Ata meeting of the Corporate Services Committee held May 25, 2016, Council adopted
procedures for the appointment of a vacancy on Council for Councillor Ward 3 and

Introduction
Hello, I am willing and ready to serve the people of Ward 3. (was the rennet-up in the last municipal
election against Ian Cdchton, 505 votes to 394 (12% percent difference’). I became interested in politics
during Mr. Phi! Sled’s term as mayor, and subsequently entered the Mayoral race in 2010. 1 received over
500 votes. Campaigning isa wonderthl opportunity to meet and greet the people in the community.
Having campaigned twice now in the Township of Severn, (extensively in Ward 3), 1 feel I have a very
good understanding of the people, their needs and the vision of the Township as a whole.
I am currently in my 6& year as a Director on the Severn Township Library Board. This has given me great
insight and experience into the Municipal Government process, niles and procedures. I have a good
knowledge and high respect of the system. I am also the Past President of the Coidwater Heritage Mill
Foundation and the current Secretaiyrrreasurer or the registered not-for-profit Steampunk Festival.
My position as secretasy and co-founder of the Coldwater BIA (2010-2014) has also given me more years
of experience working with a Committee of Council. I currently sit on the beautification committee with
Councilor Jane Dunlop Ward 2. Together we successthlly initiated the flower, flag and tree lights program
to the Main Street of Coldwater. We spent many hours volunteering to bring this project to fruition. The
flower program proved to be contagious, being the cornerstone to many other beautification projects since.
(Archwnys, Christmas tree, ironwork, interlock, and historic picture murals, etc.) All these programs
require volunteer Lime, critical thinking, tenacity, organization, timely execution, and teamwork. isa

The early years:
A mechanic by trade, I worked for Tom Smith Chevrolet out of College. At age 231
purchased a lot in Severn Township and built a house for my family. With the equity
from the house I built in 1987 J purchased a historic building in ncighboring
Waubaushene and became a Landlord. The building was in ill repair and had to be
completely renovated. It now houses 5 low-income rental apartments and was awarded a
historic plaque in 2010 by the Tay Township Historical Society (The Doctor’s House at
49 Elm St.). In 1994,1 became an entrepreneur buying my own hiway truck, hauling
wood chips and over 2 million board feet of pine lumber for pressure treating. From
1996- 2006 1 opened a variety store on the Main Street of Coldwater, raising $75,000.00
for the Lions club through the sale of Nevada tickets.
The middle years:
In 19981 purchased the old high school in Coldwater (12 Haniet St.) and upgraded the
units. Then came the “Subway” building. It was in bad condition with no bathrooms.
20 Coldwater Rd. (2001) was the next pToject purchased (see pica.). This building is an
on-going restoration projecL Next, The CLothes Closet at 9 Coldwater Rd. Took 300
sheets of drywall to restore inside and still needs on-going work. 7 River St. (2002)
housed the old print shop, a business purchased & operated by me (trophies) for 2 years.
This is a historic building (the first telegraph office) and is currently vacant. In 2005
“The Christmas store” was purchased and I exposed the tin ceiling that was buried.
The later years:
In 2008, Emm’s Café building was purchased (Art & Gift Studio). In 2008 the
apothecary historic building was slated for destruction. I made a deal with Jag Kang to
save it and moved it to my vacant lot downtown. (See pies). I met my current partner,
Suzy, who urged me to purchase the Riverside seniors building. $180,000.00 was the
purchase price to the Lions Club (netting them approx. $179,800.00). My understanding
was 113 of this money was re-directed to Bathe Hospital for a MM machine. We then
did extensive renovations and turned it into an ice cream shop. This building is rental
subsidized (by us) so it can remain an ice cream shop for atmosphere in the village and a
meeting place for family tim. 41 Coldwater Rd. was purchased in 20l1. LCBO in 2014.

lncomelWork Experience
Providing low-income housing for seniors, single moms, people on disability with menial
health problems including addictions, shut-ins and widowers is now my main source of
income. Since that first apartment building in Waubaushene, I have purchased and
restored many of the old buildings in Severn Township (Coldwater), and turned them into
low-income rental units or Commercial storefronts. (See Pictures). I feel the Main Street
of Coldwater has benefited from my dedication to careMly selecting a group of
Commercial Tenants, not necessarily the highest paying bidders. In 2016 we have turned
some units into short-term furnished rentals to keep up with the demand for short-term
lodging that is lacking in the area. Restoring the old buildings in the Township of Severn

is Suzy Buftenshaw, a person who has dedicated most of her life to community work, in
Oakville, Georgian flay Township and for the last 10 years, Severn Township. (BJA,

My father and mother both live in Severn Township. I have one younger sister Lesley

of Buffalo) and Heather Sewell (Planner for a private firm in the GTA). Having both of
these “opposite side of the desk” planners in my immediate family, bring much

communities, at family gatherings.

