Do’s and Don’ts of Bedding Care
Foam Mattress
Warranty
Information
•DO rotate your mattress as needed, this will promote even wear.
•DO use an appropriate frame and center support on queen- and king-size sets to ensure validation of
your warranty.
•DO let your new sleep set “air” upon removal from its plastic packaging. Discard the plastic wrapping
on your mattress as soon as possible; a child or pet can become entangled and suffocate.
•DO keep your bedding clean and use a mattress pad. Stains, soiling, fluid penetration or other signs
of abuse may void the warranty and make your bedding ineligible for repair or replacement.
•DO replace the foundation when purchasing a new mattress to provide the proper support for your
new mattress.
•DO carry your mattress upright on its side. It is easier to handle and less likely to damage the
mattress. If you need to store your mattress for an extended period, please store it flat.
•DO promptly dispose of old mattresses to avoid a fire hazard.
•DON’T remove the law tag at the end of your mattress as this has the identification needed to
establish your warranty rights.
•DON’T bend excessively or jump on your mattress under any circumstances. Such treatment may
damage the mattress or boxspring. Normal use on an adjustable base is permitted.
• DON’T use cleaning fluids on your mattress. The chemicals may damage some of the materials.
•DON’T allow your mattress to get wet. Any liquids, water or other fluids may damage upholstery
causing materials to compress. Serta recommends that you protect your mattress from water and
other liquids with a water proof mattress pad.
PLEASE BE ADVISED: YOUR NEW MATTRESS IS NOT FIRE-PROOF.
Your new mattress meets fire safety standards issued by the U.S. Consumer Product Safety
Commission when used by itself or with a foundation specified on the federal law tag attached
to the mattress. Compared to older mattresses, your new mattress will, if ignited, burn more
slowly and less intensely, giving you more time to escape.
IN ORDER TO REDUCE THE RISK OF FIRE:

confident that your Serta sleep set will provide you with the long-lasting comfort and support you expect.
SERTA LIMITED WARRANTY
Because we strongly believe in the quality, design and craftsmanship of our products, Serta products are
warranted against manufacturing defects in workmanship and material, as detailed below.
If you observe a defect, contact the Serta dealer from which you purchased the set. If the dealer
cannot be reached, please contact Serta Customer Support at 888-55-SERTA. In either case,
you must, within the duration of the warranty, provide the original law tags, proof of purchase
(including date of purchase) and be the original purchasing consumer.
If defective in workmanship or material, your Serta mattress and/or foundation will be repaired or replaced
(at our option) with charges, as shown on the Serta Warranty Schedule and exclusive of transportation and
inspection costs. If the Serta product you purchased is discontinued at the time of repair or replacement,
a current model of comparable quality and value will be selected.
All other claims including incidental or consequential damages are precluded. If identical materials are not
available at the time of repair or replacement, the manufacturer reserves the right to substitute materials
of comparable quality.
Any and all implied warranties on this product shall not exceed in duration the term of this limited warranty.
This warranty begins on the day you purchase your sleep set. If your sleep set is repaired or replaced, this
limited warranty will not be renewed or extended. Please refer to the Serta Warranty Schedule on this
card to determine the length of your warranty.
Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations
on how long an implied warranty lasts, so the above limitation or exclusion may not apply. This warranty
gives you specific legal rights. You may also have other rights, which vary from state to state.
Please refer to the Do’s and Don’ts of Bedding Care section of this brochure for proper sleep set care to
avoid invalidating your warranty.
Warranty Coverage Detail
The Serta Warranty covers only the following items during normal wear:
MATTRESS:
•Sagging or Body Impressions that measure 3/4” or greater, only if the mattress has been continuously
supported by a matching foundation (or equivalent) and used with an appropriate frame with center
support, or a minimum of 5 cross slats with center support that extends to the floor.
•Zippered mattress covers are warranted for two years after the purchase date from manufacturing
defects and workmanship, flaws of the zipper or seams, and tearing of fabric under normal use.
FOUNDATION:
•Broken or loose support elements
•Compression or unstapling of support elements
•Broken or loose grid top
• Splitting of the wood frame
• Loose, bent or defective wood beams
• Sagging, but only when continuously supported
with an appropriate frame with a rigid center
support

