The OMA has launched the next phase of our ongoing comprehensive
strategic integrated communications plan — a provincewide campaign that
features a series of targeted, evidence-based ads delivered across multiple
platforms, including newspapers, radio, digital and transit. Our initial ads
focus on educating and motivating the public about the reality of government funding cuts, which threaten Ontarians’ access to the quality, patientfocused care they depend on. We’ve introduced weekly campaign updates
to keep members informed and active, and are asking all members to join the
campaign and strengthen our position.
10 Utilization update: monitoring physician services
budget growth
OMA Economics, Research and Analytics has used the latest billing claims
data to estimate growth in fee-for-service and primary care payments,
which comprise approximately 85% of the physician services global budget.
Overall, the OMA estimates that the total physician budget is growing at 3.2%
— above the Ministry of Health and Long-Term Care’s arbitrary growth target
of 2.7% per year.

Legal Services has prepared a review of the events leading up to the OMA
launch of a constitutional challenge against the Government of Ontario, as
well as a summary of the details contained in the OMA filing to the Ontario
Superior Court of Justice.

Processes: OMA Quick Reference Guide
A new OMA reference guide provides physicians and medical office staff
with a general overview of OHIP claims submission reports, claims requiring
documentation, and the remittance advice inquiry (RAI) process. By better
understanding these processes, steps can be taken to avoid errors leading
to claims being rejected and/or avoid delays in processing claims that
ultimately result in payment delays.

must also be printed in block capital letters. In the right hand column, a signature is required.
Only petitions with original signatures (no scans or photocopies) can be submitted to the Legislative Assembly.

OMA Campaign Rolls Out Across Ontario:
member participation strongly encouraged!
T
he OMA has launched the next phase of our ongoing comprehensive strategic
integrated communications plan — a provincewide campaign that features a series
of targeted, evidence-based ads delivered across multiple platforms, including newspapers, radio, digital and transit.
The campaign, which will roll out in
stages in the coming months, reflects
extensive research undertaken with the
public and our membership.
Our initial ads focus on educating
and motivating the public about the reality of government funding cuts, which
threaten Ontarians’ access to the quality, patient-focused care they depend
on, both today and in the future.
OMA radio ads are running in heavy
rotation in key markets throughout
Ontario. Our print ads have appeared
in the Globe and Mail and Toronto Star
(see sample, opposite). Also, we’ve
unveiled a revamped public website —
PutOntarioPatientsFirst.com — which
will serve as a focal point of the campaign.
We aim to maximize the power
of digital communications through
Facebook and display advertising to
establish an online army of core supporters that will amplify our message
and bring pressure to government.
Recently, we’ve introduced weekly
campaign updates to keep members
informed and active, and we are asking
all members to join the campaign and
strengthen our position.

Enclosed with this copy of the OMR,
you will find a Physician’s Toolkit that
contains a variety of resources for
physicians and staff (see p. 7). The kit
provides an office poster and buttons,
a guide with tips to educate patients
and colleagues, the OMA petition and
instructions, and information cards that
encourage patients to visit the OMA
website where they can register their
email address and participate in a number of advocacy initiatives.
In recent weeks, more than 1,500
members have attended over 50 OMA
information sessions, community meetings and President’s Tour events across
the province. We’ve hosted four teletown halls and piloted an online live
question and answer session.
The OMA Response Centre, staff
and elected officials have responded
to hundreds of email queries and calls
from members seeking updates and
clarifications about our situation with
government and related Association initiatives. Thank you to all members for
your questions and suggestions.
The OMA has stepped up its communications efforts and we are doing
our utmost to provide you with as much

information as possible in a timely and
effective manner. We are carefully tracking member interests and concerns,
and collating this material to inform our
ongoing strategy and planning.
This issue of the OMR features a
categorized summary of the most frequently asked questions from members on such issues as the negotiations
impasse and government’s unilateral

Ministry’s proposed task force on physician services, the New Graduate Entry
Program, and the Baker-Price Report.

