Dear Members & Supporters:
I hope you will enjoy the Summer Issue of The Bottom Line.
ARANY is hard at work gearing up for a busy summer; we will
not rest as we continue to push our legislative agenda, grow our
membership base and enhance our visibility, both statewide and
nationally.
It is that time of year again: summer means family barbeques,
picnics and vacations and, for ARANY Members, Summer
Meetings. This year’s meeting will be held in Watkins Glen
on June 27-29, at the Harbor Hotel. This is going to be a fun
and informational opportunity to meet with your fellow ARANY
Members and share in the latest-and-greatest on what is going
on in the industry and to hear about the past year’s progress.
Saturday morning will consist of meetings and updates, including
a keynote speaker and regulatory and legislative updates.
Following the meeting, attendees will have the weekend to enjoy
Watkins Glen, Seneca Lake Wineries, races—and the great
hospitality of the area. I strongly urge you and your family to
attend the Summer Meeting. Do not miss

informed on national issues and learning about industry initiatives, best practices and business solutions. ARANY
participants were exposed to introductions and updates from the States, multiple “Strategy Sessions” and learned
about priorities for 2014 – 2015 and beyond. The ARANY delegation was the largest in number of all 13 States
represented in Washington, D.C! Members of the ARANY Washington, DC Hill Day Team include: Vince Surace, Lisa
Cimino, Shannon Banks, Rick Wilbert, Greg Beagell, Kyle Beagell, Russ Cirino and Administrator Becky Miller. We
look forward to reporting back our successes and sharing the knowledge our team gains while on “The Hill.”
Also, please keep in mind that ARA National will be hosting its 71st Annual Convention and Expo in Nashville, TN,
October 22 – 25. More details on this fantastic event will be provided in the near future. If you are interested in
attending the National Convention and Expo, please mark your calendars!
Another important date to keep in mind is the 53rd Annual ARANY Fall Convention and Tradeshow, taking place in
Albany at the Desmond Hotel and Conference Center, November 6-9, 2014. The Convention Vendor Packets have
gone out, responses are being tracked and we are happy to announce we are ahead of last year’s schedule, slating
this event to be the best Convention and Tradeshow yet! We look forward to tremendous participation from the
membership and sponsor/exhibitor base, alike.
We will be working diligently throughout the summer in order to keep the drums beating and stay focused as we
move into a busy Fall Convention Season.

ARANY IN ACTION AT THE STATE CAPITOL
LOBBY DAY – APRIL, 29 2014
On April 29, ARANY members pounded the pavement to show our presence and strength in our industry! With the
assistance of our Chief Lobbyist Rebecca Marino and Lobbyist Yomika Bennett, we attended over 20 face-to-face
meetings with Senators and Assembly Members to personally educate them about our industry and to discuss
ARANY’s legislative agenda.
We will be keeping the momentum going as representatives of ARANY travel down to Washington DC
for ARANY’s National Hill Day, June 18-20!

EARTH DAY AT THE CAPITOL - MAY 5, 2014
This year, New York State Government recognized Earth Day on May 5. In an effort to show how green our industry
is, and to show both consumers and legislators how much of a car is recyclable, ARANY displayed a disassembled
Chevy Spark. We laid the car components out, with signs identifying parts which also included recyclable liquids
as part of the display. Over 1,000 people viewed our display on the Empire State Plaza Concourse. A special thank
you goes out to Greg Beagell of Don’s Automotive (and ARANY’s Environmental Committee Chair) for making this
display a huge success!

