Filipino-Canadian artists

The North American Filipino Star is
honouring Fil-Can artists in Montreal
and suburbs who have demonstrated
fine excellence in arts.
That’s why for the first time, the NAFS,
a respected newspaper that has been
serving the Filipino community for
many years, is holding this event to
Cherylyn Toca
recognize the Fil-Can artists who have
been recognized by the other
communities except ours.
Here is the list of honourees:
Paul Baluyot — Baluyot is a stand up
comedian who recites a fast-paced
succession of numerous stories called
Paul Baluyot
`bits` and one liners which constitute
what is typically known as monologue,
routine or act. He admitted that there
are no formal schools for comedians
to study. “It takes pure talent for
someone to be a comedian, “ he said.
Baluyot added that working as a
comedian is fun but not easy. “Stand
“Maiara” (Maria Janice Galvez)
up comics are expected to deliver a
steady stream of laughs. They are
always under pressure to deliver. If
they cannot make the audience laugh,
they could be harassed or booed.”
He performs not only in colleges and
universities in Ontario and Ottawa but
also in comedy clubs in Montreal

Statement by the Honourable Rona Ambrose,
Minister of Health, on an announcement of a support
package for Canadian survivors of Thalidomide
March 6, 2015
More than fifty years ago, Thalidomide
was approved by Health Canada and
prescribed to treat morning sickness in
expectant
mothers.
Tragically,
Thalidomide caused serious and
permanent physical and emotional
damage to mothers, children and
families.
On behalf of the Government of
Canada, Iwould like to express heartfelt
sympathy and great regret for the
decades of tremendous suffering and
personal struggle that exposure to
Thalidomide has inflicted on survivors
and their loved ones.
Thalidome children wtih deformities in their arms and limbs.
No regret or sympathy and no amount
of financial support can ever undo what
happened.
www.filipinostar.org
However, today we are announcing
support that will help ensure that
survivors receive the care they need to
live the rest of their lives with dignity.
I have just spoken with Mercedes
Benegbi, Executive Director of the
Thalidomide Victims Association of
Canada, to thank her for her tireless
work on behalf of TVAC members and
tell her about new assistance the
Government of Canada will be
providing to Thalidomide survivors.
Today, our Government is taking a
historic step and announcing a
package of financial assistance that will
help cover the urgent and ongoing
healthcare needs of Thalidomide
survivors.

Recognizing the talent among our
community is long overdue
Many of our community
associations have been giving service
awards to people who have done
something good to their fellow citizens,
As far as we know, no association yet
has given any recognition to talented
Filipino-Canadians who have achieved
a considerable degree of success in
their art.
The North American Filipino
Star, having served the community for
the past 33 years and considered to be
credible and reliable, is taking the
privilege of establishing the first
awards recognizing Filipino-Canadian
artists. A committee composed of
MMTV (Mabuhay Montreal TV) crew
members, voted upon the nominated
candidates for the awards.
As we
would like to make these first awards
special, we limited our selection to four
this year.
Our first awardees are all
outstanding in their field. We are very
proud to have this opportunity to show
how we appreciate them. moreover, we
want to further their career by letting our
fellow citizens know more about them.
We are holding the awards
ceremony during the Spring Dinner
Dance Party of Mabuhay Montreal TV. It
is an occasion that will raise awareness
about two things - appreciating the
talents of our fellow citizens and
supporting the only Filipino-Canadian
made television show in Quebec.
Moreover, we are also highlighting the
role that the North American Filipino Star
has been fulfilling for many years. Like
the television show, it provides a
valuable service of informing and
educating the public about important

The North American Filipino Star
issues and providing them with timely
news locally and internationally..
Both MMTV and the North
American Filipino Star are empowering
our community. Being in the media, we
try to be fair, objective and truthful in our
reporting and broadcasting. We are
motivated by our desire to create a
positive influence over our readers and
viewers. By doing our job to the best of
our ability, we promote a positive image
of Filipinos in Canada.
MMTV’s Spring Dinner Dance
Party is going to be a very special one
for many reasons. First, it will be the first
time the North American Filipino Star
has initiated this type of award that has
not yet been done by any other group.
Second, it is going to be the night when
Filipinos in Montreal can demonstrate
their support of their own television
show, and third, it will be an opportunity
to know your local artists and start
enjoying their works.
We salute our awardees Carolyn Fe, Cherylyn Toca, Maria Janice
Galvez who is now known as “MIARA” of
the famous show “La Voix” on TVA and
Paul Baluyot who is known as a stand
up comedian. Congratulations for your
fine work in the entertainment field.
We hope that by honoring our
Filipino Canadian artists they will
continue to be successful and be better
known for their talent.
We are looking forward to
enjoying this awards night with as many
people as possible, hoping that you will
all come to give us your support.

Today, the Honourable Rona Ambrose,
Minister of Health and Member of
Parliament for Pickering-Scarborough,
Corneliu Chisu, announced almost
$8.4 million in federal funding for
several initiatives that support bringing
internationally
educated
health
professionals into the Canadian health
workforce so that Canadian families
can have better access to quality
healthcare services.
Across Canada, access to health
professionals continues to be a
challenge. Approximately 4.6 million
Canadians are without a regular family
doctor. At the same time, there are
around 10,000 newcomers to Canada
that are health related professionals.
Many of these individuals face
obstacles in finding jobs that best
match their skills and experience.
This support will help prepare doctors
and other health professionals for the
Canadian workforce. These initiatives
complement the Government of
Canada's wider support for improving

healthcare system by working with
provinces, territories and healthcare
professionals to improve access to
quality care for Canadians and their
families.
Quick Facts
Since 2006, Canada has welcomed
an annual average of more than
250,000 immigrants, the highest
sustained level of immigration in
Canadian history.
The Government of Canada is
providing $8.2 million under Health
Canada's Internationally Educated
Health Professionals Initiative to the
Government of Ontario for three
initiatives supporting internationally
educated health professionals and
their potential employers. This project
will be implemented in partnership by
HealthForceOntario and the University
of Toronto.
Funding of $150,000 has also been
provided to the Medical Council of
Canada for a project to help prepare
international medical graduates as
they move into the health workforce.

