ACCEPTING
AN
AGREEMENT
BETWEEN THE CITY OF ROSEBURG AND THE STATE
OF OREGON DEPARTMENT OF TRANSPORTATION
TRANSFERRING JURISDICTIONAL CONTROL OF
CERTAIN STREETS WITHIN THE CITY LIMITS OF
ROSEBURG
WHEREAS, the State of Oregon, by and through its Department of
Transportation, and the City of Roseburg, a municipal corporation of the State of
Oregon, have proposed to transfer jurisdictional control of certain streets and
infrastructure (namely bridges) between the two parties;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ROSEBURG, that the City Manager is designated to act as the City's
official representative for the transfer and is authorized to endorse and execute the
subject agreement and to sign all papers, documents and agreements as may be
necessary to complete the jurisdictional transfer.

THIS AGREEMENT is made and entered into by and between the STATE OF
OREGON, by and through its Department of Transportation, hereinafter called "State",
and the City of Roseburg , a municipal corporation of the State of Oregon, by and
through its City Officials, hereinafter called "City".
WITNESSETH
RECITALS
1. The Oakland-Shady Highway No. 234 is under the jurisdiction and control of the
State. Harvard Avenue, Washington Avenue and Oak Avenue are under the
jurisdiction and control of the City.

2. Pursuant to ORS 373.010, whenever the route of any state highway passes
through the corporate limits of any city, State may locate, relocate, reroute,
abandon, alter, or change such routing when in its opinion the interests of the
motoring public will be better served.
3.
Pursuant to ORS 366.395, the State may relinquish title to any of its property not
needed by it for highway purposes to any other governmental body or political
subdivision within the State of Oregon, subject to such restrictions, if any, imposed
by deed or other legal instrument or otherwise imposed by State.
NOW THEREFORE, the premises being in general as stated in the foregoing
RECITALS, it is agreed by the State and City as follows:
TERMS OF AGREEMENT
1.
In recognition of mutual benefits which will accrue to the residents of the State of
Oregon and the City of Roseburg, and for the purpose of furthering the
development of a state highway system adapted in particular to the needs of the
people of the State of Oregon, State and City have determined that a jurisdictional
transfer of right-of-way between the City and State within the city limits of Roseburg
should be accomplished.
2.
State plans to relinquish jurisdiction, control and maintenance responsibilities on
certain portions of the Oakland-Shady Highway, accept from City certain city streets
and designate them as the Diamond Lake Highway, and agree to other financial

commitments as further described under STATE OBLIGATIONS. City plans to
relinquish to State jurisdiction, control and maintenance responsibilities of certain
city streets and to accept from State portions of the Oakland - Shady Highway and
1.80 acres of State surplus property as further described under City Obligations.
3.
This agreement and jurisdictional exchange will become effective on the date when
all required signatures are obtained and shall remain in effect as long as the rightof-way is used for the City's public road purposes.
STATE'S OBLIGATIONS
1.
State shall, by resolution, formally eliminate Unit 1 as indicated in Exhibit A,
attached hereto and by this reference made a part thereof, and Unit 2 as indicated
in Exhibit B, attached hereto and by this reference made a part hereof, both units
described below as a portion of the Oakland - Shady Highway No. 234 and the
State Highway System. All rights, title and interest of State, including all jurisdiction,
maintenance and control, except as noted in item 2 under ustate Obligations", in
Units 1 and 2 described below shall pass to and vest in City. Unit 1 and Unit 2 are
described as follows:
Unit 1 as shown in Exhibit A
All land within the right-of-way boundaries of the Oakland-Shady
Highway, State Highway No. 234 (including Stephens and Pine Streets)
between Engineer's Station 1521+20 (MP 18.56) and Engineer's Station
1578+65 (MP 17.49, the southerly curb line on Oak Ave.) and lying in

