Brown to team: ‘We did it’

The City Hall atrium was filled
with supporters.
The message was overwhelmingly positive, filled with accomplishments of four years of work.
It had all the elements of a campaign speech.
This was different, though.
This was a goodbye from
Mayor Alvin Brown.
This was a show of gratitude
toward employees who helped
Brown along the way — because
as he said, “the mayor couldn’t
do it alone.”
“I’ve seen your hard work, sacrifice and love for the city,” he
told the group. “We did it.”
Words like “we” and “team”
and “teamwork” were abundant.
We made economic development a priority, he said. One of
six placards in the atrium highlighted 3,901 new jobs and $783
million in announced projects
during his four years.
“We did it,” he said. “We did
that together.”
Downtown, he asked them
to say aloud, became a priority
when there was a debate whether it should be. The Downtown
Investment Authority, Hemming
Park, the Shipyards, Brooklyn,
the duPont Center all listed as
accomplishments.
And the director of the military
affairs department was elevated
to a cabinet-level position, a priority met to help veterans find
jobs.

On the surface, it might look like a quiet,
business-as-usual summer at the Museum
of Contemporary Art Jacksonville.
Visitors strolling through the galleries,
experiencing two exhibitions of photography and works from permanent collection,

lobby and classrooms full of children are
upstairs for art camp.
Looks can be deceiving.
Museum Director Marcelle Polednik and
her staff are putting the finishing touches on several new initiatives, including a
comprehensive rebranding of the museum
designed to better position the institution
in the perception of its evolving audience.
Polednik wouldn’t provide details of the
rebranding effort, which will be unveiled
in September. “There will be a fresh face
for MOCA in the fall,” she said.
The Downtown museum at 333 N. Laura
St. last underwent a rebranding in November 2006 when the Jacksonville Museum of
Modern Art became the Museum of Contemporary Art Jacksonville.
While that transition occurred before
Polednik became director four years ago,
she it was a good decision, based on the
museum’s collection and focus.
“Contemporary art,” the majority of
MOCA’s collection, is defined as beginning
at the end of World War II.
Along with the impending “fresh face,”
changes are in the works in how the museum presents itself to the community. That
includes members and regular visitors as
well as people who don’t often visit the
museum — or never have visited.
She said the museum has developed a
presence and a voice the past four years
and it brings people Downtown every day.
But, Polednik said, “It’s time to take
our public programming beyond an artist
attending the opening of an exhibit. We
also need more emphasis on programming
for children and families and more involvement for young people.”
The improvement of Hemming Park at
the museum’s front door was a factor that
helped lead to more focus on the younger
demographic.
Polednik said moving the Sunday “Art-
with the intention to form national alliances and develop exhibits.
Also on the agenda for the summer is
planning a retrospective of “Project Atrium.”

regulate projects like huge shopping malls,
office parks or major housing developments by requiring review and comment
from state agencies and affected cities and
counties.
The process allowed governments to
request mitigation
for impacts to traffic, water, wastewater,
affordable
housing and schools.
But,
developers
often found it was
time consuming and
expensive.
The
Community Development
Act goes into effect
Tuesday. Sen. Wilton
Simpson, R-Trilby, Simpson
sponsored the measure.
Simpson wrote in a policy paper that
DRIs were never supposed to be permanent. They were supposed to be replaced
by individual counties’ comprehensive
planning process, signed into law a few
years after DRI passage.
Instead, dense/multiuse developments
went through two processes that covered
similar issues, he said. Also DRIs pushed
builders toward smaller, uncoordinated
projects, promoting urban sprawl.
Jacksonville developer Curtis Hart said
he expects the disappearance of DRIs will
probably save builders some headaches.

Coral Springs company buys
warehouse, says more possible

A Coral Springs real estate
investment group made its first
Jacksonville warehouse acquisition Wednesday, but it probably
won’t be the last.
The Eisenberg Group of Companies paid $2.925 million for a
leased warehouse at 8691 Western Way.
“This is the first of many to
come, hopefully,” said Jay Eisenberg.
The company, in its fifth generation, buys and manages industrial and commercial properties
in New York and in South and
Central Florida. Its website says
Eisenberg entities also invest in
North Carolina holdings.
Altogether, it has about 1 million square feet of space under
ownership and management.
Eisenberg said he looks for
more area warehouse and industrial properties of at least 50,000
square feet. They don’t have to
be leased, but shouldn’t be much
older than built in the late 1980s.
He said he likes Jacksonville. “I
think it’s a great city. It has a lot
to offer,” he said.

