Spain Approves New Eviction Guidelines
Spain approved a new voluntary “code
of conduct” last month for banks which
aims to help poor homeowners settle
their debts and reduce a wave of evictions
brought on by the economic crisis. Under
the new guidelines, mortgage debts can be
restructured for a period of up to 40 years
and surrendering a property as payment
may be permitted as a way of freeing a
homeowner from their debt in some cases.
Spanish banks currently seize the homes
of those who default on their mortgages
and often demand further payment from
those evicted if the value of the house has
fallen below that of the loan. The new rules
will apply in cases where every member of
a household is unemployed and mortgage
payments are equal to more than 60% of
the income
Unicaja, Caja Espana
seal state-backed
merger
Former Spanish savings banks Unicaja
and Caja Espana-Duero announced a statebacked merger agreement in March after
months of negotiations to create the country’s seventh largest bank.
Under the deal, smaller but healthier Unicaja will absorb Caja Espana-Duero, which
was heavily exposed to Spain’s real estate
collapse, creating an entity with about 80
billion euros ($105 billion) in total assets.
Spanish banks are undergoing a wave of
mergers that will likely cut their number
to 10 from 40 after the government made
them write down losses on real estate investments that turned sour, leaving billions of bad assets on their balance sheets.

The contract to complete the land sale for
the new Paramount Theme Park in Murcia,
southern Spain, has been signed given the
green light for the much awaited project
which could help boost the country’s slow
property market.
Proyectos Emblematicos Murcianos (PREMURSA), the promoter behind Murcia’s
Paramount Theme Park and LifeStyle Centre, agreed to pay 10.3 million for two
thirds of the land earmarked for the project.
Chris Mercer, director of estate agent Mercers which is based ten minutes drive from
the Theme Park, believes it will transform
the area.
‘In this time of negative reporting, particularly with reference to Spain’s economic
tribulations, it is so refreshing to have
some ultra positive news to share. After
many months of waiting it now looks as
though we have been right to have had
faith in, and publicised, the ongoing Paramount Park saga,’ he said.
Rivero Fury Over Oil
Authorisations
the new bank and issue 475 million euros
in contingent convertible bonds (CoCo
bonds) to meet government capital rules,
it said in a statement late on Friday.
It will also be responsible for 525 million
euros of preference shares that are currently controlled by Spain’s state-backed
bank restructuring fund FROB.

which automatically convert into equity

Canarian president Paulino Rivero has
vowed to block the controversial licences
granted by the Spanish government on
Friday for oil drilling off the coast of the
islands. Rivero slammed Madrid for ignoring Canarian opposition to the drilling and
said he would do everything in his power
to halt the attempts to find oil by oil multinational Repsol. It is exactly what we do
not want or need on our doorstep due to
the impact it will have on tourism and biodiversity’ said the president at the weekend, adding that he would not allow the
islands to be treated ‘like a colony’.

Spain finally passes Timeshare Directive into law
The Spanish government has finally
passed the ‘new’ European Timeshare Directive into national law.The new law will
come into force the day following its publication in the Official State Bulletin – by the
end of March. All timeshare companies
will need to ensure they are in full compliance by this date.The government, which
was only elected in November 2011, took
urgent steps to ensure that the law was
adopted as quickly as possible to avoid
fines threatened by the European Commission and passed the legislation by means
of a Royal Decree, a process that avoided
further lengthy parliamentary processes.
The Directive is of maximum harmonisation, meaning that Member States cannot
make any changes to a number of elements, including the following:
• A 14-day cooling off period
• Contracts of more than one year are within the legislation (previously it was three
years)
There is, however, the possibility to make
additions to the Directive legislation – for
instance the UK included a number of new
criminal offences – and in Spain there are a
number of variations that should be noted:
• The contract must be provided in the language of the purchaser as long as it is a
language of the EU
• The required pre contractual information
may be published on the company’s own
website or on the website of its trade body.
• Detailed information of the product must
be provided, again in the language of the
purchaser.aaaa
• Trade bodies will promote their codes of
conduct and provide relevant information,
on request, to members of the public.

Francisco Lizarza, Chairman of the Resort
Development Organisation (RDO) in Spain
and head of the Spanish lobby group, said:
“This new law sweeps away the confusion that has existed in Spain over the past
year and timeshare companies can finally
make the appropriate adjustments to their
operations.“The law will help boost consumer confidence in Spain, the most popular timeshare market in Europe, where almost half of European owners have chosen
to buy.”

This issue makes for an interesting case study as we interview Jean
Pierre and Jean Michel, two lifelong
friends form France that decided to
buy a villa between them and retire
together in Maspalomas, Gran Canaria. Jean Pierre Vanhoof aged 51
a businessman whose interests are
playing the piano. Jean Michel Balcerek is also 51 a Physicist and a Cello
Player. Both met 38 years ago at music school in France when they were
just 13 and have been like brothers
ever since. Both being single and the
best of friends, decided to take early
retirement together and buy a joint
property and move to Gran Canaria
with the help of estate agent Alex Williams owner of Dream Homes in Playa
del Ingles.

