PARAGON Award
A community outreach program that
helps provide homeless families, women
and children with much-needed shelter
and services at four state housing facilities
won a special award for the AMA.
The association is the 2009 recipient
of the National Apartment Association
(NAA) PARAGON Community Service
Award for its Big Hearts for Little Hands
community outreach program. The AMA
received recognition during a special ceremony at the NAA Education Conference
and Expo held June 25-27 at the Mandalay Bay Resort and Casino in Las Vegas.

The Legislature, which starts the second
Monday of January, technically must complete its work, including balancing the
budget, in 100 days. This means it must
complete all legislative matters and send all
bills to the governor by early April. In all
my years of lobbying, I have not once seen
legislators accomplish this, although in
2000 they did complete their work by the
end of April.
After 170 days of session, many late
nights and, at times, a rather inhospitable
environment, the Legislature transmitted
the budget bills and approximately 200
general bills to Gov. Jan Brewer. The budget bills actually missed their constitutional
deadline of July 1 by about six hours, arriving on the governor’s desk at 6:30 a.m.
The Legislature then adjourned sine die at
7:30 am. By about noon that same day, the
governor promptly vetoed virtually all the
budget bills except the General Appropriation bill (the money bill), which she lineitem vetoed several provisions that had the
effect of reducing cuts and increasing
spending for certain agencies, including
the Department of Economic Security, the
Department of Environmental Quality, the
Department of Health Services, state universities and K-12 education. The line-item
veto and the veto of all other budget bills
had the effect of increasing the total budget by $1.3 billion and putting another
$2.3 billion of federal stimulus dollars in
jeopardy.
The governor called a special session to
complete the budget and refer a temporary
sales tax increase of 1 cent to the Arizona
voters. Legislators returned to the Capitol
on July 6 to continue budget negotiations.
They passed two significant bills that day,
which the governor signed to protect the
$2.3 billion in federal stimulus dollars.
The bills include a fix to the K-12 budget,
which increased school spending from
$3.2 billion (included in the original budget) to $3.6 billion, as well as appropriations for health and welfare. There is still
much negotiation on the sales tax referral,
as many Republicans in both the House
and Senate are adamant in their opposition to the governor’s plan.
As of July 13, over 200 bills were signed,
vetoed or allowed to go into law without
the governor’s signature. These laws will
become effective on Sept. 29 unless they
were passed with an emergency clause.
AMA LEGISLATION
The AMA started the session with five
proactive bills. However, due to the difficulties of the budget and the fact that the
Senate did not hear any bills until the last
two weeks of the session, the Government
Affairs Committee determined it was in
our best interest to hold off on our bills
this year and save the political capital for
more critical fights we may face in 2010.
The following is a summary of the proactive bills and other legislation the association was supporting, opposing or
amending during the session to protect
our members.
AMA PROACTIVE BILLS
HB2167 – Water Districts. Introduced by
Rep. Bill Konopnicki, R-Safford, to address
inequity in water rates that AMA members
are subjected to in Oro Valley (Metro
Water District), the bill requires water dis-
tricts to have just and reasonable rates and
not allow one user class to subsidize
another. Although this bill did not get a
hearing due to opposition, we will continue to work on this issue with the bill
sponsor and some of our elected officials
from southern Arizona.

HB2259 – Development Impact Fee
Reform. The proposed bill addresses
municipal impact fee processes and procedures. Introduced by Rep. Andy Biggs,
R-Gilbert, the bill is identical to the legislation vetoed by former Gov. Janet Napolitano last session. Many of the bill
provisions are the same ones included in
last session’s vetoed legislation, so we will
continue working with legislators this summer to address the reform needs. In addition, the vetoed budget contained a
SB1069/SB1140– Justice Court Fees.
Introduced by Sen. Jonathan Paton, R-Tucson, the legislation would eliminate the
justice court automatic annual increase.
Although supportive of our concerns, legislative leaders felt they could not impose
this bill upon the courts due to budget cuts

SB1277 AZ Landlord Tenant Act Amendments. Rep. Barbara Leff, R-Paradise Valley, introduced the legislation on behalf of
the AMA. The bill will allow for an immediate eviction if criminal activity occurs off
of the property. Activities include murder,
gang activity, prostitution, selling or manufacturing drugs and criminal syndicate
activity. It also makes the resident responsible for guest activities if they are granted
access to the property.
HB2503 Register of Contractor – Residential Recovery Fund. Introduced by
House Majority Leader John McComish,
R-Ahwatukee, the bill will allow owners of
single-family rental homes to participate in
the residential recovery fund. The fund
currently is limited to owners that occupy
their single-family home. The bill sponsor
is willing to re-introduce this bill during
another future session, but could not move
forward with it this session as the state
once again swept the Contractor Recover
Fund, leaving a balance of less than $1 million. Sen. Leff will convene an ad hoc
stakeholder group this summer to address