LEGISLATIVE UPDATE
MEMO OF SUPPORT
SENATE BILL 5786 (DEFRANCISCO)/ASSEMBLY BILL 7234 (ENGLEBRIGHT)
The Automotive Recyclers Association of New York supports Senate bill 5786 and
Assembly bill 7234 which amends the insurance law to prohibit insurers who provide
collision or comprehensive loss from requiring a repair facility to use a specific
vendor or process for the procurement of parts or other materials necessary for the
repair of a motor vehicle.
Recently, a national insurance company instituted a mandate that automobile repair
shops use their direct repair program to purchase replacement parts. These parts
are most often not Original Equipment Manufactured (OEM) parts which meet the
original standards and specifications.
This system will direct repair shops to purchase products out of state thereby hurting
the businesses located in New York State, including over 700 automotive recyclers.
In addition, this measure limits a repairer’s right to choose the parts vendors from
whom they purchase parts; increases the number of days to repair the customer’s
vehicle; increases the indirect costs to the consumer; increases the repair facility’s
administrative time; reduces local automotive parts sales, negatively impacting local
economies; negatively impacts the part suppliers forcing below market pricing and
impeding fair trade and an open market.
This legislation is necessary in order to ensure public safety and preserve
competition in the marketplace. For these reasons, ARANY supports the passage of
Senate bill 5786 and Assembly bill 7234.
UPDATE: The parts steering bill was approved in the Rules Committee.
We have issued our memo of support to the full Senate. We will keep you
apprised of any new developments.
Senate bill 5786 by DeFrancisco, John A.. Prohibits insurers, providing
collision or comprehensive coverage of motor vehicles, from requiring
repair shops to use specific vendors or processes for vehicle repair parts
and materials.
CAPTIVE UPDATE
ARANY members are eligible to apply for workers compensation insurance through the ARANY workers
compensation captive insurance program. This program was put into place to respond to NYS effectively
forcing the ESTRA-ARANY workers compensation trust to close and in response to the member’s need for cost
effective workers compensation insurance.
The ARANY Captive is an insurance facility that is rented and controlled by the association and its membership.
The program does not have the same “joint and several” liability that a trust can have. The Captive “pools”
its members premiums and losses. Underwriting profits, a result of favorable loss experience and investment
results are returned to the members by means of a dividend.
To put this program in place ARANY partnered with Haylor, Freyer & Coon and PMA insurance, two well
respected names in the insurance industry. The members of the captive have, with help from PMA and HF&C,
kept the expense and number of claims to a minimum. The results have been beneficial to the captive
insurance members -- a 19% dividend two years ahead of schedule.

SERVE AS AN ARANY REGIONAL DIRECTOR
GOAL
To support ARANY’s statewide outreach and operations by ensuring that the membership in each ARANY Region
is being represented. Each Region shall be represented on the Board of Directors by a Regional Director, who
shall serve as a liaison between the members in a specific Region and the association’s Leadership and Staff.
Regional Directors will be appointed by the President.
STRUCTURE
ARANY divides New York State into 5 separate Regions, in which to serve members on a more local basis and
provide for greater representation. These 5 Regions are Western New York, Central New York, Northern New
York, Hudson Valley & Downstate. (see next page.)

E nsure that the membership in each region is being heard and their ideas, opinions and suggestions
are presented to ARANY Leadership.
n Recruit and retain ARANY membership within the Region.
n Recommend and review ARANY activities and directions to improve the association and better represent
the needs of the membership.
n Advise ARANY Leadership of the challenges that might arise in each region and of possible solutions.
REGIONAL DIRECTOR DUTIES & RESPONSIBILITIES:
n R
egional Directors are the eyes and ears of the ARANY in the field. They represent “grassroots”
leadership for our association. They bring management ideas, suggestions and awareness of political
and industrial problems, as well as opportunities, to the association’s leadership for review and action.
A REGIONAL DIRECTOR WILL:
n Communicate and present updates at scheduled Board Meetings or conference calls, Summer Meeting
& Annual Convention & Trade Show. Your presence at these events is important. However, if you are
unable to attend, a written report may be submitted via the ARANY Office.
n Organize in conjunction with the ARANY Office at least one meeting/event a year. Events can offer
educational, networking and social opportunities.
n Communicate with automotive recyclers in the Region in order to establish good rapport between these
professionals and the association. Identify and recruit new members for the association.
n Communicate with the ARANY Leadership & Staff periodically to compare ideas, share problems and
opportunities. Regional Director conference calls will also be conducted throughout the year.
n Conduct Member Outreach: Regional Directors will receive membership reports from the ARANY Office
and be notified when a new member joins the association. All new members should receive a personal
welcome from the Regional Director (letter, phone call or visit).
n Gather information that is beneficial to the association and industry-at-large (such as personal
business-related information on members, such as leadership positions of state/provincial/country and
local associations; persons involved in local government positions such as city council, mayor, etc.;
newspaper articles that pertain to our industry - both negative and positive; new product ideas; and
anything affecting our industry as well as the general business climate.)