Sections 24 and 25, Township 27 South, Range 6 West, Willamette
Meridian and in Section 19, Township 27 South, Range 5 West,
Willamette Meridian; Douglas County, Oregon.
Unit 2 as Shown in Exhibit B
All land within the right-of-way boundaries of the Oakland-Shady Highway,
State Highway No. 234 (North Stephens St.) between Highway Engineer's
Station 1606+30 (MP 17.08) and Engineer's Station 2410+50 (MP 14.54)
and lying in Section(s) 1, 12, 13, Township 27 South, Range 6 West,
Willamette Meridian and in Section 18, Township 27 South, Range 5
West, Willamette Meridian; Douglas County, Oregon.
2.
State shall complete the signal replacement project scheduled for construction, year
2000 for Stephens and Pine Streets. The preliminary scope of the project includes
the replacement of the traffic signals at the following intersections: Stephens and
Cass; Stephens and Lane; Stephens and Oak; Stephens and Washington; Pine
and Washington; Pine and Oak; and Pine and Lane. Included with this project will
be those improvements necessary to make the corners of these intersections meet
ADA standards. In addition, the railroad crossings shall be intertied with the new
traffic signals.
3.
State shall consider reconstruction of the Stephens and Douglas intersection to
include a left turn motion from southbound Stephens to eastbound Douglas as part
of a future preservation project.

4. As
described in the payment schedule under USTATE OBLIGATIONS" item
number 6, State shall provide funding as follows:
a) $75,000 ADA improvement project on SE Stephens and Pine to install missing
ramps, replacement of impassable sidewalks and removal of unnecessary
driveways.
b) $542,265 for a grind/overlay project on NE Stephens Street between Diamond
Lake Boulevard and Stewart Parkway.
c) $928,339 for a grind/overlay project for NE Stephens Street between Stewart
Parkway and 400 feet north of Edenbower.
5.
State shall transfer title to the City by Bargain and Sale Deed 1.80 acres of surplus
property as described in Exhibit D, attached hereto and by this reference made a
part hereof, located along NE Stephens within the City Limits of Roseburg in
exchange for a reduction of $161,075 of the project costs for State.
6.
State agrees to reimburse City in accordance with the following payment schedule
using State Funds within 90 days of the effective date of this agreement.
Future costs of preserving the roadway- (Item 4 b & c above)

7. State shall, by resolution, formally designate Unit 3, as described below as the
Diamond Lake Highway No. 73. State shall accept from the City all rights, title and

interest, including all jurisdiction, maintenance, and control of said Unit 3. Said Unit
3, described below, is shown on Exhibit C, attached hereto and by this reference,
made a part hereof.
Unit 3 as shown in Exhibit C:
All city R/W on Harvard Ave., Oak Ave. and Washington Ave. between Highway
Engineer's Station 'H'2 1+85 and the intersection on Oak and Washington Avenues
with South Stephens Street inclusive of the structures over the South Umpqua River.
This land lying in, Sections 19 and 24, Township 27S, Range 5W & 6W, Willamette
Meridian; Douglas County, Oregon.
CITY'S OBLIGATIONS
1. City agrees to accept all of State's rights, title and interest in Unit 1 and Unit 2; to
accept jurisdiction and control over the property; and to maintain the property as (a)
portion(s) of its city street system as long as needed for the service of persons
living thereon or a community served thereby. Any right-of-way being transferred in
which State has any title shall be vested in City so long as used for public road
purposes. If said right-of-way is no longer used for public road purposes, it shall
automatically revert to State.

City shall transfer jurisdiction of Harvard Ave. from the 1-5 interchange east and
Washington and Oak from Harvard Ave. to SE Stephens Street, Unit 3, as indicated
in Exhibit C.

City agrees to accept 1.80 acres of State surplus property as described in Exhibit D
valued at $161,075. Said value will be deducted from the cost of future projects
mentioned in Item 6 under "STATE'S OBLIGATIONS" in this agreement.
4.
City agrees to dollar amounts and payment schedule as outlined in State
obligations, Item No. 6.
5.
City shall pass an ordinance or resolution, as the case may be, authorizing the City
Mayor/Manager and Recorder to enter into the agreement on behalf of City.
6.
City hereby grants State the authority to enter on City's RIW for the purpose of
fulfilling States obligations.
GENERAL PROVISIONS
1. The properties above described are relinquished and transferred subject, however,
to the rights of any utilities located within said properties and further subject to the
rights of the owners of said existing facilities, if any there be, to operate,
reconstruct, and maintain their utility facilities presently located within said
properties.
2.
This agreement may be terminated by mutual consent of both parties.
3.
City, its consultants or subcontractors, if any, and all employers working under this
agreement are subject employers under the Oregon Workers Compensation Law

