CONDITIONS OF SALE
AUCTION HOUSE AS AGENT
Except as otherwise stated, John Moran Auctioneers Moran’s) acts as agent for the seller. The contract for the sale of the property is therefore made
between the seller and the buyer.
BEFORE THE AUCTION
(a) Public Preview: All property is available for inspection by public preview during the day of auction. In many cases, particular lots can be
examined in advance by private appointment. Prospective buyers are strongly encouraged to personally examine any property in which they are
interested.
(b) Buyer’s Responsibility: Buyers are responsible for determining to their own satisfaction the true nature and condition of any lot prior to bidding. Though buyers are not legally required to inspect lots prior to purchase, failure to do so may constitute a waiver of complaint that an item was
not delivered in a condition equal to the existent condition at the auction.
(c) Property Sold ‘As Is’: Neither Moran’s nor the seller provides any guarantee in relation to the nature of the property, or to any errors or omissions
in the catalogue or supplemental material apart from the Limited Warranty stated below. Condition reports are offered as a courtesy and are typically published in Moran’s catalogue or can be made available upon request. The absence of a condition report does not imply than an item is free
from defects or restoration, nor does a reference to particular defects imply the absence of others.
AT THE AUCTION
(a) Admission: The auction is open to the public, though Moran’s reserves the right to refuse admission or participation to anyone at any time.
The auctioneer may be recorded (visually, aurally or otherwise) and all participants consent to such recording.
(b) Buyer Registration: Prospective buyers must register with Moran’s before bidding. Moran’s may require identification and financial references in advance of buyer eligibility. Registered bidders accept personal liability to pay the purchase price, including the buyer’s premium plus all
applicable charges, unless Moran’s agrees in advance that the bidder is acting as agent on behalf of an identified third party acceptable to Moran’s.
In such case, Moran’s will look to the third party for payment.
(c) Bidding Guidelines: Bidding, whether in person, by agent, absentee bid, telephone, or internet, constitutes a bidder’s acceptance of these
conditions. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer retains the absolute right to reject any bid, to
withdraw, pass or divide any lots, to combine multiple lots, to advance the bidding at his or her absolute discretion and (in the case of error or
dispute, whether during or after the sale) to determine the successful bidder, to continue the bidding, cancel the sale or to re-offer and sell the lot in
question. Under no circumstances are the consignors’ or agents acting on their behalf, permitted to bid on their consignment. In the event of any
dispute after the auction Moran’s sale record shall be conclusive.
(d) Absentee, Telephone and Internet Bidding: Moran’s offers absentee, telephone and internet bidding as a convenience to clients and does
not accept liability for errors or failures to execute such bids. Absentee and telephone bids must be recognized by Moran’s prior to auction day.
When identical absentee bids are submitted that become the highest bids at the auction, the bid first received by Moran’s shall be accepted as the
winning bid. Telephone bidders are encouraged to leave minimum bids in case of technical failure. Internet bidders are subject to an additional
buyer’s premium, as noted below.
(e) Reserves: Unless indicated otherwise, lots may be offered subject to a reserve, which is the confidential minimum price below which the
lot will not be sold. The reserve for any lot shall not exceed its published estimate. Moran’s shall act to protect the reserve by bidding through the
auctioneer, who may open bidding on any lot below the reserve by placing a bid on the seller’s behalf. The auctioneer may continue to bid on behalf
of the seller up to the reserve amount, either by placing consecutive bids or by placing bids in response to other bidders. Lots without reserves are
typically opened for bidding at 50% of their low estimate. In the absence of a bid at that level, the auctioneer may proceed backwards at his discretion or deem the lot unsold if a bid is not recognized.
AFTER THE AUCTION
(a) Payment and Title Transfer: Payment and Title Transfer: The buyer agrees to pay the sum of the hammer price plus Buyer’s Premium, plus
any applicable sales tax. Buyer’s Premiums are calculated as follows: Floor, Telephone or Absentee Bidding: Buyer’s Premium of 20% (of hammer
price) when paying by cash, check or wire transfer or 22% when paying by credit card. Bidding through internet platform: Buyer’s Premium of 23%
when paying by cash, check or wire transfer or 25% when paying by credit card. Buyers outside the United States must submit payment via wire
transfer. Credit cards are not an accepted form of payment for buyers outside the United States. Buyers are strongly encouraged to provide full
payment at the auction. Payment must be received by Moran’s within the five business days immediately following the auction. The buyer shall not
acquire title or take possession of the lot until all amounts (including the hammer price, premium and applicable taxes) due to Moran’s have been
paid in full.
(b) Collection: Buyers are strongly encouraged to collect purchased items from the sale site at the time of the auction. Packing material and labor
are provided free of charge at the sale site during the auction. The packing of purchased lots at the auction is undertaken by Moran’s solely as a
convenience to customers. Moran’s is not liable for damage to glass or frames, except as a result of negligence on Moran’s part, regardless of cause
in connection with this courtesy service.
(c) Storage: Following the auction, uncollected lots shall be relocated to and stored in Moran’s warehouse. Moran’s shall retain possession of all
purchases until full payment has been received from the buyer. Lots remaining uncollected after the fifth business day following the sale, regardless
of payment status, are subject to a per-lot daily storage charge of $10.00. In addition to other remedies available by law, Moran’s reserves the right to
impose upon delinquent buyers a separate 1% monthly charge (of the purchase price, or the maximum permitted by law) commencing on the sixth
business day after the sale date.

