This committee would be put together to review police department or police officer
activity when called into service following a major event .The purpose is such as to
determine if Cuero Police are adhering to best practices and standard procedures
of law enforcement. The committee shouldn’t be called in to review minor citizen
complaints but on major issues that may or may not lead to litigation. The Chief
should be tasked with authoring a policy assuring full cooperation with the review
committee from all members of the Police Department.

The City Council may convene into executive (closed) session in accordance with the Texas Government Code when necessary
and legally justified. Any item on this agenda may be discussed in executive session if authorized by Texas Law regardless of

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUERO, TEXAS, AMENDING
THE CITY OF CUERO’S OFFICIAL COMPREHENSIVE ZONING MAP UNDER PART 1,
ARTICLE 1 OF THE CITY OF CUERO’S UNIFIED DEVELOPMENT CODE, ENTITLED
ZONING DISTRICTS BY PROVIDING THAT THE PROPERTY DESCRIBED AS LOTS 7, 8,
AND P/O 9, BLOCK 13, CUERO SUBDIVISION DEWITT COUNTY, TEXAS, 302 E LIVE OAK
SAID TRACK OF LAND DESCRIBED IN INSRUMENT RECORDED IN VOLUME ___, PAGE
____OF THE OFFICIAL PUBLIC RECORDS OF DEWITT COUNTY, TEXAS, BE REZONED
(CHANGED) FROM NC-R1 – NEIGHBORHOOD CONSERVATION RESIDENTIAL ESTATE
TO C-1-COMMERCIAL, REPEALING ORDINANCES OR PART OF ORDINANCES IN
CONFLICT THEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND PRESCRIBING
AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission of the City of Cuero, as duly formed and organized,
has presented and submitted a final report on a proposed amendment to the City’s Official
Comprehensive Zoning Map as provided in the Unified Development Code to the City Council and same
was received by the said City Council pursuant to the following:
Request for the Rezoning of the property described as Lots 7, 8, and P/O 9, Block 13, Cuero Subdivision
Dewitt County, Texas, 302 E Live Oak said track of land described in instrument recorded in Volume
___, Page ____of the official public records of Dewitt County, Texas, be rezoned (changed) from NC-R1
– Neighborhood Conservation Residential Estate to C-1 – Commercial as recommended by the Planning
and Zoning Commission. The purpose of this proposal is to amend the Unified Development Code, Part
1, Article 1, Ordinance No. 2015-30, and Official Zoning Map by changing the zoning district designation
of the property being described as Lots 7, 8, and P/O 9, Block 13, Cuero Subdivision Dewitt County,
Texas, 302 E Live Oak , Volume ___Page ___, of the official public records of DeWitt County, Texas, to
be rezoned (changed) from NC-R1 – Neighborhood Conservation Residential Estate to C-1 –Commercial.
This request has been submitted by the City of Cuero for the zoning change currently designated NC-R1 –
Neighborhood Conservation Residential Estate with the enactment of the Ordinance 2015-30 in 2015,
which established the city’s current zoning districts.b
WHEREAS, a plat of the subject property to be rezoned from designation NC-R1 – Neighborhood
Conservation Residential Estate to C-1- Commercial designation is attached hereto as Exhibit “A” and
incorporated herein by reference at length for all purposed as if fully set forth herein; and
WHEREAS, this amendment consists of changing the designation of the property being described as
Lots 7, 8, and P/O 9, Block 13, Cuero Subdivision Dewitt County, Texas, 302 E Live Oak , Volume ___
Page ___, in the official public records of DeWitt County, Texas, City of Cuero, DeWitt County, Texas,
to be rezoned (changed) from NC-R1 – Neighborhood Conservation Residential Estate to C-1 –
Commercial as depicted in Exhibit “A”; and
WHEREAS, all notices for public hearings have been provided for and public hearings held by the City
Council according to law; and
WHEREAS, all legal prerequisites and conditions for this rezoning designation have been provided for
according to law
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CUERO,
TEXAS AS FOLLOWS
SECTION ONE. That the City Council of the City of Cuero, Texas based upon the recommendation of
the Planning and Zoning Commission of the City of Cuero, does hereby and in all things amend the City’s
official Comprehensive Zoning Map as provided under Part 1, Article 1 of the City of Cuero’s Unified
Development Code, entitled Zoning Districts as provided and allowed pursuant to the provisions of the
City of Cuero Unified Development Code, including but not limited to Section 1.101 and Section 1.102 as
follows:
The Official Comprehensive Zoning Map of the City of Cuero with its amendments as previously adopted
by the City Council is here now amended as follows: the Lots 7, 8, and P/O 9, Block 13, Cuero
Subdivision Dewitt County, Texas, 302 E Live Oak, Volume __ Page ___, in the deed of records of said
County, City of Cuero, DeWitt County, Texas, depicted in Exhibit “A”; be rezoned (changed) from NCR1 – Neighborhood Conservation Residential Estate to C-1 – Commercial.
SECTION TWO: All ordinances or parts of ordinances not consistent or conflicting with, the provisions
of this ordinance are hereby repealed; provided that such repeal shall be only to the extent of such
inconsistency, and in all other respects, this ordinance shall be cumulative of other ordinances regulating
and governing the subject matter covered in this ordinance. Any cause of action accruing prior to the
passage of this ordinance shall continue as if this ordinance was not passed or any other ordinance had not
been repealed.
SECTION THREE: That it is hereby declared that the sections, articles, subsections, paragraphs,
sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence,
paragraph, subsection, article, or section of this ordinance shall be declared void, ineffective, or
unconstitutional by a valid judgment or final decree of a court of competent jurisdiction, such voidness,
ineffectiveness, or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, subsections, articles, or sections of this ordinance since the same would have been enacted by
the City Council without the incorporation herein of any such void, ineffective, or unconstitutional phrase,
clause, sentence, paragraph, subsection, article, or section.
SECTION FOUR: The City Secretary of the City is hereby directed to engross and enroll this ordinance
by copying the caption, penalty clause (if any), publication clause and effective date clause in the minutes
of the City Council and filing the ordinance in the ordinance records of the City.
SECTION FIVE: The City Secretary is hereby directed to post or publish in the official newspaper of
the City, the caption, penalty clause (if any), publication clause and effective date clause of this ordinance
in one issue of the official newspaper of the City, provided that the official newspaper is a weekly paper,
as authorized by Section 52.013 of the Texas Local Government Code.
SECTION SIX: This ordinance shall take effect immediately from and after its passage after the
required two (2) readings and the publications of the caption as the law in such cases provides.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUERO, TEXAS,
AUTHORIZING AND APPROVING A UTILITY EASEMENT FROM AUTHUR M.
BOWERS AND WIFE, KATHY G. BOWERS, HUBERT H. BOWERS AND WIFE IDA
BOWERS AS GRANTORS TO THE CITY OF CUERO AS GRANTEE ACROSS REAL
PROPERTY, BEING ACROSS TRACT OF LAND LOCATED IN THE JOHN J.
TUMLINSON LEAGUE, ABSTRACT 45, IN DEWITT COUNTY, TEXAS AND
AUTHORIZING THE MAYOR’S EXECUTION OF SAID EASEMENT AND
DECLARING AN EMERGENCY.
WHEREAS, the AUTHUR M. BOWERS AND WIFE KATHY G. BOWERS AND HUBERT
H. BOWERS AND WIFE IDA BOWERS are the owner of those the lands described in Exhibit
“A”, attached hereto and incorporated herein by reference for all purposes at length as if fully set
forth herein;
WHEREAS, the City does herenow approve the Easement in the form attached hereto as Exhibit
“B”;
WHEREAS, this City Council does hereby authorize and direct the Mayor of the City of Cuero
to execute the Easement attached hereto as Exhibit “B”.
NOWTHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CUERO, TEXAS:
SECTION ONE. That the City Council of the City of Cuero does hereby approve the Utility
Easement from AUTHUR M. BOWERS AND WIFE KATHY G. BOWERS AND HUBERT H.
BOWERS AND WIFE IDA BOWERS in the form attached hereto as Exhibit “B”;
SECTION TWO. That the Mayor of the City of Cuero, be and she is hereby authorized and
directed to sign on behalf of the City of Cuero, the Easement attached hereto as Exhibit “B”.
SECTION THREE. In order for the grant of this easement to take place in a timely manner it is
necessary that this Ordinance be adopted immediately. Such facts constitute an emergency for
the preservation of the public health, safety, and business demanding that the Rule which
requires ordinances to be read at more than one meeting of the City Council be and the same is
hereby suspended and this Ordinances shall take effect immediately upon and after its passage on
first reading.