I am writing to you because it has come to my attention that Cohn Bidmead has made a bid for
the vacant seat as Ward 3 Councillor in Severn Township. I understand that Cohn received over
43% of the populace vote during the last election which speaks volumes that there is a large
portion of the population that believed he would be an appropriate representative for Seven
Township.
Cohn Bidmead was first Introduced to me about ten years ago at St Andrews Presbyterian
church. Cohn at the time was sporting his amazing beard and he was certainly a person of
interest and someone I wanted to get to know better.
Coldwater Is an absolutely charming
community and I regularly shop, bank, socialize and participate in its many Festivals. it soon
became very apparent that Cohn Bided played a huge part in this community and its
beautification. I have seen him watering flowers over the years at all hours of the night,
adjusting lighting
,
welding and decorating archways and in general helping out whenever and
where ever he Is needed.
Cohn takes an Incredible pride in his community. As a property owner he takes a special Interest
in keeping his community looking quaint. Although he had plenty of opportunity to rent space
that is now occupied by Subway, he left the place vacant until he found the right business that
was willing to work with him in keeping Coldwater’s heritage buildings in tact. Although he is an
entrepreneur, he never allows that to interfere with the love ol his community. Cohn has taken
an active part on the Library Board, he has been the backbone and support to his partner
Suzanne Burtenshaw for the Steampunk Festival which has propelled Coldwater into the media
and is a true success story. He is also a continuous supporter of the many other initiatives and
festivals that are held in Coldwater and surrounding area.
Cohn Bidmead is a people person. He has a genuine concern for people in his community, he
converses well with everyone from youth to the elderly which is a trait that is admirable. He also
deals well with people of authority and feels comfortable in social gatherings with everyone 1mm
tradespeople to politicians. I have seen him in many social settings when my husband was
mayor 01 Georgian Bay Township and he navigates a room with confidence and ease.

constituents expect that their representative will act and perform in their best Interest. Knowing

In Conclusion
The top issue during the election in 2014 that I encountered going door to door in Ward
3, was (lie Severn Township Library. My 6 years on the library board gives me firsthand
knowledge and understanding of all aspects of this delicate and multi-faceted issue that is
extremely complex.
Other issues included school safety (sidewalks), mad safety (policing), recreation (rink
roof), services for seniors, connecting to trails, infrastructure, industrial park, etc. If
appointed, I look forward to working with the Mayor arid Councilors to shape municipal
policy and devclop an effective means of communication with the people of Ward 3.

Operating Income Increased 67% In a declining membership.

I have been a resident of Severn and in particular Ward 3 since my family and I moved here In
February 1998.
Over the years I have been active in the community and area, one such example is at Marchmont
Public School when my children attended, I advocated having the speed limit on Division Road
reduced to 40 kws while I held the position of PTA President.
I have extensive volunteer experience with organizations such as CFUW (Canadian Federation of
University Women) where I was on the Ontario Council as the Education Chair, being a Board
Member with Big Sisters and both a Board Member and active volunteer at Couchiching Jubilee
House.
I attended school at the Orillia Campus of Georgian College obtaining a diploma in Fundraising
and Resource Management and subsequently used that as both a volunteer and an employee
during The Lakehead University Capital Campaign.
This experience taught me how to listen, articulate ideas, function as a consensus builder,
conduct research, and generate proposals that are grounded and genuine. I feel that I can do the
same as a councillor for Ward 3 on the Severn Township Council.

Mayor Burkett and Members of Severn Township Council
We are writing this letter requesting that a response be provided and that it not just be “received” by
Council.
As you know there are several concerns about what is or is not happening at 3979 Sandcastle Court.
Council denied the request for an accessory apartment on June 18, 2015.
The owners/applicant decided to appeal that decision to the 0MB. It was suggested to Council by their
solicitor that an agreement should try to be reached and minutes of settlement were to be presented to
the 0MB on March 29.2016.
According to information provided by the 0MB and Township staff little or no communication occurred
to formulate any agreement and, as a result, the 0MB hearing was cancelled. There has been little, if
any discussion since then.
Since early November, second tenants have been occupying an apartment on the lower floor. The
Township building department is aware. When they mentioned this to the owner/applicant they
confirmed the second tenants and advised they were staying. According to the Building department the
unit is larger than what would be allowed under the bylaw and regardless will have to be adjusted. A
stop work order was issued in December 2015.
As Council is aware, one of the original reasons for delaying any decision, prior to denial, was to check to
see if the current septic system would serve a second unit. That test failed. For over five months the
second unit has been occupied with a deficient septic system.
We understand that very little if any progress has been made since the end of March to attempt any
arrangement that could be presented at an 0MB hearing.
Therefore ,our question is simple: What action and when will the Township Building Department take
action to enforce B y-law 2010-65 regarding the infractions at 3979 Sandcastle Court.