and shall comply with ORS 656.017, which requires them to provide workers'
compensation coverage for all their subject workers.
4.
City acknowledges and agrees that State and the Oregon Secretary of State's
office and the federal government and their duly authorized representatives shall
have access to such fiscal records and other books, documents, papers, plans and
writings of City that are pertinent to this agreement to perform examinations and
audits and make excerpts and transcripts.
5.
City shall comply with all federal, state and local laws, regulations, executive orders
and ordinances applicable to the work under this agreement, including, without
limitation, the provisions of ORS 279.312, 279.314, 279.316, 279.320, and
279.555, made a part hereof by this reference. Without limiting the generality of the
forgoing, City expressly agrees to comply with (i) Title VI of Civil Rights Act of 1964;
(ii) Section V of the Rehabilitation Act of 1973; (iii) the Americans with Disabilities
Act of 1990 and ORS 659.425; (iv) all regulations and administrative rules
established pursuant to the foregoing laws; and (v) all other applicable
requirements of federal and state civil rights and rehabilitation statutes, rules and
regulations.
6. This agreement and attached exhibits constitute the entire agreement between the
parties on the subject matter hereof. There are no understandings, agreement, or
representation, oral or written, not specified herein regarding this agreement. No
waiver, consent, modification or change of terms of this agreement shall bind either
party unless in writing and signed by both parties and all necessary approvals have

been obtained. Such waiver, consent, modification or change, if made, shall be
effective only in the specific instance and for the specific purpose given. The failure
of State to enforce any provision of this agreement shall not constitute a waiver by
State of that or any other provision.

A RESOLUTION RESCINDING RESOLUTION NO. 99·8 AND AMENDING
THE CITY OF ROSEBURG'S PUBLIC RECORDS/INFORMATION REQUEST POLICY
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROSEBURG, OREGON, THAT
RESOLUTION NO. 99-8 PROVIDING PROCEDURES FOR REQUESTS, INSPECTION
AND COPYING OF CITY RECORDS, PROVIDING FOR REVIEW OF REQUESTS AND
REQUIRING FEES FOR SUCH SERVICES AS ADOPTED BY THE ROSEBURG CITY
COUNCIL ON MAY 10, 1999, IS HEREBY RESCINDED AND REPLACED WITH THE
FOLLOWING:
Section 1. Written Requests. Unless otherwise provided by these rules, request for
inspection and/or copies of public records shall be in writing on a form prescribed by the
City.
Section 2. Procedure.
2.1
Requests for public records shall include the following:
(a)
The name, address and signature of the person making the request or their
authorized representative.
A statement of sufficient specificity to determine the nature, content and
(b)
probable department within which such record may be located.
(c)
The date of such request.
2.2
Upon receipt, the request shall be date stamped.
2.3
The person making the request should be advised that the requested
materials will not be released without the City's receipt of the fee for providing such service
as prescribed by the City Manager or his designee as described in this resolution and in
accordance with Roseburg Municipal Code 3.04.040. Failure to so advise the requesting
party of such obligation shall not relieve the requesting party of the obligation to pay the
prescribed fee.
2.4
Written requests for inspection or copies of City records shall be submitted to
the City Recorder who shall keep on file a list of fees prescribed by the City Manager or his
designee for processing public records/information requests and who shall respond to all
such requests.
2.5
If the request is not complied with, a written response explaining why the City
is unable to process the request shall be prepared and mailed to the requesting party.
2.6
The City shall respond to requests for public records within a reasonable
time, but in any event not more than thirty (30) days from the date of receipt. This time
limit may be increased when the request is not sufficiently specific to enable location of the
records or when the volume, size or location of such records makes their collection or their

