Obama Administration Tightens Overtime Exemption for
White Collar Dealership Employees
A
new U.S. Department of Labor rule
requires that by December 1, 2016
dealership “executive,” “administrative” or
“professional” (EAP) employees primarily
compensated by salary must earn at least
$913 per week (now $455) or $47,476
per year (now $23,660) to be exempt
from overtime. It will also increase the
“highly compensated employee” salary
threshold to $134,004 per year (now
$100,000). The new “white collar”
overtime rule does not change the duties
tests for these employees.
The new rule will allow up to 10
percent of the salary threshold for EAP
employees to be met by nondiscretionary
bonuses, incentive pay or commissions
if paid at least quarterly. This contrasts
with the existing requirement that the
thresholds be met only with salary. So
long as “highly compensated employees”
receive at least $913 per pay period on
a salary or fee basis, they may be paid
on discretionary bonuses and incentives
(including commissions) toward their
annual compensation threshold. The
rule also establishes a highly controversial
process by which thresholds adjust
automatically every three years, starting
in 2020. Like other aspects of the rule,
the automatic adjustment mandate likely
will be challenged in court.

white collar rule provides an overview of
how it will impact dealerships and their
employees. NADA’s Dealer Guide to the
Fair Labor Standards and Equal Pay Acts,
which describes how dealership employees
generally qualify for the “white collar”
overtime exemptions, will be revised
to reflect the new mandates before the
December 1 effective date. The guide details
how dealership employees generally qualify

Addiction Is a Costly Business Problem

Addiction hurts the bottom line in
many ways:
•Addiction costs U.S. employers $260
billion each year in lost productivity.
•On average, untreated addiction
in the workplace costs employers
$1,700 per employee, per year.
•Addiction problems cost businesses
500 million workdays annually.
•People with an alcohol problem use
twice as much sick leave and are five
times more likely to file workers’
compensation claims.
•Health care costs for employees who
have addiction problems are twice
those for other employees.
•Individuals with addiction problems are
far more likely to have worked for three
or more employers in the previous year.

2016 Legislative Session Wraps Up

session will have wrapped up. Many
legislators and politicos will have already
forgotten what happened and will be
focused on the September primaries and
the November general election.

Awareness Month and June is
Motorcycle Inspection Month in NH.
That means the riding season is here. We
in NH love our motorcycles. Our state
is one of the top in the nation when it
comes to motorcycles owned per capita.
With that in mind, NHADA Loss
Prevention wanted to take the opportunity
to discuss safety concerns and best
practices for motorcycle dealerships. As
with most risk management activities for
shop owners and managers, safety starts
at the time of hire.
Incorporating NHADA’s Strategic
Hiring Guidelines will help you hire the
correct person for the job. Employers
should insist upon candidates with: a
motorcycle license, clean driving record
and a negative pre-placement drug test.
A motorcycle safety course or refresher is
also an excellent component to new hire
orientation.

motorcycle dealership employees are the
road test and test drive. Roadways are
becoming increasingly more dangerous
due to growing traffic volume and a
distracted-driving problem reaching
epidemic proportions. Motorcycle
operators have substantial disadvantages
in that they can be hard for drivers to see,
and they have no protection from a crash.
We suggest you learn about the
Motorcycle Safety Foundation (MSF), a
not-for-profit organization sponsored by
BMW, BRP, Ducati, Harley-Davidson,
Honda, Kawasaki, KTM, Piaggio, Polaris
Motorcycles, Suzuki, Triumph and
Yamaha. For safety information or

The NH Division of Motor Vehicles
(DMV) offers a variety of motorcycle
rider education courses from beginner
to advanced, to returning riders. These
popular classes are held in various
locations statewide for an affordable price.

The foundation is an excellent safety
resource with “quick tips” providing best
safety practices, checklists and more.
“Motorcyclists should pretend they are
invisible to car drivers,” said Ken Glaser,
MSF’s director of special projects.
“If you assume others on the road can’t
see you on a motorcycle, you will tend to
ride in a hyper-aware mindset and notice
much more detail of your surroundings.
“Pretending you cannot be seen by
others will help you take the initiative to
ride more responsibly and defensively,”
he said.

easy-to-see riding gear that stands
out.

does make riding a motorcycle more
difficult.
•Lastly, on road safety, a clearly communicated zero tolerance policy for
any type of horseplay or aggressive
riding is imperative. Many serious
injuries result from operators doing
things they shouldn’t.
In addition to road safety issues, injuries
can result from the servicing and handling
of motorcycles, which are heavy and
awkward to move around and can cause
sprain- and strain-type injuries when
employees are incautious. Technicians
should use great care when lifting bikes
with a lifting device or forklift. Any
employee who operates a forklift is
required by OSHA to be trained and
authorized.
Care and proper Personal Protective
Equipment (PPE) needs to be used when
handling and charging batteries and
working on fuel system components to
help technicians avoid chemical burns
and the potential for fire.

Legislature – continued from page 5
were a few carryovers from the 2015
session; one establishes a committee to
discuss workers’ compensation soft tissue
injuries and one would change the statute
of limitation requirements for indemnity
payments. As of this writing — the last
week of the session — these bills were still
awaiting final recommendations.
We advocated for, and helped get
passed, an incentive program for trail
club membership registrations affecting
ATV users similar to those for current
snowmobilers. It is now up to the NH
Off-Highway Vehicle Association to get
the infrastructure in place for a successful
program. NHADA successfully asked to
have the start of the program extended to
January 2018.
We successfully lobbied against
repeal or modification of several bills
on distracted driving and the handsfree law. Allowing this law to remain
in place, as is, for another year helps
to ensure operator awareness of the
law and provides enhanced data on the
effectiveness of the hands-free law.
This session included two vehicle titlerelated bills, which NHADA opposed.
One bill would have changed the law
requiring only those vehicles 15 years or
newer to have titles. This would cause NH
to revert to the old way of doing things.
We also helped defeat a bill to eliminate
the NH Div. Motor Vehicles’ title bureau.
NHADA defended the title bureau, citing
the need for vehicle titles to protect both
lenders and consumers.
We thank all of you for answering
our call when we ask for your assistance
in our grassroots efforts, be it through
phone calls or emails to your legislator
or by attending a hearing and possibly
testifying; thanks to those brave folks who
were willing to do that.

Make Life Easier, Reduce Title Errors
Here is another friendly reminder from our good friends and
partners at the NH Division of Motor Vehicles (DMV) title
bureau: Reducing common title paperwork errors can make
life a lot easier! This goes for your dealership, the town clerk or
registration agent, and the DMV title bureau.
Recently a new issue joined our list of common mistakes and
missing information the DMV encounters when processing
titles. For a smooth title processing system, please ensure that all of
your staff members who handle title paperwork look out for accuracy
on these items:
•Misaligned forms: registration agents and the title bureau
staff are seeing an increase in misaligned forms. These forms can be
hard to read and at times obscure
necessary information.
As well staff should watch for these
omissions:
•Gross vehicle weight,
•Prior title numbers and state,
•Model name of vehicle,
•Number of axles on the vehicle,
•Number of cylinders, and
•Driver’s license number.
Please do not keep the owner’s original registration as it is needed
for the transfer of plates.
Give the customer the original town clerk’s copy and the
owners’ copy of the title application.