Canada and the United
States sign historic
preclearance agreement
Key Beyond the Border Action Plan
deliverable will further enhance crossborder flow of travellers and goods
March 16, 2015 - Washington - Public
Safety Canada
Today, Canada’s Minister of Public
Safety and Emergency Preparedness,
the Honourable Steven Blaney; and
U.S. Secretary of Homeland Security,
Jeh Johnson, signed the Agreement
on Land, Rail, Marine and Air
Transport Preclearance between the
Government of Canada and the
Government of the United States of
America. The Agreement is a major
commitment of the Beyond the
Border Action Plan issued by Prime
Minister Harper and President Obama
in December 2011. The Agreement
was signed in Washington following a
meeting to discuss border security.
Every day, nearly 400,000 people
cross the Canada–U.S. land border,
along with over $2 billion in goods
and services. A highly efficient border
that ensures the efficient flow of
legitimate goods and people is
essential to this trade relationship.
Through
the
comprehensive
approach to preclearance outlined in
the Agreement, Canada and the U.S.
are seeking to strengthen our
relationship and enhance our mutual
security, prosperity and economic

competitiveness.
When it takes effect, the new
Agreement will provide a legal
framework that will enable the
establishment of new preclearance
operations in any of the four modes of
transportation. It will allow the market
to propose operations when and
where it makes sense – facilitating
trade and travel, and creating
economic benefits for Canadians.
Quick Facts
Preclearance operations were
implemented in Canada for the first
time in 1952, when U.S. preclearance
officers began screening travellers for
U.S.-bound planes at the Toronto
International Airport. A formal
preclearance agreement with the U.S.
did not exist at that time; Canada and
the U.S. reached their first air
transport preclearance agreement in
1974.
Each year, roughly 11 million
passengers are pre-cleared for flights
to the U.S. at eight Canadian airports
under the current bilateral air
preclearance framework – reducing
wait times for these passengers and
often reducing the number of
connections they required.
This historic new comprehensive
Agreement covers all modes of travel,
including air. When it enters into force,
it would replace the existing air
transport Agreement, which was
signed in 2001. This single
Agreement would ensure
a
preclearance activities, regardless of
the mode of transportation, making it
easier to implement and govern
preclearance activities in both
countries.
In the Beyond the Border Action
Plan, in addition to negotiating a
comprehensive
approach
to
preclearance in the land, rail, marine
and air modes, Canada and the U.S.
committed to implementing a truck
cargo pre-inspection pilot in Canada.
Phase I of the pilot was implemented
at the Pacific Highway crossing
between British Columbia and
Washington, from June to December
2013. Phase II was implemented at the
Peace Bridge, between Ontario and
New York, from February 2014 to
January 2015. An evaluation of the
pilot will be completed by July 31,
2015.

We know that support has been
provided over the years from various
sources, including payments by the
Government of Canada in 1991.
However, our Government understands
that we have a clear moral obligation to

is also clear that more support is
needed to assist with survivors' ongoing health needs. The support we are
announcing today is responsible and it
is the right thing to do.

The North American Filipino Star
TOP FILIPINO BEAUTY PAGEANT EXPERTS AND WRITERS
Joyce Burton Titular
Why do Filipinos love
beauty pageants
I had a taste of the pageant
industry in 2001 when Leticia Bulotano
Wheeler, the CEO ofUniversal Models
Pageant (UMP), hired me to be the
company’s director. UMP was the
founder andproducer of Miss Global
Beauties, and was the owner of 5
beauty pageant franchises responsible
for sending Canadian representatives
to
international
competitions.
However, the job was not easy. From
recruitment of candidates to finding
sponsors, the challenges were
enormous in a country that loathes
beauty pageants.
Many Canadians think of
beauty pageants as shallow and
demeaning to women so that back in
1990, Toronto’s city council voted 10-7
to prohibit beauty contests from being
held at Nathan Phillips Square.
Because of this by-law, Miss Universe
2005 Natalie Glebova, was barred
from attending a "Tastes of Thailand"
festival in her home city over concerns
of
"sexual
stereotyping
and
degradation." She was told by the
Toronto officials that she would be
allowed in only if she removed her
Miss Universe sash
and crown.
If Natalie Glebova was a
Filipina who had won the Miss
Universe crown for the Philippines, her
homecoming experience would be
entirely different. She would have a
throng of well-wishers and press
conference during her arrival, victory
parades, victory dinner parties, TV
guestings, a courtesy call with the
Philippine President at Malacañang,
and commendations from the Senate
and the House of Representatives.
So why do Filipinos love
beauty pageants? Why do we take it
seriously? I asked some of the top
Filipino pageant experts and writers on
their opinion.
Joyce Burton Titular –
“For me it’s tied to the Fiesta culture
that we have. We love to party,we love
to celebrate! And we love beautiful
women and celebrate them. Pageants
are like a marriage of our Fiesta culture
with our love for gorgeous women. At
the same time, I have to admit that we
have high expectations of our beauty
queens. They have to be smart and
good examples. When they are not,
then we love to criticize them. That I
believe is another reason why we love
pageants. We have free reign to 'make
pintas' the contestants and winners.
Pinoys are notorious for being
'pintaseros' and enjoy critiquing a
whole lot. It may be funny to other
cultures but when you start talking
about beauty queens in a roomful of
Filipinos,
the
mood
changes.
Everyone sits forward in their seats,
pulses quicken, and the exchange of
comments never ends. In general,
Pinoys love and respect their beauty
queens and find pride in them.
Just my thoughts.”
Felix Manuel – “The Filipinos high
regard for women dates as far back as
the pre-Spanish Era Explorers have
documented that women were given a
special place in society. I believe that
the first beauty pageant in the country
started in 1908. It became a venue
wherein Filipinos can celebrate the
beauty and charm of its women.
From then up to now, these
pageants serve as venues where
extraordinary women, representing
their regions/ towns/barangays, etc.,
become national celebrities and role
models, thus elevating not only their
status, but their hometowns. If they
make it internationally, the whole
nation takes pride in their victories.”
Norman Tinio – “Filipinos
are a very patriotic lot. Be it in sports,
singing, dancing or pageantry. We
love cheering for the representatives
carrying the name of the country
abroad or even in those hosted in our
own backyard.
In terms of beauty contests,
the level of interest varies depending
on the specific sector of society
watching or following the same. But
where it matters most, the numbers
are large enough to make influential
steps via social media, online voting
and the like.
Successful efforts, like making
a Philippine contestant win in
popularity or fast-track events, further
fuel the drive of faithful fans to exceed
their previous best.
Overall,
beauty
contest
victories are treated like the elusive
Olympic Gold Medal that the
Philippines has never been able to
claim. So the #1 placement in the
majors such as Miss Universe, Miss
World, Miss International and Miss
Earth are tantamount to getting more
than our fair share of the same.”
Noli Berioso – “Pinoy’s
fascination on beauty pageants can be
traceable way back at the time of our
great Grand-parents. It’s part of our
culture and tradition. Beauty contest is
also a way of giving honor and pride to
Norman Tinio
Coco Alinsug
Felix Manuel
Noli Berioso
Raymond Golez
our fellow Pinay. Before, we do this
contest during town fiestas to honor the
most beautiful. But in the recent
decades, we began to conduct our
national search to select our
representative
to
compete
internationally. We are blessed with so
many beautiful Filipinas and we can't
help but to admire, love and respect
them through beauty pageants. That is
probably one of the reasons why we
arebeing tagged as one of the pageant
crazy countries in the world.”
Coco Alinsug – “Beauty
contests are everywhere in the
Philippines, from beauty pageants for
kids, to gay beauty pageants, schools,
offices, to every corner of major islands
in the Philip-pines. Ibeauty pageants
have become a national pastime like
boxing, basketball, zumba and
cockfights. The reason why it's popular
boils down to the economic situation of
the country. Filipinos love anything
beautiful as our way to cover what is
bad in the country. We are a third world
country, we have few things to be proud
of internationally (sad to say), we hardly
have any world class athletes, and we
could not even compete with our
neighboring Southeast Asian countries
as far as sports is concerned.
But we have something that they
don't have - beautiful women and
passionate and supportive populace.
Filipinos found a way to highlight what we
have and we found that formula of looking
at beauty pageants as our way to compete
internationally.”
Raymond Golez – “As the only
country to hold titles in the top 5
international beauty competitions, it is safe
to say the Philippines excel at the game of
pageantry. The country fancies on its
queens and ties pride for the Philippines to
each crown. In online social media, we
witness flare-ups of excitement when Ms.
Philippines wins, and outpourings of ire
when Ms. Philippines leaves empty handed.