retrieval difficult, in which case the requesting party shall be advised of the reason for the
delay.
Section 3. Payment of Fees.
Except as otherwise provided by these rules, public
records shall not be released for inspection or as copies to members of the public unless
the City has received payment of the established fee for providing the same from the
requesting party.
Section 4. Fees to Reflect Costs. When establishing the fees to be charged to the
requesting party for meeting public information requests, the City Manager or his designee
shall base such fees on costs the City incurs for processing the request. These costs shall
include, but not be limited to, personnel costs and costs associated with materials used in
processing the request.
4.1
Personnel costs shall include, but are not limited to, employee's time spent
while locating, reviewing and copying records and supervising public inspection of records.
Costs shall be at an hourly rate equivalent to the salary plus benefits (computed at an
hourly rate) of each employee involved in processing the request.
4.2
Costs for photographs, audiotapes and other non-paper materials shall be
reimbursed at actual costs as determined by the City Manager or his designee.
Section 5. Records Requested for Court Proceedings. The City shall not charge fees
for costs incurred by the City when an employee of the City, in the employee's role as
custodian of the records, is a witness in a trial or other court proceeding. When the City is
a party to a court proceeding and a request for copies of public records is made by a party
or representative of a party to such proceeding in the course of discovery, then the cost to
be charged for providing such copies shall be limited to those indicated in Section 4.2.
Section 6. City Manager Authority. The City Manager or his designee shall have the
authority to:
waive the requirement that the request must be in on a form provided by the

City;
waive fees if the request is of a one-time nature, requires copying five or less
(b)
pages and involves less than one-half hour of staff time to process;
waive required compliance with this resolution in special cases where the
(c)
public interest in supplying a public record free of charge outweighs the cost
of furnishing the record;
establish a particular charge or fee for routinely requested documents where
(d)
the charge is a reasonable approximation of the City's cost; and
periodically adjust fees to cover increased costs of providing public records
(e)
and information.

Section 7. Exemption from Fees. The following individuals, groups or organizations
shall not be charged a fee for photocopying costs or the first 11h hours staff time required
to process a public information request. If it is determined a specific request will take
longer than 1% hours staff time to process, the requesting party may ask the City Council
to reduce or waive all additional fees associated with providing the requested record.
(a)
any person requesting public records pertaining to a matter which specifically
affects the person is pending before the City Council or a Board or
Commission of the City;
(b)
any member of the City Council or a Board or Commission of the City, other
government agencies or the media; and
(c)
any crime victim requesting a copy of a police report pertaining to the crime
in which they have been made a victim (applies to first copy only).

A RESOLUTION AUTHORIZING THE FORMATION OF AN AREA
TRANSPORTATION COMMISSION
WHERAS, the State of Oregon, by and through its Department of
Transportation has resolved to plan for and resolve transportation issues on a regional
basis;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ROSEBURG, that the City of Roseburg endorses and will participate in
the formation of an area transportation commission representing Coos, Curry, and
Douglas Counties (The Southwest Area Commission on Transportation) to act as an
Advisory Commission to the Oregon Transportation Commission, and to function in
accordance with the draft bylaws dated February 8, 20001 as attached to this resolution.

A RESOLUTION REQUESTING THE OREGON DEPARTMENT OF TRANSPORTATION'S
PARTICIPATION AND PARTNERSHIP IN THE CONSTRUCTION OF THE
STEWART PARKWAY OVERPASS IMPROVEMENT PROJECT
WHEREAS, the need to expand the Stewart Parkway/I-S Overpass
was originally identified within the 1987 traffic circulation
report produced for the City of Roseburg by Carl Buttke; and
WHEREAS, in 1992 the City conducted a more detailed study of
the Stewart Parkway corridor titled, "Land Development Impact
Analysis for Stewart Parkway", which further identified the need
for the reconstruction of the Stewart Parkway Overpass; and
WHEREAS, in 1996 the Greater Roseburg Area Transportation
Study (GRATS) , funded entirely by the Oregon Department of
Transportation (ODOT) , identified the need to reconstruct the
overpass at Stewart Parkway as a priority project in all future
improvement alternatives developed through the Study; and
WHEREAS, the City of Roseburg has invested over $6.7 million
in projects located along the Stewart Parkway corridor as
identif i ed within the formerly mentioned studies to encourage the
use of local streets and meet the transportation needs of the City;
and
WHEREAS, the City of Roseburg's Public Works Commission and
Economic Development Commission have reviewed and approved the
preliminary plans for the Stewart Parkway/I-S Overpass Project and
support staff's desire to bid the project in March of 2001 and to
seek "partnership., in funding construction of the project from the
Oregon Department of Transportation (ODOT) as a reflection of
ODOT' s 1999 Oregon Highway Plan policy " to maintain and improve the
safe and efficient movement of people and goods .and contribute to
the health of Oregon ' s local, regional and statewide economics and
livability of its corrununities"; and
WHEREAS, the Roseburg City Council recognizes reconstruction
of the Stewart Parkway Ov erpass as the final link to the overall
improvement of the ent ire Stewart Parkway cor ridor and considers it
essential in order to adequately accommodate current vehicular
traffic capacity, provide safe pedestrian and bikeway use and
improve traffic circulation along this important corridor; and
WHEREAS, at its meeting on February 28, 2000, the Roseburg
City council authorized City staff to proceed with the design of
the Stewart Parkway overpass Project, to be funded entirely from
Roseburg Urban Renewal funds, to present said designs to ODOT and
continue to encourage ODOT' s "partnership" with the City to provide
funding for the cost of constructing such project;

