Dear 2016 Commercial Booth Vendors
The theme to this year's Mohave County Fair is "Mohave Pride, County Wide" As such, there
will be big name entertainment and we expect a great increase in attendance as a result. I would
like to extend an invitation to participate as a vendor in our 2016 Mohave County Fair at the
Mohave County Fairgrounds on:

Remember we award ribbons for those vendors that participate in decorating their booths
according to the theme and we encourage all vendors to participate.

GENERAL INFORMATION
The MCFA/MCFC reserve the right to assess reasonable costs or charges against the
concessionaire should any breach of this contract or damage to the Fair's premises occurs' Should
any party breach this contract in any respect, the other parly may institute a suit in a Arizona state
court of appropriate venue seeking specific performance or compensatory damages to remedy
this breach, but no party shall be entitled to recover punitive or exemplary damages or attorney's
fees incident to such a lawsuit.

No verbal understanding or agreement (past, present, or future), not incorporated in the
Concession Contract, shall be valid or binding. All representations regarding the Concession
Contract shall be contained in the written contract or contained herein.
Concessionaires must grant the MCFC/MCFA, its agents and representatives, at reasonable times
and places, inspection and audit ofall records concerning its operations, ifrequested.
The MCFA, its agents or employees will not be held liable for any injury or loss suffered in any
manner by or to property, equipment, employees, etc, of the undersigned, while on or off the
premises, whether caused by conditions of premises, by negligence or otherwise. Security will be
present Monday, Tuesday, and Wednesday from 8:00pm to 8:00am, prior to the event'
iwenty-four (24)hour Security wiil begin on Thursday, day of the event, at 8:00am, Security
will continue through until Monday, day after event, at 8:00am'
The MCFA, its agents or employees shall be held free and harmless from all loss, cost, damages,
liabilities or attorney fees that may be asserted against it by the undersigned or by reason of any
conduct or negligence of the undersigned or his/her employees or agents. The undersigned and
any employees or agents ofthe undersigned shall be considered lndependent Contractors

(nor shall MCFA provide any liability insurance or other insurance for the benefit of the
undersigned.)
The MCFC/MCFA, at its sole discretion, authorizes only such privileges as are required to
supply the necessary wants of the fairgoers, or may add to their comfort, convenience, and
pleasure. Under no circumstance, however, will privileges of a questionable nature or a
demoralizing tendency be tolerated upon the Fairgrounds. Businesses operating in other than a
legitimate manner will not be tolerated. No game of chance or gambling device will be allowed.
All ground leases or space contracts, unless otherwise specified, u,ill expire with the close of the
Fair each year.

temporary buildings, frames, booths, etc. must be removed within 1 day following the Fair.
inside booths and materials must be dismantled and removed on the day following the close
of the Fair. The MCFA/IvICFC is not responsible for any items left on the grounds at any time.
Buildings, frames, booths, etc. not removed within the specified time period become property of
MCFA; there will be no security after 8:00am Monday morning.
All vendor
fees are non-refundable unless the original application is declined.
A Concessionaire must confine business, promotion, and advertising to the space assigned.
Aisles may not be used for contacting patrons. Displays must not block the view of other
exhibitors. Handbills may only be distributed from booth locations.
Promiscuous or illegal literature or items of any kind is not permitted, even from within licensed
space. Failure to comply with this section will subject lessee forfeiture of space privileges
without reimbursement.
The selling of items v,,ith vulgar wording will not be tolerated. Neither will slang terms that refer
to a person's origin, sex or religious preference. Some artwork, cartoons and especially tee shirts
can be very demeaning. These are certainly not in the best of taste and are indeed very offensive
to many people and will not be tolerated.
Political parties, non-profit organizations, and religious groups will not be permitted to solicit for
donations or support on the Fairgrounds. If they so dcsire to be a part of the Fair, they must buy
commercial exhibit space at the established rate.
No secondhand articles shall be exhibited or sold unless they are in the category of antique.
Because of the amount of overhead electrical wiring, Mylar (aluminum) balloons may not be sold
on the gtounds.
No pets are allowed on the Fairgrounds, except: 1) seeing eye dogs, or dogs for the deaf;2)
police dogs on duty; 3)trained animals in scheduled acts; 4) pets entered in scheduled
competition. Please be advised, the CFA/MCFC will not be held responsible or any injury
resulting from your animal.
The space rentai agreement indicates the total size allotted for the unit or display. (Tent stakes,