Dear EarthTalk: What is Global
Divestment Day and how does it relate
to protecting the environment?
-- Michel LaPlante, New
Orleans, LA
With crucial international
climate negotiations coming up in
Paris in the Fall of 2015, the first ever
Global Divestment Day took place on
February 13-14, with activists and
everyday people across six continents
and 48 countries joining together in
more than 300 events—including
street theater, elaborate props, sit-ins,
vigils, dancing, bicycle parades and
social media blitzes—all in the name of
calling on corporations, foundations,
endowments and other institutions to
divest from fossil-fuel industries in
order to speed society’s transition to
renewable, non-polluting sources of
energy.

resources need to stay in the ground.
Yet fossil fuel companies not only plan
to extract and sell their existing
reserves but are exploring ever more
sensitive territory to find new ones,
thus ruining any chance of securing a
safe planet.”
Fossil Free and other groups
and individuals participating in Global
Divestment Day are asking portfolio
managers to stop adding new
investments in fossil fuel companies
and to sell off their holdings in the top
200 fossil fuel companies within five
years. To date more than 200
institutions with combined assets
topping $50 billion have signed on
committing to divest in fossil fuels.
Some of the heavy hitters so far
include the Rockefeller Brothers
Foundation, the British Medical
Association, Stanford University and
the World Council of Churches.
Meanwhile, a growing chorus of voices
from the financial and investment
communities agrees that divestment
might be the quickest route to
mitigating climate change. A senior

Dear EarthTalk: I saw a chart that
quantified the negative impacts on our
health of our reliance on coal as an
energy source. It was pretty shocking
as I recall. Can you summarize what
we’re dealing with here?
-- Mitchell Baldwin, Boise, ID
Coal
combustion
plants
account for more than half of
Americans’ electric power generation.
According to Coal's Assault on Human
Health, a report by the non-profit
Physicians for Social Responsibility
(PSR), coal combustion releases
mercury, nitrogen oxides, sulfur
dioxide and other substances known
to be hazardous to human health. The
report evaluates the impacts of coal
pollution
on
our
respiratory,
cardiovascular and nervous systems
and concludes that air pollutants
produced by coal combustion
contribute to asthma, lung cancer,
congestive heart failure and strokes.
“The findings of this report are
clear: While the U.S. relies heavily on
coal for its energy needs, the
consequences of that reliance for our
health are grave,” says Alan
Lockwood, a principal author of the
report and a professor of neurology at
the University at Buffalo.
The PSR report further
illustrates the adverse effects of the
mining of coal on the environment,
water and human health. Coal mining

“Coal ash is a silent killer,” says
Barbara
Gottlieb,
director
of
environment and health at PSR.
“Communities
are
drinking
contaminated water laced with toxic
chemicals that poison humans.”
According
to
the
U.S.
Department of Energy, coal plants can
reduce sulfur oxide, nitrogen oxide and
greenhouse-gas emissions by using
biomass as a supplemental fuel in
existing coal boilers. A Union of
Concerned Scientists (UCS) report
says that tree limbs and tops normally
left behind after timber harvesting
operations,
and
otherwise
unmarketable materials like dead,
damaged and small-diameter trees,
can be collected for biomass energy
use. Income from selling biomass can
pay for or partially offset the cost of
forest management treatments needed
to remove invasive species or reduce
the threat of fires.
Utilities like New Hampshire’s
Northern Wood Power are taking a
lead in putting biomass energy to work
in their power plants. In 2006, the
company replaced a 50-megawatt
coal-burning boiler in Portsmouth with
one that uses wood chips and other
wood materials for fuel. The result has
been a reduction in coal use by more
than 130,000 tons annually, reduced
air emissions by more than 400,000
tons annually and the development of
a thriving wood chip market for New
Hampshire’s forest industry.
Retrofitting coal-fired power
plants to burn biomass makes sense
for utilities trying to be greener while

The climate movement has
embraced
divestment—that
is,
ditching stocks, bonds or investment
funds deemed unethical or morally
ambiguous—given how effective the
tactic was in helping topple Apartheid
in South Africa by shaming the
companies still willing to do business
there. Other successful divestment
campaigns have targeted tobacco as
well as companies doing business in
the embattled nation of Darfur.
“The fossil fuel industry has
our political process in shackles with
its financial might,” says Fossil Free,
the group that created and organizes
Global Divestment Day. “But we are
matching their financial might with a
different kind of power... Through
divestment,
we
are
directly
challenging the social license of these
corporations who have become rogue
entities seeking profits at the expense
of people and planet.”
Global Divestment Day, the
group argues, highlights a conflict that
most politicians are loath to address:
“If the world is to avoid catastrophic
global warming, most known fossil fuel
investor Axa IM told the Guardian that
“moral issues” are playing a role in
recent low oil prices “with the
divestment movement steadily gaining
traction amongst investors across the
globe.”
Fossil Free points out that
divestment isn’t so much an economic
strategy as a moral and political one.
“Just like in the struggle for Civil Rights
here in America or the fight to end
Apartheid in South Africa,” the group
reports, “the more we can make
climate change a deeply moral issue,
the more we will push society towards
action.” The group adds that
divestment also forces prominent
institutions and individuals to choose
sides, sparking public debate on the
topics at stake and raising awareness
for doing the right thing. “We need to
make it clear that if it’s wrong to wreck
the planet,” Fossil Free concludes, “it’s
also wrong to profit from that
wreckage.”