(d) Shipping: Buyers are responsible for arranging their own shipping estimates and deliveries. Moran’s in our discretion and as a courtesy to
buyers, can arrange to have purchased lots packed, insured and forwarded by a third party shipper at the request, expense and risk of the buyer.
Moran’s assumes no responsibility for acts or omissions in such packing or shipping by other packers or carriers, even if recommended by Moran’s.
Nor does Moran’s assume any responsibility for any damage to picture frames or to the glass therein. In circumstances where Moran’s arranges for
such third party services, Moran’s may apply an administration charge of 10% of that service fee.
(e) All Sales Final: Notwithstanding other terms mentioned herein, refunds shall be given at Moran’s sole discretion. Refunds requested on the
grounds of authenticity must be made within 10 days of the auction and accompanied by a supporting written statement from a recognized authority (defined as a person who has authored, edited, or substantially contributed to a monograph on the artist, a person who has curated, organized or
substantially contributed to a solo exhibition on the artist, a person who has represented the artist’s estate or someone who represented or worked
closely with the artist while they were alive and, in any of the above instances physically handled works of the period, medium and subject matter
in question during the course of their duties) stating that the object sold is incorrect or not the work of the artist. Dealers, appraisers and representatives of other auction firms do not qualify as authenticators of individual artists unless they have had such specific involvement with that artist’s
work, as specified above, in addition to their daily duties. Refunded lots must be returned to Moran’s in the same condition as when sold. Moran’s
does not grant extensions to refund considerations based upon authenticity due to shipping delays. There are no exceptions to this refund policy.
LIABILITY AND LIMITED WARRANTY
(a) Liability: The buyer expressly agrees that (i) neither Moran’s nor the seller shall be liable, in whole or in part, for any special, indirect or consequential damages, including, without limitation, loss of profits and (ii) the buyer’s damages, if any, are limited exclusively to the original purchase
price paid for the lot.
(b) Limited Warranty: All property is sold as is. Neither Moran’s nor the consignor or our associates make any representation, express or implied
warranty (including merchantability and fitness) or guarantee in condition, size, provenance, medium, signature, inscription, exhibition history, importance, rarity, country of origin, age, genuineness, historical relevance, monetary or other value, framing or lack thereof, mounting, conservation,
coloring, palette, inscription, edition, style, label or other descriptor. No statement in the catalogue, brochures, website, bill of sale or invoice, any
supplementary material, or statements by any Moran’s employee shall be deemed such a warranty or representation or an assumption of liability.
(c) Descriptions: No warranty, whether express or implied, is made with respect to any description contained in this auction or any second opinion. Any description of the items or second opinion is for the courtesy of identifying the items for those Bidders who do not have the opportunity
to view the lots in person, and no description of items has been made part of the basis of the transaction or has created any express warranty that
