Caratteristiche Strutturali
Structural characteristic
Il corpo dell’apparecchio è costituito da un estruso in alluminio
atto ad alloggiare sia la parte di alimentazione e controllo, sia
quella Led ed ottica, con elementi terminali di chiusura in
pressofusione di alluminio. L’estruso di alloggiamento dei Led è
esso stesso elemento di dissipazione termica, in lega di alluminio
UNI 9006/1 anodizzato di colore naturale, grigio e nero. Lo
schermo di chiusura frontale è un vetro piano temperato
extrachiaro di spessore 5 mm e serigrafato nelle zone di non
interesse ottico; fissato al corpo per mezzo di viti imperdibili in
acciaio Inox A2.Guarnizioni in silicone espanso. Per la versione a
palo l’apparecchio dispone di un codolo in alluminio pressofuso
con possibilità di regolazione dell’inclinazione 0°-90° con passo
2,5° per pali il cui diametro varia dai 46mm ai 60 mm. Per la
versione da galleria è in dotazione un set di aggancio rapido
costituito da staffa in acciaio Inox A2 e molle a leva in inox AISI
304 per canalina a ricciolo.
The body is made of an aluminium extruded section, adapted to
house not only the power supplier and the lighting control, but
led and optics as well; the closing elements are in die-cast
aluminum.The extruded housing for the LED is itself an heatsink
made of an aluminium alloy UNI 9006/1 anodized in natural
colour or black. The frontal screen is an extra-clear tempered
glass of 5mm, fixed by Inox A2 screw and silicon gasket. The
pole version, is made of die-cast aluminium, with adjustable
inclination 0-90° with 2,5° step, and is suitable for pole ø46 to
ø60mm. The tunnel version is supplied with a quick fix brace
made of Inox A2 and clips made of Inox AISI 304 for spiral guide.
Led flux are updated in according to the latest version available.

della fornitura non costituiscono invalidazione del contratto. I termini di consegna convenuti hanno valore indicativo e non tassativo. In qualunque
momento l’esecuzione della fornitura potrà essere sospesa in caso di mutamento nelle condizioni patrimoniali del Committente ai sensi dell’Art. 1461
del Codice Civile.
II – PREZZI. I prezzi sono da intendere franco fabbrica della Ditta Venditrice; essi non comprendono prestazioni ad oneri non menzionati. Gli imballaggi
non si ricevono di ritorno, salvo diversa pattuizione scritta.
III – VARIABILITA’ PREZZI. I prezzi indicati nel contratto sono stati calcolati in base ai costi dei materiali e della manodopera alla data del contratto
stesso, in base alle relative tabelle dell’ANIE. Il sistema di calcolo delle variazioni di qualsiasi entità in più o in meno che dovessero verificarsi su detti
costi durante il periodo dell’esecuzione della vendita verrà effettuato in base alle clausole di variabilità prezzi vigenti per apparecchi di illuminazione
pubblicate dall’ANIE.
IV – MODALITA’ DI PAGAMENTO. Il pagamento deve essere effettuato nelle forme e nei termini espressamente previsti e specificati nella conferma. In
ogni caso deve essere effettuato al domicilio della Ditta Venditrice restando sempre a rischio del Committente la trasmissione delle somme,
qualunque sia il mezzo prescelto. Qualora sia convenuto un regolamento cambiario, sono a carico del Committente sia gli interessi di sconto che le
spese e commissioni relative; gli interessi saranno conteggiati al tasso ufficiale di sconto aumentando di 5 unità. Per nessun motivo e a nessun titolo il
Committente può differire i pagamenti oltre le scadenze pattuite, particolarmente in seguito a ritardi nella consegna dei materiali od a contestazione
di qualsiasi natura. Sui pagamenti ritardati verranno conteggiati, di pieno diritto e senza alcuna messa in mora, gli interessi al tasso ufficiale di sconto
vigenti più 5 unità senza che per questo il Committente possa ritenersi in facoltà di differire i pagamenti.
V – RISERVA DI PROPRIETA’. La Ditta Venditrice conserva la proprietà sui materiali fino a totale pagamento di essi ma i rischi sono assunti dal
compratore sin dalla consegna. Qualunque atto del Committente che, all’infuori di esplicito consenso scritto della Ditta Venditrice, involga pregiudizio
al diritto della Ditta Venditrice alla rivendita del materiale, sarà sottoposto alle sanzioni di legge.