BILLS OF INTEREST
HB2080 Contractor Retention – The legislation introduced by Rep. Laurin Hendrix, R-Gilbert, would have changed the
retention requirements as well as many
other changes to the state prompt pay statutes. After much negotiating with the subcontractors associations, we are still not
able to reach agreement on retention
reform. We expect this bill will be back
HB2073, SB1007 and SB1107 – State
Equalization Tax Rate. With a whole host
of supporters, the Legislature saw the introduction of three bills to eliminate the state
equalization tax rate set to return in 2010.
(The Legislature has already calculated the
$250 million annual cost into the 2010
again next year, as we have seen it ever year
for the last seven years.
HB2220 & SB2167 – Private Property
Trespass Towers. Introduced by Rep. Biggs
and Rep. Ed Ableser, D-Tempe, the bill
establishes new regulations for private
property trespass towing companies. The
provision of concern to the AMA, which
was also included in last year’s bill that we
defeated on the last day of session, is that
towers can bill the property owner for
towed vehicles if the owner refuses to pay
towing and storage fees. The legislation
requires towing companies to release the
vehicle even if the owner does not pay.

HB2269, HB2464, HB2545 HB2601,
SB1108, SB1210, SB1413 Foreclosure,
Tenant Notification. This is the hot topic
of the session, as you can see by the number of bills introduced on the subject.
HB2269 was the only bill to move through
the process; however, it ran out of time
and did not make it to the governor’s
office. Heavily amended in the House to
address AMA concerns regarding notice
and security deposits, the bill as introduced required the landlord to provide
notice. We urged the bill sponsor to
require the mortgage company to provide
the notice. In addition, the bill would have
required the landlord to use the security
deposit to pay for the final month’s rent,
even if the security deposit is less than onemonth rent. Fortunately, the bill sponsor
agreed to remove this controversial provision.
SCR 1026 Secret Ballots Protecting Fundamental Rights. Introduced by Sen.
Paton, the bill will prevent unions from
organizing in Arizona without a secret bal-

Introduced by Sen. Russell Pearce, R-Mesa,
the legislation will require applicants to
prove legal presence to the public housing
authority. It will not require the landlord
or its agents to verify immigration documentation. The bill did pass the Senate

Imagine my surprise to find out
you had no idea your resident was
looking to relocate. You sounded a bit
perplexed when you told me you have
been working with the back-rent pay-
ments for the past three months.
In the event you are the landlord I
am addressing, let’s talk straight.
If a renter is living paycheck-topaycheck and experiences a drop in his
or her income, how is the individual
going to catch up? Times are tough and
evictions are down. This fact tells me
landlords are allowing residents to live
in their properties and not pay rent.
The landlords I talk to in this position
are full of hope, as much hope as the
residents that promise to pay the rent
in full as soon as….
I have one particular renter who has
habitually paid rent late. Rent is due
on the first day of the month, and I
consider it late on the second day of
the month, which is the day I begin
charging late fees.
The resident recently came in to
sign a five-day notice on the fifth day
of the month. (If I don’t receive the
rent by the eleventh day of the month,
I contact my attorney; this has only
happened once in the past four years.)
I received a phone call from the
renter’s father, who informed me that
he cannot afford to continue paying
rent at the property. (The father called
without his son’s knowledge.) It seems
my resident has borrowed money from
everyone for rent through the years.
His father not only pays his rent, but
also babysits his grandchild and drives
his son around the Valley to his jobs
whenever the renter’s vehicle is inoperable.
It sounded like he pays his son’s
rent to avoid conflict. Regardless of
the arrangement, I do know that by
not adjusting my procedure, I am not
going to be the one paying his rent.
I suspect unless something does not
change in this individual’s life, he may
owe the last month’s rent and attorney
fees one day. But I guarantee he won’t
owe me three month’s rent before I file
an eviction.
If you allow your residents to string
along rent payments, use a partial rent
agreement. Set a time and money limit
for yourself, which you will not compromise before filing an eviction. AMA

Associate Member Council Meeting Recap: Attendance Keeps
Growing!
Our attendance at the Associate
Member Council meetings continues
to grow, and I’d like to thank those
who attended the May meeting, especially those of you who remembered to
RSVP! The following is a short recap of
our last meeting.
AMA Member Relations Manager
James Tunnel began the meeting with
details on upcoming AMA events. He
also introduced and thanked AMA
staff members Misty Oxborrow and
Rob Schmitz from the events and
education department for their hard
work in putting together both the
Phoenix Education Conference and
Trade Show and the Tributes Awards
presentation.
In addition to the networking and
exchange of business cards, attendees
had the opportunity to provide information about their company and the
services they offer to help cross-network
and obtain more business through the
AMA. I think it is a sign of the times
to see the same people who are now
working for different companies, and it
highlights the importance of networking amongst peers.
AMA President Tom Simplot introduced the meeting speakers: Cheri
Hull, independent business consultant
with Profit by Process (and former
director of membership for the AMA),
gave an energetic talk on “Marketing
in a Tough Economy.” She explained
how we are presenting our “brand” for
both ourselves as well as the companies
we represent. Hull prefers to rename
the “Tough Economy” as the “Touch
Economy” instead, and asked attendees
to more closely consider and be aware
of the message we communicate to
ensure that it is proper and consistent
across the different forums, such as
networking, traditional marketing and
social media. She highlighted this by
explaining that the average person
receives approximately 3,000 brand
messages every day!
I gave a brief talk about the concern
over the current economic conditions
and reviewed the importance of not
being so eager to obtain new business
that you forget the importance of earning that business. I challenged all of us
to pay close attention to the information we focus on and how that information affects our attitude.
AMA Chair of the Board John Rials, managing director of Real Estate
at Greystar Real Estate Partners, spoke
to the group about how to do business
with his company. He also provided us
with his thoughts on the economy and
which direction he thinks it is heading.
He was also very gracious in answering
a myriad of questions on both topics.
We concluded the meeting with two
prize drawings. Suzanne Scoleri of All
City Towing won a copy of Working
with Emotional Intelligence by Daniel
Goleman, which Cheri Hull donated.
Pasquale Piscitelli of Intelligent Video
Systems was the lucky winner of a luncheon with John Rials.
It is my sincere hope that those of
you who attended the Council meeting
found it worthwhile, and for those of
you who didn’t attend, please consider