Physician services budget growth update

n May 2015, OMA Council passed the following motion: “That the OMA provide
members with frequent and up-to-date utilization information so that members can
better manage their practices as the global budget approaches the cap.”
The following data provide an estimate
of growth in the main components of
the physician services global budget,
fee-for-service (FFS) payments and
primary care payments, based on billing claims data. These two payments
comprise about 85% of the entire
physician budget, and timely data is
available to track changes in these
components.
The Ministry of Health and LongTerm Care’s arbitrary growth target
for the physician budget is 2.7% per
year in total. The Ministry targets FFS
growth at 1.3%, and primary care
growth at 7.6%.
To date in 2015-16 (April-August
period), FFS payments are growing
at about 2.9% (i.e., above target) and
primary care payment growth is run-
ning at 4.5% (i.e., below target).
Overall, the OMA estimates that the
total physician budget is growing at
3.2% (i.e., above the Ministry target of
2.7%). At the same time, net physician
supply is growing at 3.2%.
OMA Economics, Research & Analytics monitors these payments regularly and provides updates to the Board
of Directors on a quarterly basis.

OMA Charter Challenge:
timeline, brief summary of OMA position

MA Council resolved on May 2, 2015, “That the Ontario Medical Association
demand the Representation Rights Agreement be amended to add a binding
dispute resolution mechanism.”
The OMA gave notice to Minister
of Health and Long-Term Care Eric
Hoskins that we sought to amend the
Representation Rights Agreement on
May 19. The OMA met with government to discuss our request for mediation-arbitration in June and July. It
was our position that physicians had a
constitutional right to have the current
bargaining impasse resolved through a
binding dispute resolution mechanism.
The government disagreed.
On July 22, the OMA invoked the
Physician Services Committee (PSC)
Special Committee/Facilitation process contained in sections 18-20 of
the Representation Rights Agreement.
Dianne Gee was appointed as the
facilitator.
We met with the government
through this facilitated process in
September and October. These talks
ended on October 9 without agreement. As a final effort, we met with
Minister Hoskins on October 20. He
continued his government’s refusal to
agree to binding arbitration.
On October 29, we commenced
our Charter challenge against the
government (see https://www.oma.

In this Charter challenge, we ask the
court for five orders:
1. A declaration that the Minister
breached the Representation
Rights Agreement during the 2014
Physician Services Agreement
negotiations and is required by the
Charter to engage in a process of
meaningful collective bargaining
with the OMA,
2. A declaration that the Ministry’s
refusal to agree to amend the
Representation Rights Agreement
to replace facilitation/conciliation
with a binding dispute resolution
mechanism violates the Charter
and an order that the Ministry must
establish a binding dispute resolution mechanism with the OMA
to resolve bargaining impasses in
respect of physician compensation
and related accountabilities,
3. A declaration that the 2.65% payment reduction in February and
the 1.3% payment reduction in
October violate the Charter, are
unconstitutional and are of no force
and effect,

4. An order that the binding dispute
resolution process (i.e. 2 above)
be used to determine the compensation to be paid to physicians
for their losses resulting from the
payment reductions (i.e. 3 above)
or damages etc. for breach of the
Charter,
5. A declaration that the “Managed
Entry” process for Primary Care
Patient Enrolment Models and the
“New Graduate Entry Program”
violate the Charter, are unconstitutional and are of no force and effect.
Section 2(d) of the Charter guarantees all Canadians the freedom of
association. As I wrote in the April
2015 OMR (available at omr.oma.org),
the Supreme Court of Canada recognized in its January 2015 decisions that
there needs to be a meaningful process of collective bargaining between
government and workers. When the
need to maintain essential public services does not allow for an effective
right to strike, there needs to be an
alternative mechanism for resolving
bargaining impasses. We ask the court
in our application to apply this principle
to Ontario physicians.

he OMA continues to monitor and respond to hundreds of questions and comments
brought forward by members at the President’s Tour and community meetings, via
the OMA Response Centre, online, and direct to OMA departments and elected officials.
A summary of members’ most common questions and answers is provided below.