NOW THEREFORE, BE IT HEREBY RESOLVED:
Section 1. The City of Roseburg hereby formally requests the
Oregon Transportation Commission to direct the Oregon Department of
Transportation's participation and partnership in funding the
construction of the Stewart Parkway Overpass Project and full
cooperation from ODOT staff toward the development of a plan for
said funding and completion of this project.
Section 2.
The City Manager is hereby directed to present
this Resolution to the Oregon Transportation Commission at its
meeting in Roseburg on April 19, 2000 .

A RESOLUTION AUTHORIZING APPLICATION FOR LOCAL GOVERNMENT
GRANT FROM THE OREGON PARKS AND RECREATION DEPARTMENT
WHEREAS, the City of Roseburg Parks Master Plan indicates the need for an
additional community park; and
WHEREAS, on November 3, 1998, the Citizens of Roseburg approved a bond
levy to fund a new community park, upgrade existing parks and add new trails within the
City of Roseburg; and
WHEREAS, the Oregon Parks and Recreation Department is accepting
applications for the Local Government Grant Program; and
WHEREAS, the City of Roseburg desires to participate in this grant program to
the greatest extent possible as a means of providing needed park and recreation
acquisitions, improvements and enhancements; and
WHEREAS, the Roseburg City Council has identified a new community park as a
high priority need for the City of Roseburg; and
WHEREAS, the new community park will provide three softball fields, baseball
fields, concession stand, restrooms, picnic areas, picnic pavilions, trails, enhanced
wildlife habitat; and
WHEREAS, the applicant hereby certifies that the matching share for this
application is readily available at this time; and
IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ROSEBURG, that authorization is granted to apply for a Local Government Grant from
the Oregon Parks and Recreation Department for $250,000.00 for development of the
new community park as specified above.

A RESOLUTION AMENDING THE CITY OF ROSEBURG PARKS RULES AND
REGULATIONS TO INCLUDE RULES REGARDING THE CITY'S NEW SKATE PARK
FACILITY AND USE OF THE STEWART PARK BAND SHELL;
AND RESCINDING RESOLUTION 98-15
WHEREAS, general rules and regulations for the City of Roseburg's
parks system were previously approved by the Roseburg City Council
through the adoption of Resolution 98-15 on October 12, 1998; and
WHEREAS, the City of Roseburg Parks and Recreation Commission
developed and approved rules specific to the use of the Stewart
Park Band Shell on June 7, 1995, and such rules should be
incorporated into the aforementioned general park rules and
regulations; and
WHEREAS, on June 12, 2000, the Roseburg City Council approved a
recommendation from the Roseburg Parks & Recreation Commission to
amend said rules to include rules and regulations applicable to the
City's new skate park facility; and
WHEREAS, it has been determined to be most advantageous to have all
rules and regulations relating to the ~eneral use of City Parks,
the Stewart Park Band Shell and the City s new Skate Park Facility,
incorporated into one document;
NOW THEREFORE, IT IS HEREBY RESOLVED, by the Roseburg City Council
as follows:
Section 1. Resolution No. 98-15 as adopted on October 12, 1998, is
hereby rescinded.
Section 2.
The City of Roseburg Parks Rules and Regulations are
hereby amended to incorporate the rules and regulations developed
for use of the Stewart Park Band Shell and to include the rules and
regulations relating to the City's new skate park facility and said
amended rules, attached hereto as Exhibit " A" and incorporated
herein by this reference, are hereby adopted and enforceable under
Roseburg Municipal Code Chapter 1.06.