Appalachia—can bury streams with
rubble and, in turn, harm aquatic
ecosystems. Waterways may also
become contaminated due to the
storage of post-combustion wastes
from coal plants, also known as “coal

sites in the United States, and toxic
residues have migrated into water
supplies at dozens of them.

2. Second strike: Candidate will lose
from 100 to 300 votes, depending on
the severity of the infraction, to be

Disqualification from the election
Mabigat ang 100 to 300 votes.
Ito ang naging isyu nuong 2011.
Nabawasan ng 300 votes ang bawat
kandidato ng Samahang Makabayan.
Bago pa mag-eleksyon, nabasa ko
ang konstitusyon at hindi ako
sangayon sa regulasyong ito. Sana,
nang bigyan ng kopya ng COMELEC
ng mga regulasyon ang mga
kandidato
bago
mag-eleksyon,
nagsabi na sila na hindi sila sangayon dito. Hindi naman sila menor de
edad at hindi pinilit na pumirma sa
candidacy form. Palagay ko, hindi
yata talaga binasa ng mga kandidto
ang Rules and Regulation of Election.
Nang matapos ang eleksyon, duon
sila nagreklamo.
Nang kumandidato ako sa
team ni Carlos Reyes nuon, hindi ko
sinagot ang mga katanungan sa
candidacy form na kahit nag-aaply
ako sa trabaho ay hindi itinatanong
tulad ng Have you been convicted of
any crime, have you filed for
bankruptcy, what is your religion?
Hindi ako na-convict ng crime, hindi
ako nag- file ng bankruptcy at katoliko
ako. Sinabi sa akin ng puno ng
COMELEC na dating president ng
FAMAS na formality lamang ang mga
tanong na iyon. Hindi ko pa rin sinagot
ang mga tanong pero pinabayaan
akong kumandidato.
Ang payo ko sa mga
kandidato, basahin at intindihin ang
konstitusyon. Walang masamang
magtanong kung hindi maintindihan
ang nakasaad sa konstitusyon. Ang
masama, ang magkunwaring alam
ang lahat.
Kung may problema ang mga
kandidato, sabihin kaagad so
COMELEC para mapag-usapan. Sa
COMELEC, sana, lagi nilang iisipin na
ang mga kandidato ay mga volunteer
lamang. Ang sabi ng isang miembro
ng COMELEC, kailangang maging
mahigpit para maging seryoso at
huwag mandaya. Tama. Kaya lamang,
konsensya ng isang kandidato kung
hindi siya seryoso sa mga ginagawa
niya at mandadaya siya. Hindi lamang
ang komunidad ang niloloko niya
kundi ang sarili rin niya. At isa pa,
bakit
siya
makikipagaway
sa
trabahong walang sueldo?
Ano nga ba ang FAMAS?
Kamakailan
ay
may
nagtanong sa akin kung ano nga ba
ang FAMAS. Akala ko ay nagbibiro
lamang siya pero naisip ko na hindi
nga pala lahat ng Pilipino sa
komunidad ay alam kung ano ang
FAMAS. Ang alam lamang nila ay ang
mga kaguluhang nababasa at
naririnig tungkol sa asosasyong ito.
Ang FAMAS ay isa sa
maituturing na pinakamatagal ng
asosasyon sa loob at labas ng
Montreal. At ito rin ang masasabing
pinakamalaki dahil unang-una, sa
numero ng mga taong nagiging
miembro pagdating ng eleksyon para
suportahan lamang ang kanilang mga
kandidato.
Walang sueldo ang mga
opisyal ng FAMAS. Ang iba, gustong
maging opisyal ng FAMAS dahil sa
pangalan lamang. Para sikat.
Mayroon naman na bukal sa kalooban
ang makapaglingkod sa komunidad.
Kung may pansariling layunin naman
ang iba, sila na lamang ang
nakaaalam.
Sa mga opisyal na tulad ng presidente
at direktor na walang masyadong
ginagawa, madali ang trabaho nila.
Subalit sa mga talagang gustong
makapaglingkod sa komunidad,
malaking abala at sakripisyo ang
ginagawa nila. Halimbawa, ang
panahon na dapat ay ilaan nila sa
kanilang
pamilya
at
trabaho,
napupunta sa FAMAS. Sila ang
dahilan kung bakit ang FAMAS ay
may serbisyong ibinibigay sa mga
Pilipino dito sa loob at labas ng
Montreal tulad ng French courses,
Heritage classes at sumasagot sa
mga katanungan ng ating mga
kababayan. Higit sa lahat, sila ang
kumakatawan sa mga Pilipino rito.
Dahil sa FAMAS, malaki ang naitulong
ng pamahalaan ng Canada at mga tao
rito nuong naminsala ang bagyong
Yolanda . At dahil sa FAMAS,
nakikilala tayo ng mga politiko.
Nakalulungkot isiping nuong
mga nakaraang eleksyon,, ang
numero ng bumoto ay umaabot nang
mahigit 2,000 pero nuong 2013, mga
700 lamang. Ano ang mga ilang
dahilan kung bakit nangyari ito?
Nawawalan ng interest ang
mga tao dahil sa gulo o intriga.
Nagkademandahan, nawalan ng
transparency sa mga pera, naalis sa
park ang botohan.
Hindi ko masisisi ang mga miembro
ng ating komunidad kung mawalan

Microphones a videographer should use
There are many types of microphones out
there: shotguns, lavaliers, hand-held stick
mics, even parabolics. Some are specialty
tools that are only used occasionally,
others travel to every shoot but rarely leave
the camera bag. Some mics, however, are
the go-to, grab-it-every-time, couldn’t-livewithout-it kind of tool that everyone who
makes media ought to own.
On our MMTV Kit bag there are 3
accessories
for
audio:
Pre-Amp,
Microphone, XLR wires and a back-up H6
Recorder.
In order to make great video you need to
record great audio. Audio is an incredibly
powerful part of your productions. It has
the power to make or break a program. No
matter how great your footage looks, it will
be thought of as a poor production if you
have weak, hissy, hollow audio.
The flip side is also true. Imperfect video
will be remembered as better than it really
is if the soundtrack is stellar. I don’t know
why this is true, but it is. Because of this,
one of the best ways to improve the
perceived quality of your edits is to
improve your audio. That means choosing
and using the right microphone. If you can
afford a whole host of them, fill your gear
bag to the brim and use whichever mic
makes the most sense on the set. Here’s a
quick overview of your options along with
my ratings and recommendations:
The Built-In Mic
Pros: The microphone that is built into
your camcorder is always present, it
cannot be lost or left behind, it doesn’t
require extra batteries, and the element
itself is generally of a pretty good
qualityCons: The secret to recording good
audio with any type of microphone is
getting the mic as close to the subject as
possible, usually within a couple inches of
the sound source you want to record.
Because the built-in mic is stuck on your
camera, you can’t get it close enough to
record good sound and still frame a usable