the goods would conform to any description made by the Auctioneer. Color variations can be expected in any electronic or printed imaging, and
are not grounds for the return of any lot.
(d) Estimates: All estimates provided are carefully considered opinions of Moran’s specialists, and are merely suggested guidelines for interested
buyers. Buyers must be aware that all property sold is subject to fluctuating values depending on the subjective interests of collectors and a wide
variety of other uncontrollable factors. The lots auctioned may sell at prices above, within, or below estimate.
(e) Notices, Demands and Refunds: Any demands for refunds, problems with the lot(s) sold or notices of any kind concerning the auction shall
be in writing and addressed to John Moran Auctioneers, Inc, 735 West Woodbury Road, Altadena, California 91001.
ADDITIONAL MATTERS
(a) Copyright: The copyright on all images, illustrations and written material produced by or for Moran’s for this auction is and shall remain at all
times the property of Moran’s. Moran’s and the seller make no representation or warranty that the buyer will acquire any copyright or reproduction
rights to a purchased lot.
(b) Buyer’s Breach of Conditions: If a buyer fails to comply with any of these conditions, Moran’s may, in addition to asserting all remedies
available by law, including the right to hold that buyer liable for the purchase price, (i) cancel the sale, retaining as liquidated damages any payment
made by the buyer, (ii) resell the property without reserve at public auction or privately upon notice to the buyer, or (iii) take such other action as
we deem necessary or appropriate. If Moran’s resells the property, the original defaulting buyer shall be liable for the payment of any deficiency
between the original sale price and any subsequent mitigation sale, including warehousing, the expenses of both sales, reasonable attorney’s fees,
commissions, incidental damages and all other charges due hereunder. In the event that such buyer pays a portion of the purchase price for any
property, Moran’s shall apply the payment received to such property that Moran’s in our sole discretion, deems appropriate. Moran’s shall have the
benefit of all rights of a secured party under the Uniform Commercial Code adopted in the State of California.
(c) Severability: Should any of these conditions be deemed unenforceable, invalid or illegal in any court having jurisdiction, that part shall be
discounted and shall have no effect on the enforceability of the remaining provisions contained herein, which shall remain valid to the fullest extent
permitted by law.
(d) Jurisdiction: The rights and obligations of the parties with respect to these conditions and the conduct of the auction shall be governed and
interpreted by the laws of the State of California. By bidding, whether in person or by agent, by absentee bid, telephone, internet or other means,
the buyer shall be deemed to have consented to the exclusive jurisdiction of the courts of the state of California or, if applicable, the federal courts
sitting in this state. Further, the buyer agrees that the venue for any action arising out of the failure to abide by these conditions, or any conduct related to or arising out of the auction, shall be the Los Angeles Superior Court, Pasadena Branch located at 300 E. Walnut Street, Pasadena, California 91101 or the Federal Court Central District located at 312 North Spring Street, Los Angeles, California, 90012-4793.