trailer hitches, awnings, etc. must not extend beyond the designated areas).
General wording such as "hats, clothing, novelties, gifts, accessories", etc. is not acceptable.
Specific descriptive terms should be used. Items not listed on the agreement and that are carried
in the display or unit are subject to removal without recourse. Food concessions must submit a
complete menu and price list. There will be no exceptions to this regulation.
Booths should be restocked only during time period designated. lf restocking must be done at
other times, hand dollies, and small wagons shall only be used.
Concessionaires
will not assign,
sublet, or otherwise dispose of space.
The Fair reserves the right to approve and control prices charged by the purveyors to
concessionaires and prices charged by concessionaires to patrons.
BUILDING HOURS
Exhibit buildings are open to the public Thursday from
10am to 10pm, and
1Oam
to 9pm, Friday & Saturday from
Sunday from 1Oam to 5pm. (No vehicles allowed inside gated area until 6pm on Sunday)
Any space that is not intact and open for business or does not have an attendant at the
space during the hours of operation specified by the MCFC during all days of the Fair shall
forfeit all move in/out fees, and rights to that space.
No exhibit or concession may be removed prior to the time specified by the Concessions
Contract on the last day of the Fair. No Exhibit or part thereof is to be dismantled or
removed before teardown time. Any removal constitutes a breach of contract and,
therefore, eliminates opportunities for renewal option for such space.
No concession/exhibit may operate prior to or after the agreement period without written
consent.
DECORATING
Back curtains and side curtains are provided in exhibit buildings only. Other decorating supplies
are to be provided by the exhibitor.
Concessionaires are responsible for their own signs. Magic marker or cardboard signs are
prohibited.
Signs should look professional. An exhibitor must provide all furniture, spotlights, etc. required
for the booth at his/her expense.
All
tables used in booths should be neatly draped on all sides exposed to the public. items used,
as decoration must meet the
City of Kingman Fire Department inspection standards.
Exhibitor shall not dri.re nails, hooks, tacks. staples, or screws into walls, ceilings, doors or

asphalt.

haylstraw and weights. NO LIQUIDS ALLOWED. Any vendor caught staking into the ground
will be asked to repair any damages and/or asked to leave immediately and will lose their place in
the next year's Fair. Crepe and comrgated paper decorations are prohibited
Tents cannot be obtained at our Fair. Tent size must be such that tie downs will still be within the
confines of space allotted. If a tent must be moved because it will not fit in space assigned, or
because the layout has been changed from the original request, etc., all fees associated with the
move are at the expense of the concessionaire.
DELIVERIES
UPS and other commercial freight carriers will be permitted to deliver packages/merchandise to
the grounds. However, the Fair does not assume responsibility for delivered goods and will not be
responsible for goods in the absence of the exhibitor. All packages should be addressed as
follows. Contact Name, Company Name, Mohave County Fair Association,2600 Fairgrounds
Blvd., Kingman, AZ 86401.
DRAWINGS/GIVE.AWAYS
All
give-away items must first be approved by the MCFC. Those olfering registration for prizes
must also provide a list of winners, their addresses, and details of prizes won prior to leaving the
grounds. The following will apply to those holding a sign-up prize drawing for the Fair:

All
concessions that intend to hold a prize drawing must obtain rvritten consent from the
Commercial Booth Director.
2. Drawings must be completed during the period of the Fair. Only the advertis ed prize may be
awarded and no further drawing or purchase must be necessary for eligibility.
3. A written statement iisting the name, address, andprize delivered to each winner must be
submitted to the Main Office.
4. If persons signing up for aprize drawing are subject to sales appointments, contacts, or calls as
a result of signing up for the drawing, this must be indicated in writing at the regisffation point.
5. Failure to comply with the above requirements could result in loss of renewal opportunities.
ELECTRICAL SERVICES

