The official will be relieved immediately and in any case with in 3 days failing which he/she will be
liable for disciplinary aciton, However if any official is working in Census duty, he/she shall not be
relieved till the Census duty is accomplished.
No TA/DA and joining time will be admissible to the official if he/she has been shifted on his/her
request after exercising option.
If there is no vacancy in the destination school for any reason the incumbent transferred shall
re-join his/her previous place of posting and also inform to concerned branch/computer cell at
HQ.
If any discrepancy is noticed in this order or there is a violation of transfer policy, It should be
brought to the notice of Computer Cell/Concerned branch within three days and the order be not
implemented.
In case of mutual transfer, it is directed that before relieving/joining the officials concerned, it
may be ensured that the distance between both the schools is not less than 8 km.
In case of urban area stations while implementing the transfer orders, it may be ensured that the
transferee has completed the rural service as per transfer policy.
The mutual transfer would be effective only when both the employees seeking mutual transfer
submit a consent document to their respective Principals.

This is with reference to orders passed in CWP No. 6960 of 2011 titled as Sh.
Bhupinder Singh and Smt. Reena Bansal vs. State of Haryana.
Brief facts of the case are that some of the guest teachers who were not having
subject combinations or the requisite qualifications, required under the relevant
Service Rules at the time of initial appointment on guest faculty basis including those
who completed the subject combination or the requisite qualifications subsequently
while continuing on the said post as guest teacher, were issued show cause notice for
terminating their services. In addition to this, some of the guest teachers, against
whom regular teachers were appointed on promotion or otherwise, were relieved. There
were the guidelines issued by the department in this regard. Those guest teachers who
were not having subject combinations or the requisite qualifications, required under
the relevant Service Rules at the time of initial appointment on guest faculty, preferred
Civil Writ Petitions (CWPs) in the Hon'be High Court and most of these CWPs have
been disposed of with the following order dated 05-08-2011.
"All these writ petitions are disposed of with a direction to the petitioners to
appear before the respective authorities which have issued show cause notice in each
case. The said authorities, after obtaining replies to the respective petitioners to the
show cause notice, shall forward the case to the Director, Elementary Education by
fixing a date of hearing before the Director in consultation with the Director. The
Director, Elementary, thereafter, would afford due opportunity of hearing to the
petitioners and pass an order in accordance with law. The petitioners shall be at
liberty to raise all the pleas that they may wish to urge against the proposed action.
Needless to mention that they may wish to urge against the proposed action. Needless
to mention that the Director would keep in mind the observation made Ist Division
Bench in tilak Raj's case (supra). The petitioners would be at liberty to impugn any
order passed by the Director in accordance with law. If any of the petitioner makes a
request for being represented by a counsel, the same shall be considered by the
Director and appropriate order made thereon. The interim order passed in favour of
the petitioners shall continue till the date of decision by the Director."
Sh. Bhupinder Singh and Smt. Reena Bansal working as Guest teacher in OHS
Bapa and GSSS Bilaspur District Yamunanagar respectively have jointly filed a CWP
6960 of 2011 against the State of Haryana. This Writ petition was listed with CWP No.
4699 of 2011. The CWP No. 4699 of 2011 filed by Sh. Gazender Singh, Science Master
GHS Khojki pur, District Panipat was admitted by the Hon'ble Court vide order dated
July 07, 2011. The operative part of the said writ petition is reproduced below for
reference:"It is also directed that there will not be any further appointment of guest
teachers during the next academic year starting from 01-04-2012 and the shortall, if
any, in the number of teachers will have to be met with by the State by undertaking a
precise and accurate exercise of posting and re-posting of teachers according to the
needs of each school.
"That being the direction issued by the Division Bench, the service of the
petitioners in the present writ petitions, who are guest teachers, may need to be
continued till 31.03.2012.
These writ petitioners are, accordingly, admitted and are ordered to be
taken up for hearing in the month of April, 2012. The interim order maintaining
the status quo of the services of the petitioners shall continue till 31.03.2012.
The State would be under obligation to comply with the directions to dispense
with the services of the guest teachers.
A photocopy of this order be placed on the connected files."
Taking into consideration, the various pleas taken by guest teachers before the
Hon'ble Punjab and Haryana High Court with regard to dispensing with their services,
the Directorate issued certain guidelines to be observed before dispensing with the
services of the guest teacher who were not having the requisite qualification at the
time of initial appointment.