Please note that this complaint, please see copy of complaint form listed below, was sent via email to
the Municipal office of the Township of Severn on May 17th 2016.
In response to my complaint I received a telephone call from Mr. Rob Martell, from the township office:
705-325-2315 Ext. 240. Mr. Martell listened to what I had to say and was very understanding regarding
my concern. He stated he would look into the matter as soon as possible but that there was not much
he could do except contact the animal control and have them increase their rounds of the area. He
suggested that I contact the township counsel. I am therefore submitting this letter to inform Mayor
Mike Burkett and/or Deputy Mayor Judith Cox and Councillor Jane Dunlop in hopes that steps will be
taken to rectify this very serious problem as soon as possible.
I have lived in Coldwater for 40 years and lam very happy and proud of our little village. Please note
that I am not alone in this complaint not only because of the dogs running free, with their owners, but
also of the cars and trucks that also use the fairgrounds as a race track all hours of the day and night.
We would like to see something done immediately, before a child or anyone gets hurt!

Some suggestions:
Cating off the fairgrounds track no vehicles allowed

Placing of multiple gravel speed ramps/bumps on the track to slow vehicles down if they must be
allowed on the track
Proving a fenced in dog park way from children’s play areas maybe on the outskirts of town as people
are also driving in with their pets so they can run free. This would indicate that they would have no
problems driving to another area!

WHEREAS, Applied Behaviour Analysis (ABA) Is the scientific process based on objective evaluation and empirically
based interventions used to achieve meaningful, generalizable and enduring behaviourial change. Intensive Behavioural
Intervention (IBI) is an application of the principles of ABA in an intensive setting used to affect behaviour change and
improvement; and
WHEREAS, the curreni waiting list of children for Intensive Behaviour Intervention (161) is over 2.000 and more than
13,000 children await Applied Behaviour Analysis (ABA); and
WHEREAS, the Province of Ontario has announced it intends to discontinue 181 services lo children over the age of four
and provide a one-time payment to assist with services, thereby abandoning thousands who have been wait-listed for
years; and
WHEREAS, there are two service models for affected children to be treated, I) the Direct Service Offering (DSO) where
children receive services directly from trained staff at Ontario’s nine regional service providers, and 2) the Direct Funding
Offering (OFO) where parents receive funding directly in order to purchase services; and
WHEREAS, the DFO model to provide services is used in Alberta, British Columbia and imminently Saskatchewan. Such
a model is clinically rigorous and has been identified by the Auditor General of Ontario as being less expensive than
Ontario’s DSO model;
THEREFORE, be it resolved that a letter be sent to Hon. Tracy MacCharles, Minister ol Children and Youth Services;
Alexander Beaina, Deputy Minister; Hon. Eric Hoskins, Minister of Health; and Hon. Kathleen Wynne. Premier of Ontario,
requesting the Province to:
I. Amend Its policy to one that will allow all children on the current waiting list to receive the 181 services promised them;
and
2. Remove the age limit for 161 therapy and replace it with a program that provides ongoing 161 services based on need
and individual development, not age: and
3. Ensure oversight by professionals and parents based on ‘development progress’ criteria and milestones: and
4. Adopt a Direct Funding Offering (DFO) model in lieu of the current Direct Service Offering (DSO) model;
AND FURTHER THAT a copy of this resolution be forwarded to all municipalities within the Province of Ontario.

Chair Stevens advised those in attendance that there are three public meetings called
this evening in accordance with the Planning Act with respect to development within the
municipality.
The Chair advised that the purpose of public meetings are to inform and provide the
public with an opportunity to ask questions or express views with respect to
development proposals. In accordance with By-law No. 2007-153, members of the
Planning & Development Committee are here to observe and listen to comments.
The Chair advised that the format of the public meetings will be as follows:
1. Township staff will generally explain the purpose and details of the application;
2. Next, the applicant will present any further relevant information;
3. Next, the public will be permitted to ask questions and express views on the
proposal and then the public portion of the meeting will be closed; and
4. Next, members of the Committee will be given the opportunity to ask questions
for clarification on the proposaL

The Chair advised that at the conclusion of the meeting Township staff will be given the
opportunity to respond to the questions and comments received. After the public
meeting is concluded, this Committee will consider the application with due regard to
the presentations and views expressed this evening. The Committee will then do one of
three things:

recommend the application be approved by Township Council at a future
meeting, or
(2)
deny the application, or
(3)
defer the application pending further reports from Township staff

adopting this Committee’s recommendation, members of the public who have provided
oral submissions or written objections but disagree with the decision may appeal the
decision to the Ontario Municipal Board, as entitled under the Planning Act. If