ARANY functions primarily as a service and advocacy organization. Only through the combined efforts of all

Service Plus Coverage Endorsement for an additional

The Property coverage portion of the policy deals with
covered losses to buildings, equipment, materials, and
fixturesatyourprinciplebusinesslocation.Coverage
is also provided for the actual amount of a covered
loss to business income and extra expense incurred as
a result of a loss to building or personal property (12
months of coverage included for most auto salvage
operations).
The Auto Dismantlers Policy offers a broad range of
property related coverage for an additional premium:
• The Central Premier Plus offers over 25 enhanced
property and prime related coverages in a single,
affordable endorsement. The coverage is provided
on a blanket basis with available limits of $25,000,
$50,000, $100,000 or $250,000 and applies separately at each premises listed on the policy.
In the event of a covered loss, the blanket limit can be
applied to one coverage or apportioned among several
coverage extensions. When the Premier Plus endorsement is attached, Equipment Breakdown coverage is
also added to the policy.

Liability Protection
Business Liability coverage protects against legal liability resulting from covered claims of others for bodily
injury and damage to their property. It also provides
coverage for your legal expenses in the event of a costly lawsuit arising from such claims. Liability limits are
available from $300,000 to $1,000,000 (per occurrence). Higher limits are available under our Commercial Excess policy.

BE ALERT!
Dear ARANY Members & Supporters:
The Department of Environmental Conversation (DEC) is out and about conducting “surprise inspections”
to make sure that yards are in full compliance with regulatory requirements. Here are some helpful spring
cleaning tips:
• Inspect all run-off points, walk the ditches looking for debris; debris is much easier to remove before
the vegetation starts growing. Additionally, plastic and miscellaneous parts should be removed from
drainage ways.
•C
lean up snow piles. Most of us push our snow into a condensed area during the winter and many
times parts end up in the pile. After a long winter, this can be substantial and should be addressed as
soon as the snow melts.
•C
heck fence lines. Wind and snow pushing tends to add items to our fence lines. Take time to clean the
fence line in the spring.
• Inspect all holding tanks. While we all should be doing regular inspections of any holding tanks,
sometimes snow buildup makes this difficult. Take a close look at all tanks to see if a new paint job is
needed, also check to make sure you have proper labeling and that the winter has not compromised any
piping or supports.
• P re-dismantle holding lots: once again snow and ice buildup during the winter makes it hard to inspect
our holding areas. Spring is a good time to check them out.
•D
elivery vehicles: spring is a good time to clean up the fleet. Image is important to inspectors who may
drop by. If your facility is clean and your fleet is clean, it helps send the correct message about your
facility.
• S tormwater exit points: be sure to inspect the exit point of any stormwater from your facility. Snow melt

STORMWATER 101
What is stormwater?
Stormwater is water from rain or melting snow that doesn’t soak into the ground but runs off into
waterways. It flows from rooftops, over paved areas and bare soil, and through sloped lawns while picking
up a variety of materials on its way. The quality of runoff is affected by a variety of factors and depends on
the season, local meteorology, geography and upon activities which lie in the path of the flow.
What is the problem?
As it flows, stormwater runoff collects and transports pollutants to surface waters. Although the amount
of pollutants from a single residential, commercial, industrial or construction site may seem unimportant,
the combined concentrations of contaminants threaten our lakes, rivers, wetlands and other water bodies.
Pollution conveyed by stormwater degrades the quality of drinking water, damages fisheries and habitat of
plants and animals that depend on clean water for survival. Pollutants carried by stormwater can also affect recreational uses of water bodies by making them unsafe for wading, swimming, boating and fishing.
According to an inventory conducted by the United States Environmental Protection Agency (EPA), half of
the impaired waterways are affected by urban/suburban and construction sources of stormwater runoff.
Examples of stormwater include oil and grease from automobiles, causing sheen and odor and making
transfer of oxygen difficult for aquatic organisms.