shot. The on-board mic also has the
terrible tendency to pick up operator noi
microphone mounted on a camera shoe.
Shotgun mics are arguably at their best
when they are mounted on boom poles
that are held over the subject’s head just
outside the frame. This allows all the
benefits of proximity, while still concealing
the microphone from view.
Cons: The highly directional aspect of a
shotgun microphone requires that it be
aimed fairly accurately at the subject you
want to record, so you need to monitor
your audio carefully. An inattentive boom
operator can easily let the mike drift or turn
in a way that causes the talent’s voice to
fall out of the mike’s sweet spot. The mic
needs to move with the subject to maintain
the best possible signal.
Summary: Shotgun mics are outstanding
tools for production, but they are
cumbersome and require an extra set of
qualified hands to operate. While they can
be mounted to a hotshoe to function as
sort of a “super” camera-mounted mic,
they are not an ideal “only” microphone if
you could have just one.
the standard for miking on-screen talent.
Summary: Lavalier mics are excellent multipurpose microphones. They record good
audio, can easily be hidden from the view
of the camera, and are available in both
wired and wireless varieties.
Which mic is the best choice if you could
only have one? The answer is, it depends.
Each mic type has its own strengths and
weaknesses and the value they have is
determined completely by your individual
needs.
The choice is yours. Evaluate these pros
and cons, and choose the mic that’s best
for the type of videos you produce.

side of the pot with the back of the
wooden spoon to make the mixture
creamy.
Remove the tied herbs; add the half
and half and spinach. Stir to
incorporate. Season with salt and
pepper (season, taste, adjust, repeat).
Serve each serving with a drizzle of
good olive oil and a splash of red wine
vinegar, per Jamie Oliver's (and my)
recommendation.
Notes
The cooking length for the lentils (and
the amount of liquid you need) will
partially depend on how old your lentils
are. Mine have been around for a
while... so they took about 6-7 cups of
broth over about 45 minutes of cooking
time. Just play it by ear and do what
feels right if it looks like it needs more
liquid and more time.

What if Pinoy Resigned?
PerryScope
By Perry Diaz
Aquino-Resign-MovementIn
the aftermath of the Mamasapano
Massacre, a groundswell is rising for
the resignation of President Benigno
“P-Noy” Aquino III. This is reminiscent
of the time leading to the uprising in
2001 when a citizens’ movement
snowballed into another people power
revolution, which came to fruition
when the generals of the Armed
Forces of the Philippines withdrew
their support for then President
Joseph “Erap” Estrada.
Known as “EDSA Dos,” it was
a coup d’état disguised as a people
power revolution, which many
believed was orchestrated by an elite
group who wanted Erap’s vice
president, Gloria Macapagal Arroyo, to
take over the presidency. Indeed, if
EDSA Dos was considered a
“revolution,” then it was a revolution of
the elite – the oligarchs of the land.
And true enough; as soon as Gloria
took over, the oligarchs placed their
people in key government positions.
Indeed, EDSA Dos was all about
power.
Gloria’s usurpation of the
presidency in January 2001 positioned
her to run for president in 2004, which
gave her the “power of the
incumbent.” Elected amidst charges of
election cheating, Gloria was in power
for nine and a half years, which made
her the longest serving president since
1986, when EDSA 1 deposed the
dictator Ferdinand E. Marcos. As we
all know now, Gloria’s reign was the
most corrupt since the time of Marcos.
People power
A q u i n o - R e s i g n Movement.2Although the Resign
Movement was gaining momentum, it
didn’t reach a critical mass that could
have ignited another people power
revolution. And after three people
power revolutions – EDSA 3 was a
failed attempt to bring Erap back to
power after Gloria was sworn into
office – the people are now tired of
“people power” revolutions. So what
we’re seeing now is a different tact to
bring down the president: the use of
the media. And this includes social
media, which in essence is another
form of “people power.” But is social

could be worse.
Then there is the problem of

that it was not a military takeover. But
that would be hard to sell. Anything
that comes close to a military coup
d’état could compel the U.S. to
withhold financial and military aid to
the country.
It’s becoming apparent that forcing PNoy to resign and replace him with a
junta wouldn’t dwell too well with the
Filipino people, many of whom have
horrendous memories of the Marcos
dictatorship.
Leaderless
and
rudderless, the Resign Movement is
beginning to show cracks on its
façade.
The challenge facing the nation is to
find an honest and incorruptible
leader. There are a few elected men
and women who have excelled in the
performance of their electoral
mandates. Anyone of them could be a
better president than Binay. But can
they beat Binay who has been
campaigning for president since he
was elected vice president in 2010?
The question to be asked then
shouldn’t be “What if P-Noy resigned?”
but it should be “What if Binay won?”

This week, I caught up with patent
attorneys Jonathan D’Silva and Bryan
Walker of MacDonald Illig Jones &

on some key strategic intellectual
property (IP) legal issues. Here’s what
they shared::
Q1: In your opinion, what are
some
of
the
top
strategic
considerations when deciding whether
to register intellectual property
internationally?
First and foremost, make sure
you have access to advisors who you
trust and who know the rules and can
make recommendations based on
your specific situation. Acting on
assumptions can foreclose your rights
and options without you even realizing
it. There are no guarantees that
registering intellectual property, (‘IP’
includes patents, trademarks, and
copyrights – it also includes trade

secrets, but you cannot register those)
will be a financially successful
endeavor. Registering IP requires a
short-term investment in hopes of a
long-term payoff.
The costs are usually paid
upfront, whereas the benefits are
typically realized years later, if at all.
This requires making projections and
educated guesses, and a business
plan is crucial. Although there are
international and multi-national treaties
that harmonize certain aspects of IP, it
is
still
highly
country-specific.
Choosing the countries where IP
protection will be sought is a strategic
decision, as it is simply impractical to
file in every country. Consider
registering your IP in those countries
where you market or manufacture your
products. Also consider where your
competitors are located, where you
compete with them, and particularly
where they have their manufacturing
capabilities.
In addition, each country
should be assessed for cost/benefit,
such as the size of the market in that
country, the barriers to entry for you
and your competition, and even the
political stability of the country. Simply

