One of the most important roles that our association plays in our
profession is political advocacy. In 2006, a good friend took some time to
share with me what kind of impact potential political issues might have on
our industry and more specifically, on the Lalli family bottom line. To be
honest, I was shocked, as any one of the issues that he described would
have significant financial and other impact on my day-to-day business and
to the clients that I was working with. I used to pay little attention to
RPAC or what the Realtors were doing to protect small business and
private property rights through political advocacy. Once I learn what was
happening and how much impact we could have I knew I couldn’t ignore it.
Let me share with you some of the recent issues that our RPAC efforts
and influence have helped with. As you read some of these, think about
what your business would look like if one of these bills or rules were
enacted in the State or a local city.
1. Business License Fees. Several years ago, a number of cities
attempted to charge business license fees to all individual Realtors
and to say that any time you represented any buyer or seller in any
city, you had to pay a separate business license fee to that City,
regardless of where your brokerage resides. An avg. business license
fee is $250 a year! We’re responsible for changing state law to
permanently fix that.
2. Mandatory Meth and Radon testing and recently an effort by the DEQ
to require mandatory testing for every wood burning stove before
closing to assure that it meets current DEQ specs. The same testing
requirements have also been tried for mold and that bill, like the meth
bill explicitly made the Realtor legally responsible.
3. We have helped kill a number of bills requiring that an attorney be paid
by the Realtor to review all documents and that the Realtor also pay
an attorney to attend every closing. If passed, this bill would have
cost you, the Realtor, hundreds of dollars (best case scenario) on
every transaction.

4. We helped pass a bill a couple years ago that limited a lender’s
ability to pursue deficiency judgments on a short sale from 7 years
down to just 3 months.
5. On a federal level, banks have repeatedly asked the government to
define real estate as a financial activity, a change that would allow
large banks to offer real estate brokerage services.
6. A minimum service law we passed several years ago stating that a
minimum service brokerage MUST: 1) communicate offers,
counters, etc. on behalf of their client, 2) answer all of their client’s
questions throughout the transaction and maintain communication
with client. This year, we added some protection language for
Realtors that if a broker refuses to work with you and insists you
work directly with their seller; you may do so WITHOUT fear of
creating an implied agency relationship. Thus your liability is
significantly less in those situations.
7. Oldies but goodies: Preserving the mortgage interest deduction,
stopping sales tax on services and prohibiting transfer taxes when
a home is sold.
Believe me, this is just a short list of what our Realtor advocacy efforts
have done and continue to do. I’ve been privileged to be involved at the
State and local level as a trustee for the last several years to
determine how we spend our RPAC dollars. It is a non-partisan, very
thoughtful process with the specific intention to help with issues and
candidates that are philosophically aligned with our views on small
business and private property rights. Frankly, I don’t really like
politics all that much, so I don’t serve on these committees because of
that. I do it because this is the single biggest impact our individual
efforts and the efforts of our Realtor associations can make.
With our RPAC fundraising lunch coming up, I hope you will take the
time to consider what our local, state and national associations do for
your business and invest in RPAC accordingly so that we can continue
to lead the charge for small business and personal property rights.

Community Easter Egg Hunt

Community Charity Event Task Force Chair,
Community Outreach Committee
On April 4, 2015 the Community Outreach Committee held their first
Annual Charity Easter Egg Hunt at Sand Ridge Park in Layton. The
charity that was chosen to benefit from this event was Fight To The Finish
or FTTF, and arm of Anything for a Friend. This organization was started
in 2010 by Becky Anderson, a cancer survivor from Layton, Utah. The FTTF
arm was carried on though Ann Smith, the mother of Tyler Smith, also of
Layton, a boy who lost his battle with cancer 2 years ago. Throughout
Tyler’s fight, the entire community bonded together by his inspiring courage
and strength, and his memory lives on through his mantra, “Fight to the
Finish.”
This organization funds “giving trees,” trees with monetary gifts and
cards attached. These trees are donated to families with children who are
fighting cancer and other life threatening illnesses.
Fresh Market, RE/MAX Metro and other local Realtors and
NWAOR Affiliates donated over 2000 plastic eggs and candy!
The event was a success with over $750.00 raised. In addition to
the Easter Egg Hunt, America First Credit Union provided free
hot chocolate for the event.
Thank you to all who helped, donated and
participated. We hope to make this an annual
event and we are looking forward to next year!