The Serta Warranty does NOT cover items not expressly listed in the “Warranty Coverage”
section, such as, but not limited to:
•Transportation and inspection costs
•Bedding used in hotels, motels or institutional facilities
• Bedding sold “as is”, or floor samples, or bedding purchased from second hand parties, non-retail
establishments or received as promotional item
• Bedding height
• Comfort preference
• Corner guards
• Replacement of another piece in a sleep set, unless it is also defective
• Body impressions in the mattress that measures less than 3/4"
• Sagging in the mattress that measures less than 3/4”
• Damage of the mattress or foundation due to misuse or abuse
• Mattress damage due to an inappropriate foundation or when an incorrect bed frame is used
• Sheet fit
• Mattress fabric, except as noted under Warranty Coverage Detail.
• Normal change in softness and recovery time associated with memory foam and latex materials over time.
This does not affect the pressure relieving qualities of these materials.
•Fabric Stains, soiling, fluid penetration, tears or burns.
•Zippered mattress cover damage due to improper care.
Important Information
Serta reserves the right to refuse service and invalidate the warranty when the sleep set, even if defective,
is in an unsanitary condition (due to blood or bodily fluid stains or soiling, infestation or other abuse), when
the sleep set has evidence of damage from liquid penetration, cleaning or the use of cleaning fluids, or
whenever the product failure is caused by factors other than defective workmanship or materials.
Allowing the sleep set to be in an unsanitary condition may damage the product and invalidate the warranty.
For the health and safety of anyone who would be required to dispose of, or otherwise handle, the sleep
set, Serta may refuse to inspect such products to assess whether covered by the warranty, in which case,
Serta reserves the right to deny warranty coverage.

MATTRESS CARE
The use of cleaning fluids may damage the fabric and materials in your mattress. Allowing water or other
liquids to penetrate your mattress may damage the layers of upholstery, causing materials to compress.
Either of these situations may result in damage that will invalidate your warranty.
We recommend that you rotate your mattress occasionally, which will increase its comfort life
and longevity. However, the option to rotate your mattress is not required for your warranty
to remain valid. Please keep your bedding clean and use a mattress pad. Stains, soiling, fluid
penetration or other signs of abuse may void the warranty and make your bedding ineligible
for repair or replacement.
Serta reserves the right to deny warranty coverage if the sleep set exhibits stains or soiling of unknown
origin or nature and it appears to Serta, in good faith, that the sleep set may be in an unsanitary condition or
may have been damaged by liquid penetration or other abuse.
REQUIRED BED FRAME EXAMPLES FOR KING & QUEEN SIZE BEDDING
This warranty is given by the Serta manufacturer whose name and address appear on the law tag attached
to your Serta product. We recommend that you examine the law tag attached to your Serta product and
record the name and address of the Serta manufacturer, and your warranty code, on this warranty card.
Retain the law tags and proof of purchase to validate warranty coverage.
On queen and King-size models, center support that extends to the floor is required.

a new Simmons ® foundation or a supportive,
rigid, non-yielding foundation. An old foundation
unit may not provide sufficient support.
●Support
your Simmons® mattress and foundation
only with a frame that provides rigid center support
as well as support for the head, foot, and sides for
queen, split queen, king and California king size sets
(as noted above). For any queen or king frame that
does not have a metal center support, you must use
at least 5 hardwood (i.e., oak or ash) slats (1” x 4”)
and add legs to the 3 center slats. By not providing
a sufficient supportive frame, damage can occur to
the product and your warranty will be invalid.*

a solid platform on top of any open slatted
mattress support system with openings between
the slats that exceed two (2) inches (e.g., a platform
bed frame in which a Beautyrest ® Pocketed Coil ®
mattress rests directly upon slats with open spaces
between the slats). Use of such an open slatted
mattress support system with spaces between the
slats which exceed 2 inches (5 centimeters), without
the addition of a solid platform will damage your
mattress and your warranty will be invalid.

