Enforcement and
consequences for
UNDERAGE DRINKING
Break any of these rules
and face the consequences!
Youth under the age of 21 charged with possession of alcohol face the following:
Fines of $470 or more or 30 days in jail
Loss of SC Drivers License for 120 days and possible loss of scholarships

What are my options if I get caught with Alcohol and I am under 21?
Youth under 21 charged with possession or other related alcohol charges may be allowed to
enter a Diversion Program entitled Alcohol Education Program which allows the charges to
be dismissed and the youth can apply to have their record cleared.
In Spartanburg
County, the
Alcohol
Education
Program requires
the following:
• 8 hour educational class
• Enrollment with the
Spartanburg Solicitors Office
• Alive @ 25
• 20 hours of community
service
Minors can or may be
denied the opportunity to
enter a Diversion Program.
The only approved Diversion
Program that allows youth to
clear a criminal charge must
be administered through the
Solicitors Office

1. It is against the law to sell any alcoholic
beverages to anyone under the age 21.
Failure to require identification to verify age will be used as evidence of the willful violation of the law

2. Merchants and Servers can face civil liability
(law suits) for providing alcohol to minors
and/or for over- service to patrons
3. Drink specials often offered during “Happy
Hour” can not be reduced less than 50% the
regular price of that beverage.
Retail establishments that sell kegs in South Carolina
must complete a Keg Registration Form as prescribed
by the South Carolina Department of Revenue.
1. Penalty for selling a keg without proper
documentation and identification could result in:
Example: $1.00 Beer is illegal unless the Beer product is generally
sold for$2.00 in the establishment

$470-$677.50 fine for first offense and $885 to $1092.50 for
second and subsequent offenses.

2. Penalty for a retail licensee selling a keg without
proper documentation and identification could
result in:

Identification Tag could result in:
Fine of $1,092.50 or more
4. Penalty for purposefully removing, altering,
obliterating, or allowing to be removed, altered,
or obliterated a keg tag could result in