How long have you been visiting the
Canary Islands, which island in particular? Which area is your favorite and
why?
We have been coming to Gran Canaria for
10 years now. Although we like the South

North of the Island because of the warmth
and the kindness of the people there so it
seemed our obvious choice when deciding
to retire abroad

How long have you been thinking
about buying?
We were looking for the property a very
short time. We arrived mid August for two
weeks and found the property while we
were there. It was a lifestyle move so in the
grand scheme of things, we found exactly
what we wanted very quickly within two
weeks.
We first started to plan it in February 2010
and began the process of buying in August
2010.
What finally made you buy?
Jean Pierre was ready to sell his company,
which meant that we were no longer bound
to any country or area. At the time we were
living and both working in London
How did you afford the purchase, did
you need a mortgage? If so how did
all of this work and come about?
Fortunately, we did not need a mortgage
but Alex from Dream Homes introduced us
to several banks and made sure we could
had one on hand in case anything went
wrong and there were delays with the sale
of the business
Why did you choose Dream Homes as

We would need more than a page to describe how kind, helpful and professional

if we were a little nervous at the beginning,

we bought it and are
absolutely delighted

How did you manage to get all the paper work and finances in order?
We were confident as we could see that
Dream Homes knew what they were doing! Thanks to them the whole process of
buying has been made totally legally and
with no horrible surprises!
How long did it take from first seeing
the property you wanted to complete
the purchase?
The whole process took about a year: but
let me explain: it could have been done in
much less of course, but Jean Pierre had to
sell his company and this took some time.

How much did the extra costs like
taxes, notary and solicitors fees come
to?
The taxes and costs came in and just under 10% of the purchase price, and we
were lucky to get a good deal with a local
solicitor too. He acted for both parties the

prefer not to use the same lawyer to represent both parties. However in our case
we were happy to do so and it saved us on

How do you plan to use the property,
as holiday home, residence, investment etc?
Now you have a property what are
you plans for the future?
The property is for our permanent residence. Although we have made moderate
changes to the property, we bought the
house fully furnished and equipped. The
couple we bought from was British & had
used the villa as a holiday rental property.
It came with absolutely everything & of
good quality, including, domestic appliances, home cinema, and cutlery even a
fondue kit!
How did you manage to get amenities
connected, was it difficult?
No! Don’t be put off buying a property
abroad; it is not so difficult, but choose
your estate agent wisely you know who we
recommend!
Enjoy it!!! On a more serious note, we
have been very busy refurbishing and renovating the house, planting a new garden
etc. although it is much easier to work in
this climate then what we have been used
to!
What advice would you give to anyone
else thinking about buying a property
overseas?
Its simple, if you are interested in buying

if we hadn’t we may not be where we are

No, it was very easy. In the Canary Islands
when you come with a smile people are always eager to help you and make things as
easy as possible.
Have you spent much time in the
property yet?
We have been in the property now for
7 months and we are over the moon
and have already made some very good
friends. It feels wonderful! Although we
have only been a short time, it feels as if
this has been our home forever. Feeling
this way makes us sure we made the right
decision.

What to look out for
If you don’t want to get involved in starting
a business from scratch, buying an existing
business may be the answer, especially if
you’re considering a business such as a shop,
a bar or a restaurant.
Hopefully, the business will have a good customer base and any licences for the business
will already be in place. All you should have
to do is register a change of ownership with
your local town hall and then build on existing business.
Beware: all may not be as it seems! Try to find
out why the owners are selling the business,
especially if the price seems reasonable.
Thriving businesses aren’t sold off at knockdown prices without a good reason. If a business has been badly run and doesn’t have a
good reputation, you could be buying something that’s more of a liability than an asset.
Make sure you get at least two independent
valuations and talk to the current owners at
length about their reasons for selling. Is competition too fierce or are there plans afoot to

build something close by that will affect your
trade? Ask your lawyer to check local planning permission applications for possible rival businesses or anything else that may have
a negative effect on your profits.
Another potential disadvantage of buying an
existing business is that you potentially also
take on the staff that go with it and you will
be subject to all the labour and social security obligations of the previous owner. Make
sure that your lawyer checks what kind of
contracts are in place for the staff, as you will
be the one who has to honour them. Check in
particular that there are no outstanding disputes with any staff. The previous employer
and you are jointly responsible for any claims
made before the sale.
Of course, you can take on a business and
choose your own staff, but the present owners will have to make their management and
staff redundant and contractual obligations

The procedure for buying a business is essentially the same as for buying any property,
but you should tread carefully through it. You

market while all the legal checks are made.