UNILATERAL ACTION
Did the OMA, in return for
being recognized as the sole
bargaining agent for physicians,
sign an Agreement in 2012
allowing the province to impose
settlements on physicians
unilaterally, without sending
them to binding arbitration?
The OMA is, and has always been,
categorically opposed to unilateral
action by the Ontario Government. It is
destructive to the relationship between
the parties and the health care system
in our province. The OMA did not agree

to unilateral action in return for sole bargaining rights.
In 2012, the OMA sought mediation-arbitration as a means to resolve
issues between the parties and to
conclude renewal Physician Services
Agreements. The Ontario Government
rejected the OMA request. In turn, we
negotiated the facilitation-conciliation
process. This then meant that government had to at least follow a process
with third-party neutrals. With the three
Supreme Court decisions from earlier
this year, the status quo is constitutionally deficient and we are again seeking
mediation-arbitration.
Mediation-arbitration is a very common process for resolving disputes, like

the current one involving the Ontario
Government and the OMA. The mediation-arbitration process runs throughout the Ontario public sector and,
more broadly, it is the process in place
to resolve disputes between medical
associations and governments in most
other provinces and territories throughout Canada. Why is final dispute resolution such a standard process in Ontario
and throughout Canada? It is a balanced process that produces fair and
reasonable results in stark contrast to
blunt, unilateral government action.
The OMA, on behalf of its members,
will continue in its efforts to conclude a

mediation-arbitration. This is the right
way forward for the parties and, more
importantly, the patients of our province,
who are entitled to a sustainable and
responsive health care system. Ontario’s
physicians will not settle for less.
Did the government’s final offer
include funding increases to
cover growth in demand in the
system?
The government’s 1.25% increase
falls well short of the 2.7% growth in
2014/15 originally estimated by government, which increased to a 3.5%
growth in demand for physician services
in 2014/15. Worse yet, the government
has unilaterally limited funding for physician services by imposing a hard cap.
If physicians’ costs associated with
providing care to patients exceeds the
hard cap, the Ministry of Health and
Long-Term Care will take back those
additional dollars from physicians, presumably by either more fee cuts or
increasing the payment discount. There
are no limits on the frequency, timing or
extent of the defunding by the Ontario
Government of services offered by physicians.
Did the OMA reject a fair deal
from the government?
The OMA rejected the government’s
offer because it failed to fully fund the
necessary growth in the health care
system. Ontario’s physicians could
not accept an agreement that failed to
protect and strengthen patient-focused
care by ignoring the challenges precipitated by a growing and aging population. In fact, on January 15, 2015, the
OMA offered to freeze physician fees
for two years if the government agreed
to adequately fund growth and put
patients first. The government refused
the OMA’s counter-offer of freezing
physician fees for two years and went
ahead with unilateral action.
Did the OMA effectively ask for
unilateral action by failing to
accept the government’s offer?
The OMA couldn’t accept an agreeONTARIO MEDICAL REVIEW
ment that failed to protect and
strengthen patient-focused care by
ignoring the challenges precipitated by
a growing and aging population. We did
not ask for or agree to unilateral action.
Instead, the OMA remains committed to working with all stakeholders
within the health care system, including
the government, to restore and protect
the principles of patient-focused care.
What is the OMA’s plan to stop
the government from unilaterally
cutting fees and acting with
heavy-handedness?
Unfortunately, government has the legislative power to take any action it wants.
The only barrier is the Constitution. That
is why we are bringing the Charter challenge.
The other protection is to have a
Physician Services Agreement — that
is why we need patients and physicians
to let government know this must be a
priority.
Did the government ask the
OMA to provide feedback on
its proposed changes and
reductions, and the Association
chose not to?
The OMA sent the Ministry a comprehensive response to its proposed
changes on August 5, 2015. In fact, as
recently as September 17, 2015, the
OMA sent a letter to Minister Hoskins
detailing our concerns about the government’s unilateral cuts to funding for
physician services. Ontario’s physicians
are, and have always been, committed
to working with all stakeholders within
the health care system, including the
government, to restore and protect the
principles of patient-focused care.
Is it true that government has
been forced to implement this
second round of cuts because
physicians are too quickly
depleting the $11.6 billion they
have been budgeted for the
fiscal year?
Ontario’s population is growing and
aging. An estimated 140,000 people