The more than 53,000-squarefoot building was developed in
1975 on 8 acres. Eisenberg said it
is leased to Carrier.
The Jacksonville Bank issued a
$2.065 million loan.
The Eisenberg Group and its
affiliated companies continue
a family venture that started in
1897 in New York as a rag busi-
ness. It grew to be one of the
largest recyclers of textile waste
in the country and provider of
cotton waste for currency and
paper manufacturers throughout
the world.
It also has developed large
warehouse and distribution facilities.
Jay Eisenberg joined the company in 1980. When the decision was made to relocate part
of the business to South Florida,
he concentrated on buying and
managing properties. He has led
the group since 1988.
His son, Scott Eisenberg, joined
in 2014, focusing on residential
properties in New York and is a
licensed real estate sales associate
in Florida.

biggest problem, pension.
“Say it one more time,” he
asked the group. “Pension.”
He asked for a round of
applause for his chief of staff,
Chris Hand, who helped guide
the talks that ultimately resulted
in a deal being approved last
week.
Karen Bowling, his former chief
administrative officer, received
applause for her work in reorganizing the city.
So, too, did Dave Roman.
Brown’s first campaign manager
also headed up the city’s parks
initiatives, another accomplishment Brown praised for his four
years.
And finally, he thanked his
family, who joined him at the
podium to a chorus of applause
and a standing ovation.
Brown’s wife, Santhea, his
“best friend in the whole wide
world,” and their sons, Joshua
and Jordan, who were “down
here” four years ago, Brown said
holding his hand flat around his
waist. Now, they’re “up here” he
said raising it toward the middle
of his chest.
He concluded, as he often does,
by thanking God for the blessings he and Jacksonville have
received.
Much was accomplished by
everyone, he said, because of a
shared vision.
It’s a vision ending in less than
a week, a time Brown believed
he’d be entering his second four
years.
“I thought I had it,” he said
afterward.
A result that caught him by
surprise, but one with which he
said he’s now at peace.
He said the Wednesday event
wasn’t fully a goodbye.
He’ll see the people who
helped him in the trenches again,
reach back out in the coming
months after he has a chance to
decompress.
“I will see them again,” he said,
then smiled. “Once you work for
the mayor, you always work for
the mayor.”
Next month will be his first
in some time out of the public
spotlight.
He said he feels guilty for missing his sons’ spring break, which
was in the heart of Brown’s campaign against Mayor-elect Lenny
Curry.
Brown will make up for that
lost time with trips over the next
month, with at least a stop at Disney World on the agenda.

always been closest to him.

Judge considers challenge DRI
to abortion waiting period

Only days before a new Florida
law would start requiring 24-hour
waits before women can have
abortions, a Leon County circuit
judge is considering whether to
place a hold on the law while
a constitutional challenge goes
forward.
The law (HB 633), which passed
in April, is slated to go into effect
July 1. The day after Gov. Rick
Scott signed the law, the American Civil Liberties Union filed
a constitutional challenge and
sought an emergency injunction.
On Wednesday, Chief Circuit
Judge Charles Francis heard
arguments from the ACLU and
Attorney General Pam Bondi’s
office and then said he’d issue
a ruling quickly on whether to
grant an injunction.
Both sides are expected to
appeal an adverse ruling.
The new law adds to the information that physicians performing abortions must provide to
women to obtain their consent.
Under the law, the information
must be provided in person to
women at least 24 hours before
the procedures are performed —
requiring women to make two
trips to abortion clinics.
Supporters of the law contend
it will give women more time to
reflect on their decisions. Opponents contend it will place obstacles before women seeking abortions, especially women who are
victims of violence and women
who are low-income and live in
rural areas.
In a one-hour hearing Wednesday, ACLU attorney Renee Paradis pointed to Florida’s “explicit”
constitutional right to privacy as
the basis for challenging HB 633.
“Florida is one of only five
states with this kind of strong
privacy protection in the Constitution,” she said. “None of those
five have a waiting period. The
only one that tried to have a waiting period was struck down by
the courts in Montana.”
But Blaine Winship, special
counsel to the attorney general,
said the state has a vested interest
in its residents’ well-being.
Winship also contended that
nothing in the new law removes a
woman’s right to get an abortion.

on DVD.
The future direction for the
museum will take advantage of
the steadily growing popularity
of contemporary fine art and narrow the focus of how MOCA will
position itself in the local, national and international markets.
“Contemporary art museums
are thriving and moving toward
specialization,” said Polednik.
“The challenge is to distinguish
each museum. We need to determine what’s right for MOCA and
how we can do it better.”