all times to avoid stains (including MoistureBan™

HOW CAN I GET SERVICE ON MY WARRANTY?
Contact your original Simmons ® dealer. If your

copy of original bill of sale is needed to determine
original date of purchase. Model name label and
law label must be attached to identif y the bedding
and validate this warranty.
WHAT IS COVERED?
If you purchased a Simmons ® mattress and use it
with a foundation and frame that provide proper
support, this warranty covers manufacturing
defects in your Simmons ® mattress or foundation.
This warranty also covers faults in materials or
manufacturing defects in the removable fabric
cover available on select models. Replacement
of one piece does not automatically result in
the replacement of any other piece. This limited
warranty is provided only to the original purchaser.

MATTRESS
Tempur-Pedic warrants that it will, at Tempur-Pedic’s option, replace or
repair purchaser’s Tempur-Pedic® mattress sold in the U.S. if it is defective
due to faulty workmanship or materials, subject to the limitations described
in this limited warranty. Tempur-Pedic undertakes no responsibility for the
quality of the goods except as otherwise provided in this contract. There
are no warranties that extend beyond the description on the face hereof.
The removable cover on a TEMPUR mattress is specifically included
within this warranty for 25 years from the date of purchase against
faults in material or workmanship under the same terms described
in this warranty for mattresses. Specifically excluded within
this warranty coverage is replacement of the cover for damage
attributable to normal wear and tear. In the event that the cover
for the mattress needs to be replaced, within the terms of this
warranty, Tempur-Pedic will replace it with the current style of cover
available for the mattress, which may be a different color, design or
material than the original cover. Replacement of the cover will not
result in replacement of the underlying mattress.
This limited warranty is valid only in connection with the original
purchase of new products and extends from the original purchase date of
the original product purchased. An “original purchaser,” for the purposes of
this limited warranty, is an individual or entity who purchases the product
directly from Tempur-Pedic or from an authorized retailer of Tempur-Pedic
with the intent to use the product for personal consumer use and not with
the intent to resell the product. An individual or entity that purchases the
product from whatever source with the intent to resell the product is an
unauthorized reseller (“unauthorized reseller”).
This limited warranty does not apply to floor models or “demos” (except
as specifically provided herein) or to products sold by unauthorized
resellers, including without limitation, unauthorized resellers on third
party websites such as Craigslist, eBay, Amazon, etc. As noted above,
unauthorized resellers are not “original purchasers” for the purpose of this
limited warranty. If purchaser is not the original purchaser of this product,
purchaser takes the product “AS IS” and “with all faults.”
IF THE PURCHASE OF THIS MATTRESS WAS NOT DIRECTLY FROM
TEMPUR-PEDIC, PROOF OF PURCHASE WILL BE REQUIRED TO

Tempur-Pedic mattresses are designed to work on a firm, solid-surface,
non-spring foundation or an adjustable bed base that is structurally
capable of supporting the weight of purchaser’s Tempur-Pedic mattress
and user(s). This limited warranty and other performance warranties are
based on tests conducted on “sets” that consist of our mattresses and our
foundations/adjustable bed bases. THEREFORE, IF PURCHASER USES
INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED
BASES, OR BED FRAMES WITH THIS MATTRESS, SUCH USE WILL VOID
THIS LIMITED WARRANTY AND ALL OTHER WARRANTIES, WHETHER
EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE
IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR

This limited warranty covers the following
items during normal wear:

three-fourths (0.75) of an inch that is not associated with an indentation or
sag which results from use of an improper or unsupportive foundation or
adjustable bed base. Normal wear required that purchaser’s mattress be
continuously supported by a matching foundation or adjustable bed base
with a proper bed frame sufficient to support the collective weight of the
mattress and foundation.
• A proper bed frame must provide sturdy support for both the mattress
and foundation; including a center support and having at least 5-6
legs for queen, king and cal king and 4 leg support for twin and full
mattresses. For queen, king, and Cal king slatted style bed frames,
it is incumbent upon purchaser to ensure that the frame utilized offers
ample structural support for the mattress and foundation in view of that
particular slatted style frame. The use of a bed frame is important for
the life and protection of your sleep system. Failure to have a proper
bed frame may invalidate the limited warranty. Neither mattresses,
individually, nor sleep systems (mattress and foundation combination)
are intended to sit/lay flat on the floor or on a waterbed frame or
platform of untreated wood or untreated wood covered with fabric.
• Please Note: Tempur-Pedic highly recommends a 3-bed beam support
system (available from Tempur-Pedic or Retailer at an additional cost)
or a support system of similar quality that is designed specifically to
give slatted style bed frames for queen, king and Cal king mattresses
additional structural support.
2. Any physical flaw in the mattress that causes the TEMPUR® material
to split or crack, despite normal usage and proper handling (as outlined
in the Mattress Use & Care Instructions).
This limited warranty does not cover:
1.A normal increase in softness of the TEMPUR® pressure-relieving material
which does not affect the pressure-relieving qualities of the mattress.
2.Comfort preference.
3.Physical abuse or damage to the structure and/or its cover material,
including but not limited to, burns, cuts, tears, liquid damage or normal
wear and tear.
4.Damage associated with the use of the product with an improper bed
frame, foundation, or adjustable base. See above description and
illustrations for a proper bed support.
5.Replacement of the accompanying piece in the Tempur-Pedic sleep system where
only one piece is defective, unless that accompanying piece is also defective.
6. Floor models or “demos” sold at a discount (See specific warranty language for
demos and floor models.)
7. Product sold by unauthorized resellers who are not company authorized
retailers.
Year 1 through 10 – Full Coverage of Parts and Labor
During the first ten (10) years of this limited warranty, Tempur-Pedic will
not charge purchaser to repair or replace purchaser’s mattress (or its original
cover) if it is deemed defective, but any transportation costs associated with
repairs or replacements are purchaser’s responsibility. In no event, however,
will the transportation costs exceed Tempur-Pedic’s then-standard freight
charges. No new warranty is provided with a replacement mattress.
The warranty for the replacement mattress runs from the date of original
purchase of the replaced mattress.
In connection with the replacement of a mattress (or of its original cover)
in compliance with the terms of this limited warranty during years 1-10, if a
purchaser elects to upgrade to a more expensive product, it may do so by
paying the difference between the cost of the original product being replaced
and the cost of the upgraded product plus the cost of any related additional
sleep system pieces not being replaced as part of the warranty exchange.
In the event of an upgrade as described in this paragraph, a new warranty
will be provided for the upgraded pieces only.
Year 11 through 25 – Prorated Coverage
During years 11 through 25 of this limited warranty Tempur-Pedic
will, at its option, repair the mattress (or its cover) at a handling cost to
purchaser, or replace the mattress (or its cover) at a prorated charge
to purchaser plus transportation costs. If Tempur-Pedic replaces the
mattress, the prorated replacement charge purchaser pays will depend
on when the mattress is replaced. In the unlikely event that the original
cover provided with the Tempur mattress is replaced, these same
proration terms apply.
If the mattress (or its cover) is replaced during the eleventh year of this
limited warranty, the prorated replacement charge purchaser pays will be
fifty (50) percent of the original purchase price.
Based upon this proration, if the product is replaced after the eleventh
year but before the twenty-first year, the prorated replacement charge
purchaser pays will increase by five (5) percent for each subsequent year