The file has been perused and the matter is decided as under:
Persons who have fulfilled the requisite academic qualification
prescribed in the Service Rule till the date of his continuation on
guest faculty basis are not to be removed from the said faculty in view
of judgment dated 30.03.2011in Tilak Raj's case and subsequent
judgments of Hon'ble High Court in various other cases.
Persons who have not completed the requisite academic qualification
prescribed in the Service Rule till the date of his continuation on
guest faculty basis are to be removed from the said faculty.
3. Persons with B.A. B.Ed. qualification and holding JBT posts are not
to be removed in view of the NCTE Notification No. 61-1/2011-NCTE
(N&S), dated the 23 rd August, 2010 and further amended by
Notification dated 10.06.2011 which made candidate with
B.A./B.Sc./B.Com with at least 50% marks and B.Ed. qualification
eligible for appointment to Class I to V upto 01.01.2012 as JBT
Teachers.

In the instant case, Sh. Bhupinder Singh, Science Master and Smt. Reena
Bansal was earlier given hearing on 1.12.2011 and 2.12.2011 respectively. Both the
teachers during hearing had admitted that they were not having the requisite
qualification as prescribed under the Service Rules of 1998. But in view of order
passed by the Hon'ble Punjab and Haryana High Court they were allowed to continue
to work as guest teacher in the respective schools till 31.03.2012. Thereafter, no
information was received from the petitioners regarding the qualification which they
have acquired to be eligible for the post of Science Master or SS Mistress. Therefore, it
was decided to afford an opportunity of hearing to the petitioner to explain their case
Accordingly, a notice was issued to the petitioners to appear before the Additional
Director, Elementary Education alongwith the documents to establish their claim to
continue as guest teacher in the schools where they were initially appointed on guest
faculty basis.
Sh. Bhupinder Singh, stated that he was possessing B.Sc degree with
Mathematics Physics and Computer Science at the time of initial appointment
as guest teacher. Now he has passed an examination of Chemistry as an
additional subject for Bachelor of Science part-II on August 01, 2011.
Photocopy of the result cum details marks card was placed on record. He
further stated that he had appeared in Chemistry part-III and the result is still
awaited. It was further stated that as soon as the result of the said examination
is declared he will submit the copy of result in the department and requested to
allow him to continue to work as guest teacher in the same school.
Smt. Reena Bansal at the time of hearing on 19-6-2012 stated that she was not
possessing the requisite qualification as prescribed under the Service Rule of
1998. She was possessing B.A. degree with English, Economics, and Music as
elective subject. She further stated that she had appeared in Political Science
examination for B.A. part-I in the year March, 2012. She further stated the
result of the said examination is still awaited and she will also acquire the
requisite qualification as prescribed rules as early as possible. She further
requested to allow her to continue as SS mistress on guest faculty basis in the
school where she is presently working.
I have taken into consideration the facts brought on the record, the guidelines
issued for the guest teachers by the department and the service rule applicable in this
case. Both the guest teachers had admitted that they were not possessing the requisite
qualification as prescribed under rule at the time of their initial appointment on the
guest faculty basis. Even today they do not possess the prescribed qualification. It is
also a matter of record that the department had taken similar view in all such cases
where the guest teachers were not qualified at the time of initial appointment had not
acquired the prescribed qualification even while continuing as guest teachers, their
services were terminated.
In view of above stated guidelines since in the instant case also Sh. Bhupinder
Singh as well as Smt. Reena Bansal had not acquired the prescribed qualification even
continuing as guest teacher till date. They have not submitted any document to
establish that they possess the prescribed qualification, therefore, the department is
not inclined to give any favour to these two petitioners. They have not submitted any
order regarding whether the stay granted by the Hon'ble Court upto 31.03.2012 was
further extended. Keeping in view the facts explained above and similar stand taken
by the department, both the teachers who were not qualified for the post of Science
Master and SS Master at the time of initial appointment or even now they are not
qualified due to lack of subject combination needed for these posts it would not be
appropriate to allow them to continue as guest teacher.
Hence, the services of Sh. Bhupinder Singh, presently working guest faculty
(Science master) GHS Bapa district Yamuna Nagar and Smt. Reena Bansal working as
guest faculty (SS Mistress) in GSSS, Bilaspur district Yamuna Nagar are hereby
terminated with immediate effect.
