discussion covering what the district office is and its role in congressional
relations, vision for aging and special needs policy agenda for the 112th
Congress, how NAELA members can create a relationship with their district
office staff and build upon that relationship for future advocacy, how NAELA
members can involve their clients in advocacy and share clients’ stories
with representatives, and how NAELA members can use their district’s
constituent services to help their clients. This session will empower NAELA
members in districts with new representatives to contact those representatives, build relationships, and educate them on NAELA’s public policy

Continuing Legal Education
Credit
Application for CLE credit for the conference
has been made in all states with mandatory CLE
requirements. The number of credits approved in
each state differs. In order to be eligible for CLE
credits, you must sign in at the NAELA CLE Registration Desk. Please note that several states
require you to complete state-specific forms.

The Advocacy/Litigation Section addresses the interests of
members who are involved in various types of advocacy and
litigation efforts as part of their Elder and Special Needs Law
practice. The Section publishes its newsletter, The Advocate,

Benefits and Financing Section
The primary focus of the Benefits and Financing Section is
educating NAELA members about the importance of planning, financing, accessing, coordinating, and advocating
for all potential benefits, both public and private, to ensure
that seniors and people with disabilities have all the financial
support that is available to maintain their continued independence. The Section publishes a newsletter twice per year.
Guardianship/Capacity Section
This Section explores the issues related to the legal adjudication of capacity, the administration of guardianship estates,
and the guardian’s fiduciary liability as well as the attorney’s fiduciary liability in the guardianship process. Section
members network by sharing information on case law and
other related materials in its newsletter, The Bulletin, which is
published twice per year.
Health Care Section
The Health Care Section is committed to providing education and support to NAELA attorneys for their efforts to
advocate for and assist clients to protect patients’ rights and
obtain increased access to health care, including palliative
care and other health care, which will lead to improved quality of life. The Section publishes a newsletter twice per year.
Practice Development/Management Section
As an Elder and Special Needs Law attorney, how do you

2011 NAELA Awards
John J. Regan Writing Award
Special Needs Leadership Award
The John J. Regan Writing Award will be
presented on Thursday, May 19, at 4:15
p.m., prior to General Session II, located in
Encore Ballroom 4-8. Professor Jeffrey N.
Pennell receives this year’s award for his
article, “Special Needs Trusts: Reflections
on Common Boilerplate Provisions,” published in the Fall 2010 NAELA Journal. The
award was established in 1996 in memory
of John J. Regan, a long-time NAELA member and Fellow, and a pioneer in Elder Law.
The award is meant to encourage quality
submissions to NAELA Journal from NAELA
members and non-members.
NAELA presents its second Special Needs
Leadership Award to Renee Wallace of
Houston, Texas. The award will be presented on Friday, May 20, during the Business Meeting Luncheon, located in Encore
Ballroom 4-8. The Special Needs Leadership Award is to given to an individual who
makes a significant contribution to the lives
of those with Special Needs.
Theresa Award
Renee is the founder of Vita-Living Inc.,
a Houston-based, non-profit organization providing services and supports for
children and adults with intellectual and
developmental disabilities. Vita-Living
seeks to provide each of its clients with a
safe and stimulating environment, as well
as a meaningful place in the community.
Renee is also the author of Creative Caring,
a biographical account of the challenges
she and her husband faced in raising their
special needs son Ricky and establishing
Vita-Living.
The 2011 honoree for outstanding contribution to persons with special needs is
NAELA Member Renée Colwill Lovelace,
Esq. Theresa Award Honorees seem to
all have one thing in common: they all
have a blood-line of community service.
The Theresa Foundation which supports
children with special needs was established
by Past President Vincent J. Russo and
Susan Russo, in memory of their daughter,
Theresa. The presentation of the award will
take place on Saturday, May 21, 2011 at
8:00 a.m., prior to General Session VII.
Cohn Sisters’ Scholarship for
Patient Advocacy
We honor NAELA member Renée Colwill
Lovelace, Esq. of The Lovelace Law Firm,
Dripping Springs, Texas, for her outstanding
community service. In addition to providing quality estate planning, Ms. Lovelace
is a celebrated disability rights advocate
who has served on numerous boards and
committees. Renée worked to establish a
mental health law project with the Dallas
Bar Association, has taken many individual
pro bono cases, and handled corporate
work for nonprofit organizations. She was
one of the primary team members drafting
and establishing the Arc of Texas master
pooled trusts, and wrote and compiled
a 1,000-page guide for Texas attorneys
to use as a resource when representing
families of children with disabilities. Renée
also recently wrote the book Pooled Trust
Options: A Guidebook, published in 2010,
a project of the National Plan Alliance.
Presidents’ Recognition Award
Each year the current NAELA President
selects an outstanding individual to receive
the President’s Recognition Award. This
year’s award is presented to NAELA member Kevin Urbatsch, San Francisco, Calif.
NAELA will make a donation to the organization of choice Kevin’s choice. The award
is presented during the Annual Business
Meeting on Friday, May 20.
Outstanding Chapter Member
Award
In all groups, there are always one or two
members who stand apart from the rest
based on their willingness to do whatever is
needed to get the job done. The Outstanding Chapter Member Award is presented
annually to that NAELA Chapter member.
The award is in recognition of the outstanding initiative and leadership the member
demonstrates on behalf of the Chapter.
Congratulations to all of the Outstanding
Chapter Member Award recipients. Their individual acceptance speeches can be found
on the conference USB Drive after speaker
biographies.
Jessica L. Fisher, Mechanicsburg, Pa., and
Mark G. Wermerskirchen, Willmar, Minn.,
are this year’s winners of the Cohn Sisters’
Scholarship for Patient Advocacy. The
scholarship is available through the NAELA
Foundation in memory of Vivian Cohn Smith
and Lorrie Cohn, sisters of NAELA Fellow
Helen Cohn Needham. This annual scholarship is available to Elder Law attorneys
who are unable to afford to attend a NAELA
Annual Meeting, and who would use the
training to assist and advocate on behalf of
the disabled and incapacitated.
The Cohn Sisters’ Scholarships for Patient
Advocacy are made possible through the
continuing generous donations made in the
names of Vivian and Lorrie to the NAELA
Memorial Fund, by their family and friends,
Needham, Mitnick & Pollack, PLC, and
other individuals and law firms.

Conference Scholarship
Congratulations to Kristen Prull Moonan,
the winner of the second Young/New
Attorneys Section Conference Scholarship.
The scholarship was established in 2010
as a means to encourage newer NAELA
members to attend a national conference.
The criteria for the scholarship are: 1) the
entrant must have never attended a NAELA
national conference, and 2) the entrant
must be willing to write a brief article
regarding the experience for the Young/
New Attorneys’ newsletter. Please look for
Kristen and ensure that her first conference
experience will leave her wanting to