VI – CONSEGNA. Il termine di consegna indicato non impegna la Ditta Venditrice, la quale non è tenuta a corrispondere indennizzi di sorta per
eventuali danni diretti ed indiretti dovuti a ritardi di consegna o ad interruzione od a risoluzione parziale o totale della fornitura. Il termine di
consegna decorre dalla data della conferma d’ordine e in ogni caso non ha inizio prima de ricevimento della rata di pagamento all’ordine quanto essa
sia stata concordata. Esso si intende di diritto adeguatamente prorogato: se i pagamenti non vengono effettuati puntualmente, se il Committente
manca di fornire in tempo utile quanto stabilito in contratto o se comunque insorgono cause indipendenti dalla Ditta Venditrice, ivi compresi
eventuali ritardi di subfornitori.
VII – RESO MERCE. La merce può essere resa esclusivamente previa autorizzazione della Ditta Venditrice e con un deprezzamento del 30%.
VIII – LUOGO DELLA CONSEGNA. La consegna, a termine dell’Art. 1510 del Codice Civile, si intende convenuta nelle Officine del costruttore ed eseguita
all’atto della tradizione del materiale al Committente, o comunque al vettore, anche se il prezzo comprende il trasporto o la Ditta Venditrice si assume
il montaggio in opera. Nel caso di trasporto ad opera del venditore, la consegna si intende effettuata nella data e nell’ora indicata nell’avviso di merce
spedita. Se per un motivo qualsivoglia, approntati che siano i materiali no è avvenuta la tradizione per fatto indipendente dalla Ditta Venditrice, la
consegna si intende ad ogni effetto eseguito dal semplice avviso di merce pronto o di merce pronta per il collaudo. Avvenuta la consegna, tutti i rischi
sui materiali si trasferiscono al Committente donde il diritti alla Ditta Venditrice nel caso citato di ritarda tradizione per fatto non suo, di addebitare al
Committente le spese di magazzinaggio, manutenzione, custodia, assicurazioni, ecc. La merce anche se venduta franco destino viaggia sempre a
rischio e pericolo del Committente; pertanto la Ditta Venditrice assume a suo carico le sole spese di trasporto.
IX – DATI TECNICI. I materiali forniti, salvo diverse particolari prescrizioni da concordarsi per iscritto, corrispondono alle vigenti norme del CEI –
Comitato Elettrotecnico Italiano, ove queste siano applicabili. La Ditta Venditrice si riserva di apportare in qualunque momento ai propri prodotti
quelle modifiche che ritenesse tecnicamente convenienti. I disegni dalle Ditta Venditrice sono di sua proprietà e non possono dal Committente essere
consegnati a terzi ne prodotti senza autorizzazione scritta.
X – GARANZIA. La Ditta Venditrice garantisce la buona qualità e la buona costruzione dei propri materiali obbligandosi, durante il periodo di garanzia
appresso specificato, a riparare o sostituire gratuitamente nel più breve tempo possibile quelle parti che per cattiva qualità del materiale o per difetto
di lavorazione o per imperfetto montaggio (nel caso in cui il montaggio sia stato da essa assunto) si dimostrassero difettose, sempre che ciò non
dipenda da naturale logoramento, da guasti causati da imperizia o negligenza del Committente, da sovraccarichi oltre i limiti contrattuali, da interventi
non autorizzati, da manomissioni eseguite o fatte eseguire dal Committente, da casi fortuiti o forza maggiore. Il periodo di garanzia degli apparecchi
prodotti nello stabilimento della Ditta Venditrice è di 24 mesi dalla consegna, di cui agli art. VI e VII. A richiesta, previa valutazione dell’ufficio tecnico,
sarà possibile ottenere l’estensione di garanzia fino a un massimo di 60 mesi. Per i componenti non di fabbricazione della Ditta Venditrice, valgono le
garanzie delle Cose fabbricanti. Le garanzie cessano allo scadere del termine anche se i materiali non sono stati per qualsiasi ragione, messi in servizio.