The Chair requested staff to explain the intent and purpose of Zoning By-law
Amendments for 4994 & 4997 Shady Lane.
The Planner advised those in attendance that the purpose and effect of the proposed
Zoning By-law Amendment is to amend Zoning By-law No. 2010-65 as it applies to
properties described as Block A and Lot 40, Plan 1294, geographic Township of North
Orillia, now in the Township of Severn, municipally known as 4994 and 4997 Shady
Lane. The proposed Zoning By-law Amendment would rezone the subject properties
from the Shoreline Residential Two (5R2) Zone to the Shoreline Residential Three
(SR3) Zone to recognize the existing shoreline residential properties which do not have
frontage on or are not directly accessible from a year round municipally maintained
road. The holding provision will be discussed with the applicant and the adjacent
landowner in order to satisfy all parties involved prior to passing of the Zoning By-law.
The Planner advised that notice of this application was given in accordance with the
Planning Act on April 29, 2016 and the following correspondence has been received:

In August of 2010, Council passed By-law No. 2010-65, the Township’s new
Comprehensive Zoning By-law. This replaced the zoning by-laws of the former
Townships of Orillia, Medonte, Matchedash, Tay and the Village of Coldwater. Under
the former Township of Orillia Zoning By-law, the subject properties were zoned
Shoreline Residential (SR). In fact the current dwelling at 4994 Shady Lane (Lot 40,
Plan 1294) was listed as a seasonal residential dwelling within the former Township of
Ohllia’s Zoning By-law and 4997 Shady Lane is currently a vacant lot therefore is not
mentioned specifically within the By-law. The third and fourth properties on Shady Lane
(numbers 5011 and 5017) are already zoned Shoreline Residential Three (SR3).
Despite Shady Lane being a private road with four properties directly accessible from
this private road, it is located on a Township road allowance (shown on Plan 1294,
attached as Appendix 2). As with other similar circumstances that have come to
Township staffs attention, the Clerk’s department will be contacting the owners of each
of the properties to begin the process of obtaining a License agreement with insurance
for their continued use of the private road on the Township road allowance.
Zoning By-law 2010-65, as amended has 4994 and 4997 Shady Lane zoned as
Shoreline Residential Two (SR2). Section 3.26.1 of Zoning By-law 201 0-65 states that
no building or structure shall be erected on any lot unless there lot fronts upon and is
directly accessible from a road maintained year round by a public authority, there is then
a couple of exceptions including those lots with a road use agreement or within the
Shoreline Residential Three (5R3) Zone. The intent of the 5R3 zone is to recognize
shoreline residential properties that are within a limited service area, such as those
accessible by a private road or water access only.
The proposed zoning by-law amendment would rezone 4994 and 4997 Shady Lane
from the Shoreline Residential Two (SR2) Zone to the Shoreline Residential Three
(5R3) Zone to reflect the access to these shoreline residential properties by a private
road. The properties are designated Shoreline Residential under the Township of
Severn’s Official Plan and are located within the Rural and Agricultural designation
under the County of Simcoe’s in effect Official Plan and therefore the proposed zoning
amendment to a residential zone recognizing the limited serviced area would conform to
both Official Plans.
A draft by-law is attached as Appendix 3 for Committee’s consideration.
Subject to the comments received at the public meeting, any additional submissions
from circulated agencies and departments, and any further review that Planning
Committee may seek, Staff supports this proposed amendment to the Zoning By-law.

BEING A ZONING BY-LAW TO REGULATE THE USE OF LAND AND THE
CHARACTER, LOCATION AND USE OF BUILDINGS OR STRUCTURES ON
CERTAIN LANDS DESCRIBED AS BLOCK A AND LOT 401 PLAN 1294,
GEOGRAPHIC TOWNSHIP OF NORTH ORILLIA, NOW IN THE TOWNSHIP OF

WHEREAS the matters hereinafter set out comply with the Official Plan in effect
for the Township of Severn;
AND WHEREAS the Council of the Corporation of the Township of Severn
deems it advisable to amend the provisions of Zoning By-law No. 2010-65, as otherwise
amended, as they apply to those lands described as Block A and Lot 40, Plan 1294,
geographic Township of North Orillia, now in the Township of Severn, municipally
known as 4994 and 4997 Shady Lane;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SEVERN HEREBY ENACTS AS FOLLOWS:
1. THAT Schedules “C-S’ of Zoning By-law No. 2010-65, as otherwise amended, is
hereby further amended by changing the Zone Classification on certain lands
described as Block A and Lot 40, Plan 1294, geographic Township of North
Orillia, now in the Township of Severn, municipally known as 4994 and 4997
Shady Lane, from the Shoreline Residential Two (SR2) Zone to the Shoreline
Residential Three (SR3) Zone, in accordance with Schedule “1” attached hereto
and forming part of this By-law.
2. THAT Zoning By-law No. 201 0-65, as otherwise amended, is hereby amended to
give effect to the foregoing, but Zoning By-law No. 2010-65, as otherwise
amended, shall in all other respects remain in full force and effect save as same
may be otherwise amended or herein dealt with.