come into the province every year, putting new demands on the health care
system. Patients are becoming more
complex and require more health care
services. Physicians are providing the
services to meet the increasing needs
of our growing and aging patient population.
My Section is being most
impacted by the latest cuts. Why
is the OMA not advocating for
my Section?
The OMA speaks for all Ontario physicians. Unilateral cuts to physician services by this government impact us all.
That’s why we’re asking the government to get back to the table and put in
place a deal that restores and protects
the principles of patient-focused care.
The OMA had the government’s
reconciliation plan in July, but
didn’t notify members until
September. Why?
In July, the Ministry presented the OMA
with a reconciliation proposal for comment. We provided the Ministry with our
concerns. In September, the Ministry
then advised us that it was proceeding
with its reconciliation plans, despite our
concerns and objections.
The OMA is committed to providing members with correct information
in a transparent manner. As soon as
we became aware of the government’s
plan to unilaterally cut funding for physician services, we shared that information with members.
Will there be a 10%-20%
clawback at the end of the year?
Current OMA expenditure growth
estimates are about 3% for 2015/16.
The unilateral action implemented by
the Ministry to date covers the difference between the 1.25% growth that
the Ministry will fund, and the current
estimated growth rate of 3%. If utilization continues at its current rate, the
government may implement additional
clawbacks or discounts. The magnitude of additional government actions
should not exceed 1%-2% based on

Is it true that patients will not be
affected by the government’s
cuts to funding for physician
services?
With a growing and aging population,
Ontario’s publicly funded health care
system will be put under immense
strain. By cutting the necessary funding for physician services, the government is seriously impacting patients’
ability to access quality care in the years
to come. At a time when Ontario is
growing, and when demand for quality, patient-focused care is up, the government’s approach of cutting funding
for physician services is not the way to
solve the serious problems facing our
health care system.
Is it true that physicians are
simply asking for higher
compensation?
Ontario’s physicians are advocating
for an agreement that secures quality,
patient-focused care and fully funds
the increased demand for care. The
number of patients is increasing, the
number of physicians is increasing, and
the number of services is increasing.
Physicians are not looking for our pay
to increase — in fact, we offered a twoyear freeze on fees. We are looking for
government to fully fund this increased
demand. Effective October 1, 2015, the
government will have cut funding for
physician services by a total of 6.6%
since February 2015. In doing so, the
government is threatening access to
quality, patient-focused care.
What is the OMA’s advice to
members regarding participation
in Ministry activities during the
current negotiations impasse?
Officials from the Ministry and OMA
deal with each other frequently across
a range of physician services and health
system issues. These dealings occur on
an ad hoc basis (i.e., meetings between
senior officials in respect of a new initiative), through periodic meetings
between Ministry and OMA counterparts, and in forums like the Physician
Services Committee (PSC). These
interactions between the OMA and the
Ministry continue to serve as important vehicles for information exchange
and consultation between the parties,
despite the negotiations impasse and
the absence of a Physician Services
Agreement.
This may be through:
• Participation.
• Communication of government initiatives to physicians.
• Advocacy/implementation of OMA
initiatives.
The OMA is taking a responsible
and constructive approach to dealings
that occur in these forums, but will also
use them as opportunities to raise the
appropriate objections to the Ministry’s
plans.
Based on Board direction to date,
staff and committees have used the
following measures to determine the
OMA’s involvement:
• Is the activity not related to the
implementation of unilateral action?
[Participate]
• Is the activity directly related to clinical care? [Participate]
• Does the OMA need to be there to
present an alternate point of view,
protect the interests of physicians,
or rebut comments by government?
[Participate]
• Does the OMA need to advise its
members of activities that are being
undertaken? [Communicate]
Participating in activities with the
government — particularly activities
that position physicians as advocates
for our patients — is reasonable, consistent with our research findings, and
in line with OMA strategy.
CHARTER CHALLENGE
(2012 and 2015)
I heard that in 2012, the OMA
gave up on binding arbitration
when it dropped its Charter
challenge. Is that true?
The OMA did not give up on binding
arbitration when it settled the Charter
challenge in 2012. Quite the opposite
is true.
In 2012, the OMA launched a
Charter challenge in response to
the government’s rigid approach to
Physician Services Agreement negotiations and its May 2012 decision to
make unilateral cuts to the Schedule of
Benefits.
In the Charter challenge, the OMA
was seeking a court order that the
Ministry engage in a process of meaningful, good faith consultation and dialogue with the OMA to establish a PSA.
This was what the OMA was entitled to
under the Charter case law in effect at
that time.
Ultimately, the OMA and Ministry
entered into a “Representation Rights”
Agreement in which the Ministry explicitly acknowledged that it is required
to negotiate with Ontario physicians,
through the OMA, in respect of physician compensation and related issues.
The agreement also included several dispute resolution mechanisms
that required the Ministry to negotiate and work collaboratively with the
OMA in the future. These protections
are stronger than those contemplated
by the Charter case law in effect at that
time. In fact, even if the OMA’s Charter
challenge had been entirely successful, a court would not have found that
doctors or the OMA had these constitutional entitlements.
Although the OMA proposed and
fought hard for a mediation-arbitration process in 2012, the Ontario
Government was adamantly opposed
to such a system, and rejected the