Il pronto intervento in garanzia da parte dellaDitta Venditrice rimane subordinato all’osservanza delle condizione di pagamento da parte del
Committente o di altre eventuali condizioni particolari pattuite. I lavori inerenti alle riparazioni o sostituzioni in garanzia, saranno eseguiti nelle
officine della Ditta Venditrice. Nulla sarà dovuto al Committente per il tempo durante il quale l’impianto sarà rimasto inoperoso, né egli potrà
pretendere risarcimenti o indennizzi per spese, sinistri o danni diretti conseguenti a quanto specificato al primo capoverso del presente comma,
nonché alle suddette riparazioni o sostituzioni. Tutti i trasporti relativi alle operazioni eseguite i garanzia hanno luogo a spese, rischio e pericolo del
Committente. In nessun caso si potranno
intendere prorogati i termini di decadenza e di prescrizione di cui all’art. 1512 del Codice Civile.
XI – CONTROVERSIE. I contratti, anche se stipulati con cittadini esteri o per materiali forniti all’estero, sono regolati dalla vigente legislatura italiana.
Foro competente è soltanto quello avente giurisdizione nella sede legale della Ditta Venditrice anche in deroga agli art. 32 e seguenti del Codice di
Procedura Civile, esclusa per il Committente la possibilità di adire l’Autorità Giudiziaria di altro luogo anche in via di garanzia o di connessione di
causa, ma slava la facoltà alla Ditta Venditrice di esperire, in qualità di attrice, un’azione nel luogo di residenza, in Italia o all’estero, del Committente.
Le eventuali contestazioni non dispensano il Committente dell’osservare le condizioni di pagamento pattuite e non implicano alcun prolungamento
dei termini convenuti.Le spese di contratto, la sua registrazione e l’eventuale trascrizione sono a carico del Committente.
RESA DELL’IMBALLO: la merce si intende venduta Franco Fabbrica con imballo compreso
Le condizioni di vendita qui sopra riportate corrispondono in tutto a quelle stabilite dall’ANIE (Associazione Nazionale Industriali Elettrotecnica ed
Elettroniche)
DELTA CONTRACT SPA
GENERAL SALES CONDITIONS - LIGHTING EQUIPMENT
I – INTRODUCTION. The supplies only include what is expressly specified in the order acceptance confirmation of the Vending Company and are
governed by these general conditions, save for provisions resulting from an explicit written agreement. Any changes or notifications during the supply
do not constitute the invalidation of the contract. The agreed delivery terms are merely indicative and are not binding. The execution of the supply
may be suspended at any time due to changes to the financial conditions of the Buyer in accordance with the Art. 1461 of the Italian Civil Code.
II – PRICES. The prices are to be understood as ex-works of the Vending Company do not include services at charges that have not been mentioned.
The package cannot be returned, save for a different written agreement.
III – CHANGES IN PRICES. The prices shown in the contract were calculated based on the costs of the materials and labour on the date of the contract
based on the related ANIE tables. The calculation system of any kind of changes, whether more or less, that may arise to said costs during the period
of execution of the sale will be carried out based on the clauses of the changes of prices in force for lighting equipment published by ANIE.
IV – MEANS OF PAYMENT. The payment must be made according to the norms and terms expressly set out and specified in the confirmation. In any
case the amounts must be transferred to the domicile of the Vending Company, still always at the risk of the Buyer whatever the chosen method. If an
exchange regulation is agreed, the discount interest and related charges and commissions are at the expense of the Buyer. The interests will be
calculated at the official discount rate plus 5 units. The Buyer cannot defer the payments beyond the agreed deadlines for any reason or to anyone
else, especially following delays in delivering the materials or disputes of any kind. As of right and without any default interest, the interest on delayed
payments will be calculated at the official discount rate in force plus 5 units, without the Buyer deeming that it has the right to defer the payments for
this.
V – RETENTION OF TITLE. The Vending Company keeps the ownership of materials until paid in full, but the risks are assumed by the Buyer upon
delivery. Any action of the Buyer that results in jeopardizing the right of the Vending Company to resell the material will be subjected to legal
sanctions, save for the explicit written consent of the Vending Company.
VI – DELIVERY. The delivery period shows does not bind the Vending Company, which is not bound to pay indemnities arising for any direct or indirect
damage due to delivery delays, downtime or the partial or total return of the supply. The delivery period is effective from the date of the order
confirmation and in any case does not begin prior to having receiving the payment instalment for the agreed amount. This is regarded as being
adequately extended by right; if the payments are not made punctually, if the Buyer fails to supply what is set out in the contract in useful time or if
causes nonetheless arise regardless of the Vending Company, therein including any delays of sub-contractors.
VII – RETURN OF GOODS. The goods may only be returned upon the authorization of the Vending Company and with a depreciation of 30%.
VIII – PLACE OF DELIVERY. In accordance with Art. 1510 of the Civil Code, the delivery is agreed to the workshops of the manufacturer and carried out
upon the handover of the material to the Buyer or to the carrier, even if the price includes the transportation of the Vending Company assumes the
assembly on site. In case of transportation to the site of the vendor, the delivery is deemed to have been done on the date and at the time shown in
the notice of goods shipped. If for any reason, the materials are prepared but the handover does not happen due to independent events of the
Vendor Company, the delivery is deemed as having been done to all effects by the straightforward notice of goods ready or goods ready for testing.
Once the delivery has been made, all the risks concerning the materials transfer to the Buyer, giving the rights to the Vending Company in the cited
cases of delayed delivery for reasons not of its own making to charge the Buyer for warehousing, maintenance, custody, insurance, etc. costs. Even if
sold postage-paid, the goods always travel at the risk and danger of the Buyer, hence the Vending Company only assumes the transportation costs.
IX – TECHNICAL DATA. Save for special prescriptions to be agreed in writing, the materials supplied correspond to the standards in force of the CEI
(Italian Electrical and Technical Council), where applicable. The Vending Company reserves the right to change its products at any time where deemed
technically convenient. The designs of the Vending Company are its own property and may neither be given by the Buyer to third parties nor
produced without written authorization.
X – WARRANTY. The Vending Company guarantees the good quality and manufacture of its materials, being obliged to repair or replace free of charge
the parts as soon as possible during the specified warranty period that are proven to be faulty due to the poor quality of the material, faulty
manufacturing or imperfect assembly (if the Vending Company assembled it), as long as this doesn’t depend on natural wear and tear, breakdowns
caused by misuse or negligence by the Buyer, overloading beyond the contractual limits, unauthorized interventions, tampering done or made to be
done by the Buyer, or force majeure. The warranty period of the equipment produced in the factory of the Vending Company is 24 months from the
effective, as stated in Art. VI and VII. On request prior evaluation of our Technical Dept. you can get an extended warranty up to 60 months max. The
warranties of the manufacturing CSE apply for the parts not manufactured by the Vending Company. The warranties cease upon the expiry of this
period even if the materials have not been put into service for any reason. The repair service under warranty by the Vending Company remains
subordinate to the observance of the payment conditions by the Buyer or other agreed special conditions. The work relating to repairs or
replacements under warranty will be done in the workshops of the Vending Company. Nothing will be owed to the Buyer when the system remains
inactive and it cannot make claims for compensation or indemnities for charges, losses or direct damage resulting from what is set out in the first
paragraph of this point, as well as for the aforesaid repairs or replacements. For all the transportation relating to the operations carried out, the
warranties give rise to costs, risks and damage of the Buyer. In no case may the expiry and prescription dates stated in Art. 1512 of the Civil Code be
deemed as extended.
XI – DISPUTES. Even if stipulated with foreign citizens or for materials supplied abroad, the contracts are governed by the Italian legislation in force.
The only competent court is the one having jurisdiction in the registered office of the Vending Company, also in provision of Art. 32 and ff. of the
Italian Code of Civil Procedure, apart from the Buyer’s possibility of applying to the Judicial Authority of another place also as a guarantee or related
cause, but save for the right of the Vending Company to carry out an action in the place of residence of the Buyer in Italy or abroad as the plaintiff.
Any disputes do not waiver the Buyer from observing the agreed payment conditions and do not imply any extension of the agreed terms.
The costs of the contract, its registration and transcription are at the expense of the Buyer.
RETURNING THE PACKAGING: The goods are deemed to have been sold ex-works with the packaging included.
The a fore stated conditions of sale fully correspond to those set out by ANIE (Associazione Nazionale Industriali Elettrotecnica ed Elettroniche).
As Delta Contract S.p.A. employs a system of continual product improvement it reserves the right to modify any of its products without any prior
notification.
