Advocacy Report

he 2009 Florida League of Cities Advocacy Report
highlights key legislation considered this past legislative
session that preempts, or would have preempted,
municipal Home Rule authority. Included in this report
are the House and Senate sponsors, co-sponsors and key votes
on several issues considered this past session that specifically
impacted city government.
In addition, enclosed is a list of House and Senate members with
the cities they represent. This information was compiled to serve as
a tool for municipal officials to use in the interim to better educate
House and Senate members on the impacts these bills could have
on your city.
The Advocacy Report is one of a series of publications the League
produces to inform municipal officials on the 2009 legislative
session as it relates to cities. Other publications include: post
legislative session articles in the May/June issue of the Quality
Cities magazine and the Legislative Final Report, which summarizes
key legislation that passed and failed this session.

Impact Fees – Passed
CS/CS/HB 227 is an unfunded mandate because it reduces the authority of local governments to impose impact fees. This legislation
eliminates the presumption of correctness for impact fee ordinances and the authority of courts to give deference to them when they are
challenged in court. The bill shifts the burden of proof to the government to prove by a preponderance of evidence that the amount of
the fee and its imposition meet the requirement of state legal precedent.

Non-Homestead Cap and First-Time Homebuyers Exemption – Passed
SJR 532 proposes a constitutional amendment for the 2010 general election ballot that would limit the assessment growth on commercial and residential rental property to 5 percent. The bill also provides first-time homebuyers a property tax exemption equal to 25
percent of the property’s just value, not to exceed $100,000 in the first year. The amount of the exemption is reduced by 20 percent
each succeeding year.

HJR 1263/ SJR 1906 proposed a constitutional amendment to limit the collection of revenues by state and local governments. Revenue growth for state and local governments would have been capped by changes in population and inflation, plus a multiplier for growth.
Though the legislation did not pass the Legislature, HJR 1263 did pass the House Military and Local Affairs Policy Committee and SJR
1906 passed the Senate Community Affairs Committee.

1.35 Percent Property Tax Cap – Did Not Pass
HJR 385 (Rivera) and SJR 738 (Bennett) proposed a constitutional amendment that would have restricted the aggregate taxation
on a parcel of real property to 1.35 percent of the property’s taxable value. If placed on the ballot and passed by the electors, it would
mean that municipalities, counties, school boards and special districts would only be able to levy 13.5 mils to any piece of property in the
aggregate. This legislation did not pass the Legislature, but HJR 385 passed the full House and SJR 738 passed the Senate Community
Affairs Committee.
