Board of Public Instruction of Pinellas County, Florida Principal Correspondents Index Subject Index 21 25 29 SCOPE AND CONTENT NOTE This Supplement to Part 23 of Papers of the NAACP reproduces the working case files of the NAACP's general counsel and his Legal Department staff for the period from 1960 to 1972, but focusing on the years from 1965 to 1972. Building on its legal victories in cases such as Smith v. Allwright, Sweatt v. Painter, and Brown v. Board of Education, and the passage of landmark federal civil rights legislation in 1964 and 1965, the NAACP, during the 1960s and 1970s, continued its legal battle against racial discrimination. The case files in Supplement to Part 23 pertain to school desegregation, employment discrimination, discrimination in the criminal justice system, voting rights, and demonstrations and boycotts. The files consist of correspondence discussing strategic decisions in the litigation process, exhibits, briefs, lawyers' notes, depositions, and transcripts of court proceedings. Due to the massive size of the NAACP Legal Department Case Files, UPA has organized this Supplement to Part 23 into several series based on geographic location. Series A covers southern states and is further divided into three sections. Section I covers Alabama, Arkansas, and Florida. Section II covers Georgia, Maryland, North Carolina, South Carolina, and Virginia. Section III covers Kentucky, Louisiana, Mississippi, Tennessee, and Texas. Series B covers northeastern states while Series C and Series D cover the midwest and west, respectively. This guide provides a reel index as well as an alphabetical correspondents index and subject index for the cases in Series A, Section I. Alabama cases in this edition pertain to employment discrimination, school desegregation, and voting rights. The first Alabama case is Buckner v. Goodyear Tire and Rubber Co. The plaintiffs in this case were David Buckner and other African American employees of the Goodyear Tire and Rubber Company plant in Gadsden, Alabama. Buckner and his coworkers made several charges of employment discrimination, including the maintenance of racially segregated facilities, discriminatory hiring and recruitment practices, and discriminatory selection of candidates for entry into the company's apprenticeship program. Local 12 of the United Rubber, Cork, Linoleum, and Plastic Workers of America also became a defendant in this case because of the collective bargaining agreement between the union and Goodyear Tire and Rubber Company. This case begins at Frame 0001 of Reel 1 and continues through to Frame 0429 of Reel 3. The second major Alabama case in this edition is Lee v. Macon County Board of Education. The parents of African American school children in Macon County brought this case in 1963 because of continued segregation in the county school system. In February 1964 Alabama Governor George C. Wallace and members of the State Board of Education were added as defendants in this case. The plaintiffs charged that Wallace and the State Board of Education actively interfered with the process of eliminating segregation in the Alabama public schools. The files for this case include dramatic testimony involving confrontations between the plaintiffs' lawyers and Alabama school officials on racial issues and states' rights. Materials from Lee v. Macon County Board of Education begin at Frame 0430 of Reel 3 and continue through to Frame 0736 of Reel 9. Other Alabama cases in this edition pertain to employment discrimination and voting rights. The employment discrimination cases are Love v. United States Steel Corporation, McCune v. Jones Foundry, Nash v. Tennessee Valley Authority, and Pettway v. American Cast Iron Pipe Co. The voting rights cases are Nixon v. Brewer and Sims v. Amos. In the case of Nixon v. Brewer, the plaintiff is E. D. Nixon, an NAACP and labor leader in Alabama since the late 1920s and one of the leaders of the Montgomery bus boycott of 1955-1956. Arkansas cases in this edition pertain to employment discrimination and school desegregation. The first employment discrimination case is Alexander v. Warren School District No. 1 Board. In this case, Travistine Alexander, a veteran elementary school teacher, charged that she had been discriminated against when the school board refused to renew her contract for the 1970-1971 school year. This case indicates some of the problems faced by African Americans as schools in southern states attempted to desegregate, often at the expense of African American school administrators and teachers. This case begins at Frame 0453 of Reel 10 and continues through to the end of Reel 11. The other two employment discrimination cases from Arkansas are Irvin v. Mohawk Rubber Co. (Reel 13) and Norman v. Missouri Pacific Railroad Company (Reel 14 and Frames 0001 through 0174 of Reel 15). In Irvin v. Mohawk Rubber Co., Melvin D. Irvin and and Johnnie E. Lewis, African American employees of the Mohawk Rubber Company, sued the company and Local 539 of the United Rubber, Cork, Linoleum, and Plastic Workers of America. Irvin and Lewis charged that the company restricted African American workers to specific departments and that the union failed to represent the interests of African Americans. In Norman v. Missouri Pacific Railroad Company, John W. Norman and other African American employees asserted that the railroad classified African Americans as train porters but required them to perform the same tasks as the higher-paid white brakemen. The Arkansas school desegregation case in this edition is Cato v. Parham (Reel 12). The plaintiffs in this case were Samuel Wayne Cato and other African American students and their parents in the Dollarway School District No. 2 in Jefferson County, Arkansas. The defendants in the case were Lee Parham and members of the Board of Directors of the Dollarway School District No. 2. This case originated in 1959 as Dove v. Parham and is indicative of the ability of southern school districts to delay the process of school desegregation. Florida cases in this edition concern school desegregation and employment discrimination. The first Florida case is Board of Public Instruction of Duval County, Florida v. NAACP (Reel 15, Frame 0175 through Frame 0770). In this case, parents of African American school students in Duval County conducted a school boycott in order to protest the slow pace of school desegregation. The Board of Public Instruction sued the NAACP claiming that the association had coordinated the boycott and that the boycott violated Florida's compulsory school attendance law. Florida ex rel. Hawkins v. Board of Control (Reel 15, Frame 0771) involved Virgil D. Hawkins' application to the University of Florida law school in 1949. The final case in this edition is Smith v. Board of Public Instruction of Pinellas County, Florida. This case involved the closing of the Skyway campus of St. Petersburg Junior College and the dismissal of several African American teachers. The dismissed teachers sued the Board of Public Instruction, arguing that they had been terminated because of their race and, further, that the actions of the Board of Public Instruction violated Florida's teacher tenure laws. This edition of Papers of the NAACP represents the first supplement of legal case files microfilmed by UPA focusing on the period after 1965.
