suites. Although this trend has been diluted by a greater supply of rental condos hitting the market in late 2013, we are still experiencing steady rental demand and a solid rental rate increases in many specific buildings. BEFORE RENTING YOUR CONDO You should be fully aware of the contents of the declaration, by-laws and rules that govern the specific condominium building for which you have an interest. When you lease your unit, you are required to; a) Notify the condo corporation, within its specified time period that your unit is leased. b) Provide the corporation with the lessee’s name, the owner’s address, and a copy of the lease or summary in a format prescribed by the corporation. c) Provide your tenant with a copy of the declaration, by-laws and rules. As the unit owner you are required to take all reasonable steps to ensure that your tenant complies with the Condominium Act, the declaration, the by-laws & rules. If you terminate the lease of your unit you are required to notify the corporation in writing. If you assume interim occupancy of a unit – that is, before it becomes registered – the developer has the right to withhold consent for you to rent it out, or in the alternative may charge a fee for allowing you to rent the unit, prior to the buildings’ registration. Embracing an art deco aesthetic in the indelible three-storey lobby, designer Lisa Boyer will play with rich textures, symmetry and bold lines. Once a playground for the rich and famous, the icon will return to a bustling hub, the Gatsby-embellished lobby will become a place for residents to welcome guests and socialize, complete with a sleek coffee bar and baby grand piano. “The Royal Connaught is something incredibly unique, it is an architectural landmark with such a rich and storied history.