Ed Lehman, Clay’s planning and zoning director, said the movement
to eliminate Developments of Regional Impact date back nearly 20
years.
Under the process, a development had to exceed a certain
number of homes before it would
qualify for review. The threshold varied by county and was
determined by population. For
example, DRI review in St. Johns
County kicked in for any development over 1,000 homes.
But, things got complicated
when building near a county border.
For developments within one
mile of a county line, the threshold of the smaller county applied,
Hart said. In Duval County for
example, the threshold was 3,000
homes, compared to 1,000 in St.
Johns. Builders worked around
the rules.
“You might be limited to developing under 1,000 units in order
to avoid the DRI oversight,” Hart
said.
There’s been a movement to
roll back DRIs for almost 20 years,
said Ed Lehman, Clay County
Planning and Zoning director. He
formerly worked for the Northeast Florida Regional Council,
which oversaw the DRI review
process.
A few years ago, Florida
passed a law that exempted several dense counties from DRI
review, including Duval, because
they were already highly urban-
ized, he said.
The 2015 law though is the first
time DRIs have been eliminated
altogether.
Traffic mitigation was always
the most expensive DRI item,
Lehman said. DRIs in Clay County, for example, paid to four-lane
U.S. 17.
The cost and complexity of DRI
review likely means builders and
developers will be happy to see it
go, Lehman said.
He reflected, though, that some
of the region’s better projects —
Nocatee, Eagle Harbor and Pace
Island — were built under DRI
law. In 2006, St. Johns County
had eight active DRIs, more than
any county in Florida.
Lehman agreed with Simpson
that large county projects are now
managed effectively by the comprehensive review process.
Still, he’s curious to see what
happens now when a development is proposed right against
the border of a neighboring county. One that impacts traffic or
otherwise pressures a neighbor.
“No county ordinance addresses impacts with another county,
and now there’s no process for
handling that,” he said.

MISSING
Work to start on Citizens’ Downtown offices

LLC received approval Wednesday for the $4.1 million first phase
of the Citizens Property Insurance Corp. renovations Downtown, a step toward bringing at
least 1,000 jobs to the Northbank.
The move is expected to start
this fall and be completed by the
first quarter of 2016.
The city approved nine permits
for Auld & White to renovate
132,362 square feet on five floors
at EverBank Center.
The total lease of 234,150 square
feet encompasses eight floors and
part of the first.
The Tallahassee-based insurer
will phase in the work. Total tenant improvements are estimated
at nearly $10.5 million, according
to a lease document.
EverBank Center, at 301 W. Bay
St., will house Citizens Property’s
consolidated office and IT center.
The insurer will move opera-
tions from four Baymeadowsarea locations and also relocate
some IT jobs from Tallahassee
and Tampa.
The entire project is expected
to total almost $49.1 million, comprising the 10-year lease, furniture, equipment and other items
and startup costs.
The move also strengthens
Downtown’s office market. The
project boosts the 30-story building’s occupancy to more than 90
percent.

The St. Johns River Water Management District (District) gives notice
of receipt of the following Individual
Consumptive Use Permit (CUP) permit

The District issues two types of Individual consumptive use permits (CUPs)
– staff-issued CUPs (where the proposed consumptive use does not exceed
500,000 gallons per day on an average
annual basis), and Governing Boardissued CUPs (where the proposed consumptive use exceeds 500,000 gallons
per day on an average annual basis or
the District receives a timely substantial
objection). Decisions on applications for a
staff-issued Individual CUP will be made
at the District’s service center where
the application is processed, unless the
application is upgraded to an application
for a Governing Board-issued Individual
CUP as explained below, in which event
the Governing Board will consider the
application at a noticed Board meeting.
The Governing Board normally meets on
the second Tuesday of the month.
A substantial objection to an application for a staff-issued Individual CUP
must be made in writing and filed with

Regulatory Support, P.O. Box 1429, Palatka, FL 32178-1429, or by e-mail at
[email protected], within
14 days of notification of the application.
Please include either the Permit Application Number or the Project Name in the
objection. Notification of the application
is either the fifth day after the date on
which the written notice is deposited
in the U.S. mail (for those persons who
receive actual notice by U.S. mail), the
date on which the notice is e-mailed (for
those persons who receive actual notice
by e-mail), or the date the notice is published in the newspaper (if actual notice
is not provided by U.S. mail or e-mail). A
“substantial objection” means a written
statement directed to the District that
identifies the objector, concerns hydrologic or environmental impacts of the
proposed consumptive use, and relates
to applicable rule criteria. A timely substantial objection will cause an application for a staff-issued Individual CUP to
be considered an application for a Governing Board-issued Individual CUP. If
the District receives a timely substantial
objection from you, then you will receive
written notice of the District’s intended
decision on the permit application.
Decisions on applications for a Governing Board-issued Individual CUP
will be made by the District’s Governing Board. Notice of Intended District
Decision will be provided to persons
who have requested individual notice. A
request for individual Notice of Intended
District Decision on an application for a
Governing Board-issued Individual CUP
must be received by the Director, Bureau
of Regulatory Support, prior to the date
the Notice of Intended District Decision
is generated. For those applications, you
are advised to notify the District within
14 days of notification of the application if you have questions, objections,
comments or information regarding the
proposed consumptive use. If you make
a written request to the District for additional information regarding a specific
permit application, you will be provided
an opportunity to obtain the available
information. Please note that filing a
written objection does not entitle you to
a Chapter 120, Florida Statutes, administrative hearing.