Higher gas prices and a down
economy may have helped save lives in
2008, as the National Highway Traffic
Safety Administrations (NHTSA) reports that 2008 had the lowest number
of traffic fatalities in 47 years. Still,
37,300 people dead, a 9 percent drop
compared to 2007, are too many.

Take Appropriate Steps When Identity Theft Occurs
In the business of property management, there exists a continuous
exchange and collection of personal
information pertaining to each and
every renter. The collection of personal
information is essential to the efficient
and effective management of residential rental properties. But what happens when this information gets into
the wrong hands?
The incidence of identity theft in
the United States is on the rise. According to the Federal Trade Commission’s (FTC) Consumer Sentinel Network
Data Book for January to December
2008, there were 313,982 identity theft-
related complaints made in the United
States in 2008 alone. Among those,
Arizona had the highest per capita rate
of reported identity theft complaints.
Due to the sensitive and private
nature of the information contained in
resident files, it is important that when
and if a breach of this information
occurs, both the landlord and affected
renters take certain preventative measures as quickly as possible.
The first step management should
take is to immediately contact the local
police department, the FTC and the
three main credit reporting agencies
(Equifax, Experia and Trans Union) to
report the theft. The landlord should
also circulate a letter to all affected
residents to apprise them of the situation and provide them with as much
guidance as possible in the prevention
of the occurrence of identity theft.
There are several preventative
measures affected residents can take
as well. First, they should contact all
of their creditors and any financial institutions where they have accounts to
inform them that personal information
concerning their credit has been stolen.
Renters can ask them to put a hold
on use of their accounts until positive
proof of identity is apparent. They may
also request placement of a temporary,
90-day fraud alert on their credit cards.
The affected residents should also
contact the three main credit reporting agencies and request placement of
a fraud alert on their credit report as
well. This can assist in preventing the
identity thief from opening any new accounts in their name. Another preventative measure the affected residents
can take is to contact their local police
department and ask them to place a
flag on their driver’s license. This may
be helpful should someone attempt to
provide the police with their license
number and date of birth during a traffic or other law enforcement stop.
While it is always smart to monitor your credit reports for any signs
of fraud—such as accounts that are
not yours or debts that you cannot
explain—if a breach occurs, such monitoring is imperative. Victims of identity
theft are entitled to one free copy of
their credit report from each of the
three main credit reporting agencies as
soon as they place a fraud alert on their
credit report, regardless of whether or
not they have already obtained the one
free credit report they are entitled to
for that year.
While there is no way to ensure
that identity theft thieves will not steal
sensitive and personal information,
and there is no easy cure if it happens,
taking proactive and immediate measures to prevent the use of such stolen
information can alleviate much of the
potential emotional and financial damage that can occur. AMA

Gilbert
The town passed a sales tax increase of
$0.25 per dollar. The new tax rate will be
1.75 percent effective on Sept. 1. It is critical to notify your Gilbert residents of this
increase by Aug. 1. We understand there is
a movement underway to refer the sales tax
increase to the ballot, and volunteers are
currently circulating petitions. A new
mayor and two new Council members
took office on July 1.
LOCAL UPDATES
TUCSON
Sales Tax on Rent. The Tucson City
Council did not include this provision in
the budget after a couple of months of
grassroots efforts by our members and residents.
Neighborhood Preservation Ordinance. The mayor and City Council
approved changes to their neighborhood
preservation ordinance (NPO), including a
fee for re-inspections of nuisance properties if management does not rectify any violations. The proposed fee is $75 per
inspection (not violation), and the city will
charged the fee to properties (owner-occupied and rental) if the owner responds to
the initial citation and cleans up the property.
Buckeye and Glendale.
Both cities are in the process of increasing their impact fees. The Glendale fees
increase in nominal; however, Buckeye is
proposing a change to its methodology
that will have an adverse and inequitable
impact on multi-family properties. We are
still working with the mayor and Council
members in Buckeye to address concerns.
In addition, Buckeye will be increasing its
water and wastewater rates. AMA