Paulo Avelino admits he had
relationship with KC Concepcion
Is Miss Universe Philippines 2015
Pia Wurtzbach dating PNoy?
Paulo Avelino on KC Concepcion: "Well, she's single, she's
beautiful… We have different priorities now."
After months of being coy
about the issue, Paulo Avelino finally
admitted he was in a relationship with
actress KC Concepcion.
The 26-year-old actor revealed
this in an interview with ABS-CBN
showbiz talk show “The Buzz” on
Sunday.
Asked by “The Buzz” co-host
Boy Abunda if he had a relationship
with KC, Paulo said: “KC and I are
friends. And I will always be there for
her whenever she needs me.”
He added, “Well, she's single,
she's beautiful… We have different
priorities now so...”
But Abunda called out Paulo
for not answering the question, adding
he first admitted courting KC in a
episode of “The Buzz” in 2013.
“Nagkaroon ba kayo ng
relationship ni KC Concepcion, yes or
no,” asked “The Buzz” co-host Kris
Aquino.
To
this,
Paulo
simple
answered: “Yes.”
The actor didn’t elaborate
when he and KC broke up.
This comes just days after
Paulo shrugged off reports that he has
already broken up with KC, even
though the two never admitted they
were in a relationship.
“Hindi naman siguro nagbibreak ang magkaibigan,” Paulo said in
an interview with the press last week.
Paulo admitted he was
courting KC in 2013.
Not yet the time for love
"Hindi rin siguro talaga
panahon ng pag-ibig."
Thus said Paulo Avelino when
asked why he's still single during the
press conference of ABS-CBN's
upcoming soap opera "Bridges of
Love" on Tuesday.
The
actor
has
been
romantically linked to fellow ABS-CBN
artist KC Concepcion since 2013, but
the two remain mum on the current
status of their relationship.
Paulo also dismissed talks that
they've broken up, saying, "Parang
wala namang inaamin na naging kami,
tapos break kaagad?"
"Hindi naman siguro nagbebreak ang magkaibigan," he added.
The ABS-CBN star said he and
KC are "trying to be better, better
people."
"Sa ngayon, nagfo-focus kami
sa sarili namin," Paulo also said.
Paulo's last known relationship
was with LJ Reyes.
Paulo said he's happy for LJ,
who is reported to being dating ABSCBN actor JC De Vera.
"Akin,
it's
only
about
happiness. Kung saan masaya si LJ or
kahit si JC--kahit sino pa ang piliin nila,
basta masaya sila," he said.
Paulo talked to members of the
press to promote "Bridges of Love,"
which will also star Maja Salvador and
Jericho Rosales.
Paulo served as the replacement for
John Lloyd Cruz and Xian Lim for the
role. John Lloyd begged off the project
last year. Xian was initially chosen to
replace John Lloyd, but was pulled out
off the project by the network to do a
soap opera with Kim Chiu.
"Lagi naman nangyayari yan,
kahit sa Hollywood, na may
napapalitan... But I'm blessed that I
have work this year and I was
considered for the role," Paulo added.
"Bridges of Love" premieres
this March on ABS-CBN. Pia Wurtzbach: "Matagal kong niligawan itong koronang ito. Ito yung
boyfriend ko ngayon."
Pia Wurtzbach is already
being courted by issues, days after
being crowned the 2015 Miss Universe
Philippines.
According to GMA-7 Arnold
Clavio in his tabloid column published
March 11, the 25-year-old beauty
queen was reportedly seen with
President Benigno Aquino III in a
restaurant in Quezon City on March 7.
This raises the question: Are
Pia and Aquino dating?
Pia denied the rumor in a
taped interview with GMA-7’s “24
Oras” aired Tuesday.
“No, No,” she answered when
asked about reports that she dated
Aquino.
She also said, “It’s very flattering but
this is my first day as Miss Universe
Philippines 2015. And I’m just trying to
savor the moment. I’ve been waiting
for this crown for a long time. Matagal
kong niligawan itong koronang ito. Ito
yung boyfriend ko ngayon.”
Pia joined the Bb. Pilipinas
pageant in 2013 and 2014 before
winning the top crown this year.
But it seems like Pia was
singing a slightly different tune in her
interview with ABS-CBN’s “Aquino and
Abunda Tonight” on Tuesday, aired
hours the "24 Oras" hour interview,
when she faced the show’s co-host
and the president’s sister, Kris Aquino.
When asked by Kris if she is
dating her brother, Pia said, “I know
him. I talk to him. He’s very fun to talk
to.”
“Please make him happy. He
needs it,” Kris told Pia.
“He’s a very busy man. And
I’m also busy preparing for the Miss
Universe,” Pia said.
President Aquino’s love life
has made headlines over the years. In
the past, he was linked to radio disc
jockey Grace Lee, politician-television
host Shalani Soledad and stylist Liz

Toni Gonzaga addresses
criticisms over her Bb. Pilipinas
hosting stint
Toni Gonzaga
TV host Toni Gonzaga has
acknowledged
the
controversy
spawned
by
her
seemingly
unconventional hosting style at the
recent Bb. Pilipinas beauty pageant.
“This would be the first and
last time I will talk about this kasi
noong Sunday (March 15) pa po ito
nangyari… Tapos na po ang
coronation night and we have
declared the winners so there’s no
point of looking back and talking
about it over and over again,” she
initially said during the press con for
“You’re My Boss,” a Star Cinema
movie starring herself and Coco
Martin.
Extending her apologies to
“to those who were not pleased”
following what she said had become a
“national debate,” she continued,
“Siyempre po doon po muna sa hindi
natuwa at hindi naibigan ang
napanood nila noong Sunday, I am
humbly… (offering) an apology if I
have offended or I have maligned or I
have hurt anyone of you.”
Noting it was “never my
intention (to do any of the above),”
Toni revealed, “Prior the show, I was
instructed po to make the show fun,
light and ease the tension especially
during the Q and A portion.”
Despite criticisms she earned
for what some people deemed as
irreverence,
the
singer-actress
remains grateful for the experience.
“Thank very much to the committee of
the Bb. Pilipinas for the opportunity to
host such a wonderful event kasi first
time ko ma-experience ’yung
ganoong ka-sayang crowd, ganoong
ka-wild na audience,” she said.
She also thanked those who
defended her and extended kind
words. “(I) really appreciate that from
the bottom of my heart.”
She shared that the Bb.
Pilipinas committee commended her
for the job she did, relating,
“Maganda po ’yung sinabi nila sa
akin. Actually, even the Special
Events, they texted me very nice and
encouraging words and I’m very
thankful for that.”
Capping her apology, she
said in jest, “And in the spirit na rin po
of beauty pageants, let’s end this
issue with world peace.”
“You’re my Boss” is written
and directed by Antoinette Jadaone
on the heels of the successful “That
Thing Called Tadhana.” It tells of an
amusing predicament of a top-level
executive and an assistant who will
switch roles in a desperate act to
close a huge deal. It opens April 4. Toni Gonzaga checks Bb. contestant 23′s jawline during the Q&A