of the Laguna Art Association. His knickers, belted blue jacket, white hair, and neatly trimmed beard made him a highly recognized local artist around

Note: T.C. Steele befriended writer Gene Stratton Porter (1863-1924) through their mutual love of flowers, particularly dahlias. The youngest of twelve
children, Porter started writing as a child. She married Charles Porter in 1886 and by the late 1890s regularly submitted articles to magazines such as Ladies'
Home Journal, McCall's Magazine and The Metropolitan Magazine. She initially published anonymously so articles that might not be well received did
not embarrass her husband. Eventually, she did publish articles and books in her own name on birds, flowers and nature, and through her work made the
acquaintance of Indiana artist Steele. Family oral history suggests that Porter commissioned Steele to paint the present still life depicting a central vase
bursting with multi-colored dahlia blooms. The original long-necked brown vase seen at the painting's right is in the collection of the T.C. Steele State Historical Site in Nashville, Indiana. Note: The Empire Mine is the site of the oldest, largest, and richest gold mine in California. From 1850 to its closing 106 years later in 1956, it produced 5.8
million ounces of gold. Some of the most productive years were under the direction of California State Senator Thomas Fowler of Visalia who purchased the
mine in 1878 and formed the Empire Gold and Silver Mining Company. Fowler oversaw an intense period of construction of the mine and poured most of his
personal fortune into the endeavor. A 2 mile cable tram was built to carry ore down from Empire Mountain to a new mill 2,000 feet below; ''[i]n the Spring of
1879, Fowler organized the Mineral King Wagon and Toll Road Company to complete the remaining 25 miles of road from the bridge across the East Fork of the
Kaweah River...to Mineral King'' (J.G. Moore, ''Exploring the Highest Sierra'', Stanford, CA, p. 268). By August 15, 1879, wagons entered the Mineral King Valley
for the first time. Just a few years later in 1886, Thomas Hill was there to paint the present work. Hill had begun painting Yosemite and Sierra landscapes in the
1860s and his paintings of these subjects were hugely popular and commanded high prices by the 1880s. The present work shows the entrance to Empire Mine
cut into the side of a steep mountain at the left of a sweeping mountainscape painted in the artist's signature naturalistic tones. Provenance: Estate, Las Vegas,

Note: Local-born artist Guy Rose spent eight years living in Giverny, France where he
was strongly influenced by his friend Claude Monet and other impressionist painters
working there. When Rose returned to California in 1914, he brought with him an
intensified focus on light that can be seen in his execution of California landscapes
from this mature Impressionist period. ''The ceaseless interplay between the appearance and dissolution of form, and the challenge of transfixing a moment's perception,
continued to fascinate Rose as it had his precursors in Impressionism'' (W. South,
''Guy Rose: American Impressionist'', Oakland, CA, 1995, p. 67).
In his first years back in California, Rose worked most frequently in Laguna Beach
and the Sierras while feverishly exhibiting and selling on both Coasts, teaching and
becoming involved in major local art clubs and organizations. Rose first visited
Carmel-by-the-Sea in 1918 and it immediately became ''the primary focus of what
were to be his last years of painting'' (W. South, p. 67).
Rose produced a prodigious number of Carmel coastals in a three-year period,
exploring similar locations and views but always approaching each painting as a
unique experience. ''It was clearly not Rose’s intent to paint the same scene over and
over, but rather to paint the varied experiences of expansiveness versus enclosure, of
translucence versus opacity, or warmth versus cold'' (W. South, p. 67).
''Sand Dunes'' is a lovely, atmospheric example from this important Carmel period.
Rather than painting from a vantage point of coastline yielding to ocean, in the
present work, Rose paints from the coastal dunes back toward a deep landscape
of rolling hills and a vast cloud-filled sky. The contrast of warm and cool tones is
extreme in the composition, with a relatively thin band of distant hills and fields
painted in cool greens, purples and blues inserted between broad, flat planes of warm
sand and clouds. Rose paints with intentionally sparing detail, choosing to apportion
the canvas in broad, flat planes of color that harken back to Japanese compositional
influences. Coastal dune grasses and shrubs spring out of an otherwise constrained
environment, painted with sculptural brushwork that finishes the scene.

