TomatoFest Moving to Downtown Auburn
Auburn, NY — TomatoFest is moving to downtown Auburn. Emerson Park has hosted the event for the past three
decades. This year, the 31st annual TomatoFest will still take place the first weekend after Labor Day, and will still feature
a buffet of music, children’s activities, food vendors and more. With the assistance of a $3,000 Finger Lakes Community
Arts Grant for its MusicFest, the event will also feature more bands than ever on four stages. It hosted 28 on three stages
in 2015.
TomatoFest board member Gilda Brower said the location will likely be a closed-off section of Genesee Street between
South and William Streets and will also include the neighboring section of State Street. Prison City Pub & Brewery will
host a new Brew Run 5K Race at 4 p.m. Saturday, Sept. 10. Brower said Prison City owner Dawn Schulz has pledged
to donate proceeds from the run to area food pantries. The brewpub will also host a concert at that time — possibly
outdoors, Brower said. Other new additions to TomatoFest may follow.

Unity House Seeks Nominations
Auburn, N.Y. — Nominations are now being accepted for the 6th annual Fred Atkins Community Service Award. This
award is given by Unity House each April in memory of Frederick J. Atkins, a beloved Cayuga County volunteer who
passed away in 2009 at the age of 95. The award recognizes an outstanding individual who volunteers in Cayuga County
and who exemplifies Fred’s high moral standards and philanthropic spirit. The winner receives a $250 cash prize, and
$250 to donate to a Cayuga County non-profit of his or her choice. Award will be made at Unity House’s annual board
dinner on April 25. Nominations are due by 5:00 pm on Monday, March 7. Learn more and find the nomination form at

Unity House 3rd Annual Art Flaire Now Part of Founder’s Day
Auburn, N.Y. — Unity House of Cayuga County seeks high-end artists and crafters to
exhibit and sell their artwork at the 3rd annual Art Flaire fundraising event. This year,
the fair will be part of Auburn’s downtown Founder’s Day celebration, Saturday, August
13, 10:00 a.m. to 4:00 p.m. in the Market Street Park across from Hunter Diner. A 10’x10’ booth space costs $60, and
applications are due by Friday, July 22. If applications with payment are received by March 15 with a silent auction
donation pledge, the booth fee will be reduced to $45. All proceeds from Art Flaire will benefit Unity House and the

Auburn, N.Y. — Champions for Life is hosting a Health and Wellness Seminar Series with speakers from all aspects
of the field. The next seminar topic will be “Medical Weight Loss” and will be held on Tuesday, March 1, from 6:30 to
8:00 p.m. April 5, May 3, and June 7 seminar topics will be “Developing a Healthy Lifestyle,” “Nutrition for Health and
Wellness,” and “Tying it all Together: Where do I go from here?” respectively. All seminars take place at Champions
for Life, 453 Grant Ave., Auburn. Registration is required at $5 per seminar. Each participant will receive a one-day
pass for the Fitness Center at CFL and a fitness center orientation from Amy Spin.

Open Enrollment, Ongoing Enrollment and Special Enrollment Periods: What’s the Difference?
The annual open enrollment season for obtaining health insurance through the Individual Marketplace has just ended. While opportunities for enrolling in coverage are currently limited,
there are still some options available. This month’s Navigator News article describes three different types of enrollment periods.
Open Enrollment is a defined period of time in which a person can enroll in health insurance.
For people who have employer-sponsored plans the open enrollment period will take place once
a year, based on the initial date the employer originally signed up for the insurance, and typically lasts for one month. Those who have or need insurance on the Individual Market and don’t
meet certain qualifications must be sure to renew/enroll during the Individual Market open enrollment period. For 2016 coverage, this three-month window of opportunity began on November 1, 2015 and concluded on January 31, 2016.
Ongoing Enrollment is available all year long for certain situations. Small employers who
haven’t offered coverage and now wish to provide this benefit to employees can enroll their
qualifying business at any time. Individuals who qualify for programs such as Medicaid and the
new Essential Plan can also enroll all year long. Children may be enrolled in Child Health Plus
at any time.
Special Enrollment Period, or SEP, refers to a specific enrollment opportunity that is triggered
by a qualifying life event. This enrollment period is usually 30 days for employer plans and 60
days for the Individual Marketplace. It’s very important to notify your employer or the Marketplace within the specified window, or the opportunity will be missed.
Examples of Qualifying Life Events:
 Getting Married
 Having a baby/Adopting a child
 Becoming a Citizen, National or lawfully present individual
 Moving to New York State, or within the state when it affects your health insurance
coverage area
 Becoming newly eligible or ineligible for Advance Premium Tax Credits (must already be enrolled in a Qualified Health Plan through NYSOH)
 Losing health insurance with minimum essential coverage for the following reasons:
 Lost Job
 Divorce
 No longer eligible to be on parent’s plan (e.g. turning 26)
 COBRA coverage expired
Losing coverage due to non-payment or voluntary termination does not qualify!