Zoning By-law Amendment is to amend Zoning By-law No. 2010-65 as it applies to
properties described the South Part of Lot 1, Concession 1, geographic Township of
North Orillia, now in the Township of Severn, municipally known as 4089 Digby Drive as
follows:

To rezone the severed property under provisionally approved Consent
Application B-03-1 6 containing the existing residence from the Residential One
(Ri) Zone to a site specific Residential One Exception (R1-x) Zone in order to
recognize the deficient lot area of the property; and

provisionally approved Consent Application B-03-l 6, from the Residential One
(RI) Zone to a site specific Residential One Holding (R1-Hx) Zone. The site
specific holding zone will prohibit the development on the retained lands until
such time as the applicable development agreements are in place to permit the
development of the lands accessible from Birkeshire Woods Lane.
The Planner advised that notice of this application was given in accordance with the

The intent of Zoning By-law amendment application Z-16-05 isto rezone both the
retained and severed portions of the subject property from provisionally approved
consent application B-OS-i 6. The rezoning application consists of the retained lands
being rezoned from the Residential One (Ri) Zone to the Residential One Holding
Twenty Eight (R1-H28) Zone and the severed lands being rezoned from the Residential
One (R1)to the site specific Residential One Exception Thirty (R1-3O). The subject
property is located at 4089 Digby Drive, being Concession 1, South Part Lot 1,
Reference Plan 51R-38931, Parts 1-7, geographic Township of North Orillia, now in the
Township of Severn (Appendix 1).
The intent of provisionally approved consent application B-O3-1 6 is to sever the existing
house from the land that was originally intended to be a part of the Locke subdivision
with the extension of Birkshire Woods Lane. The sketch from application B-03-16 is
attached as Appendix 2. The applicant currently has provisionally approval to sever a
portion of the property containing the existing dwelling with frontage of approximately 45
metres (147.6 feet) on Digby Drive and area of approximately 0.281 hectares (0.69
acres). The retained lands would then have frontage of approximately 61 metres (200
feet) on Birkshire Woods Lane and area of approximately 1.224 hectares (3.02 acres).
The subject property was given provisional approval once before under consent
applications B-O5/06/07/08-09 which proposed to create four new lots and one retained.
The new lots were to have been created around the turn around for the extension of
Birkshire Woods Lane. The pavement turn around and some servicing is in place as an

extension of the neighbouring Locke subdivision however the consent applications as
previously approved lapsed, meaning a new approval would be necessary to permit
further development on the lands. The Locke subdivision developer had already
installed the servicing and pavement on the property with the assumption that approval
of the applications was imminent. Once the applications lapsed the developer of the
Locke subdivision requested that Council place a 1 foot reserve across the property or
road allowance to prevent the subject lands from being developed without the proper
agreement in place. Council did not purse the 1 foot reserve at the time of the request.
The current proposal is to rezone the subject lands to allow for the conditions of B-0316 (listed in Appendix 3) to be fulfilled so the severance can be finalized. The proposed
severed lands from B-03-16 contain the existing dwelling, septic and well at 4089 Digby
Drive; this proposed lot area of approximately 2,792 square metres is less than the
required area for the Ri zone, however is substantially larger than the newer lots within
the neighbouring Locke subdivision which have site specific R1-22 zoning to permit a
minimum lot area of 2,000 square metres. The retained lands from B-03-1 6 or the
vacant lands containing the paved turn around are proposed through this zoning by-law
amendment application to be placed in a site specific holding zone (H28) which would
prohibit development until such time as a development agreement is finalized between
the Township, neighbouring developer and property owner. Staff believe this is a better
approach than the initial consideration of the 1 foot reserve as the investment of the
original developer is still being protected while incorporated into the Township’s Zoning
By-law.
A brief discussion of the various planning documents that have bearing on this
application follows.
Provincial Plans Policy Statement (PPS), 2014 and Growth Plan for the Greater
Golden Horseshoe, as amended

Planning staff believe that this application will not offend the Provincial planning policy
documents as this rezoning will help facilitate the infilling or completion of the
neighbouring subdivision which is located within a Settlement Area and therefore a
focus of growth for the Township.
County of Simcoe 2008 Official Plan, Amended February 2015
Section 3.3.1 of the County of Simcoe Official Plan states that “Subdivision of land by
Plan or consent, or plans of condominium, are permitted only for the land uses
permitted in the designation or that maintain the intent of the Plan’s objectives and
policies.” This property is within the settlement area of Bass Lake I Marchmont,
therefore the objectives of the Settlement section are applicable. The objectives of the
Section 3.5 Settlements are as follows:
3.5.1 To focus population and employment growth and development within settlements,
with particular emphasis on primary settlement areas, in accordance with the policies of
this Plan.