CITY OF ROSEBURG PARKS
RULES AND REGULATIONS
The following City of Roseburg Parks Rules and Regulations, adopted
by the Roseburg City Council on June 12, 2000, via Resolution No.
2000-11, shall be observed within the public parks of the City of
Roseburg, Oregon.
As used herein, the words "public park" shall
mean and include all property now or hereafter owned and/or
controlled by the City of Roseburg, Oregon, and operated as a park
or an area of City beautification available for the use of the
public .
GENERAL RULES OF CONDUCT IN CITY PARKS.
The following rules and
regulations for the conduct of persons using the public parks of
the City of Roseburg, Oregon, are hereby established and shall be
observed and enforced within said public parks:
1.
No person shall build any fire within any public park
except as permitted in a stove or fireplace designed and
provided therefore.
2.
No person shall permit any domestic animal owned by, or
in the custody of the person, to run at large within any park
or enter any pond, fountain or stream thereof, and all
domestic animals within any public park shall be kept in
control at all times on a leash not more than eight {8) feet
in length. Also, no person shall tease, annoy or injure any
animal within any park facility including ponds, streams, or
fountains.
3.
No overnight camping will be permitted in any park or
part thereof without prior approval of the City.
4.
No person shall ride or drive any horse or other
livestock, or permit any horse or other livestock, to go upon
any portion of a public park at any time except as authorized
by the City.
5.
Except for park maintenance, public utility and other
vehicles judged necessary by the Parks & Golf Director for the
construction and maintenance of City parks and utilities
therein, no motorized vehicle, of any type, shall be operated,
stopped, parked or left standing in a public park, other than
on roads, designated trails and parking areas, specified for
that type of vehicle use.
The Parks & Golf Director may
impose reasonable conditions on park use when exempt vehicles
are required within a park .

6.
No person shall operate a motorized vehicle, or a
bicycle, skateboard, roller-skates, roller blades, or any
other type of vehicle, in any public park in a manner that
endangers, or would be likely to endanger any person or damage
any property.
7.
No person shall be permitted within a public park,
including the City Skate Park facility, between dusk and dawn
with the following exceptions:
7.1 As permitted for special occasion upon application
and approval by the Parks & Golf Director.

7.3 Organized events that the City has approved such as
Music on the Half Shell, Legion Baseball, Little League
activities at Gaddis Park, scheduled softball league and

8.
No person may erect signs, markers or inscriptions of any
type within a public park, except in a specially designated
area, without permiss i on from the Parks & Golf Director . The
following activities are prohibited in all public parks unless
specifically authorized by the Parks & Golf Director:
8.1 The distribution of any circular, notice, leaflet,
pamphlet or written or printed information of any kind.
8.2 The solicitation of, or engagement in, the sale of
any merchandise or service, or the operation of any
concessions, within any public park without a permit from
the Parks & Golf Director.
9.
No person shall swim, wade, bathe or operate a boat in
any area of a public park except in those areas so designated.
10. No person shall operate any public address or loudspeaker
system, or operate a radio or other electronic audio device,
in any public park in a manner that constitutes a noise
disturbance.
For purposes of this section,
a "noise
disturbance" means any sound which annoys or disturbs a
reasonable person of normal sensitivities, but does not
include sounds arising from and consistent with any activity
approved by City sponsorship or for which a permit has been
issued by the Parks & Golf Director.

11. Car washes and garage sales are prohibited on public park
property.
12. Bicycles and motor-driven vehicles are prohibited in the
City Skate Park facility.
13. No person shall interfere with or disrupt any activity in
a public park which has been authorized by City permit.
14.
Persons desiring to use park property to picket or
protest activities authorized by City permit shall be allowed
to occupy the sidewalks and bicycle/pedestrian pathway
abutting Stewart Parkway only. If the number of people using
the designated area is ten {10) or more, the activity must
also comply with City parade regulations.
15.
The playing or practicing of golf is prohibited in any
City park other than Stewart Park Golf Course, unless
authorized by the Parks & Golf Director.
16. Any activity or conduct which is incompatible or
conflicts with any City-sponsored park activity is prohibited.
17. Any activity that is not authorized by a City permit
which is incompatible with or disrupts the general public use
of park property is prohibited.
RULES SPECIFIC TO USE OF THE STEWART PARK BAND SHELL FOR EVENTS NOT
UNDER CONTRACT WITH THE CITY: Persons issued a permit for use of
the Stewart Park Band Shell for events other than those sponsored
by the City of Roseburg shall be responsible for seeing that the
following rules and/or requirements are followed, met and adhered
to:
1.
At least one week prior to the event, Permittee shall
provide the City with proof of liability insurance in the
amount of $500,000 and a rider naming the City as an
additional insured.
2.
The sales, dispensing and/or consumption of alcoholic
beverages during events held at the band shell is prohibited
without a special occasion liquor license obtained from the
Oregon Liquor Control Commission and approved by the City
Manager. The license must be presented to the City a minimum
of three days prior to the event.
3.
Permittee must pay a permit deposit at least two weeks
prior to the date of the event to cover the cost of City
services such as police, parks and public works crews if these
services are required.
The amount of the deposit will be
determined on an event by event basis. A final accounting for
these services will be done by the City within 10 days