EXCLUSIVE: BUSINESS COUNCIL PREVIEWS LEGISLATIVE AGENDA FOR 2016
As lawmakers return to Albany, the state’s biggest business lobbying group is preparing to fight back against a
proposal to raise the minimum wage and push for policies benefiting employers.
Top priorities include tax cuts for small business, parity for upstate New York on infrastructure spending and
expanding employer-focused education programs.
One of the most important issues remains keeping state spending in check, said The Business Council of New
York State Inc. President and CEO Heather Briccetti in an exclusive interview previewing the group’s agenda.
“We’ve had some experiences where state spending has gotten out of control, and typically that gets funded by
increased taxes,” Briccetti said. “That’s always going to be on the top of our list.”
Small business tax reform - The council is targeting small businesses for tax cuts this year — a call that Gov.
Andrew Cuomo appears to have partially heard with a proposal to expand an exemption for personal income tax
to more businesses.
“Any small business should enjoy a reduction in taxes regardless of how an entity is formed,” Briccetti said. “You
should not be excluded from a tax reduction because you’re not incorporated.”
Cuomo’s proposal excludes businesses making more than $390,000 in net income if they are incorporated. If a
business has more than $1.5 million in gross receipts, owners won’t be eligible for an expanded personal income
tax exemption.
His proposal would lower the corporate tax rate for small businesses with fewer than 100 employees and less
than $390,000 in net income. It also includes partnerships, LLCs and S-corporations in a personal income tax
exemption for people claiming less than $250,000 on their individual taxes. That exemption would be increased
to 15 percent from 5 percent.
Infrastructure - Ensuring the historical parity between upstate and downstate infrastructure spending is another
priority. Briccetti said recent developments with state funding for the MTA and new Tappan Zee bridge have
thrown off that balance.
The Business Council supports using one-time payments from state legal settlements for roads, bridges, water
and sewer projects.

BUDGET ADDRESS
ALBANY, N.Y.—“Governor Cuomo has laid out an ambitious agenda that includes many legislative proposals
championed by The Business Council of New York State,” said Heather C. Briccetti, president and CEO of The
Business Council of New York State, Inc. “We are particularly pleased that the Governor has once again kept
spending growth at or below 2 percent. We are also looking forward to ensuring the Governor’s small business
tax cut proposals are enacted and the Property Tax Cap is not weakened. Despite these and other positives, we
remain adamantly opposed to the Governor’s proposal to raise the wage for entry-level workers to $15 an hour.
Its impact will be especially significant among young and low-skilled workers seeking entry-level jobs, and in
areas upstate that have yet to recover losses sustained during the Great Recession. The Business Council also
has real concerns about the proposed paid leave mandate on employers. While we reserve judgment until the
full details are released, we believe this mandate would be particularly harmful to the same small businesses
the Governor is supporting through other budget initiatives. Today is the
beginning of negotiations over the 2016-17 Executive Budget, and we will
have much more to say as we go over its details and work with the Governor
and the Legislature to enact pro-growth, pro-business legislation supported
by our members.”

EMPLOYERS MUST POST OSHA 300A INJURY/ILLNESS SUMMARY FROM
FEBRUARY 1 THROUGH APRIL 30
It’s that time of year again, when OSHA requires covered employers to annually complete an OSHA Form
300A “Summary of Work-Related Injuries and Illnesses,” to summarize the number of work-related injuries
and illnesses that occurred in the workplace during the previous calendar year that were logged on the OSHA
300 Form. The completed OSHA Form 300A for 2015 must be certified by a Company Executive, and be
conspicuously posted in the workplace where notices to employees are customarily posted, until April 30.
A separate OSHA Form 300A must be completed for each establishment, or worksite, that is expected to be in
operation for one year or longer.

Covered employers must post the form, even if there were no recordable injuries or illnesses in 2015, by placing
a zero on each bottom line. A copy of the form should be made available to employees who do not report to any
fixed worksite, or who travel from worksite to worksite.
Organizations with 10 or fewer employees during all of 2015, religious organizations, and certain low-hazard
industries, are normally exempt from OSHA’s general recordkeeping and posting requirements, and do not have
to complete or post the OSHA Form 300A. However, due to changes in OSHA’s recordkeeping requirements that
went into effect last year, certain previously exempt industries are now covered.

During the morning, Auburn Superintendent Jeff Pirozzolo
presented Auburn’s new P-Tech program. Auburn High School
technology teacher Kevin Casler introduced some of the students
enrolled in P-Tech. Students in this six year program will earn
a high school diploma and an associate degree from Cayuga
Community College. This public/private partnership will prepare
local students with the education and training to fill technical jobs
available in our area.
From the younger set, first and second graders from JordanElbridge demonstrated their ability to write code, as part of
the nationally-based “Hour of Code” initiative. This computer
skill can be a step up into future employment and educational
opportunities. J-E Elementary Principal RJ Hartwell and teacher
Tracy Fanning accompanied the students.
Moravia Superintendent Michelle Brantner and BOCES Assistant Superintendent for
Curriculum Jessica Docteur joined forces to present Removing Barriers to Education:
The Face of Education in Cayuga County 2016. They discussed the impact of poverty
on learning, the Common Core and fiscal challenges and how local districts are
navigating challenges and celebrating successes.
Weedsport Board of Education President Eric Zizza was
joined by Auburn Board Member Kathy Rhodes to talk to
the class about school board service.
Leslie Rose McDonald, Founder and President of Pathfinders CTS, Inc. presented
a workshop during the afternoon entitled EMOTIONAL INTELLIGENCE IN ACTION: Leveraging EQ for Greater
Business and Career Success. Incorporated into the presentation was the work of Daniel Goleman, and research that tells
us the value of emotional intelligence in
the workplace and other relationships.