To the Honorable Mayor Meyer and City Councilmen,
The Market on Main committee and Cuero Main Street Advisory Board request the attached road closures
for Saturday, April 23. These closures will provide a safe area for visitors to shop the Market. We request
the 100 block of S. Gonzales and the 200 block of E. Main be closed at 7:30AM on Saturday, April 23 and
be re-opened no later than 10:00PM on Saturday, April 23, 2016.
The commitee also request the Farmer’s Market vendors be allowed to set up on the sidewalk in front of
City Hall, under the awning. Permission will be requested of Edward Jones and Frank Burns Accounting
as well. It will be best for the Farmer’s Market vendors to be under the shade of an awning to protect
their fresh produce.

JOINT GENERAL ELECTION
May 7, 2016
JOINT ELECTION AGREEMENT
BETWEEN DEWITT COUNTY AND
CITY OF CUERO,
CITY OF YORKTOWN, AND YORKTOWN INDEPENDENT SCHOOL DISTRICT
WHEREAS, the County of DeWitt (“DeWitt County”), City of Cuero (“CC”), City of Yorktown (“CY”), and
Yorktown Independent School District (“YISD”) collectively referred to hereinafter as the “Participating
Entities”, will each hold elections on May 7, 2016; and,
WHEREAS, DeWitt County, CC, CY, and YISD desire to enter into a Joint Election Agreement for the
purpose of sharing election equipment, election officials, and sharing precinct polling locations and election
ballots where appropriate;
NOW, THEREFORE, DeWitt County, CC, CY, and YISD enter this Joint Election Agreement under the
terms that follow:
SCOPE OF JOINT AGREEMENT
The Participating Entities enter this Joint Election Agreement (“Agreement”) for the conduct of
the elections to be held on May 7, 2016.
APPOINT ELECTION OFFICER
The Participating Entities appoint the Elections Administrator, DeWitt County, Texas, to serve as
the Election Officer for each Participating Entity in order to perform and supervise the duties
and responsibilities of the Election Officer for the May 7, 2016 election.
EARLY VOTING AND ELECTION DAY
Early Voting and Election Day voting shall be held in common precincts where appropriate at
the dates, times, and location recommended by the Elections Administrator and authorized and
ordered by the governing body of each Participating Entity.
JOINT ELECTION COSTS; ADJUSTMENT OF COSTS IN THE EVENT OF CANCELLATION OF
ELECTION OR OTHER CHANGES; PAYMENT
The estimated election expenses, including administrative costs and expenses for facilities,
personnel, supplies, and training for each Participating Entity is as reflected in the cost estimate
attached and incorporated as “Exhibit A”. If a Participating Entity cancels its election, it shall be
responsible only for its share of prorated expenses through the date of cancellation.
MISCELLANEOUS POSITIONS
This Agreement becomes effective upon execution by all Participating Entities. The obligations
of the Agreement will continue as to each Participating Entity until each Participating Entity has
made full payment of its share of election cost under this Agreement and other agreements
related to May 7, 2016.