Note: Guy Rose's mature, fully impressionistic style developed during his nearly thirteen years abroad, the last eight spent living and working in
Giverny, is celebrated in the painting ''Duck Cove - Wickford'' (W. South, ''Guy Rose: American Impressionist'', Oakland, CA, 1995, p. 59). The
painting was likely executed during a brief period in 1913 or 1914 when Guy and Ethel Rose summered in Rhode Island, where Rose taught an
outdoor sketching class at Narragansett Pier in an area south of Wickford.
''Duck Cove - Wickford'' captures a sweeping view of waterways and land that encompass the Duck Cove salt marsh in a bold palette of blues
and chartreuse balanced by more muted brown, grey and blue tones in the foreground and sky. Ribbons of water traverse the irregularly shaped
marsh flowing toward Wickford Harbor and Narragansett Bay as foreground sand and rocks yield to lush green grasses along the channels'
edges. The day is sunny with a light layer of clouds adding a play of pattern against blue sky. Dominating and contrasting the otherwise completely naturalistic environment is a spindly wooden bridge crossing a narrow strait.
Rose's brief time in New England came after he and Ethel left France in 1912 and before they returned permanently to California in autumn
1914. During this short period when the couple spent part of each year in New York and the Wickford area of Rhode Island, Rose exhibited
regularly including a notable 1913 show at Macbeth Gallery. The few documented identifiably Rhode Island subjects the artist produced, including this painting, reveal the full commitment to and synthesis of French Impressionism presented in fresh American subject matter that Rose
would continue to explore in California.

Note: Joseph Henry Sharp, considered the ''spiritual father'' of the Taos Society of Artists, made his first fateful trip to New Mexico in 1883. Growing up in
Ohio, he was fascinated by Native Americans from a young age and never lost interest in the American west during his extensive years of study in Europe
and years teaching and working as an illustrator in Cincinnati. After numerous trips west, Sharp went to live there permanently first in Montana where
he worked as an artist and illustrator recording the Northern Plains Indians and then finally to Taos in 1912. In Taos, Sharp was a charter member of the
Taos Society of Artists founded the same year as his arrival. The present work depicts Taos Indian Francisco Martinez in profile. Martinez is painted as an
individual with careful attention to clothing detail and Sharp's signature use of light which enhances the figure's features. Martinez went on to be Chief of
the Taos Pueblo and he and family members were regular subjects for the artist. Alternative title and inscription possibly in the artist's hand on the original

Note: Local Monrovia artist Anna Katharine Skeele spent many summers working and living among the Taos Indians at the Taos Pueblo. The present work
is an important example from these extended trips. Skeele focuses on women working, placing the monumental figures directly at the foreground of the
scene. One woman assists a young child on a horse while it waters and a second woman bends to fill a clay pot in the same stream. Painted in a stylized
modernist style, Skeele keeps detail to a minimum on the ground and in the background hills in order to focus all of the viewer's attention on life in the
Pueblo. Skeele moved to California in 1912 and attended Pomona College. Extensive art studies continued after graduation, first at the California School
of Fine Arts in 1920 then in Monterey under Armin Hansen, at the Art Students League in New York under Charles Hawthorne, and finally in Paris and
Florence. After her travels, Skeele returned to Monrovia where she would remain permanently and was an art teacher at Monrovia High School for many
years. Summers spent in Taos enabled Skeele to explore the Native culture that would be the most important subject of her artistic career. The present
work, as well as a number of additional works throughout this auction catalogue by Skeele, her husband Frode Dann, and her niece's husband Paul Coze all
come out of Coze's estate and as a collection offer an incredible variety of fresh estate pieces featuring many of the most meaningful subjects to each of the

of the artist with friends and family, notes from friends and suitors, fliers

Note: Anna Katharine Skeele's sketchbooks and college scrapbook offer a
once in a lifetime opportunity to explore the artist's life and artistic process
in detail. Skeele's time at Pomona College in the late teens is presented
through interesting and amusing entries in her scrapbook. Photographs
of Skeele dressed as a buccaneer for Halloween and many party invitations from both friends and suitors paint a colorful and fun loving life as a
college student. The sketchbooks are full of detailed studies and finished
scenes, many focused on Taos Indian ceremonies and landscapes. An
extended 1949 trip to Europe is also documented beginning with scenes
from the ship (including a study of an inebriated passenger asleep on a
deck chair) and continuing through Scandinavia and down to Toledo,
Spain. At least two Taos scenes in the books are studies for works sold
through auction in recent years as well as a number of figure studies