following the event, at which time the Permittee will be
reimbursed for any over payment or billed for costs in excess
of the amount deposited.
4.
Permittee must provide, at its own expense, all traffic
control and security needed throughout the duration of the
event.
The minimum traffic control and security will be
determined by the City on an event by event basis. Vehicles
parked in the Legion Field area when games are in progress
must be kept out of the fire lanes and not be double parked .
5.
Fermi ttee must provide an adequate number of portable
toilets to meet crowd demands.
6.
For crowds over 1,500, Permittee must provide additional
trash containers at a general rate of one (1) trash container
per every 50 people .
7.
The decibel level of any sound produced as part of or as
a result of the event shall be limited to 95-100 decibels .
8.
Permittee shall be held liable and responsible for any
damage beyond normal wear and tear upon the facilities used
during the event . Climbing on the band shell structure for
any reason is strictly prohibited.
9.
Due to limited availability of parking space,
Permittee anticipates an extra large crowd, Permittee
encouraged to provide shuttle bus service to the park.

in conjunction with use of the band shell must enter into a
separate agreement with the City.

than 9 : 30 p . m.
Penaltv for Violation: A violation of these rules and regulations
constitutes a violation under Roseburg Municipal Code Chapter 1.06
and may also constitute an offense under Roseburg Munic i pal Code
Chapter 7. 02 .
Penalties for such violations are set forth in
Roseburg Municipal Code Chapter 1.06. The City reserves the right
to exclude and/or ban, from any and all park facilities, any person
who has been found guilty of violating any of these rules and
regulations or who has vandalized, damaged or taken park property
or facilities, or attempted to do so .

CATEGORIZING TAXES FOR SAID TAX YEAR; ELECTING TO
RECEIVE STATE REVENUE SHARING; AND MAKING
APPROPRIATIONS
WHEREAS, the Budget Committee of the City of Roseburg, Oregon, has
approved a proposed budget for the fiscal year commencing July 1, 2000; and
WHEREAS, at a regular meeting of the City Council held on June 26, 2000, a
public hearing on said proposed budget was duly held after the giving of notice thereof
as provided by statute, proof of which is on file in the Office of the City Recorder of the
City; and
WHEREAS, the officer responsible for disbursing funds to cities under ORS
323.455, 366.785 to 366.820 and 471.805 shall, in the case of a city located within a
county having more than 100,000 inhabitants according to the most recent federal
decennial census, disburse such funds only if the city provides four or more of the
following service(s): (1) police protection; (2) fire protection; (3) street construction,
maintenance and lighting; (4) sanitary sewer; (5) storm sewers; (6) planning, zoning and
subdivision control; and (7) one or more utility services; and city officials recognize the
desirability of assisting the state officer responsible for determining the eligibility of cities
to receive such funds in accordance with ORS 221 .760; and
WHEREAS, the City of Roseburg certifies that it provides police protection, fire
protection, street construction, maintenance and lighting, and storm sewers;
NOW, THEREFORE, BE IT RESOLVED:
Section 1. After public hearing held on June 26, 2000, the Roseburg City Council
hereby adopts the budget for the tax year commencing July 1 , 2000, as approved by the
Budget Committee, a copy of which is marked Exhibit "A" and attached hereto.
Section 2. The City hereby levies the taxes for each fund provided for in the aggregate
amount of $8.35 per $1 ,000.00, be assessed pro rata upon all taxable property within
the City of Roseburg, Oregon, for the tax year covered by that levy.
Section 3. The City hereby declares the following allocation and categorization, subject
to the limits of Section 11 b, Article XI of the Oregon Constitution, constitute the
preceding aggregate levy:

Section 6. The Recorder of said City shall certify to the County Clerk and County
Assessor of Douglas County, Oregon, the tax levys provided for in this Resolution on or
before July 15, 2000, and shall file required documents with the County Assessor in
accordance with ORS 294.555.