This Agreement may not be amended or modified except in writing executed by the Participating Entity.
The obligations under this Agreement are performable in DeWitt County, Texas.
Venue for any dispute arising under this Agreement shall be in Cuero, DeWitt County, Texas. This
Agreement shall be governed by and constructed in accordance with the laws of the State of Texas and
the United States of America.
If any provision of the Agreement is found to be invalid, illegal, or unenforceable by a court of competent
jurisdiction, such invalidity, illegality or unenforceability shall not affect the remaining provisions of the
Agreement; and the Participating Entity shall perform their obligations under this Agreement as expressed
in the terms and provisions of this Agreement.

BY TERMS OF THIS CONTRACT made and entered into by and between DeWitt County (“DeWitt County)
and City of Cuero (“CC”), City of Yorktown (“CY”), and Yorktown Independent School District (“YISD”),
collectively hereinafter referred to as the “Political Subdivision(s)”, and duly constituted and acting DeWitt
County Elections Administrator hereinafter referred to as “Elections Administrator”, and by authority of
Texas Election Code Sections 31.092 and 271.002 and Texas Education Code Section 11.0581 for
conducting and supervision of the Joint General Election on May 7, 2016.
THIS AGREEMENT is entered into in consideration of the mutual covenants, agreements, and benefits to
the Political Subdivision(s) hereinafter set out. IT IS AGREED AS FOLLOWS:
I.
ADMINISTRATION
The Elections Administrator agrees and shall coordinate, supervise, and handle all aspects in
administering of the election in accordance with the provision of the Texas Election Code and as
outlined in this Agreement.
The DeWitt County Elections Administrator, in connection with the holding and supervision of
said election shall serve as the administrator for the Joint General Election; however, the
Political Subdivision(s) shall remain responsible for the decisions and actions necessary for the
lawful conduct of its election. The Elections Administrator shall provide advisory services in
connection with decisions to be made and actions to be taken by the Political Subdivision(s).
It is understood that other Political Subdivision(s) may wish to participate in the use of the
DeWitt County’s electronic voting system and polling places, and it is agreed that DeWitt
County and the Elections Administrator may enter into other joint election agreements and
contracts for elections services for those purposes on terms and conditions generally similar to
those set forth in this contract. The Political Subdivision(s) agree that DeWitt County may
enter into joint election agreements with other Political Subdivision(s) that may have territory
located partially or wholly within the boundaries of Political Subdivision(s).
At each polling location, the Political Subdivision(s) shall share voting equipment and supplies
to the extent possible. However, in no instance shall a voter be permitted to receive a ballot
containing an office or proposition stating a measure on which the voter is ineligible to vote.
Each Political Subdivision(s) ballot shall be prepared to distinguish one from the other. The
Political Subdivision(s) may share a mutual ballot in those polling places where jurisdictions
overlap and share common territory. Multiple ballot styles shall be available in those shared
polling places where jurisdictions do not overlap.
The Elections Administrator will prepare an Estimated Cost of Election Services for the County
Election Services Contract, see Exhibit “A”.

II.
VOTING SYSTEM
DeWitt County owns an electronic voting system which has been duly approved by the
Secretary of State pursuant to Texas Election Code Chapter 122 as amended and is compliant
with the accessibility requirements for persons with disabilities set forth by Texas Election Code
Section 61.012.
The voting system to be used in the election is Hart Voting System 6.2.1. Early voting and
Election Day voting will be conducted on the eSlate DRE (Direct Recording Equipment) and the
eScan voting system. Absentee Voting will be processed through the eScan voting system.
Provisional ballots cast on Election Day will be cast only on paper provisional ballots.
III.
EARLY VOTING
The Political Subdivision(s) agree to conduct early voting and to appoint the Elections
Administrator as the Early Voting Clerk in accordance with Sections 31.097 and 271.006 of the
Texas Election Code to supervise the conducting of early voting in person and by mail and
supply personnel to serve as deputy early voting clerks.
a) The Political Subdivision(s) further agree that the Elections Administrator may appoint other
deputy early voting clerks to assist in the conduct of early voting as necessary, and that
these additional deputy early voting clerks shall be compensated at an hourly rate set by
DeWitt County pursuant to Section 83.052 of the Texas Election Code.
b) Early voting by personal appearance will be held at the location, dates, and times listed in
Exhibit “B”.
c) As Early Voting Clerk, the Elections Administrator shall receive applications for early voting
ballots to be voted by mail in accordance with Chapters 31 and 86 of the Texas Election
Code.
d) Persons voting by mail will send their marked ballots to the office of the DeWitt County
Elections Administrator. All requests for early voting ballots by mail to be voted which are
received by the Political Subdivision(s) shall be forwarded immediately on the day of receipt
to the office of DeWitt County Elections Administrator via fax or courier for processing.
e) The Elections Administrator shall, upon request, provide the Political Subdivision(s) a copy
of the early voting report on a daily basis and a cumulative final early voting report
following the election.
f) All early voting ballots (those cast by mail and those cast by personal appearance) will be
prepared for counting by an Early Voting Ballot Board.
IV.
VOTING LOCATIONS
a) The Elections Administrator shall select and arrange for the use of and payment for all
Election Day voting locations.
b) Voting locations shall be compliant with the accessibility requirements established by
Election Code Section 43.034 and the Americans with Disabilities Act.
c) In the event a voting location is not available, the Elections Administrator will arrange for
use of an alternate location with the approval of the Political Subdivision(s). The Elections
Administrator shall notify the Political Subdivision(s) of any changes from the locations
listed in Exhibit “C”.