OMA’s requests in this regard.
That was 2012. Today, as a result
of three Supreme Court decisions
released in late January 2015, representative associations now have much
stronger constitutional rights. It is with
the release of these recent Supreme
Court decisions, all of which were
released after the bargaining impasse,
that the OMA is now seeking a binding
dispute resolution mechanism.
Can we get the cuts to stop while
the Charter challenge is before
the courts?
It is not possible for the OMA (or
another party) to obtain an injunction
to stops the cuts. This is because the
Ontario courts are not permitted to
grant an injunction against the Crown.
As a result, in light of the fact that the
cuts are being imposed by way of regulations made by cabinet, they cannot
be the subject of an injunction.
Why did the OMA wait so long to
pursue legal options?
It was essential that we followed
through with the process to request
mediation-arbitration. We needed to
exhaust all non-legal avenues to obtain
mediation-arbitration.
What will the Charter challenge
actually get members?
The OMA is asking the Ontario Superior
Court of Justice to strike down the government’s unilateral action and find that
a binding dispute resolution process
must be established to resolve future
bargaining disputes between the OMA
and the government.
We anticipate that the challenge will
result in a permanent and stable framework in which Ontario’s doctors and the
government can work collaboratively
to make decisions about the future of
Ontario’s health care system.
PHYSICIAN ACTION
Why isn’t the OMA supporting
physicians who want to take
actions that limit patient
services?
Since January, the OMA Physician
Activities Working Group (PAWG) has
been developing physician activities
that do not impact patient services.
The OMA recommends that physicians do not take any actions that
limit patient services as the College of
Physicians and Surgeons of Ontario
(CPSO) policy on Providing Physician
Services During Job Actions is extremely
strict.
There are other activities, such as
petitions in offices, sharing impact stories and meeting with MPPs, that all
physicians can participate in, and the
OMA encourages that.
Any members who have questions
about the CPSO policy are encouraged to seek advice from the Canadian
Medical Protective Association (CMPA).
Can we close our offices with
enough notice? College rules
cannot stop us from closing our
offices one day a quarter.
The College policy requires that during
a service withdrawal you must:
1. Mitigate the adverse impact of the
job action on patients and/or the
public,
2. Provide,
a. urgent care; and
b. non-urgent care necessary to
prevent harm, suffering and/or
deterioration; and
3. Ensure health care concerns are
assessed and appropriately triaged
so that urgent and/or necessary
medical care can be obtained.
The original version of this policy only
required physicians to provide “emergency care and ensure that patients
are not abandoned” during a job
action. This policy has now been significantly tightened to require physicians
ensure that “health care concerns” are
assessed and appropriately triaged.
“Health care concerns” is a much more
onerous standard than “emergency
care.”
In the 2014 amendments to this
policy, the College removed all of the
qualifiers that previously applied to
these obligations. For example, the previous version of this policy only required
physicians to take “reasonable steps
where possible” to mitigate the adverse
impact of the service withdrawal. The
fact that these qualifiers have now been
removed informs us that the College
no longer accepts taking “reasonable
steps,” etc., to fulfill these obligations to
be sufficient.
If during an action any of these
requirements is not met, the physicians
who took part in the action may be subject to complaints, which the College
must investigate.
Outline the communication
between the OMA and CMPA
and CPSO regarding physician
action.
The CPSO does not provide advance
directions on actions proposed by
members. Instead, it monitors actions
and responds as it sees necessary.
If any member of the public makes
a complaint, the CPSO is required
to commence an investigation.
The CMPA advises members must
comply with the CPSO’s policy on
Providing Physician Services During
Job Actions, and that it is extremely
restrictive of any plan to withdraw services.
Further, it is not possible to tell
in advance whether a particular service withdrawal will result in College
complaints/discipline as it depends
upon the events that unfold. Members
should contact the CMPA if they wish
specific advice in this regard.
That’s why we’re asking the government to get back to the table and put in
place a deal that restores and protects the principles of patient-focused care.