of the prorated period (i.e., 55% of the original purchase price if replaced
during year twelve; 60% of the original purchase price if replaced
during year thirteen, etc.) If the product is replaced in year 21 or any
point thereafter prior to expiration of the limited warranty, the prorated
replacement charge purchaser pays will the same as if the product
was replaced in year 20. If you pay the replacement charge required in
connection with a claim made during the prorated coverage period, the
existing warranty will continue to cover the replacement product only for
the balance of the original 25 year limited warranty period and no further
prorated costs for any additional approved warranty claims made against
the replacement product will be required.
Mattress Demonstration Samples and Floor Models
Demonstration samples (“demo(s)”) and floor model(s) will enjoy
a 25 year limited warranty determined not by the original purchase
receipt date but by the “date of manufacture” disclosed on the law tag.
However, except for verifiable warranty defects, demos and floor models
are sold “as is” and “with all faults.” Covers on demos and floor models
(whether removable or not) are not warranted or guaranteed at all for
such samples or floor models.
During the first ten (10) years of this limited warranty, demo or
floor model products purchased at a discount will be repaired by
Tempur-Pedic at no charge to the purchaser or will be replaced for
a charge equal to the cost of the replacement mattress less the amount
paid by the original purchase for the demo or floor model. If the demo or
floor model product has been discontinued then the charge will be the
cost of the reasonable equivalent of the discontinued item [or any
upgraded item] less the amount paid by the original purchaser for the
demo or floor model product. During years eleven (11) through twentyfive (25) of this limited warranty, demo or floor model products purchased
at a discount will be repaired by Tempur-Pedic at no charge to the
purchaser or replaced at a prorated charge to purchaser based on the
replacement cost less a percentage of the discounted amount
the original purchaser paid for the products plus transportation costs.
If Tempur-Pedic replaces the mattress, the prorated replacement charge
purchaser pays will depend on when the demo or floor model product
is replaced and the amount the original purchaser paid for the product.
If the demo or floor model product is replaced during the eleventh year
of this limited warranty, the prorated replacement charge purchaser pays
will be the difference between full replacement value less fifty (50) percent
of the actual discounted price paid by the original purchaser. Example:
If the demo or floor model product’s replacement cost is $2000 and the
original purchase price paid by the original purchaser was $600, then the
replacement charge for the product in year 11 would be
$2000 – ($600 x 50%) = $1700.
If the demo or floor model product is replaced after the eleventh year but
before this limited warranty expires, the prorated percentage of the original
purchase price subtracted from the replacement cost would decrease by
five (5) percent for each subsequent year of the prorated period (i.e., 45% of
the original purchase price if replaced during year twelve; 40% of the original
purchase price if replaced during year thirteen, etc.) to a minimum of 5%
of the original price being subtracted from the replacement cost. Example:
If the demo or floor model product’s replacement cost is $2000 and the
original purchase price paid by the original purchaser was $600, then the
replacement charge for the product in year 12 would be $2000 – ($600
x 45%) = $1730. If the demo or floor model product’s replacement cost
is $2000 and the original purchase price paid by the original purchaser
was $600, then the replacement charge for the product in year 21
through year 25 would be $2000 - ($600 x 5%) = $1970. If you pay the
replacement charge required in connection with a claim made during the
prorated coverage period, the existing warranty will continue to cover the
replacement mattress for the balance of the 25 year limited warranty period
and no further prorated costs for any additional approved warranty claims
made against the replacement mattress will be required.
If the demo or floor model product has been discontinued then the
replacement charge will be the cost of the reasonable equivalent of
the discontinued item [or any upgraded item] less the appropriate
percentage of the amount paid by the original purchaser for the
demo or floor model product.
Additional Limitations on Warranty Coverage
In the event a warranty claim is filed and a warranty replacement is
deemed necessary, purchaser will be required to surrender the original
product to Tempur-Pedic at the time of replacement.