d) If polling places for the May 7, 2016 Joint General Election are different from the polling
place(s) used by the Political Subdivision(s) in its most recent election, the Political
Subdivision(s) agrees to post a notice at the entrance to any polling places in the
jurisdiction stating that the polling location has changed and stating the Political
Subdivision(s) polling place names and addresses in effect for the May 7, 2016 election.
V.
PREPARATION OF SUPPLIES AND VOTING EQUIPMENT
a) The Elections Administrator shall procure, prepare, and distribute voting machines, election
kits and election supplies including, but not limited to official ballots, sample ballots, voter
registration lists, instructions and forms, signs, maps and other materials used by the
election judges in conducting the election in conformity with the polling places established
for the election.
b) The Elections Administrator shall procure, prepare, proof and distribute programmed ballots.
c) The Elections Administrator shall be responsible for the preparation, testing, and delivery of
the voting equipment for the election as required by the Election Code.
d) The Elections Administrator shall provide legal notice of the date, time and place of testing
of the electronic tabulation equipment and conduct such testing.
VI.
ELECTION JUDGES, CLERKS, AND OTHER ELECTION PERSONNEL
While taking into account the judges approved by the political subdivisions, the Elections
Administrator shall be responsible for the appointment of the presiding judge and alternate
judge for each polling location in accordance with Chapter 32 of the Texas Election Code.
The Elections Administrator shall make emergency appointments of election officials if
necessary.
Upon request by the Elections Administrator, the Political Subdivision(s) agree to assist in
recruiting polling place officials who are bilingual (fluent in both English and Spanish).
a) The Elections Administrator shall arrange for the notification, including writ of election,
training and compensation of all presiding judges and alternate judges.
b) The Elections Administrator will be responsible for notifying each election judge and
alternate judge of the eligibility requirements of Subchapter C of Chapter 32 of the Texas
Election Code and will take the necessary steps to insure that all election judges appointed
for the Joint General Election are eligible to serve. The Elections Administrator shall notify
all election judges and alternate judges of his or her appointment and for determining the
number of clerks that the presiding judge may appoint to work at each polling place.
c) Election judges shall be responsible for acceptance of election supplies and materials at the
date, time, and place determined by the Elections Administrator. Each presiding election
judge will be sent a letter from the Elections Administrator notifying him of his appointment,
the time and location of training, the distribution of election supplies, and the number of
election clerks that the presiding judge may appoint.
d) Each election judge and clerk will receive compensation at an hourly rate established by
DeWitt County pursuant to Texas Election Code Section 32.091 at $10.00 per hour. The
election judge or their designated clerk will receive an additional $25.00 for picking up the
election supplies prior to Election Day and for delivering election returns, supplies, and
equipment to the DeWitt County Elections Administrator’s Office after the polls close.

e) The Elections Administrator may employ other personnel necessary for the proper
administration of the election, including such part-time help as is necessary to prepare for
the election, to ensure the timely delivery of supplies during early voting and on Election
Day, and for the efficient tabulation of ballots at the central counting station. Part-time
personnel working as members of the Early Voting Ballot Board and/or Central Counting
Station on election night will be compensated at the rate set by DeWitt County in
accordance with Election Code Sections 87.005, 127.004, and 127.006.
VII.
EARLY VOTING BALLOT BOARD
DeWitt County shall appoint an Early Voting Ballot Board (EVBB) to process early voting
absentee results from the Joint General Election.
a) The Presiding Judge, with the assistance of the Elections Administrator, shall appoint two or
more additional members to constitute the EVBB.
b) The Elections Administrator shall determine the number of EVBB members required to
efficiently process the early voting absentee ballots.
VIII. CENTRAL COUNTING STATION AND ELECTION RETURNS
The Elections Administrator shall be responsible for establishing and operating the Central
Counting Station to receive and tabulate the voted ballots in accordance with the provisions of
the Texas Election Code and of this agreement.
a) The Elections Administrator hereby, in accordance with Section 127.002, 127.003, and
127.005 of the Texas Election Code, shall appoint the Central Counting Station officials. The
counting station manager or representative shall be responsible for releasing cumulative
totals and precinct returns of the election results and precinct reports as tabulated to the
Political Subdivision(s), candidates, press, and general public by distribution of hard copies
or electronic transmittals by facsimile (when so requested). To ensure the accuracy of
reported election returns, results printed by the tapes produced by DeWitt County’s voting
equipment will not be released to the Political Subdivision(s) at the remote collection sites
or by phone from individual polling locations.
b) The Elections Administrator will prepare the unofficial canvass reports after all polling places
have been counted, and will provide a copy of the unofficial canvass to the Political
Subdivision(s) as soon as possible after all returns have been tabulated.
c) The Elections Administrator shall supervise the handling and disposition of election returns,
voted ballots, etc., and tabulate unofficial returns and assist in preparing the tabulation for
the official canvass.
d) The Political Subdivision(s) shall be responsible for the official canvass of its Election.
e) The Elections Administrator will prepare the electronic precinct by precinct results reports
for uploading to the Secretary of State as required by Section 67.017 of the Election Code.
The Elections Administrator agrees to upload these reports for each Political Subdivision(s)
unless requested otherwise.
f) The Elections Administrator shall be responsible for conducting the post-election partial
manual count required by Section 127.201 of the Texas Election Code unless a waiver is
granted by the Secretary of State. Notification and copies of the recount, if waiver is
denied, will be provided to each Political Subdivision(s) and the Secretary of State’s Office.