‘chillax’
Siyempre naman ako, I take the
opportunity as it comes.”
She is aware that there are
better singers around but she remains
undaunted. “Siyempre naman kung
pwede ako maging superstar na
singer gusto ko ’yan talaga,” she says.
Solenn Heussaff
Multi-faceted celebrity Solenn
Heussaff is raring to record a new
album that she hopes would be a
reflection of her vibrant personality.
On the kind of music she
gravitates to, Solenn says she’s partial
to music that’s appropriate at the
beach. “’Yung maganda (rin) sa road
trips,” she adds. “Siyempre ’pag nasa
club ako, gusto ko ng club music, pero
kung may choice ako, mas gusto ko
makinig ng relaxed songs.”
“It’s a new journey and I think
it will be close to my heart kasi mas
vibe ko ’yung chillax music,” she says.
This time, Solenn eyes an alloriginal album, which will be released
under Universal Records. She has
started writing lyrics but isn’t rushing
her compositions. And with a new
direction in music comes a
relationship with a new label. She
notes, “I’ll be at home here (Universal
Records) and I’ll be able to do what I
want to do.”
After initially making a mark as
model and actress, Solenn maintains
singing is her first love.
“Actually nung pumasok ako
sa show business, gusto ko lang
magkaroon ng album. Gusto ko
magka-album to say to my kids in the
future na may album ako,” she shares.
“Dati hindi ko alam na magiging tuluytuloy (ang singing career ko).
www.filipinostar.org
Private person
Solenn may talk openly about
her career but to this day she is
evasive about her love life.
On marriage plans with
Argentinian boyfriend Nico Bolzico
with whom she got engaged in
December last year, Solenn maintains,
“No plans. Matagal pa ’yan. Ayoko
pag-usapan. It can wait.”
That said, Solenn points out
she will definitely wed before her
brother Erwann Heussaff, who is in a
relationship with actress Anne Curtis.
“Siyempre mas matanda
naman ako kay Erwann,” she says.
“Malayo pa sila (ni Anne kasi) sobrang
bata pa ni Erwann.”
Solenn maintains she is not
envious of friends who have already
settled down. “Everyone has a
different time for everything, whether
you’re 21 or 55. You live your own life.
Ako never akong (nainggit),” says she.
Still, she stresses marriage
won’t clip her wings. “I’m not that type
of woman na ’pag kinasal nasa bahay
lang. I want my own life, my own
friends.”
‘Bestie’ tandem
Meanwhile, Solenn is also
busy writing her book, which is coauthored by model Georgina Wilson.
“The book has advice about
everything – from sex, to relationship,
to abuse, to food, to diet; as in lahat
nandun that people don’t want to talk
about on TV,” Solenn shared, noting
how she and Georgina share opinion
based on personal experiences.
“We’re not saying correct kami
sa advice but we’re just sharing, from
living abroad and living here, ’yung
different perception of things. I think it
will have an effect (on the readers),”
Solenn noted.
The book will be launched in
April. March 2015

Alex Gonzaga can sing,
too
Alex Gonzaga
Here’s a secret just let out of the bag:
Alex
Gonzaga’s
friends
have
compilations of her songs. They were
recorded long time ago when she
would sing in class while waiting for
teachers to come.
While people know her more
as comedienne, Alex has a burning
passion for singing.
The public will hear more of
this in her debut album under Star
Music and the company is confident
she won’t let them down.
“She can really sing. Singer
siya who happens to be funny at hindi
comedienne who happens to sing.
Iyon ang gusto naming i-prove sa
album na ’to, na sobrang ganda talaga
ng mga vocal performances niya,”
said the label’s Jonathan Manalo.
He disclosed Star Music
originally intended to release just a
song by Alex. Upon hearing her demo,
however, they realized that here’s a
talent worthy of a full album, hence,
the six-track “I am Alex G.” It consists
of songs Alex describes as “bubbly,
fun, and easy-listening.” Some of the
titles are “Di Ko Akalain,” “Alam Mo Na
’Yan” and the promotional song
“Panaginip Lang.” “Lahat pwede kumanta pero
hindi lahat pang-recording ang boses.
Ako, particularly, bibigyan ko ng
recording contract ang isang singer
kung maganda ang boses niya sa
recording. And si Alex, magandang
pakinggan ’yung boses niya sa
recording,” Jonathan added.
Alex considers the album a
dream come true.
“Pinag-pray ko po ito. Tapos
inasar ko sila (Star Music na bigyan
ako ng album), nagpadala naman po
sila sa emosyon nila. Nagpagamit po
sila kay Lord,” she said in jest.
Taylor Swift inspired Alex in
doing the album. Like the American
superstar, Alex’s songs aim to uplift the
spirit of listeners. Her songs have
strong recall and are quick mood
uppers.
Admittedly, Alex believes her
singing has a long way to go before it
could even match her sister’s, singeractress
Toni
Gonzaga.
With
confidence, however, she hopes to
also go far in the music scene.
“Lahat naman pwede kumanta
basta may confidence ka lang. ’Yun
lang ’yun. Whatever your note is,
dapat i-carry mo ’yun kasi lagi namang
nadadaan ’yan sa performance,” said
she, who is set to have her first major
concert in April at the Araneta
Coliseum.
Meanwhile, Alex disclosed her
“Dear Alex, Break na kami, Paano?!
Love, Catherine” will soon become a
movie under Star Cinema. She said it’s
about giving people lessons she
learned from her past romances.
“Nandito po ’yung lahat ng
klase ng lalaki na nananakit sa mga
babae – mga oportunistang lalaki!”
she said of her book.
The 27-year-old celebrity, who
is also headlining the TV adaptation of
“Inday Bote,” hopes for more good
things in her career.
“Si Lord na po ang bahala
kung ano ang next na ibibigay niya.”