3.5.2 To develop a compact urban form that promotes the efficient use of land and
provision of water, sewer, transportation, and other services.
3.5.3 To develop mixed use settlements as strong and vibrant central places and to
create healthy settlements and communities that are sustainable.
3.5.4 To promote development forms and patterns which minimize land consumption
and servicing costs.
This application is needed in order to facilitate the future development of the vacant
portion, the retained lands from B-03-1 6, which were originally planned to be part of the
neighbouring Locke subdivision. This rezoning to a holding zone as well as a consent
agreement registered on title, another condition of the severance, will prevent the
premature development of the lands and facilitate the appropriate development
agreement when the lands will be developed as part of the Locke subdivision. The
future development of these lands will help achieve the objectives listed above of the
settlement designation.
Township of Severn Official Plan
The subject property is designated Settlement Living area under the Township’s Official
Plan. The objectives of the Settlement Living Area are to direct the focus of growth and
development to these areas by creating opportunities for various forms of residential
intensification and encouraging a variety of housing types to house persons with
diverse social and economic backgrounds, needs and desires.
Due to the large size and potential scale of future development of the proposed retained
lands, lack of an agreement with the property owner and neighbouring developer, the
provisionally approved severance could have been dealt with through a plan of
subdivision application, rather than the consent, according to the policies within Section
B8.2 of the Township’s Official Plan. The planning department believed a severance
application was appropriate in this case as the applicant only requested to sever the
house from the developable land. With the proposed rezoning, the retained lands will
not be developable with even one dwelling without Council’s approval to remove the
holding zone. The current property owners have not made any further development
plans for the lands therefore the future development potential is uncertain at this time.
However, this property will likely be developed in the future with multiple severance
applications and at least one development agreement in order to cover the appropriate
share of the servicing and road costs which would be evaluated under the applicable
policies at the time an application(s) is submitted. Therefore, staff believe the intent of
the Official Plan will be maintained with this zoning by-law amendment application as
future development will not take place until the appropriate agreement and zoning are in
place if the property was rezoned to the recommended site specific Residential One
Holding Twenty Eight (R1-H28) Zone.

Township of Severn Zoning By-law 2010-65
The subject property is currently located entirely within the Residential One (Ri) Zone.
Part of the zoning by-law amendment application is to place the retained lands into a
holding zone which would prohibit development until the appropriate development
agreement is finalized. The other part of the rezoning application is to acknowledge the
reduced lot area of the proposed severed lands as the minimum lot area required for the
Ri Zone is 4,000 square metres. Placing the severed lands into the site specific
Residential One Exception Thirty (R1-30) lands would permit a minimum lot area of
2,500 square metres. This recommended minimum lot area is less than the approximate
proposed severance area, however, as the final survey and reference plan have not
been completed planning staff recommend a lesser number than that approved to allow
for some flexibility.
A draft by-law is attached as Appendix 4 for Committee’s consideration.
Subject to the comments received at the public meeting, any additional submissions
from circulated agencies and departments, and any further review that Planning
Committee may seek, Staff supports this proposed amendment to the Zoning By-law.
Financial Impact
There are no external costs associated with the proposed zoning by-law amendment.

provide Council with a summary of the background to the By-law and is based on
previous reports received by the Planning Committee related to the proposed creation
of three new building lots on the subject lands which lie to the north of the cul-de-sac
bulb at the end of Hume Street in Marchmont.

A zoning by-law amendment is required to fulfil a provisional condition of consent
applications B-20/21/22-14. It would rezone a portion of the proposed Lot 3 and a
portion of the retained lands (Lot 2) from provisionally approved consent applications B20/21/22-14 from the Residential One Exception Twenty Two (R1-22) Zone to the
Environmental Protection (EP) Zone.
In the fall of 2014, Mitchinson Planning and Development Consultants submitted a
proposal for three severed lots (applications B-20-21-22-2014) and one retained parcel
to the Township. At its November 25Lh, 2014 meeting Planning and Development
Committee adopted a resolution to defer the proposal pending further discussions with
the proponent regarding lot configuration and further information regarding site
conditions and servicing.
An engineering assessment of the suitability of the subject lands for septic systems and
additional environmental analysis was completed and submitted to the Municipality.
Based on these submissions, Council determined that it was satisfied regarding the
appropriateness of the proposed development on the subject lands.
The proposed dimensions were modified slightly from the original proposal and have
been approved as follows:

The proposed lots would meet or exceed all of the Township’s zoning standards, except
for the frontage of the retained lot. A minor variance was approved for a lot frontage of
27.5 metres (90.2 feet) rather than the 30 metre required minimum.
The parent property at the northerly end of Hume Street is 9.7 hectares (24.1 acres) in
area. The frontage encircles the existing cul-de-sac bulb at the north end of the road
allowance for Hume Street. There is currently an existing dwelling on the property,
addressed as 3680 Hume Street.

The subject lands are within the Bass Lake/Marchmont Settlement Area and have a
“Living Area” designation. The zoning is Residential One Exception Twenty-Two. The
R1-22 zoning provides for 30 metre frontages and 4,000 square metre frontages for lots
on private services and applies to much of the developed area in the Marchmont and
Bass Lake sefflement area.
The proponent is seeking to create three residential lots. According to Section B8.2.7 of
the Township Official Plan:
“Application(s) which would result in the creation of multiple lots within the lands
designated SETTLEMENT LIVING AREA, SETTLEMENT EMPLOYMENT AREA,
SHORELINE RESIDENTIAL AREA, and HIGHWAY EMPLOYMENTAREA, shall
be subject to review and approval by both the Planning Committee and Council
prior to being considered by the Committee of Adjustment. The Planning Committee
and Council shall have regard for Sections 81.4, 81.5 and 88 in considering a
multiple lot severance.
Assessment of the effect of permitting the creation of lots by consent shall take into
consideration the past, present and potential future applications in both the
immediate and surrounding area.”
Section Bi .4 of the Township Official Plan lists numerous considerations that should be
satisfied prior to any land subdivision or consent for a land severance. These
considerations include: soil conditions, water/sewage services, traffic effects, frontage
on a public road, potential impacts on adjacent uses, Minimum Distance Separation
(MDS) requirements for livestock barns and cultural / natural heritage resources.
At the time Hume Street was developed, future development of the subject lands was
anticipated as evidenced by the creation of the cul-de-sac bulb and the placement of
the lands in the same zoning as its neighbours. At the time, development by plan of
subdivision was expected, but due to the environmental constraints on most of the
property, the available development envelop does not have the potential to generate
more than three new building lots given the current zoning regime. This reduction in the
area which is available reflects more stringent environmental policies and the findings of
an Environmental Impact Study prepared for the property because of its proximity to a
Provincially Significant Wetland (PSW) to the west.
Proposed Lot Configuration
Although cul-de-sacs are generally considered less desirable than through streets from
a maintenance and access perspective, the removal of most of the subject lands from
the development envelope would require the constriction of over 400 metres of

municipal street through environmentally sensitive lands to connect to Wainman land if
the adjacent property at 3656 Wainman Line was ever developed. As Meadowview
Court already terminates in a cul-de-sac, the more northerly route is the only alternative
for a through street.
The addition of three new lots to an existing dead-end street with five existing homes for
a total of eight does not constitute a level of development which is considered
unacceptable on a dead-end street. The ability to create a proper turn-around for snow
removal equipment is seen as beneficial.
Due to the presence of a large area of environmentally sensitive lands, the lot sizes
cover a very wide range. With the exception of the retained lot, the proposed frontages
and lot areas meet or exceed the requirements of the existing zoning by-law, but the
lots have less frontage than their immediate neighbours due to the frontage on the cul
de-sac bulb. The applicant’s environmental consultant has revaluated the boundary of
the wetland areas and an adequate envelope for buildings and associated tile fields
appears to exist on each parcel. New dwellings will be subject to a requirement for a lot
grading plan as part of the standard building permit process. It should be noted that, at
0.6 hectares, Lot 4 is quite a bit smaller than its neighbours, but still substantially
exceeds the existing zoning requirement.
The proposed lots will be serviced with private well and septic systems. Due to the total
number of lots proposed and their creation through the Consent process, a hydro
geological assessment is not required under MOE guidelines. Staff is not aware of any
constraints on water supply for the neighbouring lots. Soil conditions and drainage may
be acceptable as the proposed lots represent a continuation of the existing pattern of
development to the limit of the area identified as being associated with a wetland
environment. The boreholes completed onsite confirmed that the installation of
individual sewage disposal systems will not be restricted by poor soil conditions or a
high water table. A site visit by staff verified the description of the soil profiles in the
boreholes and the absence of a high water table at the time or on a seasonal basis.
Site conditions in terms of vegetation and ground water conditions were also consistent
with the revised delineation of the wetland boundary.
The new lots will not create any traffic hazards due to the small number of lots and their
location at the northern terminus of Hume Street. Public Works will ensure appropriate
driveway locations through the standard entrance permit process and severance
application review. As the property is located within a settlement area, predominately
absent of any cultural heritage features and are beyond the limits of the identified
environmentally sensitive lands, in conjunction with the proposed rezoning of much of