IX.
DUTIES AND SERVICES OF POLITICAL SUBDIVISION(S)
The Political Subdivision(s) in connection with the holding and supervision of said election shall
assume the following responsibilities and shall directly bear any attendant costs for the same:
a) Preparation and adoption of election orders, resolutions, notices, official canvass and any
other pertinent documents required by the Texas Election Code and/or the Political
Subdivision(s) governing body, charter, or ordinances.
b) Posting or publication of election notices.
c) Deliver to the Elections Administrator as soon as possible, after ballot positions have been
determined, each Political Subdivision(s) official wording and information for the Joint
General Election that is to be printed on the ballot with the exact form, order, wording
including Spanish translation, and spelling that is to be used.
d) Each of the Political Subdivision(s) shall be responsible for paying all Judges and Clerks
(Early Voting, Election Day, Early Voting Ballot Board, and Central Count Station).
Statement of Compensations will be provided by the Elections Administrator.
e) Each of the Political Subdivision(s) shall be responsible for proofreading and approving the
ballot insofar as it pertains to that authority’s candidates and/or propositions.
f) Each of the Political Subdivision(s) shall provide a copy of their respective election orders
and notices to the DeWitt County Elections Administrator.
g) Provide the Elections Administrator with an updated map and street index of their
jurisdiction in an electronic or printed format.
h) Pay any additional costs incurred by the Elections Administrator for any additional verified
cost incurred in the process of running this election or if a recount for the election is
required or the election is contested in any manner.
i)

If necessary, prepare a submission to the U.S. Department of Justice for preclearance of the
joint election procedures, polling changes, and voting changes, pursuant to the Federal
Voting Rights Act of 1965, as amended. By signing this agreement the Political
Subdivision(s) certifies that it has no unresolved preclearance or voting rights issues known
to it that would preclude or delay Department of Justice preclearance of joint elections.
PAYMENT FOR SERVICES, ELECTION EXPENSES AND ALLOCATION OF COSTS
The Elections Administrator will be responsible for payment to all vendors who have provided
services, supplies and voting locations for the election. The Political Subdivision(s) shall not be
liable to any third parties for any default by DeWitt County in connection with holding the
election, including failure by DeWitt County or its Elections Administrator to pay for services,
supplies and voting locations for this election.
The Political Subdivision(s) agree to share the costs of administering the Joint General Election.
a) Since another Political Subdivision is using the services of the DeWitt County Elections
Administrator for early voting and election day, many of the expenses incident thereto may
be split evenly by said Political Subdivision(s) (on a prorate basis) as applicable. Costs for
Early Voting by Mail shall be allocated according to the actual number of ballots mailed to
each Political Subdivision’s voters.

b) After the date of the election, and completion of all duties required of the DeWitt County
Elections Administrator, the Elections Administrator shall compute a final statement of the
exact amount of the Political Subdivision(s) obligation, under terms of this agreement, for all
services rendered, together with administrative fees, less any partial payments and bill their
prorate share of said sum. Statement of Compensations will also be provided for the
Political Subdivision’s use in paying all Judges and Clerks (Early Voting, Election Day Judge,
Early Voting Ballot Board, and Central Count Station).
c) The DeWitt County Elections Administrator shall provide copies of all invoices received by
DeWitt County for payment of services or supplies of which the Political Subdivision(s) is to
reimburse DeWitt County.
d) The Political Subdivision(s) shall pay to DeWitt County the actual costs incurred by DeWitt
County in conducting this election, together with an additional ten percent (10%)
administrative fee, pursuant to Texas Election Code, Section 31.100.
e) The Political Subdivision(s) shall pay to DeWitt County the balance due within thirty (30)
days after receipt of the final invoice from the Elections Administrator.
f) The DeWitt County Elections Administrator shall deposit all funds payable under this
contract into the appropriate funds within the county treasury in accordance with Election
Code Section 31.100.
XI.
ESTIMATED COST OF SERVICES – SEE EXHIBIT “A”
The Political Subdivision(s) agree that Exhibit “A” is an estimate only and the Political Subdivision(s) are
obligated to pay the actual expenses of the election.