Fil-Am turns heartache to
breakthrough
Brad Go interviewed couples in countries like Spain, Australia, Italy
and the Philippines for The Hush Project.
It may have been emotionally
draining and costly for Fil-Am Brad Go
to embark on a journey around the
world interviewing couples and writing
tunes. But his ambitious idea paid-off
as he was able to produce an album
that gave him the break towards a
mainstream recording career.
Through MCA Music, the
singer-songwriter recently released his
nine-song pop rock debut album
called The HUSH Project, the HUSH
being an acronym for “Have U Seen
Her” which is the title of the blog he
created chronicling an affair that
inspired him to travel to select cities
and talk to people about love.
He shares, “One rainy New
York night in September 2012, I met a
girl. She didn’t have an umbrella so I
offered to share mine. We eventually
started dating and although it didn’t
work out, I was inspired to travel
around the world in search of credible
stories to use as inspiration for my
album.”
The umbrella moment seems
like an image straight out of The
Hollies’ iconic piece Bus Stop.
The New Yorker went to
Barcelona
(Spain),
Melbourne
(Australia), Singapore, Palermo (Italy),
Berlin (Germany), Paris (France),
Manila (Philippines) and Tokyo
(Japan) where he met an interracial
couple and whose story inspired him
to write I Want You Now — the album’s
carrier single.
For the Manila trip, Brad
visited his family’s hometown and
interviewed the only grandparent he
has left. The latter spoke about her
devotion to his grandfather and how
different romantic relationships were
back in 1950s Philippines.
Also working as a freelance
video editor and director, the
multifaceted act decided to try his luck
here and formally launch his album,
performing along with two former
members of veteran pop band True
Faith (Ferdie Marquez and Bimbo
Yance) during an afternoon press
gathering in Quezon City.
He found his travels life-
changing, with each trip giving birth to
a new song. “On top of the excitement
of being in a new place, there was the
thrill of trying to find a person receptive
to the project and willing to share their
story. Those interviews really offered
me a chance to share some truly
happy moments with people,” he
recalls.
With the addition of bonus
track Carry You Home, the other seven
songs in The HUSH Project are All
Along, It’s You, Follow Through,
Firestarter, Feel This Way, Love Is Love
and Time Machine.
MCA
clearly
recognized
Brad’s talent as it commissioned him
to write a song for rising star Darren
Espanto. For that challenge he came
out with Makin’ Moves which appears
on the latter’s self-titled album.
“I’m excited to promote the
album in the Philippines and abroad.
I’m also excited to start writing my next
album and further develop my catalog
as a songwriter for other artists as
well,” he relates.
Brad just did a series of gigs and radio
guestings in Metro Manila — a
privilege for Manileños who witnessed
an artist who has already played clubs
in downtown New York.
Confidence and emotions
come abound through him on stage,
and his laudable effort at translating
some English lyrics to Tagalog only
added extra flavor to his classy act.
MCA A&R manager Francis
Guevarra, who happens to be an exTrue Faith member, too, offers his
observation as to Brad’s strengths:
“He is a very marketable artist. We are
looking forward to helping him
cultivate and grow his personal brand
as a musician and songwriter. The
HUSH Project is just the first step.”
As for the girl he prefers addressing
simply as “her”, Brad expressed
gratitude, saying, “Without you none
of this would have happened.”
The HUSH Project is available
online via iTunes, Spinner, Spotify, and
Deezer. March 2015

From Page 13 - International Trade
requires at least a 3 to 4 year time
commitment and has several stages,
each requiring a financial commitment.
First, there is the initial drafting of a
quality PCT patent application that will
serve as the basis for what will
subsequently filed in all desired
countries.
Conservatively,
budget
US$20,000 to US$75,000 for drafting
and filing of the PCT patent
application. This should include costs
for a prior art search and analysis and
a draftsman for the drawings. Second,
applicants have up to 31 months
(depending on the country) from their
first, original filing to decide in which
countries to enter the ‘National Stage’,
which is often around US$5,000 per
country (plus translation costs where
needed). This is because patent
protection is country-specific. There is
no such thing as an international
patent.
Third, in any given country,
prosecution of the patent application
(the process of taking a filed
application through issuance, which is
never guaranteed) can take a variable
amount of time and money—
US$20,000 to US$30,000 or more—
depending
on
the
difficulty
encountered. The time frame ranges
typically from two to five years—
sometimes more—from when the
The North American Filipino Star
patent application enters the National
Stage of a particular country to when
the patent application is prosecuted.
Finally, you also have to be aware of
payment of maintenance fees, which
vary by country. Some countries
require annual payments even before
the patent issues, some require
payments after the patent issues, and
others require payment over some
other schedule. These fees can
exceed US$10,000 over the life of the
patent in each country. Enforcement
costs of a patent can vary widely, as
something as a simple cease-anddesist letter, licensing agreement, or a
cross-licensing agreement with a
competitor (involving their patents as
well) can resolve enforcement issues
for as little as a few thousand dollars.
Few patents are ever litigated,
but for those that are, the costs can run
into the millions. For trademarks and
copyrights, the costs and time
commitment are typically a fraction of
those required for patents. The
processes
of
registration
and
enforcement are much simpler and
therefore typically cost less. Register

Q3: In what kinds of
international situations is it better to file
a patent vs. keeping IP as a trade
secret?
Some assets, despite their
high value (e.g., customer lists) are not
patentable, thus making trade secret
protection the obvious decision. For
those assets that are patent-eligible
subject matter (i.e., process, machine,
composition of matter, and article of
manufacture), there are several
considerations that should be
examined in consultation with a patent
attorney. First is duration. Patents are
of a limited duration (by international
treaty, about 20 years from filing) in all
countries, whereas a trade secret can
retain its status until it is revealed,
which may never happen. Thus, if
long-term protection is desired beyond
the term afforded by a patent, then a
trade secret may be best.
A great example of this is the
formula for Coca Cola from 1886,
which is still protected as a trade
secret. Second is susceptibility to
Reverse-Engineering. A patent must
disclose sufficient details to allow
others to make and use the invention
once the patent expires. By contrast, a
trade secret loses its value if
competitors can reverse-engineer it,
which can leave the trade secret owner
without recourse.
Generally,
the
more
susceptible something is to reverseengineering, the less it would be a
viable trade secret. In addition, if your
process involves a combination of
elements, some of which are easier to
reverse engineer than others, it may be
possible to patent those portions of the
process that are easier to reverse
19
engineer
while
maintaining
confidentiality on those parts that you
can keep secret.
Third, if the trade secret is
reverse engineered, this can open up
the possibility of competitors filing
patents on the trade secret. Some
countries recognize a prior-use
defense, and this scenario could also
raise
inventorship
issues.
Nevertheless, having a competitor file
a patent on one’s own trade secret is a
nightmare, and can be avoided by
pursuing patents instead of trade
secret protection at the outset. Fourth,
it may be possible to obtain a patent
on something that is currently a trade
secret, thus giving up trade secret
status. Conversely, a patented
invention cannot later become a trade
secret. Fifth, if you have already
missed the deadline to allow you to file
a patent application on your invention,
you may have no choice but to try to
keep it as a trade secret.
