… an activity which may cause either a direct physical change in
the environment, or a reasonably foreseeable indirect physical
change in the environment

“Discretionary Project” means
… a project which requires the exercise of
judgment or deliberation when the public agency or
body decides to approve or disapprove a particular
activity, as distinguished from situations where the
public agency or body merely has to determine
whether there has been conformity with applicable
statutes, ordinances or regulations.

“Ministerial Project” means
… a project which requires a decision applying
fixed, objective standards with little or no personal
judgment by a public official as to the wisdom or
manner of carrying out the project, such as
conforming with applicable zoning and building
codes, and paying fees.

Fair Argument Standard

Legal Standard - EIR is required if fair argument
exists that a project may have a significant effect on
the environment
Fair argument must be backed by substantial
evidence
Generally does not matter how much evidence
supports the opposite conclusion of less than
significant

Definition of “Significant effect on environment”
…
Substantial, or potentially substantial, adverse change in
any of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historic or aesthetic significance.
A social or economic change by itself shall not be considered a
significant effect on the environment.