XV.
WITHDRAW FROM CONTRACT DUE TO CANCELLATION OF ELECTION
The Political Subdivision(s) may withdraw from this agreement and the Joint General Election
should it cancel its election in accordance with Chapter 2 of the Texas Election Code.
a) The Political Subdivision(s) shall pay the Elections Administrator a contract preparation fee
of $75.
b) The Political Subdivision(s) are fully liable for any expenses incurred by DeWitt County on
behalf of the Political Subdivision(s) plus an administrative fee of ten percent (10%) of such
expenses for its share of prorated expenses through the date of cancellation.
c) Any monies deposited with the Elections Administrator by the withdrawing authority shall be
refunded minus the aforementioned expenses and administrative fee if applicable.
XVI.
RECORDS OF THE ELECTION
The Elections Administrator is hereby appointed general custodian of the voted ballots and all
records of the Joint General Election as authorized by Section 271.010 of the Texas Election
Code.

a) Access to the election records shall be available to the Political Subdivision(s) as well as to
the public in accordance with applicable provisions of the Texas Election Code and the Texas
Public Information Act.
b) The election records shall be stored at the offices of the Elections Administrator or at an
alternate facility used for storage of county records.
c) The Elections Administrator shall ensure that the records are maintained in an orderly
manner so that the records are clearly identifiable and retrievable.
d) Records of the election shall be retained and disposed of in accordance with the provisions
of Section 66.058 of the Texas Election Code.
e) If records of the election are involved in any pending election contest, investigation,
litigation, or open records request, the Elections Administrator shall maintain the records
until final resolution or until final judgment, whichever is applicable.
f) It is the responsibility of the Political Subdivision(s) to bring to the attention of the Elections
Administrator any notice of pending election contest, investigation, litigation or open records
request which may be filed with the Political Subdivision(s).
XVII. RECOUNTS
A recount may be obtained as provided by Title 13 of the Texas Election Code.
a) The Political Subdivision(s) agree that any recount shall take place at the office of the
Elections Administrator, and that the Elections Administrator shall serve as Recount
Supervisor and the Political Subdivision’(s) official or employee who performs the duties of a
secretary under the Texas Election Code shall serve as Recount Coordinator.
b) The Elections Administrator agrees to provide advisory services to the Political
Subdivision(s) as necessary to conduct a proper recount.
XVIII.RUNOFF ELECTION
The Political Subdivision(s) shall have the option of extending the terms of this agreement
through its runoff election, if applicable.
a) In the event of such runoff election, the terms of this agreement shall automatically extend
unless the Political Subdivision(s) notify the Elections Administrator in writing within 10 days
of the original election.
b) The Political Subdivision(s) shall reserve the right to reduce the number of early voting
locations and/or Election Day voting locations in any runoff election.
c) If necessary, any voting changes made by the Political Subdivision(s) between the original
election and the runoff election shall be submitted by the authority making the change to
the U.S. Department of Justice for the preclearance required by the Federal Voting Rights
Act of 1965, as amended.
d) Each Political Subdivision(s) agrees to order any runoff election at its meeting for
canvassing the votes and to conduct its drawing for ballot positions at or immediately
following such meeting in order to expedite preparations for its runoff election.

GENERAL PROVISIONS

Nothing contained in this contract shall authorize or permit a change in the contract with whom
or the place at which any document or record relating to the Joint General Election on May 17,
2016, is to be filed or the place at which any function is to be carried out, or any
nontransferable functions specified under Section 31.096 of the Texas Election Code.
In the event that legal action is filed contesting the Political Subdivision(s) election under Title
14 of the Texas Election Code, the Political Subdivision(s) shall choose and provide, at its own
expense, legal counsel for the County, the Elections Administrator, and additional election
personnel as necessary.
Nothing in this contract prevents the Political Subdivision(s) from taking appropriate legal
action against any other Political Subdivision(s) and/or other election personnel for a breach of
this contract or a violation of the Texas Election Code.
The Political Subdivision(s) agree that under the Constitution and laws of the State of Texas,
neither DeWitt County nor the Political Subdivision(s) can enter into an agreement whereby
either party agrees to indemnify or hold harmless another party; therefore, all references of
any kind, if any, to indemnifying or holding or saving harmless for any reason are hereby
deleted.
This agreement shall be construed under and in accord with the laws of the State of Texas, and
all obligations of the Political Subdivision(s) created hereunder are performable in DeWitt
County, Texas.
In the event of one or more of the provisions contained in this Agreement shall for any reason
be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or
unenforceability shall not affect any other provision hereof and this agreement shall be
construed as if such invalid, illegal, or unenforceable provision had never been contained
herein.
The Political Subdivision(s) shall comply with all applicable laws, ordinances, and codes of the
State of Texas, all local governments, and any other Political Subdivision(s) with local
jurisdiction.
The waiver by any party of a breach of any provision of this Agreement shall not operate as or
be construed as a waiver of any subsequent breach.
Any amendments of this agreement shall be of no effect unless in writing and signed by the
Political Subdivision(s) hereto.
The Elections Administrator shall file copies of this contract with the DeWitt County Treasurer
and the DeWitt County Auditor in accordance with Section 31.099 of the Texas Election Code.

letter of representations on file with the depository trust company, delegating the authority to
certain members of the City Council and City Staff to approve and execute certain documents
relating to the sale of the bonds; and providing and effective date.\