the site as Environmental Protection, the proposed residential lots will not create any
adverse effects on adjacent lands or negatively impact any cultural or natural heritage
resources. The proposed lot fabric represents the completion of development in this
area with lots of a similar size and character to their neighbours. Future development of
the lands will not be possible under the current policy regime and proposed lot fabric.
Section Bi .5 of the Township Official Plan states that Council may direct studies to be
undertaken in the course of considering development proposals. As outlined above, the
applicants have commissioned an EIS and based the development proposal on the
findings from that study, including a recommendation regarding zoning the identified
area in an Environmental Protection category.
Council has previously stated that it is satisfied that a plan of subdivision is not required
for the proposed multiple lot creations. Typically a plan of subdivision is needed for
multiple lots within a Settlement Living Area as municipal services such as water,
sewer, roads and sidewalks need to be addressed within the area. As this development
will be on private services, at the end of an existing municipal road without a sidewalk,
planning staff feel a plan of subdivision is not necessary as the municipal services and
infrastructure available within the area already exist. The creation of a paved turn
around for the snowplough will be addressed through the execution of a Consent
Agreement required as a condition of approval.
Financial Impact
There is no financial impact to the Municipality. All costs will paid by the developer,
including the cost of improving the turn-around for the snowplough at the end of Hume
Street.
Conclusion
A draft by-law is attached as Appendix 3 for Committee’s consideration.
Subject to the comments received at the public meeting, any additional submissions
from circulated agencies and departments, and any further review that Planning
Committee may seek, Staff supports this proposed amendment to the Zoning By-law.
Planning staff are of the opinion that the rezoning to extend an Environmental
Protection (EP) zoning across the subject property as proposed is appropriate and will
facilitate the completion of development in that area in compliance with municipal
planning policies.

APPENDIX I
PROPERTY SUBJECT TO APPLICATION FOR

PROPOSED ZONING AMENDMENT
THE CORPORATION OF THE TOWNSHIP OF SEVERN
BY-LAW NO. 201 6-XX
BEING A ZONING BY-LAW TO REGULATE THE USE OF LAND AND THE
CHARACTER, LOCATION AND USE OF BUILDINGS OR STRUCTURES ON
CERTAIN LANDS DESCRIBED AS PART OF LOT 3, CONCESSION 1,
GEOGRAPHIC TOWNSHIP OF NORTH ORILLIA, NOW IN THE TOWNSHIP OF
SEVERN (3680 Hume Street)
WHEREAS the matters hereinafter set out comply with the Official Plan in effect
for the Township of Severn;
AND WHEREAS the Council of the Corporation of the Township of Severn
deems it advisable to amend the provisions of Zoning By-law No. 2010-65, as otherwise
amended, as they apply to those lands described as Part of Lot 3, Concession 1,
geographic Township of North Orillia, now in the Township of Severn, municipally
known as 3680 Hume Street;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SEVERN HEREBY ENACTS AS FOLLOWS:
1. THAT Schedules “5-6” of Zoning By-law No. 2010-65, as otherwise amended, is
hereby further amended by changing the Zone Classification on certain lands
described as Part of Lot 3, Concession 1, geographic Township of North Orillia,
now in the Township of Severn, municipally known as 3680 Hume Street, from
the Residential One Exception Twenty Two (R1-22) Zone to the Environmental
Protection (EP) Zone, in accordance with Schedule “1” attached hereto and
forming part of this By-law.
2. THAT Zoning By-law No. 201 0-65, as otherwise amended, is hereby amended to
give effect to the foregoing, but Zoning By-law No. 2010-65, as otherwise
amended, shall in all other respects remain in full force and effect save as same
may be otherwise amended or herein dealt with.

3. THAT subject to the provisions of the Planning Act, R.S.O. 1990, as amended,
this By-law shall come into force on the date it is passed by the Council of the
Corporation of the Township of Severn.

MOTION CSC052516-14: Moved by Member Burkett and seconded by Member Taylor
that Confidential Planning Report No. P16-025, dated May 17,
2016, with respect to a Municipal Responsibility Agreement for
1959 Peninsula Point Road be received;
AND FURTHER THAT a letter of credit be required as security
for this agreement as determined by the Township’s Consultant
to cover future replacement costs;
AND FURTHER THAT staff be directed to report further on the
amount of securities required including escalation costs for the
future.