25-YEAR LIMITED WARRANTY
ADVANCED PERFORMANCE PLATFORM FOUNDATION (“FOUNDATION”)
Tempur Production USA, LLC (“Tempur-Pedic”) warrants that we will, at Tempur-Pedic’s option,
replace or repair purchaser’s Tempur-Pedic® foundation if it is defective due to faulty workmanship or
materials, subject to the limitations described in this warranty.
This warranty covers the following items during normal wear:



Structural damage/broken components
Squeaks, rattles or noises
Sagging that is not associated with use of an improper bed frame.
A proper bed frame must provide sturdy support for both the mattress and foundation; including
a center support and having at least 6 legs. For queen, king, and cal king slatted style bed
frames, it is incumbent upon purchaser to ensure that the frame utilized offers ample structural
support for that particular slatted style frame. Failure to have a proper bed frame may invalidate
the warranty.
Please Note: Tempur-Pedic highly recommends a 3 bed beam support system (provided by
Tempur-Pedic at an additional cost) or a support system of similar quality that is designed
specifically to give slatted style bed frames additional structural support..

replacement charge purchaser pays will increase by five (5) percent for each subsequent year of the
prorated period (i.e., 55% of the original purchase price if replaced during year twelve; 60% of the
original purchase price if replaced during year thirteen, etc.) If the mattress is replaced in year 21 or

Tempur-Pedic foundations are designed to work in conjunction with a Tempur-Pedic mattress. This
warranty and other performance warranties are based on tests conducted on “sets” that consist of our
mattresses and foundations. Tempur-Pedic foundations should be placed on a bed frame that is
structurally capable of supporting the weight of the purchaser’s Tempur-Pedic mattress, foundation, and
user(s). IF PURCHASER USES INAPPROPRIATE BED FRAMES WITH THIS FOUNDATION,
SUCH USE WILL VOID THIS WARRANTY AND ALL OTHER WARRANTIES, WHETHER
EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES
OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Tempur-Pedic may
require proof of the quality of bed frame if purchaser makes a claim under this warranty. Tempur-Pedic
reserves the right to invalidate this warranty if the foundation is found to be in an unsanitary condition.
The Consumer Product Safety Commission has created the Standard for the Flammability (Open Flame)
of Mattress Sets in Federal Register 16 CFR Part 1633. Foundations are specified for use with particular
mattresses and therefore use outside of these specifications, should not be construed as 16 CFR Part 1633
compliant.
This warranty is valid only for the original purchaser from the original purchase date of the original
product purchased. An original purchaser is one who purchases the product directly from Tempur-Pedic
or an authorized retailer of Tempur-Pedic. If purchaser is not the original purchaser of this product,
he/she takes it “as is” and “with all faults.” If the purchase of this mattress was not directly from TempurPedic, proof of purchase will be required to demonstrate that purchaser is the original purchaser
and eligible to make a valid claim under this warranty.
In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be
required to surrender the original product to Tempur-Pedic at the time of replacement.

DELIVERY NOTICE Your mattress may have been delivered folded to make it
easier to transport. If your mattress is delivered this way, particularly in weather
below 50°F, do not force it to lay flat. It may take a few hours, depending on the
temperature of your room, but your mattress will naturally unfold as it warms up.
Mattress Use & Care Instructions
The following are instructions regarding the
use and care of your Tempur-Pedic® mattress:
1. Tempur-Pedic mattresses are designed for use with a firm, solid-surface, non-spring
foundation or adjustable bed base that is structurally capable of supporting the weight
of a Tempur-Pedic mattress. The warranty is based on tests conducted on “sets” that
consist of Tempur-Pedic mattresses and a Tempur-Pedic Foundation or TempuRErgo™ Adjustable Base. If a Tempur-Pedic mattress is placed on something other than
a Tempur-Pedic Foundation or TempuR-Ergo Adjustable Base, the burden of proof
regarding the structural capacity of the foundation in the event of a warranty claim is
transferred to the consumer and may place the warranty in jeopardy. Placing plywood
or particle board over an existing foundation is not recommended and may not provide
the support a Tempur-Pedic mattress requires.
2. Remember that your Tempur‑Pedic mattress is sensitive to temperature. In rooms of
65°F or less, your mattress will become somewhat firmer. However, it will readily warm
and respond to your body temperature when you lie on it. We do not recommend using
an electric blanket or heating pad with your mattress. These items can impair the unique
ability of your Tempur‑Pedic mattress to react to your body temperature and conform
to your body shape.
3. We do not recommend using conventional mattress pads or mattress covers as they
can affect the full pressure-relieving experience of our proprietary TEMPUR® material.
However, Tempur-Pedic branded mattress protectors have been specifically designed
to protect your Tempur‑Pedic mattress while not impacting the feel or performance.
4. You never have to flip or rotate your Tempur‑Pedic mattress.
Your Tempur‑Pedic mattress features a one-sided design and should never be flipped.
5. It may take a while to become accustomed to the unique feeling of your Tempur‑Pedic
mattress. Most people are very comfortable on the first night, but others may need
extra time to adjust to the pressure-relieving qualities of the TEMPUR material.
6. Your mattress may have a slight odor remaining from our unique manufacturing
process. All polyurethane-based materials have this characteristic. This is normal
and completely harmless and will dissipate within a few days.
7. When transporting or storing your mattress, lay the mattress flat . The handles
included on some Tempur‑Pedic mattress models are for positioning purposes
only — not for carrying.
8. The covers on some Tempur‑Pedic mattress models are removable for washing.
We recommend a cold temperature setting for machine washing and a cool setting for
machine drying. Air-drying is best. Do not “over-dry” the cover and do not use chlorine
products or harsh stain removers. Never wash the TEMPUR material.