What actions should we
undertake?
The OMA will be providing opportunities for physicians to get more
involved in activities, as we have done
in various ways since January (note
the Physician’s Toolkit mailed with this
issue of OMR).
We encourage members to reach
out to your MPP and other local politicians with your concerns and your
stories of how patient care is being
impacted. Also, please share your stories on the OMA websites so we may
provide them to our media contacts.

Why is the OMA not releasing the
full data set from the Physician
Activities Working Group
survey?
First, we need to seek the input of OMA
Council on results of the Physician
Action Survey. Once released, the
results from the survey could become
public, which would present a problem
as the raw data could be misconstrued
and end up in the media with out-ofcontext information. As such, we are
providing summary findings, which is
the same approach taken with all surveys done by the OMA.
GOVERNMENT TASK FORCE
Why has the OMA agreed to sit
on the Ministry task force on
physician services?
On October 22, Minister Hoskins
announced a task force to make recommendations for improving and funding physician services. The OMA has
not yet received details of the task force
proposed by the Minister.

The OMA will participate. We believe
this should be a future-oriented task
force designed to study the long-term
sustainability of Ontario’s health care
system, including systemic changes
necessary to ensure the system’s ability to deliver the quality care Ontarians
deserve well into the future.
We are participating in this task force
because we believe it is our responsibility to find both immediate and
long-term solutions to protect quality,
patient-focused care.
The OMA can better influence and
direct this task force if we are at the
table than not. The Ministry of Health
and Long-Term Care will claim what
it wants, but given the fact that we
have commenced litigation against the
Ministry, the current level of co-operation between us should be apparent.
We can actively try and develop the
terms of reference for what the OMA
believes the task force needs to look
at. And if we cannot influence — we
will be at the table to voice any objections.
NEW GRADUATE ENTRY
PROGRAM (NGEP)
The OMA has serious concerns with the
New Graduate Entry Program (NGEP)
and the problems it poses for new family physicians.
This program is an untested model
that has been unilaterally imposed by
the government. The NGEP should
have been negotiated as part of the
Physician Services Agreement, which is
a requirement under the Representation
Rights Agreement.
The OMA is taking action to address
the Ministry’s Managed Entry Program
and NGEP in Section 1 (h-j) of our
Charter challenge notice of application.
The NGEP is government’s attempt
to fix problems with the Managed Entry
Program that it introduced as part of