5. Presentation and Recognitions:
5.1. Cuero Main Street Annual Report.
Main Street Director Morgan Rath presented Council the 2015 Annual Main Street
Report.
5.2. Annual Report from Turkey Fest of use of Hotel/Motel funds.
Turkey Fest Representatives Annette Rath and Cory Thamm presented Council
with 2015 Turkey Fest Annual Report.
5.3. Annual report from Cuero Heritage Museum of Hotel/motel tax use
Wayne Adicks presented Council with the 2015 Annual Heritage Museum report.
6. Public Hearing: opened 6:31
6.1. Public Hearing on a request for a zoning change from R-1 residential to C-1
Commercial use for property located at 302 E. Live Oak. Applicant is Darlene Bomba-Sager.
Darlene Bomba-Sager presented her proposal to Council as to why she feels her
property should be rezoned to commercial. She stated she has had a hair salon business for

thirty years and now is hoping to sell the property and feels it would sell better if it is zoned
commercial as there is commercial around it and it being so close to the court house.
Reverend Bill Cottman spoke against changing the zoning to commercial due to the
residents east of the property and the church.
Opened public hearing at 6:35 p.m.
6.2. Public Hearing on a zoning change from NC-R1, Neighborhood Conservation
Residential Estate to C-1, General Commercial, and a preliminary and final replat of property
located at 101 W. Heaton Street for the purpose of construction a gas station/convenient store
servicing both tractor trailers and standard vehicular customers. Applicant is Brian Dlugosch.
Donald Oroien, ADA Consulting Group, Inc. representative for Brian Dlugosch,
presented to Council the plans for construction a service station/convenience store at the
corner of Heaton Street and Esplanade Street. Two lots are zoned residential and will need
to be rezoned commercial. The remaining three lots will be replatted to make one large
parcel of four acres. A detention pond will be installed; hours of business will be 5:00 am to
12:00 am. .
Rudy Osequda, 201 Clarence St., owns property behind the proposed project and
was concerned about the sewer line which is always having trouble. City Manager Raymie
Zella stated that the sewer line would be replaced. His other concern was lighting and
Robert Stoddard advised that the lighting would be according to ordinance which will not
allow flooding to surrounding properties.

7. Ordinances - Emergency Reading
7.1. Discuss/consider and possible action on Ordinance No. 2016-03, budget amendment
of FY Budget 2015-2016.
Connie Hawes, Finance Director, presented the first budget amendment to Council.
Motion made by Councilmember Johnson, seconded by Mayor Pro Tem Matthys, to
approve Ordinance No. 2016-03 Budget Amendment. The motion was approved
unanimously.
8. First Reading of an Ordinance
8.1. Discuss/consider and possible action on first reading of Ordinance No. 2016-04
Authorizing the issuance of “City of Cuero”, Texas General Obligation
Refunding Bonds, “Series 2016”. Levying an annual Ad Valorem Tax
within the limitations prescribed by law, for payment of the bonds;
prescribing the form, terms, conditions and resolving other matters
incident and related to the issuance, sale and delivery of the bonds,
including the approval and distribution of an official statement pertaining
thereto; authorizing the execution of a paying agent/registrar agreement, a
purchase contract and an escrow deposit letter; complying with the letter
of representations on file with the depository trust company; Delegating
the authority to certain members of the City Council and City Staff to

approve and execute certain documents relating to the sale of the bonds
and providing and effective date.
Anne Burger Entrekin, from Norton Rose Fulbright, presented to Council
and stated that the best rate is 3.27% which she said was very good. Motion
made by Councilmember Johnson, seconded by Councilmember Allen, to
approved Ordinance 2016-03, General Obligation Refunding Bonds. The
motion was approved unanimously.
8.2. Discuss/consider and possible action on first reading of an Ordinance No. 2016-05
requesting to close a portion of the 400 block of W Prairie running in an
Easterly/Westerly direction between part of Block 51 and lots 3,4, and 5 Block 56 Cuero
Addition to the City of Cuero, with the Northern boundary of said street running along
the Southern boundary of Block 51 Cuero Addition and the Southern boundary of said
street running along the Northern boundary of Lots 3 through 5, Block 56, Cuero
Addition.
Motion made by Mayor Pro Tem Matthys, seconded by Councilmember Johnson, to
approve Ordinance No. 2016-05 closing of 400 block of Prairie Street. This is only
closing, not vacate o abandon. The motion was approved unanimously.
8.3. Discuss/consider and possible action on first reading of Ordinance No. 2016-06,
request for a Zoning Change from NC-R1, Neighborhood Conservation Residential
Estate to C-1, General Commercial, 302 Live Oak.
Motion made by Councilmember Glover, seconded by Councilmember Fuqua, to
approve the first reading of Ordinance No. 2016-06, a Zoning Change from NC-R1,
Neighborhood Conservation Residential Estate to C-1, General Commercial, 302
Live Oak. The motion was approved unanimously.
8.4. Discuss/consider and possible action on first reading of Ordinance No. 2016-07,
request for a change of zone from NC-R1, Neighborhood Conservation Residential to C1, General Commercial for 101 W. Heaton St, Cuero, TX.
Motion made by Councilmember Glover, seconded by Mayor Pro Tem Matthys, to
approve the first reading of Ordinance 2106-07, change of zone from NC-R1,
Neighborhood Conservation Residential to C-1, General Commercial for 101 W.
Heaton St. Motion was approved unanimously.
8.5. Discuss/consider and possible action on first reading of Ordinance 2016-08, request
for a preliminary and final plat for 4.311 acres, Lot 1, Texan-Cuero Subdivision, 101 W.
Heaton Street.
Motion made by Councilmember Allen, seconded by Councilmember Fuqua, to approve
the first reading of Ordinance No. 2016-08, preliminary and final plat for 4.311 acres, Lot
1, Texan-Cuero Subdivision, 101 W. Heaton Street. The motion was approved