FOOD & LIQUOR
No concessionaires/exhibitors may sell alcoholic beverages.
All
food concessions must be substantial in structure an neat in appearance. All rules, as set forth
by the Aizona Department of Health, must be followed. If rules and standards are not followed as
directed, this will serve as grounds for closure without recourse. If MCFC policies are not
observed, renewal for future privileges will not be considered.
All trailer unit food stands are required to have skirting around the bottom to cover wheels and
holding tanks. The hitch must be skirted or removed. Storage units or areas adjacent to the food
stand/trailer must be attractive, either by fencing or placing in an enclosure. A refrigerator/freezer
setting next to the stand, in plain view of the public, is not acceptable.
All temporary stands and trailers are required to be hooked into sanitary sewer (as available) or
holding tank. Backup holding tanks are to be stored under unit, behind skirting, away from public
view.
Each food concessionaire shall prominently display a neatly printed or painted sign, showing price
of items to be sold.
INSURANCE
The MCFA/MCFC will assume no liability for injury to property or person, or death of any person
or persons on or about the premises. Likewise, the MCFA/MCFC will not be responsible for any
damage to exhibits, merchandise, or concessions caused by theft, wind, hail, water, or any cause
whatsoever. Concessionaire agrees to defend at his/her own expense, indemnify and save
harmless the MCFA/MCFC from any and all liabilities, penalties, damages, costs, expenses,
causes of action and claims of every kind arising from illness, death, bodily injury or property
damage to any person whomsoever, occasioned by or growing out of or in any way connected
with the occupation or use of the leased premises or activities associated with the display/booth.
Lessee must obtain at his own expense and submit to the MCFC, one or more policies of
insurance that will afford protection coverage for the duration of the Mohave County Fair
(including set-up before and tear-down after the Fair) in accordance with the requirements set
forth below:
A. Workers' Compensation Insurance: if required by state law, concessionaires shall
provide workers' compensation insurance for employees at the Fair. Workers' Compensation
Insurance shall comply in all respects with the state of Arizona.
B. Public Liability and Property damage insurance: Concessionaires shall obtain
and property damage insurance in comprehensive general liability form as shall
protect them, the MCFA and the County of Mohave, and their elected and appointed officers,

agents, and employees, from claims for personal injury, including rvrongful death, and from
claims for property damage, which may arise from the existence, construction, operation, removal,
or products of the concession. Comprehensive general liability coverage shall include product
liability insurance coverage on all food stuffs, beverages, and merchandise sold.

All exhibitors and concessionaires
are required to have minimum general public
liability
insurance coverage on the Fair operation. The Commercial Booth Director requires a certificate of
insurance or a copy of that policy. Mohave County/Mohave County Fair Association must be
named as additional insured. Failure to place a copy of the insurance certificates on file with
the Commercial Booth Director before the start of Fair will result in cancellation of contract
or forfeiture of renewal privileges.
You may purchase insurance through us by filling out the insurance rider in vour contract.
Each vendor is responsible for the safe keeping of personal properties. Vendors are urged to
obtain insurance that covers the entire value of their proper8. MCFA. its aqents. directors.
and emplovees. are not responsible for lost. stolen. or damaged property.
LOGO USE
The MCFA logo is a registered trademark. Use of the name MCFA or any part of its graphics
program is strictly forbidden without written consent of the MCFA Board of Directors. For further
information, contact the Commercial Booth Director. Unautliorized use will result in removal of
those items from sale and forfeiture of renewal rights.
LOST AND FOUND
A lost and found department is maintained at the Main Fairgrounds Office.
MAINTENANCE SERVICES
The MCFA/MCFC must approve all maintenance improvements. The MCFA/MCFC
and the
Mohave County Department of Health must first approve any modification of food concessions.
On-site contractors/persons in charge of work must receive the written approval of the
MCFA/MCFC prior to starting work. All requests must be in writing and will be
acknowledged/approved in writing. The concessionaire must pay damages resulting from
noncompliance. This includes both material and labor charges. All concessionaires not complying
fully with this regulation may have privileges revoked.
PAYMENTS
No space can be occupied until the balance of all amounts owed is paid. If a check is returned, the
dollar amount becomes due immediately by cash or money order, plus handling fees. All
payments retumed after the conclusion of the fair will be turned over to the Mohave County
attorneys office.
PUBLIC ADDRESS SYSTEMS
Any public address or amplifying system must have approval before

business. If sound becomes offensive to neighboring exhibitors, management reserves the right to

