Contract & Progress Payment
Contract & Progress payment structure for House and Land
All purchases at Creation Homes will be made on a split contract structure. A split contract is where the purchaser
signs two contracts, one for land and one for the house.
Land Contract – the land contract is a traditional real estate contract, where there is:1. A deposit required on contract signing off 5% / 10%.
2. A finance clause that states when the purchaser must have finance in place.
3. A settlement date on the land contract, that will be a certain number of days from the date upon which the
develops solicitors advise the purchaser’s representatives that the plan of subdivision is registered and the titles
have issued. Settlement occurs on the nominated settlement date, and the title of the lot is transferred to the
purchaser’s name.
House Contract – the house contract is a Housing Industry Association (HIA) issued contract with
amendments. It is signed at the same time as the land contract. It has:1. A requirement for signing in full on a number of pages, and initials on all pages.
2. All drawings and specifications must be signed as well
3. There is a requirement for a deposit to be paid on contract signing of 5% of the contract
price
4. On completion of certain stages, progress payments need to be made to the
builder in the following manner
a. Slab Completion 10% (of the contract price)
b. Frame Completion 20%
c. Lock up Completion 35%
d. Fix out completion 20%
e. Final 10%
*The purchaser understands that due to planning approvals they are unable to make changes to the
plans, both internally and externally.
Progress Payment Structure
This is an easy process as the purchaser’s lender will have structured the loan to
match this payment process; it works in the following manner:
1. Creation Homes completes the relevant stage (5 stages in total)
2. Each stage is inspected and approved by a building surveyor
3. Creation Homes then issues a progress claim invoices to the client.
4. The client approves payment and sends to their bank to payment
5. The bank makes the payment direct to Creation Homes, from the already approved
building loan.
6. This process occurs within 7 days
FAQ
Q: Is the Landscaping included?
A: Yes, landscaping to the front, rear and sides.
Q: Is the driveway included?
A: Yes, driveways are included.
Q: Is fencing included?
A: Yes, fencing is included to the side and rear of the property. Fencing
requirements are in line with the planning and design guidelines for
the development.
Q: Can I make changes to the Façade, look & colours?
A: No, our design team went to extensive lengths to ensure that
each façade is unique to each home and has been designed
to meet the stringent guidelines of the development.
Market trends, quality and affordability are also taken
into consideration during the design process – ultimately
offering you a quality finish at the right price. It also may be
a requirement under the planning permit, that changes cannot be
made on products.
Q: Can I make changes to the plan?
A: No, your home has been designed to meet planning and developer guidelines. We
also consider factors such as maximising the design in order to maximise returns for
the investor and therefore, increase the enjoyment of the occupier.
Q: Can I visit the site during construction?
A: No, there is no need for you to visit! To ensure peace of mind we out source independent inspections and
reports by a qualified building inspector during construction. We will also keep you informed with progress
with emails throughout the building process. For workplace health and safety reasons we advise against visits.
When we have received your certificate of occupancy you will have the opportunity to visit the site with a Creation
Homes Representative where we will present your new property to you.
Q: I would like to do the painting of the inside myself. Am I able to do that?
A: No. Creation Homes stands by their reputation for workmanship and quality and also ensures our on-site trade’s people are
experienced and qualified. This ensures that your certificate of occupancy is granted and your build quality is up to standard. Coupled
with our buying power, we are able to provide a first rate finish at a reasonable cost.
Q: Will my new property meet all building standards and requirements?
A: Yes it sure will. Your property has been designed to meet Victorian Building Standards and will be constructed to meet the Victorian Building Codes and Practices.
Q: What does ‘Turn Key Product’ mean?
A: Your home comes complete! No need to worry about extra money for driveways or fencing or landscaping. By referring to our extensive inclusions list you can see it’s just
a matter of turning the keys and moving in the furniture.
Q: Is this a fixed price contract?
A: Yes, the contract you sign is the price you pay; you won’t be charged with additional hidden costs.