know if your cover is removable.

In connection with the replacement of a mattress (or of its original cover)
in compliance with the terms of this limited warranty during years 1-10, if a
purchaser elects to upgrade to a more expensive product, it may do so by
paying the difference between the cost of the original product being replaced
and the cost of the upgraded product plus the cost of any related additional
sleep system pieces not being replaced as part of the warranty exchange.
In the event of an upgrade as described in this paragraph, a new warranty
will be provided for the upgraded pieces only.
Year 11 through 25 – Prorated Coverage
During years 11 through 25 of this limited warranty Tempur-Pedic will,
at its option, repair the mattress (or its cover) at a handling cost to purchaser,
or replace the mattress (or its cover) at a prorated charge to purchaser plus
transportation costs. If Tempur-Pedic replaces the mattress, the prorated
replacement charge purchaser pays will depend on when the mattress is
replaced. In the unlikely event that the original cover provided with the
Tempur mattress is replaced, these same proration terms apply.
If the mattress (or its cover) is replaced during the eleventh year of this
limited warranty, the prorated replacement charge purchaser pays will be
fifty (50) percent of the original purchase price.
Based upon this proration, if the product is replaced after the eleventh year
but before the twenty-first year, the prorated replacement charge purchaser pays
will increase by five (5) percent for each subsequent year of the prorated period
(i.e., 55% of the original purchase price if replaced during year twelve; 60% of the
original purchase price if replaced during year thirteen, etc.) If the product is replaced
in year 21 or any point thereafter prior to expiration of the limited warranty, the prorated
replacement charge purchaser pays will the same as if the product was replaced in
year 20. If you pay the replacement charge required in connection with a claim made
during the prorated coverage period, the existing warranty will continue to cover the
replacement product only for the balance of the original 25 year limited warranty
period and no further prorated costs for any additional approved warranty claims
made against the replacement product will be required.
Mattress Demonstration Samples and Floor Models
Demonstration samples (“demo(s)”) and floor model(s) will enjoy a 25 year
limited warranty determined not by the original purchase receipt date but
by the “date of manufacture” disclosed on the law tag. However, except for
verifiable warranty defects, demos and floor models are sold “as is” and “with all
faults.” Covers on demos and floor models (whether removable or not) are not
warranted or guaranteed at all for such samples or floor models.
During the first ten (10) years of this limited warranty, demo or floor model
products purchased at a discount will be repaired by Tempur-Pedic at no
charge to the purchaser or will be replaced for a charge equal to the cost of
the replacement mattress less the amount paid by the original purchase for the
demo or floor model. If the demo or floor model product has been discontinued
then the charge will be the cost of the reasonable equivalent of the discontinued
item [or any upgraded item] less the amount paid by the original purchaser for
the demo or floor model product. During years eleven (11) through twenty-five
(25) of this limited warranty, demo or floor model products purchased at a
discount will be repaired by Tempur-Pedic at no charge to the purchaser or
replaced at a prorated charge to purchaser based on the replacement cost
less a percentage of the discounted amount the original purchaser paid for the
products plus transportation costs. If Tempur-Pedic replaces the mattress,

Tempur-Pedic warrants that it will, at Tempur-Pedic’s option, replace or repair
purchaser’s Tempur-Pedic® mattress sold in the U.S. if it is defective due to faulty
workmanship or materials, subject to the limitations described in this limited warranty.
Tempur-Pedic undertakes no responsibility for the quality of the goods except as
otherwise provided in this contract. There are no warranties that extend beyond the
description on the face hereof.
The removable cover on a TEMPUR mattress is specifically included within this
warranty for 25 years from the date of purchase against faults in material or
workmanship under the same terms described in this warranty for mattresses.
Specifically excluded within this warranty coverage is replacement of the
cover for damage attributable to normal wear and tear. In the event that the
cover for the mattress needs to be replaced, within the terms of this warranty,
Tempur-Pedic will replace it with the current style of cover available for the
mattress, which may be a different color, design or material than the original
cover. Replacement of the cover will not result in replacement of the underlying
mattress.
This limited warranty is valid only in connection with the original purchase of new
products and extends from the original purchase date of the original product purchased.
An “original purchaser,” for the purposes of this limited warranty, is an individual or entity
who purchases the product directly from Tempur-Pedic or from an authorized retailer
of Tempur-Pedic with the intent to use the product for personal consumer use and not
with the intent to resell the product. An individual or entity that purchases the product
from whatever source with the intent to resell the product is an unauthorized reseller
(“unauthorized reseller”).
This limited warranty does not apply to floor models or “demos” (except as specifically
provided herein) or to products sold by unauthorized resellers, including without limitation,
unauthorized resellers on third party websites such as Craigslist, eBay, Amazon, etc.
As noted above, unauthorized resellers are not “original purchasers” for the purpose of this
limited warranty. If purchaser is not the original purchaser of this product, purchaser takes
the product “AS IS” and “with all faults.” IF THE PURCHASE OF THIS MATTRESS WAS
NOT DIRECTLY FROM TEMPUR-PEDIC, PROOF OF PURCHASE WILL BE REQUIRED TO
DEMONSTRATE THAT PURCHASER IS THE ORIGINAL PURCHASER AND IS ELIGIBLE
TO MAKE A VALID CLAIM UNDER THIS LIMITED WARRANTY.
Tempur-Pedic mattresses are designed to work on a firm, solid-surface, non-spring
foundation or an adjustable bed base that is structurally capable of supporting the
weight of purchaser’s Tempur-Pedic mattress and user(s). This limited warranty and
other performance warranties are based on tests conducted on “sets” that consist of our
mattresses and our foundations/adjustable bed bases. THEREFORE, IF PURCHASER
USES INAPPROPRIATE FOUNDATIONS, BOX SPRINGS, ADJUSTABLE BED BASES, OR
BED FRAMES WITH THIS MATTRESS, SUCH USE WILL VOID THIS LIMITED WARRANTY
AND ALL OTHER WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING,
WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE. Tempur-Pedic may require purchaser to
provide proof of the quality of the foundation, adjustable bed base, or bed frame used
in conjunction with the mattress if purchaser makes a claim under this limited warranty.
Tempur-Pedic reserves the right to invalidate this limited warranty if the foundation is
determined, in Tempur-Pedic’s reasonable discretion, to be inadequate or if the mattress
is found to be in an unsanitary condition.
We encourage you to protect your investment by keeping your proof of purchase
documents in a safe place to support the attached 25 Year Limited Warranty on
your new Tempur‑Pedic mattress.