issue wamings to the offending exhibitors. If the situation is not resolved after two warnings, the
offender's electric service will be disconnected or exhibitor will be asked to vacate the grounds.
RENEWAL OF PRIVILEGE
In Order to attempt and maintain quality concessions and exhibits, it is the policy of the MCFC to
extend renewal opportunities to concessionaires. However, the Fair reseryes the right to refuse to
renew any space rental contract when, in the sole discretion of the Fair management, such action
is in the best interest of the Fair.
Grounds or space alterations or other changes may make it necessary to eliminate certain
previously available spaces frotn one year to the next. In such instances, the MCFC reserves the
right to offer substitute locations or discontinue contracts at its own and sole discretion. All
request for changes in locations or additional space must be submitted in writing. Only written
requests are considered. Exhibitors
will
be notified
if their requests can be granted.
All
units/displays must meet the MCFC aesthetic requirements. Cleanliness, appearance, conduct,
quality of booth structure and display, compliance to regulations and deadlines, and compliance to
health and safety standards are considered important. These guidelines must be followed or
renewal privileges will be cancelled.
As a rule, all assumed rights/privileges in respect to the leased space are nonexistent upon
transfer. Space cannot be transferred to a new owner with the sale of a business. The MCFC may,
however, approve transfers when it is in the best interest of the Fair. A concessionaire desiring to
transfer interest should notify the Commercial Booth Director in writing. Decisions will be based
on whether the transfer will provide the best return rate for the MCFC. Factors the MCFC will
consider include, but are not limited to, the multiple ownerships, experience, financial stability,
length of time spent on waiting list, and other health, safety, and enjoyment factors. The
commercial Booth Director will notify the concessionaire of the final decision regarding transfer.
Notification will be in writing. Renewal rights may not be sold!
SECURITY
Incidents of vandalism are few in number. When an incident does occur, it is normally minor in
nature. The MCFe/IvICFC assumes no liabiiity for loss or damage to any property of the
concessionaire or exhibitor.

Each concession location must have a sign in clear view for the public that identifies who the
owner/operator is and where the home office is located.

STORAGE TRAILERS
Trailers used for storage of supplies or offices
of concessions or exhibits may be

must be parked in the campgrounds unless otherwise approved by the MCFC. No tent camping is
allowed on concessions locations. ln general, all storage units are to be parked in the Vendor
Storage Lot, and all sleeping units are to be in the Campgrounds areas.

TRASH COLLECTION
Eu.h Coo..ssionaire is responsible for appearance of the grounds in front and to the rear of his
exhibit area. Refuse should be placed in appropriate containers. Trash bags should be used and
ties must secure the bags. Cleanliness is a must. Violations will result in non-renewal of
privileges.
VEHICLES
Vehicles will only be allowed in gated area from:
8:30am to 9:30am for setup
11:00pm to 12:00pm at night
No vehicles will be allowed through gates after 10:00am or before 10:00pm and 6:00pm on
Sunday.

LICENSES & PERMITS:
All
vendors are required to have a Kingman Business License at the time of application. A copy
an existing Kingman Business License must be submitted with your application. If you do not
have a Kingman Business License the City of Kingman requires allvendors to have a Special
Event Permit which you can purchase for $1 1.00 with a completed Special Event Permit form
when you turn in your application.

ALLOWANCES:
Six (6) badges will
be provided to each vendor. These will serve as admission and parking pass
and must be worn at all limes by the vendor or their employees. Additional badges may be
purchased for $7.00 each, but no more than 10, and must be requested with your application.
All badges will be given out with vendor packets, NO badges will be issueC once the event
officially opens You will be responsible for distributing the badges to your employees/workers
before the event opens. lf passes aren't given out to your employees/workers before the event
starts they will have to pay full admission price. (There will be NO REFI-INDS for this).
The Mohave County Fair Association Rules & Regulations are all made part of this vendor
contract/application and are fully incorporated herein. The vendor agrees that helshe has read and
understands the terms and conditions of this contract and shall apply, unless amended, by mutual
consent in writing and signed by both parties herein.
This contract must be signed and all fees must be paid before July 15,2016 before contract is
considered legal and binding. No Vendor spaces will be verbally held. All payments must be
Cashier's Check, Money Order, or Personal Check, Please print clearly or type information. Make
