Description of Property
The original developer plans were to create a unique waterfront development
community.
While the upland development was completed and transferred to the
condominium association, the developer still holds the riparian rights to the waterfront (via
an exclusive easement), and marina related property and offers the following exclusive
opportunity.
The property is located within the Alta Mar Condominium residential community
located on State Road 80 / Palm Beach Boulevard, with the benefit of fronting both the
Caloosahatchee River and Billy's Creek with easy access to the IntercoastalWaterway (ICW).
This offering includes a 1,200 square foot commercial condo unit that was originally
designed to serve as a harbormaster's unit. The unit includes two full-service bath rooms,
one standard bathroom, and a laundry room. The unit is currently in gray shell condition
with the exception of the bath/shower/laundry portion.
The purchase of the commercial unit will transfer all rights to 109 permitted wet slips.
Fifty one (51) slips are reserved for sale to residents of Alta Mar, and 58 that are designated as
public use slips, all subject to the terms of the state submerged land lease.
Purchase of the marina also includes 72 designated spaces in the parking garage.
Obligations of Purchaser
The purchaser would be obligated to finalize the submerged land lease prior to
construction of the marina. Refer to the memorandum prepared by Hans Wilson, P.E.
regarding the status of the lease and related issues tied to the marina and use of the
sovereign state submerged lands.
Currently there are special conditions that must be complied with prior to the State
releasing the approved submerged land lease.

Subject: Alta Marina, LLC – Marina Status
Below is the status of the proposed project. Currently Tarragon Corporation is
seeking to sell the marina. The asking price is $2.5 million.
All state and federal regulatory permits have been issued regarding the marina.
There are 109 wetslips currently permitted: 51 private and 58 public. The
Department of Environmental Protection (DEP) permit was issued on September
20, 2007 and expires on September 20, 2012. The Army Corps of Engineers
(COE) permit was issued on October 10, 2007 and expires on October 10, 2012.
A City of Ft. Myers building permit is still needed prior to the commencement of
construction.
A submerged land lease from the state is still pending resolution of the
unauthorized fill parcel. As of now there is currently no temporary use agreement
from the Board of Trustees. In order to obtain a submerged land lease the issue
of the illegal fill on the northwest corner of the property on Billy’s Creek must be
resolved.
In order to resolve the issue of illegally filled state lands the filled area will have to
be purchased from the state. The area at issue will need to be surveyed by a
certified surveyor. Once the survey is prepared and an appraisal is completed by
a state approved appraiser, the land may be submitted for purchase to the
Governor and Cabinet, sitting as the Trustees of the Internal Improvements Trust
Fund. This will allow for a submerged land lease to be issued. Also, as a
condition of the lease, a conservation easement must also be established on the
property. The conservation easement description and drawings must also be
prepared by a professional surveyor.
Once this is complete, there would be a short sequence of events needed to
complete the entitlement process for the marina prior to construction.