9. Resolutions
9.1. Discuss/consider and possible action on Resolution No. 2016-04 awarding bid for
new restrooms at the Boys and Girls Club.
Motion made by Councilmember Allen, seconded by Councilmember Johnson, to
approve Resolution No. 2016-04, awarding the bid for the new restrooms at the Boys
and Girls club to A&A Constructors, Inc. The motion was approved unanimously.
9.2. Discuss/consider and possible action on Resolution No. 2016-05, awarding the bid
for the Museums air conditioning/heating projects.
Motion made by Councilmember Allen, seconded by Councilmember Johnson to
approve Resolution No. 2016-05 awarding the bid for Museums air
conditioning/heating projects to Jahn Refrigeration. The motion was approved
unanimously.
10. Council Consideration and Action Items
10.1. Discuss/consider and possible action on software for the Golf Pro Shop.
Parks Supervisor David Danish presented information to Council on new software for the
golf pro shop which would allow for charges to be made by members for items and pre
scheduling for T-Times and better track for inventory.
Motion made by Councilmember Allen, seconded by Councilmember Hedrick, to
authorize the purchase of the software for the Pro Shop. The motion was approved
unanimously.
10.2. Discuss/ consider and possible action to call for bids for repairs to the Hike and
Bike (Walking) Trail in Cuero Municipal Park
Work consists of cleaning and milling areas at crossings to match existing surface,
applying a tack coat and 1 ½ inches of compacted hot mix asphalt surface and rolling.
8930 linear feet X 8 foot wide=71,440 square feet.
Motion made by Councilmember Johnson, seconded by Councilmember Allen to
authorize requesting bids for repairs to the Hike and Bike Trail. The motion was
approved unanimously.
10.3. Discuss/ consider and possible action to call for RFP's from Architect's for
renovations to the existing library.

Motion made by Councilmember Hedrick, seconded by Councilmember Allen, to
authorize asking for RFP’s for renovations to the exiting Cuero Library. The
motion was approved unanimously.
10.4. Discuss/ consider and possible action calling for bids for adding new sewer lines in
recently annexed areas along Old Yoakum Road and an area along North Terrell Street
behind the Cuero Hospital.
Motion made by Councilmember Allen, seconded by Councilmember Johnson to
authorize calling for bids for adding new sewer lines in recently annexed areas along

10.5. Discuss/consider and possible action to call for bids for seal coating of streets and
road repairs in annual Maintenance.
Motion made by Councilmember Allen, seconded by Mayor Pro Tem Matthys to
authorize calling for bids for seal coating of streets and road repairs in annual
Maintenance. The motion was approved unanimously.
10.6. Discuss/consider and possible action on cost sharing for curbs and gutters within
the city.
City Attorney, James Crain explained option to Council stating that if the City was to
allow payout for curb and gutters it should be an assessment. It can be done as a charter
revision or pass by ordinance.
Motion made by Councilmember Fuqua, seconded by Mayor Pro Tem Matthys to
authorize city attorney to prepare something for doing an assessment. The motion
passed unanimously.
11. Reports
11.1. City managers report
1. Update on Wastewater Treatment Plant and TCEQ Inspection.
Reported that it is up and running. TCEQ inspection was excellent.
2. Scenes for Christmas in the Park
Two scenes will be remaining up all year. Veterans and Flag.
3. Recycling at collection center.
Reported that cardboard recycling may be turned over to TDS. Cost to bale it is too
costly.
11.2. Discuss/consider procedures taken for the conditional use permit issued for the McDonalds
properties.

Building Supervisor, Robert Stoddard, gave full detail as to the procedure used for the
allowing of the McDonalds sign to remain in its present location.
February 2014 Council adopted the Interim Ordinance 2014-08 which allowed for a DRC
(Development Review Committee) to be formed while the (UDC) Unified Development
Code was being prepared. The committee consists of department heads for the street
department, water/wastewater department, electric department, Planning and Zoning
Chair, City Manager, fire department and Building supervisor and not requiring to be an
open meeting.
February 2015 the UDC was adopted and the Interim Ordinance went away.
According to the UDC not all permitting of building or signs are required to go to Planning
and Zoning or Council.

7:48 Council reconvened
Attorney Brian Cromeens spoke regarding the McDonalds sign and asked that Council
revoke the conditional use permit and redo the procedure used to approve the sign
remaining on the former McDonald property.
Jeff Steen asked Council to reconsider and redo the process in the public.
12. Consent Agenda: Motion made by Councilmember Glover, seconded by Councilmember
Johnson to approve the Consent Agenda. The motion was approved unanimously.

It’s time for the City of Cuero Annual Easter Egg Hunt!
The City of Cuero would like to invite you to the 17th Annual Easter Egg Hunt, Saturday, March
26, 2016 at 10:00a.m. This year the event will be held on the #1 soccer field in Cuero
Municipal Park. We will have activities set up around the area for the children.
-All children participating in the hunt will be given a wristband.
-The Easter Bunny will be available for pictures from 10:30a.m. – 11:30a.m.
-We will have music and activities including: hot boiled egg, inflatables, duck pond, bean bag
toss and more.
-Activities will be from 10:00a.m. – 12:00 p.m.
-Easter Egg Hunt will begin at 12:00 p.m.
-Refreshments will be served.
