BE IT ENACTED:
Section One. Purpose and Findings
1. The Shiprock Associated Schools, Inc. is a tribally-controlled school as defined under
the Tribally Controlled Schools Act. The school operates all education and educationrelated programs, as well as construction and facilities repair and improvement programs,
pursuant to provisions of Public Law 100-297.
2. Aside providing education to its students, the school operates a residential dormitory
program. Approximately 100 students reside in the dormitories, attending school on a
daily basis. Unfortunately, the dormitories are 72 years old, presenting many hazards.
There is the presence of asbestos, deteriorating water pipes, poor drainages, dilapidated
masonry walls, floors, footings, foundations and roofs, as well as problems with electrical
wiring and heating systems, among various other issues. See attached resolution of the
school board for the Shiprock Alternative Schools, Inc., no. 10-010 (Exhibit "A"), letters

of the Head of Maintenance and Facilities and the Dormitory Manager (Exhibits "B" and
"C" respectively).
3. The school (Shiprock Alternative Schools, Inc.) has been seeking funds for the past
12 years hoping to address the problems posed by its deteriorating dormitories.
Currently, the Bureau of Indian Affairs has no funding to correct the serious deficiencies.
Section 2. Recommendation for Funding
The Navajo Nation hereby recommends that the New Mexico Legislature help fund
construction for deteriorating dormitory buildings at the Shiprock Alternative School,
Inc.

Supporting and Authorizing the Submittal of the Shiprock Associated Schools, Inc. Proposal for Funding to the State of
New Mexico Legislature in Santa Fe New Mexico, for Shiprock Associated Schools Inc.-Residential Program Dorm
Construction Project.
WHEREAS, The Shiprock Associated Schools, Inc. is a tribally controlled school as defined in Sec. 5212(g) of the Tribally
Controlled Schools Act in that it is operated by a Tribal organization enrolling students in High School, Mid School, and
Elementary grades, and
WHEREAS, The Shiprock Associated Schools, Inc. is organized under Public Law 100-297, the Tribally Controlled Schools,
Act and authorized by this Act to operate schools and residential dormitory programs, and
WHEREAS, The Shiprock Associated Schools, Inc. was reauthorized by the Education Committee as Legislative No. 016304 to continue grant operation of all education and education-related programs, and school construction, facilities
improvement and repair, and minor improvements and repairs projects pursuant to the provisions of Public Law 100297, beginning July 2, 2010 and ending June 30, 2013, and
WHEREAS, The Shiprock Associated Schools, Inc. School Board has been seeking Dormitory Construction Funds to the
B.I.A Office of Facilities, Management, and Construction (OFMC) for the past 12 years for new dormitory construction,
however it was not considered and presently NO FUNDIND AVAILABLE BY THE BUREAU OF INDIAN EDUCATION (B.I.E)
Dorms are 72 years old. Constantly needing costly repairs and maintenance jeopardizing the conformance with 25 CFR,
Part 36; Federal Dormitory Standards, The Buildings are now considered hazardous of asbestos, exposure, deteriorating
water pipes, drainages, masonry walls, floors, footings and foundations, roofs, electrical wirings, heating systems, etc.
Annually, approximately 100 students reside in the dorms to attend schools daily.
NOW THEREFORE BE IT RESOLVED THAT:
The Shiprock Associated Schools, Inc. Board reaffirms its support and authorized the submission of Shiprock Associated
Schools, Inc.; Residential Program Dorm Construction Proposal for funding.

Dear Mr. Hale:
The Shiprock Associated Schools has been seeking funding to replace the old deteriorated
Residential Buildings. However, our efforts have been without any success. The Buildings
consist of 1204, 1205 and 1206 which house our Residential students during the school year.
Our Maintenance Staff maintain the buildings to the best of their capabilities but there are still
shortfalls due to the deterioration of the buildings. Therefore, Safety and Health issues arise and
repairs are dependent on building replacement for the proper resolution. Although these matters
are apparent and the Central BIE OFMC office is aware, there has been no budget allocation for
replacement of these buildings.
We appreciate your assistance and support in our efforts in seeking funding for replacement of
our Residential Buildings. If you have any questions regarding this matter, please contact me at

Council Delegate present at the meeting. Thereafter, to support our Request for the Support Resolution, the following
information was requested:
1) A letter by our Facility Department Manager documenting there is no funding available through the Bureau of
Indian Education Facility Department, (Attached) written by Dean Clark, SASI Head of Facilities on September 09,
2013,

A Shiprock Associated Schools Inc, School Board Resolution, (Attached) approved by the SASI School Board on
September 09, 2013,
3)
And Student Data, (attached) School Years 2008 through 2012 ISEP Student Headcount Verification of
enrollment.
I look forward to receiving a Support Resolution from the Navajo Nation Health, Education, and Human Services
Committee on behalf our Shiprock Associated Schools Inc, Residential Program and School Board. The Support
Resolution will support our quest in approaching the New Mexico Legislature in 2014, and together in unity, we strive
toward seeking funding for new dormitories.