A RESOLUTION AUTHORIZING THE INSTITUTION OF PROCEEDINGS
IN EMINENT DOMAIN FOR THE ACQUISITION BY CONDEMNATION
OF PROPERTY INTERESTS ALONG VINE STREET, ALAMEDA
STREET AND OAKLAND AVENUE FOR THE PURPOSES OF
CONSTRUCTION OF STREET IMPROVEMENTS
The City Council of the City of Roseburg finds that:
The City Council has authority under provisions of the City Charter and
applicable state law to institute proceedings in eminent domain for the acquisition by
condemnation of private property for public purposes, including the improvement of City
streets and construction of curbs, gutters, sidewalks and other features.
Vine Street, Alameda Street and Oakland Avenue are designated on the
comprehensive plan as collector streets. The City is in the process of bringing the
named streets up to City standards by widening the streets, replacing curbs and gutters,
and installing sidewalks. No sidewalks currently exist along any portions of the said
streets in the affected area.
The proposed improvements are in compliance with and in furtherance of the
plans and specifications prepared by the City Engineer in accordance with provisions of
the Roseburg Municipal Code and applicable policies of the City of Roseburg.
The public good realized from the project far outweighs any damage that affected
property owners might sustain, particularly in light of the City's obligation to provide just
compensation to the affected property owners.
The costs of delaying the project, the savings from efficient construction
management techniques, and the need to facilitate the safe and efficient movement of
traffic requires the City to act promptly to acquire the necessary property interests for
this project.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ROSEBURG, a Municipal Corporation of the State of Oregon, as
follows:
Section 1. Based upon the above findings, which are incorporated herein by
reference and hereby adopted, the City Council of the City of Roseburg does hereby
find, declare and determine it necessary to acquire certain ownership in fee to the real
property more particularly described in Exhibit A attached hereto and incorporated
herein by reference in order to construct the street widening improvements to Vine
Street, Alameda Street and Oakland Avenue in accordance with the preliminary design
prepared by the City Engineer and approved by the City Manager.

Section 2. The City Council does hereby direct that the City Manager shall
institute negotiations with affected property owners to acquire the needed property
interests described in Section 1. If those negotiations are unsuccessful, the City
Manager shall, at least 20 days prior to the filing of any action for condemnation, make
a written offer to the owners or parties having an interest therein, as set forth in
Exhibit A attached hereto and incorporated herein by reference, of a stated amount of
compensation therefor and for any compensable damages to remaining property. If the
offer is not accepted, the City Manager shall institute proceedings in eminent domain for
the condemnation of the real property interests described in Section 1.
Section 3. The City Council further directs that the City of Roseburg shall obtain
immediate possession of the real property interests described in Section 1 if
negotiations would delay the construction of the described improvements.
Section 4. The City Council hereby declares that the improvements above set
forth are for a public purpose, are necessary for the public welfare, are the most
compatible with the greatest public good and the least private injury, and are authorized
under the laws of the State of Oregon and Charter and ordinances of the City of
Roseburg.
Section 5. The City Council further declares that the real property interests
described in Section 1 shall be used by the City of Roseburg for public purposes at the
earliest possible date and, in any event, no later than ten years from the date this
Resolution is adopted by the Council.

compensation outlined in the above Section 1 are hereby rescinded
and repealed effective November 1, 2000.
Section 3.
The rates of compensation established by this
Resolution shall become effective on November 1 1 2000, and remain
in effect until otherwise amended.

IT IS HEREBY RESOLVED by the City Council of the City of Roseburg, Oregon, that
Resolution No. 92-13 adopted by the City Council on August 24, 1992, is amended to
establish a Measure 7 Property Compensation Application Fee to Administration - City
Manager's Office, effective immediately:
