The Quesadilla Exlposion
The quesadilla has become the new sandwich, panini, sub or po-boy. Just about anything goes as long as you have a little cheese
to hold it together. Take a couple of tortillas
and add anything you like in between the two.
It’s not just chicken and cheese any more.
Gourmet it up with a little brie and apples
or make it a southern treat with some BBQ
sauce; and bacon just makes anything taste
better in my opinion! Quesadillas are a creative quick way to give new life to left overs
from the night before. Left over chicken? It’s
quesadilla time! I always have tortillas on had
for that last minute dinner decision. Here are
a few ideas to change up your dinner tonight.

about who loves his team more. The Redskins
fan insists he is the most loyal. 'This is for the

the mountain. Not to be outdone, the Eagles fan
shouts, 'This is for the Eagles!' and throws
himself off the mountain. The Ravens fan is next
to profess his love for his team. He yells, 'This is

Annual Military Care Package Event
a total of
2000 care
packages,

Please start
gathering

to
ship to the
Troops, this
year
our
goal is 2500
packages
which means over 50,000 pounds of supplies and also in
the area of $30,000 to ship packages, so anything you can
do to help us raise funds, spread news about the event and
encourage community groups, schools, scouts to start organizing collections is welcome. This year there will be a $5
donation at the door with all funds going directly to shipping
these care packages to Our Troops over in Korea, Iraq, Afghanistan, on the seas and on the line protecting US.
One of the most active programs BOTG-NY has is our
care package program. We regularly acquire the names of
deployed military members who are furthest from the available resources. As PXs and other supply lines close, more
and more of our men and women are having trouble finding
the basic necessities. BOTG-NY collects toiletries, snacks,
and other supplies for which we receive requests directly
from the front lines, packs the items along with notes of
thanks and support, and mails them to the individuals serving in harm’s way. For $15, you can sponsor the shipping for
one of our care packages. This small investment provides a
value beyond measure to the recipient. Won’t you help? To
make a donation please go to www.BootsonthegroundNY.

If you would like to include a brief note of support in your
care package, please use the “Order Notes” section upon
check out. Thank you!

Glaucoma
Awareness Month
Glaucoma is a complicated
disease in which damage
to the optic nerve results
in vision loss. Glaucoma
is a very misunderstood
disease. Often, people don’t
realize the severity or who is
affected.
Four Key Facts About Glaucoma
1. Glaucoma is a leading cause of blindness
Glaucoma can cause blindness if it is left untreated. And
unfortunately approximately 10% of people with glaucoma
who receive proper treatment still experience loss of vision.
2. There is no cure (yet) for glaucoma
Glaucoma is not curable, and vision lost cannot be
regained. With medication and/or surgery, it is possible to
halt further loss of vision. Since open-angle glaucoma is a
chronic condition, it must be monitored for life. Diagnosis is
the first step to preserving your vision.
3. Everyone is at risk for glaucoma
Everyone is at risk for glaucoma from babies to senior
citizens. Older people are at a higher risk for glaucoma but
babies can be born with it (approximately 1 out of every
10,000 babies born in the United States). Young adults
can get glaucoma, too. African Americans in particular are
susceptible at a younger age.
4. There may be no symptoms to warn you
With open-angle glaucoma, the most common form,
there are virtually no symptoms. Usually, no pain is
associated with increased eye pressure. Vision loss begins
with peripheral or side vision. You may compensate for this
unconsciously by turning your head to the side, and may
not notice anything until significant vision is lost. The best
way to protect your sight from glaucoma is to get tested. If
you have glaucoma, treatment can begin immediately.
Symptoms of Angle-Closure Glaucoma
• Hazy or blurred vision
• The appearance of rainbow-colored circles around
bright lights
• Severe eye and head pain
• Nausea or vomiting (accompanying severe eye pain)
• Sudden sight loss
Angle-closure glaucoma is caused by blocked drainage
canals in the eye, resulting in a sudden rise in intraocular
pressure. This is a much more rare form of glaucoma,
which develops very quickly and demands immediate
medical attention.
In contrast with open-angle glaucoma, symptoms of
acute angle-closure glaucoma are very noticeable and
damage occurs quickly. If you experience any of these
symptoms, seek immediate care from an ophthalmologist.
If you are diagnosed with glaucoma, it is important to set
a regular schedule of examinations with your eye doctor to
monitor your condition and make sure that your prescribed
treatment is effectively maintaining a safe eye pressure.

FOOTBALL JOKE
FOOTBALL GIRLFRIEND
Tebow, a local football star, is jogging
down the street when he sees a
building on fire. A woman is standing
three floors up on ledge holding her pet cat in
her arms.
'Hey, lady, 'yells Tebow, 'Throw me the cat.'
'No, 'she cries, 'It's too far.'
'I play football, I can catch him.'
The smoke is pouring from the windows, and
finally, the woman waves to Tebow, kisses her
cat goodbye, and then tosses the moggy down
onto the street. Tebow keeps his eye on the cat
as it comes hurtling down toward him. The
feline, bounces off an awning and Tebow runs
into the street and catches the cat. He jumps six
feet into the air and makes a spectacular one
handed catch. The crowd that has gathered to
watch the fire, breaks into cheers. Tebow does
a little dance, lifts the cat above his head,
wiggles his knees back and forth, then Tebow
“spikes” the cat into the pavement.

Ask the Attorney is a monthly column which allows readers to have their
legal questions answered by qualified attorneys. You may submit your questions via email or call the number listed below for immediate answers. All
inquiries are confidential and free. The names of those submitting questions
are changed to ensure anonymity.
QUESTION: I am Trustee of my mother’s Irrevocable
Medicaid Trust. My mother has recently moved to an
assisted living. May I pay her assisted living costs from
the assets in the trust?
ANSWER: The short answer is no; you may not.
In order for a trust to be considered “exempt” for
Medicaid purposes, it must provide that no principal
distributions can be made to the grantor (your mother).
This requirement ensures that if your mother did need
Medicaid to cover the cost of her long term care,
whether at home or in a nursing home facility, the trust
is exempt because its terms forbid distributions back
to your mother. If the terms permitted distributions to
your mother or if the trust were revocable, Medicaid
would consider all assets in the trust as “available” to
your mother if she applied for Medicaid.
You may ask why protecting the assets for Medicaid
is so important. The reason is that Medicaid is the
primary source of payment for long term care in the
state of New York. Nursing home stays average around
$15,000.00 per month. For many, this ongoing cost will
result in the rapid depletion of their resources.
However, Medicaid will pay for the cost of nursing
home care so long as the applicant is financially
eligible. To be financially eligible in 2015, an applicant
can have no more than $14,850.00 in resources. This
resource allowance does not include retirement
accounts which are considered exempt so long as the
applicant is taking equal monthly distributions
according to the life expectancy chart used by the
Department of Social Services in their county. Assets
must be transferred to the trust and out of the applicant’s name for five years or more in order for the
assets to be considered “unavailable” for Medicaid to
cover nursing home care. However, if an individual
needs home care, assets transferred to an irrevocable
trust are considered “unavailable” in the month after
they are transferred. This is because there is no five
year lookback period for home care.
Medicaid Trusts may provide that income, that is, any
interest earned on assets in the trust, be distributed to
your mother. Therefore, to the extent that there is
income earned on the assets, that income may be
distributed to your mother if the terms of the trust so
permit. If the trust does not permit income to be
distributed to your mother, there may be a way to
partially terminate or amend the trust even if it is irrevocable. Consult with an experienced Elder Law
attorney in your area to review your options.
Isolation During Winter Months
Can be Serious for Seniors
Winter weather makes life unpredictable for all of us.
However, when you combine the physical and cognitive
challenges so many seniors face, you truly have serious
possible health and safety issues. Walking outdoors in winter
weather can be treacherous for anyone, especially seniors.
They may be afraid to go out of their home or to tackle the winter
snow or ice to see their friends or family. Seniors that used to be
active and suddenly find themselves unable to go out whenever
they wish can get lonely.
Loneliness, as a result of lack of social contact, is a leading
cause for poor physical and mental health among the elderly
leading to early death. When loneliness sets in it can increase the
risk of high blood pressure, over eating, under eating, excessive
drinking, depression, heart disease and other debilitating
diseases such as arthritis, osteoporosis and glaucoma. People
who are lonely are twice as likely to experience a decline in daily
activities. Health deterioration in the elderly who live alone and
have few visitors is less likely to be noticed and followed up with
medical attention.
Risk Factors for Elderly Loneliness
•
Women are more likely to experience loneliness
•
The older the individual is, the more lonely they may be
•
A person living alone
•
Poor economic situation
•
Poor outlook on health
•
Infrequent contact with relatives and friends
•
Adult children not living in close proximity
Dealing with Loneliness
Below are some ideas for ways to encourage social
interaction between a senior and others.
•
Learn programs like Skype to communicate with family and
friends
•
Keep socially active by joining senior center activities
•
Daily exercise can ward off depression
•
Keep ongoing communication even if it is just a daily 5
minute call
•
Take up a hobby
•
Adopt a pet – pet ownership can reduce feelings of isolation
•
Ask friends and family to visit or call on a schedule so there
is some contact every week
•
Go on outings near other people: movies, shopping,
restaurants, library, etc.
•
Have more family get-togethers
•
Reach out to neighbors, congregation members or former
coworkers you think might be experiencing the season by
themselves. Call them, email them, knock on their doors. A
quick check-in can go a long way.

GRAF CONTINUES 5TH ANNUAL
TOY DRIVE FOR VICTIMS OF
DOMESTIC VIOLENCE
Assemblyman Al Graf (R,C,I-Holbrook) is continuing his holiday toy drive for children who are
victims of domestic violence in our community.
Domestic violence is a major problem that often
goes overlooked in the United States that has only
recently gained more attention due to the publicized acts of high profile athletes and celebrities.
“Domestic violence is a very serious problem that
we are continuing to fight,” said Graf. “Often forgotten
are the children who are displaced when they are torn
from the comforts of their homes while fleeing abusive
situations. Our annual toy drive is a chance to put a
smile on the faces of those children, even though,
for many of them, their true wish during the holidays
is more about their families. I would like to thank the
Omicron Chapter of Kappa Mu Epsilon National
Mathematics Honor Society at St. Joseph’s
College of New York for their wonderful gift of
more than $1,000 in donated toys for our cause. It
is the selfless acts like this that the holidays are all
about.”
Toys will be donated to the Victims Information
Bureau of Suffolk which assists families who are
victims of domestic violence.
Skiing and snowboarding:
Safety tips for families
Skiing and snowboarding are popular winter sports.
But each year, children and adults are injured while
involved in these sports, and sometimes the injuries
are very serious. The number of brain and spinal cord
injuries resulting from skiing and snowboarding is
increasing worldwide.
Safety starts with the right equipment
Wear the proper equipment including a helmet and
goggles, wrist guards for snowboarding. Helmets can
reduce the risk of a head injury. Preventing serious
head injuries is everyone’s job, no matter your age.
Check you and your child’s equipment at the start
of each ski day. You should also teach your child how
to check her own equipment. Many injuries happen
because of poorly adjusted bindings. Release bindings
on skis and snowboards should be adjusted so that
they are right for your child or teen’s weight and skiing
ability.
Don’t borrow equipment. If you don’t have equipment
of your own, rent it from a reputable ski shop or resort,
and make sure that the boots fit and the bindings are
adjusted correctly.

Kappa Mu Epsilon who donated over $1,000 in toys.
SHORT WINTER
JOKE
Prepare before going out
• Check the weather forecast. Dress for the weather.
Wear layers of clothes and pack extra hats and
gloves.
• Take lessons. If your child or teen is new to skiing,
sign him up for lessons with a certified instructor.
• Know the condition of the trails. Don’t ski or
snowboard on trails that are closed or if you don’t
know the conditions.
• Never ski or snowboard alone. Ask older children to
check in regularly with an adult.
• Be aware of physical and environmental hazards
like trees or icy patches on the trail.
• Respect limits. Don’t ski or snowboard on hills that
are above your skill level. Teach your child or teen
that it’s important that he try more difficult slopes
gradually and only as his skills get better.

5 REASONS NOT TO SELL
YOUR HOME YOURSELF
In today's market, with homes selling quickly and prices rising,
some homeowners might consider trying to sell their home on their
own, known in the industry as a For Sale by Owner (FSBO). There
are several reasons this might not be a good idea for the vast
majority of sellers.
HERE ARE FIVE OF THOSE REASONS:
1. THERE ARE TOO MANY PEOPLE TO NEGOTIATE WITH
Here is a list of some of the people with whom you must be prepared
to negotiate if you decide to For Sale By Owner:
• The buyer who wants the best deal possible
• The buyer’s agent who solely represents the best interest of the
buyer
• The buyer’s attorney (in some parts of the country)
• The home inspection companies, which work for the buyer and will
almost always, find some problems with the house
• The appraiser if there is a question of value
2. EXPOSURE TO PROSPECTIVE PURCHASERS
Recent studies have shown that 89% of buyers search online for a
home. That is in comparison to only 20% looking at print newspaper
ads. Most real estate agents have an internet strategy to promote the
sale of your home. Do you?
3. RESULTS COME FROM THE INTERNET
QUOTATIOUS DITTIES
Where do buyers find the home they actually purchased?
• 44% on the internet
• 33% from a Real Estate Agent
• 9% from a yard sign
• 1% from newspaper
The days of selling your house by just putting up a sign and putting it
in the paper are long gone. Having a strong internet strategy is crucial.

my name was SHUT UP.

4. FSBOing HAS BECOME MORE AND MORE DIFFICULT
The paperwork involved in selling and buying a home has
increased dramatically as industry disclosures and regulations
have become mandatory. This is one of the reasons that the
percentage of people FSBOing has dropped from 19% to 8% over
the last 20+ years. The 8% share represents the lowest recorded
figure since NAR began collecting data in 1981.
5. YOU NET MORE MONEY WHEN USING AN AGENT
Many homeowners believe that they will save the real estate
commission by selling on their own. Realize that the main reason
buyers look at FSBOs is because they also believe they can save the
real estate agent’s commission. The seller and buyer can’t both save
the commission.
Studies have shown that the typical house sold by the homeowner
sells for $210,000 while the typical house sold by an agent sells for
$249,000. This doesn’t mean that an agent can get $39,000 more for
your home as studies have shown that people are more likely to
FSBO in markets with lower price points. However, it does show that
selling on your own does not make sense.