BAKER-PRICE REPORT
Can the OMA comment on the
Baker-Price Report?
Ontario physicians share many of the
principles found in the Baker-Price
Report, including: access to a family physician for all Ontarians, equitable access to interprofessional care,
effective integration of patient care,
and timely and appropriate access.
However, we also have some serious
concerns with the report:
1. The report represents a significant change in how primary care
is organized in Ontario at a time
when the government has made it
clear it won’t work with physicians
and won’t fund the full cost of the
growing medical needs of patients
across the province.
2. The report proposes another layer of
administration in the form of Patient
Care Groups (PCG) — in a time
when health care resources are
limited. We wonder if this will mean
less resources going into actual
patient care.
3. As detailed in the report, many
elements of the PCG role, including the ability to determine physician funding, violate the OMA’s
Representation Rights Agreement
as set out in the 2012 Physician
Services Agreement.
4. The government has had the report
for nearly a year and needs to
clearly say what parts of the report
it intends to implement.
5. We know that it’s best for patients
for the health care system to build
on success — not throw the system
into chaos.
This is a report that is long on
concepts and short on implementation strategy. What patients need is a
stronger health care system — not just
more concepts.
The OMA recognizes that there is
work to be done, but patients can’t
wait for the government to reorganize
primary care — AGAIN.

and Service Delivery
In September, the Auditor General
released its special report entitled
Community Care Access Centres Audit
and Service Delivery.
The report reiterates that there are
inconsistencies in home care provision
and service fees which vary depending
on where patients live. There are 16
recommendations that aim to address
inconsistencies in home care provision, service fees and home care eligibility criteria. The report suggests the
government analyze home and community care with a focus on identifying
the highest quality, cost-effective care.

Ministry Meeting with HospitalBased Physician Groups on
Physician Leadership in Health
System Funding Reform
The Ministry of Health and Long-Term
Care has been holding meetings
around the province with various hosONTARIO MEDICAL REVIEW
pital medical staff groups to discuss
Physician Leadership in Health System
Funding Reform (HSFR).
The main topic of these sessions is
the potential impact that the quality of
clinical documentation has on patient
care and hospital funding through
HSFR. A component of these presentations is an explanation of the link
between clinical documentation, coding and abstracting, and hospital funding formulas such as Quality-Based
Procedures (QBPs). In its presentation,
the Ministry acknowledged that “while
the current crisis in health care necessitates cost control while striving for
improved quality of care, this does not
compromise the physician’s role as a
End of Life Planning and Care in Ontario:
iDECIDE Research Study
The OMA is participating in a three-year study funded by the Canadian
Institutes of Health Research (CIHR) aimed at improving communication
and decision-making about goals of care in late life for patients who have
serious illness.
The Improving Decision-Making During Serious Illness in Late Life
(iDECIDE) research study builds on findings from an earlier study. It found
that while patients who experience a serious illness late in life would prefer
treatment aimed at maximizing their quality of life rather than prolonging it,
too often there is no discussion with clinicians about patients’ goals of care,
which may result in more invasive and aggressive treatment than patients
would like.
The iDECIDE study proposes a set of interrelated studies that will generate the evidence needed to inform the development of a multifaceted suite of
tools to improve decision-making about goals of care for patients with serious illness. The research will create a bundle of tools to help patients, families
and clinicians make better decisions together so that patients receive the
compassionate care they want at this critical time in their lives.

Changes to Pharmacy and
Prescribing Payments and Policies
The Ministry of Health and Long-Term
Care is examining areas where expenditures in the Ontario Drug Benefit
(ODB) Program are outpacing normal
system growth. To generate savings,
the Ministry introduced amendments
to regulations under the ODB effective
October 1, 2015.
• First, the Ministry is limiting the number of dispensing fees paid to pharmacies for 15 categories of chronic
use medications, to a maximum of
five fees per recipient, per drug, per
year. There are exemptions for ODB
recipients who require more frequent dispensing due to a medical
condition. The full list of medications
subject to this rule can be found at

communiq.aspx.
• Second, the Ministry will only reimburse a higher-cost brand product
through a “no substitution” claim
when medically necessary and
where an ODB recipient has experienced an adverse reaction to a minimum of two interchangeable generic
products. An ODB recipient with a
valid “no substitution” prescription
that was filled prior to October 1,
2015, will be permitted to renew and
refill their brand therapy as directed.
The OMA is participating in the
Ministry’s Long-Term Care Medication
Management working group to ensure
that expert clinical opinions are sought
before any drugs are automatically
substituted.