Note: Paul Coze emmigrated from France to the United States in the 1930s, lived briefly in Pasadena
in the 1940s where he taught at the Art Institute and worked in the art department at 20th Century
Fox, and settled in Phoenix by the 1950s. Coze married Katharine 'Kay' Coze, niece of artists Anna
Katharine Skeele and Frode Dann. He maintained an active art studio in Phoenix where he produced many significant civic murals around the city, scores of which have been lost to renovation
and construction. Of particular interest to the artist was the local Native American culture. In the
present work, Coze incorporates Native American and art elements together to create a Surrealist,
off-kilter and thoroughly unique self portrait. Other examples of the artist's work included in the
sale continue similar themes of surrealist/modern depictions of self and Native American culture.

depicts a Gypsy tent camp located at the Whittier Narrows, just east of Los Angeles. The camp was erected by Gypsies from around the United States
who came together to elect a new queen. ''It was a huge encampment, very, very exciting, lots of color.... The tents were decorated. It was almost like going

Millard Sheets'', Oral History Program, UCLA, 1977, vol. 1, p. 37). Sheets recalled that he skipped classes for nearly a month during the six-week Gypsy
encampment in order to execute at least a dozen oil paintings on-site, including the present work (M. Sheets, p. 37). The color and exotic ritual of the Gypsy
culture is on full display in ''The King’s Tent'', which captures vibrantly dressed figures in small groups gathering before a line of white tents. Painted in the
thick, bold brushwork that defines Sheets' early oils, ''The King’s Tent'' is a rare and important work from this maturing period. The year 1928 was a seminal
moment for Sheets. He was approached for representation by The Dalzell Hatfield Gallery, located near the Chouinard campus, and they purchased about
20 canvases at the onset of their association, including ''The King’s Tent''. Sheets estimated that they sold at least 3,000 of his paintings and prints during

Exhibited: Hammer Galleries, New York, NY, 1960's; California Institute of Technology, Baxter Hall, Pasadena, CA, on long exhibit and loan 1972 to 2015. Note: Pulitzer prize winning cartoonist, sculptore and author Rube Goldberg is best known for his
convoluted and complicated cartoons and contraptions that solve a simple problem. The present work is a rare polychromed
ceramic, metal, string and found object sculpture illustrating how to trap a mouse. The brass presentation plaque reads:
''Woman, frightened by mouse, jumps on stool, hitting head against teeterboard and spilling water from pitcher into bathtub
- bather scrubs back with brush attached to large jack lift which lifts dog to grab bone and work gears, causing mallet to strike
shell of turtle - turtle pulls in neck, setting off cannon which shoot cannonball through coiled pipe - ball lands in the cup which
its weight pushes down hand which closes mousetrap and, at the same time, causes it to upset innocent bystander who lights off
fuse and sets off rocket which takes mouse and trap to the moon - never to be heard of again.'' The piece is purported to be one
of only 3 such sculptures made by Goldberg; each is of the same mechanism. The sculpture is presented in a clear acrylic case
on a wooden table base, measuring 48'' H x 46'' W x 19'' D overall. In the mid-1960s Robert L. and Mary H. Meyer purchased
the present work from a Hammer Gallery exhibition of Goldberg’s work. Goldberg was present at the exhibit. The mousetrap
sculpture was shipped to Meyerís downtown Los Angeles law office where it was displayed until his death in 1972. At that time,
for security and insurance purposes, the sculpture was loaned to the California Institute of Technology where it remained on
display until 2015. Provenance: with Hammer Galleries New York, NY; Private Collection, Los Angeles, CA, acquired from the
